Key points:

 This report presents the findings and recommendations (set out in Section 6) of the Crawley Town FC Travel Partnership Scrutiny Panel‘s investigation into match day parking.

4/1 Section 1 – Establishment of the Panel and its Scope

1.1 The Crawley Town FC Travel Partnership Scrutiny Panel was established in July 2011 to review the transport/travel related issues surrounding Crawley Town FC (CTFC) and to work in partnership on such issues/other factors arising to support its transition and growth. The Panel’s work was initially deferred pending the planning application for the erection of a new east stand at Broadfield Stadium (owned by the Council) and there was also an extended period of discussion about the purpose and remit of the Panel internally within the council, before a final decision was made by the Overview and Scrutiny Commission (OSC) that there was a strong benefit to conducting a member-led review that was open to the public.

1.2 The Panel met 5 times between August 2012 and February 2013. The Members of the Panel were: Councillors M G Jones (Chair), B K Blake, Dr H B Bloom, J I Denman, A J E Quirk, C A Moffatt and B J Quinn.

Recommendation (1)

a) The Commission is asked to note the report and to endorse the recommendations, and amend any recommendations as appropriate, of the Crawley Town FC Travel Partnership Scrutiny Panel.

b) That the Commission be provided with a first update report at its meeting on 7 October 2013

The Cabinet is requested to support this report and the recommendations, as endorsed or amended by the Overview and Scrutiny Commission.

Section 2 – The Panel’s investigations and information gathering

Methods of investigation

2.1 Witnesses. The following attended witness sessions, as the most appropriate stakeholder representatives as identified through the Scoping Framework:

4/2 2.2 ‘Have Your Say’ leaflets, press releases and website info Streets and roads in the wards perceived to be affected by inconsiderate and/or dangerous match day parking were identified as households in Southgate, Broadfield and . Households in each of these wards received a hand-delivered ‘Have Your Say’ leaflet, requesting information, opinion and possible solutions to the match day parking issues. The leaflets were delivered by the Chair and other members of the Panel.

Each meeting of the Panel was advertised in an editorial in the local press, and also on the CBC website. Residents were also invited to provide comments via email or telephone. There was additional coverage on BBC Radio and online at the local website Crawley Happy Times.

2.3 Site visit On 5 January 2013, during a capacity-crowd game (Reading FC v Crawley Town FC), the Chair, 1 other Member and the Democratic Services Manager visited the neighbourhoods affected to witness the issues first-hand.

2.4 Survey A 4 week survey was conducted by Steve Kirby, Enforcement & Technical Services Manager, CBC, and written and photographic evidence was gathered on both match and non-match days in order to provide comprehensive proof of the reported issues, and to establish whether problems also exist on non match days (Appendix A refers).

2.5 Similar reviews conducted by other local authorities The Final Reports of Stoke City Council and Middlesbrough Council were considered, although the differences in issues and club sizes in relation to Crawley meant these were limited in value as part of this exercise.

Stoke CC had many different parking problems (including a lack of parking spaces) and indicated it was not possible to resolve a significant proportion of these in the near future. It identified main problems were caused by both home and away supporters. It did, however, recommend improved signage, promotion of car sharing, cycling and provision of cycle parks.

Despite its far larger football crowds, Middlesbrough recommended similar solutions including highlighting alternative modes of transport, it also recommended a Park & Ride option as a long-term solution which was not concurrent with solutions recommended by the Crawley Scrutiny Panel (this was recommended in anticipation of the Club’s return to the Premiership. However, Middlesbrough has not returned to the Premiership at the time of this report).

4/3 Section 3 – The Findings

This section explains the views of the stakeholders and of the residents affected.

3.1 The nature and extent of the problem and the areas most affected The Panel arranged a number of meetings in order to discuss the extent of the problem and to discuss possible solutions with the other stakeholders and residents.

3.1.1 Crawley Borough Council survey The survey, attached as Appendix A, was conducted over 4 days with twice daily observations. On 2 of the days, Crawley Town matches were played at home.

3.1.2 Crawley Town FC The outgoing CTFC Chief Executive attended one meeting, and the CTFC Safety Officer attended one meeting. One of the suggested solutions was a Traffic Regulation Order (TRO); the Chief Executive felt the responsibility for funding such a scheme lay with Crawley Borough Council, not the club.

