COVID-19 DISCLAIMER

The novel coronavirus, COVID-19 (including without limitation, any successor strains of novel coronavirus) (hereinafter referred to as “COVID-19”), has been declared a worldwide pandemic by the World Health Organization (“WHO”). COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. You represent and warrant that you have familiarized yourself with the most recent guidance and protocols issued by the WHO and the Centers for Disease Control Prevention (“CDC”) for slowing the transmission of COVID-19 and agree to comply therewith. You further represent and warrant that you have not: (i) traveled to a highly impacted area subject to CDC Level 3 Travel Health Notice within the last fourteen (14) days, (ii) been exposed to any person returning from a highly impacted area subject to a CDC Level 3 Travel Health Notice within the last 14 days, or (iii) been exposed to any person who has a suspected or confirmed case of COVID-19. Finally, you agree to abide by any and all rules and COVID-19 protocols set forth by Rock n’ Concepts, LLC (“Rock n’ Concepts”) and Hometown Heroes for this event. Notwithstanding any protocols put in place for the event, Rock n’ Concepts and Hometown Heroes cannot guarantee that you, and/or any of your family members or other individuals with which you are in contact will not become infected with COVID-19. Further, attending this event could increase your risk and/or your family members’ risk of contracting COVID-19. By completing your ticket purchase, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you and/or your family members with which you are in contact with may be

HOMETOWN HEROES │ COVID-19 Festival Waiver exposed to or infected by COVID-19 by attending the event and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. You understand that the risk of becoming exposed to or infected by COVID-19 while attending the event may result from the actions, omissions, or negligence of yourself or others, including, but not limited to, Rock n’ Concepts and Hometown Heroes employees and/or contractors. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself and/or any of your family members (including, but not limited to, personal injury, disability, and/or death), illness, damage, loss, claim, liability, or expense, of any kind, that you and/or any of your family members may experience or incur in connection with your attendance at the event (collectively, “Claims”). On behalf of yourself, and on behalf of your family members, you hereby release, covenant not to sue, discharge, and hold harmless Rock n’ Concepts, Hometown Heroes and their employees, agents, parents, subsidiaries, assigns, contractors and representatives, of and from any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Rock n’ Concepts, Hometown Heroes, their employees, agents, parents, subsidiaries, assigns, contractors and representatives, whether a COVID-19 infection occurs before, during, or after the event.

HOMETOWN HEROES │ COVID-19 Festival Waiver CODES OF CONDUCT

Below are our Codes of Conduct that are agreed upon FIRST at ticket purchase, SECOND at emailed details of event, and THIRD upon arrival to event along with the capture of a verbal acceptance at entry. All cars to be inspected by security at entry as well.

1. I certify that neither myself nor my guests have been in contact with an individual that has tested positive for COVID-19 in the past 15 days.

2. I understand that I am not allowed to leave my defined space without an escort for the show unless it is for an emergency, at which time I promise to adhere to maintaining the required 6’ social distancing standards.

3. I will adhere to the required 6’ social distancing standards in the restroom waiting areas. Restroom pickup is available through the Roovy app.

4. No weapons or outside food & beverage are permitted.

5. I certify that the temperature of my guests and myself was checked upon entry and we were cleared of having a fever at time of entry. I also certify that to my knowledge, neither I or my guests have had a fever in the last 15 days.

6. At no time will a guest be allowed to combine or share spaces with other guests. The MAX number of people per car space is 6.

7. Hometown Heroes takes this public health crisis extremely seriously and will not tolerate disregard for our requirements pertaining to social distancing and our Codes of Conduct. Violation of ANY of these points will result in immediate removal from the event with NO REFUND.
