KIDZ CLINIC CHRISTMAS PARTIES

Thanks to a number of sponsorships and generous donations, our annual Kidz Clinic Christmas parties were once again a tremendous success. Jumping castles, magicians, dancing contests and games kept the children entertained and there were eats and sweets aplenty. (It’s the one day we don’t worry too much about sugar intake!) Each child received numerous brand new gifts, party packs and take-home treats.

KIDZ CLINIC “ROOTS & SHOOTS” DOG WASH DAY

In November an SPCA mobile clinic treated 250 domestic animals for free in Alexandra.

The clinic visit to Carter Primary School closed a 16-week programme named “Care of domestic animals in my community”, that had been presented to a group of grade 7 pet owners by WMACA’s Alex Kidz Clinic and Jane Goodall's Roots and Shoots Institute SA.

Empathy is an important skill related to success in many areas of human development – social, academic and personal. Learning how to respond empathetically is the best antidote to violence, bullying and other unwanted aggressive behaviour.

Children who are empathetic tend to be more resilient; they are better able to handle stress and “bounce back” from difficulties. Empathy promotes “moral intelligence”, the capacity to understand right from wrong and the ability to act on that understanding. A morally intelligent person makes decisions that benefit not only her/himself but also others around them.

Children often experience a natural affinity for animals, which is why a growing variety of programmes pair animals with children.

SISTERS WITH BLISTERS

“Thousands of sisters and misters braved the rain weather and took to the streets of Bryanston on Saturday the 24th of November to speak out against the violence against women and children at Jacaranda FM’s Sisters with Blisters in association with 1st for Women.

The walk, held at Bryanston High School attracted more than 6 500 people who wore heels, pumps and takkies in the true spirit of the event; to earn their blisters and help raise awareness and money for the cause and the two worthy charities who are active in the fight against abuse of women and children.

The field of 6 500 people raised an incredible R460 000.00 which was donated on the day to Women and Men Against Child Abuse (WMACA) and Sonke Gender Justice network for the exceptional care and support they provide to women and children affected by the abuse.”

Since the opening of the first Kidz Clinic in 2000, WMACA have provided more than 90,748 treatment services to 14,442 children and 13,426 parents/caregivers.

WMACA achieved extensive Luke Lamprecht, Miranda Jordan, Suellen Sheehan and Germaine Vogel, addressing the media at the WMACA press conference media coverage in this quarter of reporting mainly through WMACA’s press conference in support of the victims of Bob Hewitt and our participation in the Sisters with Blisters walk, which also resulted in a generous donation made to WMACA.

The International Hall of Fame suspended Hewitt in November and the outcry from Hewitt’s supporters who blamed and attempted to shame the adult survivors prompted WMACA to host a press conference, which included an exclusive interview with Suellen Sheehan who opened a case against Hewitt more than a year ago. The press conference at the Hilton Hotel on the 26th November was a huge success, attracting national media attention as well as SAPS and NPA responses to confirm their commitment to process this case. WMACA also took this opportunity to launch its 16 days of Activism Campaign.

This quarter of reporting also marks 16 October, Baby Michael’s birthday and WMACA sent out an "In memoriam" press release. Last year on the 13th July 2012 Michael’s parents each received two ten year sentences nine months after his death (of broncho-pneumonia on 16 October 2011).

‘It’s very sad to think that Baby Michael would have been nine years old if he were still alive today. Just because his parents are convicted does not mean it is over. His tragic story and that of Baby Wade should be kept alive through memory to keep the topic of abused and shaken baby syndrome in front of mind.

16 DAYS OF ACTIVISM BOB HEWITT CASE – Press conference

As mentioned above WMACA invited press to an exclusive interview on 26 November with Suellen Sheehan, one of Hewitt’s young prodigies that he coached in the early 80’s and molested when she was a young girl.

Hewitt was suspended indefinitely on the 15 November from The International Tennis Hall of Fame as a result of evidence presented by their hired attorney’s investigations, which included interviews with alleged victims, who were between the ages of 12 and 15 when coached by Hewitt decades ago.

4 "The allegations brought to us were extremely troubling, and we're confident we've taken the appropriate action," said Mark Stenning, chief executive of the organization based in Newport, Rhode Island.

Plaques honouring Hewitt at the hall were removed, as was his entry on the organization's website. "Bob Hewitt ceases to exist in the Hall of Fame," Stenning said. Australian- born Hewitt won 15 Grand Slam doubles titles in the 1960s and 1970s and was inducted into the Hall in 1992. No one has ever been suspended or expelled from the Hall. He has also subsequently been removed from the South African Sport and Arts Hall of Fame.