Another possible way to reduce the number of poorly parked vehicles was to ‘name & shame’ such drivers by means of a photograph on the CTFC website. The CTFC Safety Officer felt this would have little effect and would not want to promote such a campaign on the CTFC website (although he did agree an article could be run on the subject).

The Safety Officer also felt increased signage would have little effect as drivers tend to be creatures of habit, and that it was human nature to want to continue to drive and park as close to the ground as possible.

3.1.3 Metrobus It was felt by Metrobus that they currently provide sufficient match day services (23 buses per hour) and that these are well used by supporters. However, they will work with the Club to look at increasing capacity of services on busy match days

Metrobus felt greater prominence of the PlusBus scheme (which gives passengers 70p of savings) could be given on the Crawley Town FC website

Cost of match day ticket scheme: This is being dealt with by the Travel Group and discussions are being held between Crawley Town FC and Metrobus.

3.1.4 County Council (WSCC) Action was taken in late 2012 to introduce waiting restrictions and reduce parking on the A23 to address safety issues, amid concerns that this would displace vehicles to park in the neighbouring roads. At the meeting on 17 September, some residents reported this was the case.

Planning or development control conditions attached to schemes such as match day ticket: WSCC Travel Plan Coordinator reports work ongoing on this – undertakings agreed in Travel Plan by CTFC have not all been fully delivered, eg. lack of provision of additional signage, information distributed at matches on public/other means of accessing the stadium etc. CTFC has commissioned a monitoring survey, as required as condition of the Travel Plan, but WSCC has not yet seen the report on this, although it was agreed at the Steering Group meeting on 13 February that it will be submitted to WSCC within one year of the East stand being operational (approx April 2013). It was also agreed at this meeting, that CTFC would investigate the potential to offer financial/ticketing incentives to encourage season ticket holders to travel by bus or car share

4/4 3.1.4 Sussex Police During a home match against Portsmouth FC (Sunday 9 September 2012), Sussex Police ran checks on parked vehicles and established that 91% of these belonged to local supporters, which indicates the problems are caused not by away supporters, but local ones. By definition, the Police confirmed that ‘local’ meant motorists whose home addresses are in the Crawley and Horley town areas.

The Police Liaison Officer felt that regardless of the variety of possible solutions, drivers would continue to use residential parking because of laziness and because it was free, and would only park elsewhere if obliged to because of an enforcement zone.

Sussex Police also advised that resources would continue to be directed to dealing with dangerous parking, but that incidents of obstruction of the highway, and in relation to pavements, would always be subject to differing perceptions of the problem. These would not always satisfy the legal requirements that the Police must observe for an offence to be committed, even if the public may consider otherwise. However, if poor parking was observed and judged to be dangerous or obstructive it would be addressed.

Legislation Sussex Police provided the following pieces of legislation for inclusion in this report to clarify the definition of dangerous or obstructive parking:

 Section 22 of the Road Traffic Act 1988 makes it an offence for the person in charge to leave a vehicle or trailer on a road in such a position or condition as to cause a danger to other road users. If a person in charge of a vehicle causes or permits the vehicle or a trailer drawn by it to remain at rest on a road in a position or in such condition or in such circumstances as to involve a danger of injury to other persons using the road, he is guilty of an offence.

 Section 137 of the Highways Act 1980 makes it an offence to wilfully obstruct the highway. 137(1) If a person, without lawful authority or excuse, in any way wilfully obstructs the free passage along a highway he is guilty of an offence.

3.1.5 K2 Representatives reported that the K2 car park was available for supporters to use only on a very few dates throughout the season and other than that, the only other dates when it could be used were during the summer. It was also reported that supporters wishing to use the K2 car park were frustrated that having used it on one of the very few available dates, it was then not available in the following weeks, making it an unreliable alternative place to park.

Although use of the K2 car park had originally been part of the planning application for the new stadium, this was retracted as the overspill could not be guaranteed. Also, K2 no longer has use of the Thomas Bennett Community College car park: the agreement was withdrawn when building work at the College was carried out. There has been no subsequent discussion on its use, as K2’s current provision of parking spaces is currently considered to be sufficient for their needs.

3.1.6 Southern Rail The Southern Rail representative reported it would be possible to use three or four boards at Crawley station to advertise local bus services to the stadium.

3.1.5 Residents and affected neighbourhoods Public meetings were also held at community centres in the affected neighbourhoods, and the public attendance figures are as follows:  Southgate - 21  Broadfield - 8  Tilgate - 7

4/5 26 completed ‘Have Your Say’ leaflets were returned, and 11 emails and 1 letter were received, and these identified the following roads as being affected by match day parking:

Southgate Wainwrights, Swaledale Close, Downland Drive, Brighton Road, Barrington Road, Wensleydale, Tyler Road, Ditchling Hill, Cissbury Hill, Southgate Avenue, Wakehurst Drive, Teesdale, Chatsworth Row.

Broadfield Lundy Close, Anglesey Close, Windsor Close, Highwood Park and Mountbatten Close.

Tilgate Due to protracted winter weather conditions, it was not possible to arrange delivery by volunteers prior to the date of the Tilgate meeting.

The reported problems include:  Obstructions at junctions  Double parking  Parking on pavements & verges  Parking across residents’ garages, access gates & pathways  Difficulty parking near to own home  Impaired visibility at junctions  Emergency vehicles unable to access certain roads  Insufficient police presence  Cars parked in the bus lane

Key finding 1: The majority of poorly parked vehicles on match days appear to belong to local supporters. Sussex Police conducted a survey of cars at a home match which indicated that 91% of vehicles belong to local supporters.

Key finding 2: Although WSCC state that schools could be contacted to discuss use of their car parks to ease parking issues, they contend that such action would, in their opinion, contradict the terms of the Travel Plan which seeks to promote and incentives drivers to use alternative transport. WSCC are concerned that providing extra parking spaces could be seen to exacerbate the problem, rather than alleviate it.

The consensus of opinion from WSCC, CBC, CTFC and Sussex Police is that an enforcement zone is the only solution that will have a significant impact on the problems caused by inconsiderate and/or dangerous parking in residential streets.

However, the general opinion from residents, expressed during the consultation process, is that increasing the number of parking spaces and/or creating a Park & Ride scheme are the solutions. Residents who attended the various meetings as part of the consultation process made it clear they were strongly opposed to any form of charging them for permits, or any other expenditure connected with parking near their homes. They stated that they felt as they already pay their council tax, this would be unacceptable. Residents also stated they felt any fees or permits required for parking should be paid for by CTFC.

Key finding 3: The survey conducted by Steve Kirby, Enforcement & Technical Services Manager, on behalf of Ken Trussell, appeared to indicate that parking issues exist in the Southgate and Broadfield wards throughout the week, not just on match days. However, it was also clear from the information collected by officers that parking pressures were significantly higher on matchdays when CTFC were playing at home.

4/6 Existing issues notwithstanding, residents believe match day parking exacerbates the issue for them, sometimes intolerably. The Panel has also received more than enough qualitative evidence from residents both in writing, and in person at the public meetings, to complement the survey above, and to confirm that strength of feeling.

Section 4 - Potential Solutions

4.1 To discuss potential solutions, determine approximate costs of these, and to examine the advantages and disadvantages of each.

Following consultation with members of the public, stakeholders and officers, a table of all suggested solutions to the parking issues was compiled and provides the advantages, disadvantages and approximate costs of each suggestion. Please see Appendix B.

Below is additional information on the major options already listed on the table.

4.1.1 Park & Ride at Pease Pottage. WSCC felt that should this not prove to be financially viable, they would be unwilling to encourage drivers to park there and walk to the ground as there were highway safety issues involved (namely no continuous pedestrian footpath between the two sites). Metrobus also indicated, from their experience elsewhere that unless other measures were taken to compel motorists to use the Park & Ride scheme, it was unlikely to be effective.

4.1.2 Use of school car parks: WSCC advised that although schools could be contacted individually to discuss use of their car parks to ease parking issues, such action would contradict the terms of the Travel Plan which seeks to promote and incentivise drivers to use alternative transport. To provide extra parking spaces could be seen to exacerbate the problem, rather than alleviate it.

4.1.3 Residential parking scheme: The cost of implementing a match day residential parking scheme on average amounted to c£14k per year. This covers cost of permits and of enforcement in a typical sub-zone (approximately 20 – 30 roads) but not initial outlay on signage. It is not possible to clarify signage/line costs until the area covered by a potential scheme is known and how many signs etc would be required. However, as a ball park figure, each sign costs around £100 and £1 per metre of line.