Suellen Sheehan, one of his alleged victims broke down during the WMACA press conference and struggled to control her emotions while telling how Hewitt, who coached her for years, made sexual advances towards her and allegedly molested her. Sheehan who opened a case of sexual assault against Hewitt in December 2011 said, “The only thing that matters is what was done to us. That’s it!”

Acknowledging Suellen’s emotions and her courage to speak out publically to seek justice and raise awareness to parents on the dangers of career offenders, WMACA advocacy manager Germaine Vogel said at our conference “That’s why we are highlighting this not only to put pressure on our officials to move forward on this case but to highlight the devastating effects of child abuse.”

WMACA is waiting for The National Directorate of Public Prosecutions to decide on whether to prosecute and will continue to communicate and pressurise officials to do so.

The 16 Days of Activism for No Violence Against Women and Children campaign is a time for all to reaffirm their commitment to creating a society that is safe and secure for women and children. This year marks the 13th anniversary of the national campaign.

The Boksburg Kidz Clinic was featured in the Boksburg Advertiser, as one of the major role players of service delivery to victims on the East Rand.

SOWETO VIRAL VIDEO GROUP SEX CASE

Proceedings in the case previously called the “Soweto Video Gang Rape” case were postponed until the 27th of March 2013.

The video of seven young men seemingly gang-raping a 17-year-old mentally challenged girl, went viral earlier this year, sending shockwaves here and abroad.

WMACA have been following this case from the start, as we are concerned about the welfare of the juveniles involved – the victim and the offenders – and we want to understand the circumstances in an

5 environment which produces this type of sexual behaviour among teenagers.

Only when the court hears the results of a required report from the Department of Public Prosecutions will we know whether or not the victim is intellectually challenged and if so what her intellectual capacity is – which is crucial to determining her ability to give informed consent which in turn will influence the charges to be brought against the remaining suspects. Furthermore, charges relating to sexual acts with a mentally disabled person rely not only on the mental ability of the disabled person, but also the offender/s’ knowledge of the fact that the victim was disabled and could not consent.

‘Even if the other charges are dropped, some of the suspects might still face charges of engaging the sexual services of a minor for reward, using a minor to create child pornography, possessing and distributing child pornography, committing a sexual act in the presence of a minor, and committing a sexual act in the presence of an adult’.

KARATE COACH SENTENCE

WMACA expressed shock at the court’s decision to sentence a karate coach who sexually assaulted 11 of his students to three years of correctional supervision. “We are shocked that the magistrate considers this an appropriate sentence,” said spokeswoman Vincentia Dlamini Ngobese. She said the organisation had expected the State to exercise its obligation to protect children. Peter Foyn, 69, was sentenced to three years’ house arrest by the Alexandra Magistrate’s Court on the 5th of December. Magistrate Syta Prinsloo said Foyn would also have to do 20 hours of community service a month and undergo rehabilitation at his own expense.

In sentencing him, Prinsloo made reference to the five life sentences and 175 years imposed on Johannes Steyn, dubbed the “Sunday Rapist”. Ngobese said Steyn would still be offending if he had not being caught. “[He was caught for] crimes he had committed while he was supposed to be doing community service, under correctional supervision, for previous sexual assault convictions,” she said. “The seriousness of Johannes Steyn’s crimes escalated over time while he was under State supervision.”

Prinsloo said 69-year-old Foyn would be subjected to house arrest in those three years. Foyn nodded as Prinsloo told him his name would also be recorded in the sexual offenders register. The magistrate warned him that if he failed to inform prospective employers of his record, he would face imprisonment. “You are also not suitable to work with children from today Peter Foyn, right, and lawyer Rod Montan outside onwards, do you understand?” Prinsloo told Foyn, who listened closely the Alexandra Magistrates Court. to the sentence. “Yes. Fully. Thank you,” Foyn said to the magistrate.

Foyn, who has been a karate instructor for 43 years, pleaded guilty last month to 10 counts of sexual assault. The students said the instructor had fondled their breasts and private parts. They were aged between eight and 34 years.

“PRETORIA 9” HOUSE OF HORRORS INCEST TRIAL

On the 23rd of November, the case was postponed yet again until the 9th of April 2013! In the latest appearance, Magistrate Pieter Nel was accused of being biased towards the State and asked to recuse himself. Accused

6 number 1’s attorney asked Nel to recuse himself, and that the grandfather’s ill health wasn’t taken into consideration.

‘The case was postponed to April to give the State time to provide the defence team with further particulars and for the magistrate to rule on the application for his recusal’. Furthermore, accused number 2’s attorney resigned because he didn’t support this motion and said it’s was a waste of the court’s time. So a new attorney will need to be found for the grandmother.

We are appalled at the way this case is being dragged out. ‘This is a case of grievous sexual abuse of children, not just of child pornography.’

BOKSBURG CRéCHE PRINCIPAL CASE

PRE-SCHOOL CHILD VICTIM FORCED TO IDENTIFY THE PERPETRATOR FACE TO FACE WITH A ROW OF MALE PRISONERS!

‘There have been several setbacks and postponements in this case but for me today, the 5th of November, the most shocking violation of a victim’s rights was that one of the child victims was taken to the Modderbee prison and forced to identify the perpetrator in an open room, face to face, among a row of male prisoners! The child had already verbally named and identified the perpetrator – how could anyone inflict such trauma on this very young child? By law the required methods of hiding the victims during an identity parade has to be upheld at all times. We at WMACA want to know who took this child to the prison and we want them charged and held accountable!’ reported an irate Vincentia Dlamini- Ngobese, WMACA Spokesperson present at the South High Court.

‘We know from our sources that several children have disclosed alleged sexual abuse by Mr McPherson- their crèche Principal. Staff members working at the créche have reported that at least one child told them of the abuse. Apparently, according to the disclosure from this child, McPherson would take a sponge mattress to his office at break and pick a child to call in, and would then abuse them’, says Vincentia.

‘These cases were reported as far back as 2010 and the medicals are positive. However there have been several delays due to time lapses in receiving all the DNA results due to incorrect area information to the forensic lab, court officials had to wait for school holidays to interview the children to try not to disrupt their schooling, McPherson has submitted many bail applications and his lawyer died in a car accident which meant more delays while applications had to be submitted to Director of Public Prosecutors for guidance for new legal representation. This case was then moved to the High Court’.

Based on the charges – and if he is found guilty - we at WMACA expect a life sentence for each of these first batch of cases and for any other child rape cases that are brought to the court!’

WMACA ASKED TO COMMENT ON CHILD-ON-CHILD VIOLENCE

The shooting of a Grade10 pupil by a fellow pupil at Phineas Xulu Secondary school in Vosloorus in November has once again drawn attention to the growing number of children killing children in . There are at least nine known cases of children who have been murdered by other children in the past four months in the country.

Some experts have cited overexposure of children to violence and lack of parental guidance for the growing

7 problem. Women & Men Against Child Abuse, advocacy manager, Germaine Vogel said the problem of children killing other children was “very disturbing”.

“It’s happening at an alarming rate in communities and environments where violence is rife. We are failing our children if we do not look at how to prevent these murders,” Vogel said. She said the judicial system should be unswerving in punishing perpetrators of crimes against children.

Throughout the past year – apart from child victim intakes - the Alex Kidz Clinic has assisted more than 1400 community members with advice and referrals to services such as Pro Bono legal services, SASSA for support grants, SANCA for drug abuse, Social Development for foster care/adoptions, Maintenance Court, protection orders and to ADAPT for social work services for adults.

Kidz Clinic staff have also mediated family and marital disputes in 594 cases. When people are experiencing some kind of conflict and they don’t know who to turn to, they often come to the police station, where our Clinic is based. When the police don’t know how to deal with a matter that doesn’t involve criminal charges, they will refer to us. Our staff know Alex and its community well and are often able to give guidance in matters which could, if left unchecked, possibly lead to domestic violence.

SENTENCES / CONVICTIONS - Oct to Dec

ALEXANDRA

• A case that was meant to go to trial in October – for the rape of a 12-yr-old girl by a 48-yr-old known male adult – was struck off the roll, pending receipt of the outstanding DNA results.

• A 30-yr-old male was found guilty of Statutory rape of a 15-yr-old girl and given a 5 year suspended sentence.

• A case was opened for rape of a 13-yr-old girl by a boy of 18. The case was withdrawn by the girl’s father, as she like the boy and refused to testify against him.

• A 30-yr-old male was found guilty of raping a 15-yr-old girl. He was sentenced to 10 years; 5 years in prison and 5 years suspended.

• In a Tembisa case, a 31-yr-old male was found guilty of raping a 14-yr-old girl. He was given a 5-year wholly suspended sentence. (It is alleged that the sex was consensual.) The Ladies’ Group from the US Consulate General, who organised a bake sale and a presents drive for the Kidz • A 14-yr-old male juvenile raped his own sister who is Clinics, with WMACA Director Kevin Barbeau 8 years old. He was arrested and the court has ordered him to attend a diversion programme.

• A 16-yr-old male Juvenile raped his cousin, a girl of 5. He was arrested his first appearance is set for January. Also a Tembisa case.

BOKSBURG

• A 14 year old girl reported being raped by a group of five young men. The girl was coming home from church one evening with her sister, when two young men chased them and managed to get hold of her, the sister got away. They then took her to the bushes where three other young men were waiting. The men then covered her face with a cloth and took turns raping her. The girl is not sure how many of the men raped her.

The assailants reportedly ran away when they heard people approaching, who were the police and the girl’s mother, who had been alerted by the sister. Two of the men were arrested and each received a life sentence on 11/10/2012 in the Vosloorus Court. The other three men were never identified.

12 • A 13 year old girl had gone to the toilet at night and had been grabbed by a male neighbour, aged 25. He grabbed her and closed her mouth and pulled her into his house. The man raped her more than once and threatened to kill her if she screamed. The child was found at 06h00 the next day and disclosed what had happened. The neighbour was arrested. Assessment sessions were completed and a report was compiled.

The case was finalised on 26/10/2012 and the perpetrator was sentenced to 16 years for rape and 3 years for kidnapping.

• An 11 year old girl’s mother opened a case of Assault after she noticed scars on her daughter and the child then disclosed that her paternal uncle had beaten her, after accusing her of stealing R20-00. Assessment sessions were booked and the child missed some sessions. The case was then finalised before the report could be compiled. The paternal Uncle pleaded guilty and he was fined R4000-00.

• A 34 year old man was found guilty of attempted rape of a 15-yr-old school girl on 22/11/2012 and sentenced to 5 years imprisonment. The girl was waiting at school for a lift when an unknown man The wonderful people from Vodacom who, with a team asked her where the toilet was and claimed he was of volunteers, sponsored the entire Duduza Christmas waiting for his sister. The child went to show him where party and put in every effort to make it such a success. the toilets were and he then pulled her into the toilets and tried to rape her. The girl faked an asthma attack and he fled. As he ran away the child screamed and two men caught the unknown man. The police were then summoned and arrested him. Bail was denied.

ORANGE FARM

• A 10yr old girl was raped & physically assaulted by her stepfather. Case finalized on the 01 October2012 and perpetrator sentenced to 5yrs imprisonment.

• Another 10 year old girl was raped by her Stepfather. The case was finalised on 08/11/2012 and the perpetrator was sentenced to 15 years imprisonment for count (1) of Rape and 15 years for count (2) of Assault with intent: GBH and he will serve a full 15 year term without Parole

• A 16 year old girl was raped by a known male neighbor. TRENDS / UNUSUAL CASES (Warning: Content is Disturbing)

We see many unsettling cases of child abuse at the Kidz Clinics, but recently we have encountered some very disturbing ones, particularly due to the fact that biological mothers were actively involved in the sexual violation of their children:

14 1) A 10 year old girl was referred to Kidz Clinic Boksburg by SAPS. The girl’s mother reported to the Police that she had come home late at night after being out drinking, and had found the child concerned and a younger child, aged 3, crying after the stepfather had allegedly raped the 10-yr-old.

The stepfather was arrested and later received bail. The medical exam was positive for penetration.

The police were confused as the child presented two conflicting statements. Initially she had said that it was the stepfather and then later she said that it was a “Tsotsi”

During the assessment sessions the child disclosed that she had originally said that it was the stepfather as this was what she had been instructed to do by her mother and maternal grandmother. The child changed her story because the stepfather’s mother told her to say that it was a “Tsotsi”, in order for the stepfather to be released.

The child disclosed to the Social Worker that she was very scared to tell the truth, as she did not want any of her parents or family to get arrested. The Social Worker explained to the child that it is not her duty to protect people, especially people who abuse her.

The child then disclosed to the Social Worker that it had not been the stepfather who had raped her. The children had been left sleeping in the house and the mother and stepfather had returned home drunk. The mother herself had digitally raped (penetration by fingers) the child and then placed the unconscious stepfather on top of the child, and inserted his penis into her vagina. The mother then woke the younger sibling up to witness the “rape”.

The younger child was very traumatised by having to witness this and felt sorry for the stepfather – she commented on the fact that he was not covered with even a blanket before they took him to the police station.

The Social Worker then called the mother in and indirectly asked her exactly what had occurred on the night and what her corroborating evidence was. (The mother had been told by the child that she had told the truth and was shocked but did not harm the child). The mother eventually disclosed the same story to the Social Worker, admitting that she had injured the child herself as a plan to get the stepfather arrested.

The investigating officer was made aware of the truth. An assessment report has been compiled and the Investigating Officer and the Prosecutor are to decide the way forward for this case.

There are numerous charges that the victim’s mother may be arrested for and charged with: Rape, Compelled Rape, Exposure to Sexual Acts, Defeating the ends of Justice, Falsifying evidence.

2) In another Boksburg case, a three year old girl came home to her grandparents after a visit to her mother and asked her grandmother whether her Grandfather is going to hit “those people” Her grandmother asked for clarification and the child said: “Is grandpa going to hit those people to death like he says if anybody hurts me?”

The granny noticed something was amiss and asked the child what had happened and why she said this – the child said “just because”. The following day the child was still very out of sorts, wasn’t eating and was struggling to urinate and defecate.

When the granny bathed her, she spoke to her about touches and reminded her that nobody is allowed to touch her private places. The three year old then told the granny that *Tim, her mother’s fiancé had “tickled her fanny”. The granny asked her if she is sure of this and the child then showed the grandparents how he had sexually violated her. They then immediately took her to the Police Station for a statement. The child was seen by the SAPS Trauma Counsellor.

That night the child needed assurance that nobody will be able to take her away from her Granny and Grandpa. She then told the Granny that *Tim had hurt her a lot and that it had bled and her mother had bathed her. She

said she did not have her clothes on and that *Tim was also not clothed. Again the grandmother asked her if she was sure and she said yes.

In both the SAPS statement and at the Trauma Counsellor the child had said that her mother must go to jail because she was cross with her too.

The granny asked her why she was angry with her mother, and whether she hurt the child too? The child then said no, that her mother had not hurt her, but she had licked her and pointed to her vulva. Her granny asked her if she was fibbing. The child then said that no, she really wasn’t fibbing, and said “*Tim bumped mommy at the back there and then milk came out of his thing” and then the granny asked what happened next, to which the child replied that “then mommy wanted me to lick her fanny, but it stinks and tastes bad like pepper”

The mother and the fiancé had threatened the child by saying that he would kill her and the mother if she told.

The medical was positive for anal penetration. Sessions were booked and the child disclosed consistently in the first session.

The fiancé was arrested – no bail. Our social worker informed SAPS of the mother’s role in the abuse and a warrant for her arrest has been issued.

The investigating officer said this was on record as per the statement taken by SAPS, but they had not mentioned anything as they first wanted to have confirmation (which was achieved through the “Blind assessment” technique) before arresting the mother.

STAFF TRAINING

3 October – Forensic Assessment and Report Writing training

Through a sponsorship by the World Childhood Foundation, WMACA were privileged to host a three-day course titled “Assessment of Child Sexual Abuse” presented by Edith Kriel of the Child Trauma Centre in Cape Town.

All our Kidz Clinic staff and management attended, and we were fortunately in a position to invite Social Workers from Lifeline, Teddy Bear Clinic and the Department of Social Development - to share our resources, and exchange knowledge and information with our partner role players.

The assessment process is the first step necessary to help children who have been sexually abused and are having difficulty disclosing. It is important to understand what, if anything, happened to the child, who should be involved to help the child be safe, and what should be the next steps in order to help the child to heal. Although there is no standardised interviewing protocol, certain guidelines should be followed, not only for the child’s best interests, but also to provide the court with an accurate and legally defensible assessment report in criminal proceedings.

Many topics were covered during this training, including:  The difference between Therapeutic and Forensic Interviews  Child Developmental considerations  Difficulties in interviewing abused children  The Phased approach for interviewing suspected victims of sexual abuse

 The intensity of abuse and the victim/offender relationship  Quantity and quality of details, and external and internal consistency of statement  False allegations  Report writing: Assessment, competence, victim impact.  Exercises relevant to: Pre-school and Primary school children, and adolescents  Therapeutic methods and tools

The knowledge gained from this course is of immense value to us as an organisation working in the child abuse arena, where we don’t only want to help children, but also need to ensure that offenders are effectively dealt with in the justice system.

We would like to present refresher courses to our staff annually, and would like to invite other organisations to participate again, in an effort to empower the whole Child Protection network in South Africa.

Edith is a social worker who has specialised in working with traumatised children for the past 16 years. She developed the Teddy Bear Clinic into a multi-level service, initiated the Child Witness Project in the Western Cape and developed the Healing Project on behalf of RAPCAN. She is the co-founder of the Child Trauma Centre in Cape Town and offers multi-disciplinary workshops on a range of topics including helping the traumatised child and working with helping professionals to prevent and manage secondary trauma.