WSCC advised that residents parking schemes are not normally considered for only a couple of roads. Even if there were residents who needed to park on-street, they would more than likely choose to park in the next free road, rather than pay for a permit. The scheme would then cost a lot to enforce etc, with no one actually using it. Parking schemes are designed to be self financing so there must actually be a demand from residents to park on-street, and also a wide area affected, in order to justify the introduction of a scheme.

There would then be the issue of who would be responsible for financing the start up costs of the scheme and any ongoing expenses.

4.1.4 TRO: The option of a TRO (e.g. yellow lines that could apply all of the time, for part of the day/evening or just on match days) could apply to one, or any number of roads, or any parts of roads, so that the worst affected areas could be protected. The only downside is that yellow lines would also apply to residents.

A TRO is normally prioritised by County Councillors at County Local Committee meetings, although they currently only get three a year. However, developer-funded TROs also exist, whereby a developer can contribute £5K toward the advertisement/legal costs etc. Cost of signs & lines as above. The Club, as the developer, may wish to consider contributing to this. 4/7

4.1.5 Permanent signage at CBC, in cooperation with Southern Rail, to arrange for permanent signage to be erected prominently on the station concourse directing supporters to appropriate bus stops. This would aid travel to stadium by bus, with the potential to reduce travelling by car.

4.1.6 Stakeholder shared public awareness campaign in local publications WSCC is not currently able to support this as they claim that it could potentially open them up to requests to do the same in other areas of the county that do not come within their works programme. The cost of a 2 page article in the local press was considered too high. They are also looking at a leaflet to raise awareness of appropriate parking skills.

4.1.7 Increased information on CTFC website Agreement by the Chief Executive to add improved parking plans to the Crawley Town FC website.

4.2 Preliminary statutory stakeholder opinion on best solution

Listed below are the most likely effective solutions in the considered opinion of Crawley Borough Council, West Sussex County Council and Sussex Police.

4.2.1 CBC (Enforcement & Technical Services Manager and Cabinet Member for Environmental Services) The best option would be to apply for a Traffic Regulation Order consisting of Double Yellow Lines around problematic areas which would encourage people to use the provided facilities to park without being in contravention. Motorists that fail to comply will be issued with a Penalty Charge Notice.

4.2.2 WSCC A two step approach might work best, and starting off with smaller measures may prove advantageous. i) Implement a series of double yellow lines at various junctions etc as well as single yellow lines in lengths of road that could apply from 3-4pm (for example). This could be funded directly by the football club and progressed through our TRO Team. This would deal with the worst problems. Residents could also be informed of the potential for access protection lines.

ii) If there is still a recognised problem after the introduction of yellow lines, a match day parking scheme could be considered. This could also be funded by the football club.

4.2.3 Sussex Police The first part would be the introduction of a match day TRO, to cover an area large enough that the two free parking facilities which are currently provided by the club are inside the boundary of that additional Match Day TRO.

This would then also require a match day Residents Only parking scheme, within the match day TRO area, which would then also need the addition of civil enforcement officers or community wardens. These would need to enforce the match day Residents Only parking scheme, with police enforcing, as necessary on the 40 mph roads, as is already in place.

4.3 Financial Implications The cost of the match day residents parking scheme would be approximately £15-18k per annum. This covers initial set-up costs of £14k, and signage at £100 per sign, and lines at £1 per metre. Costs thereafter would be approximately £14k per annum for the renewal of permits etc. It is anticipated these costs would be met jointly by CBC as owner of the stadium, WSCC as the Highway Authority, and CTFC as their activities have contributed to the issues. If the recommendations are agreed, officers, in consultation with Members, would need to identify how the costs can be budgeted for. The Budget for 2013-14 was set by Full Council 4/8 on 27 February 2013, and the above estimated costs have not been considered as part of the Budget.

However, these costs may well differ from the above estimate, as the exact area to be covered by such a scheme has not yet been determined, and without further joint work by officers of both CBC and WSCC, the nature of the TRO cannot be established (i.e. a consolidated TRO). A meeting between CBC and WSCC is scheduled for 11 March to consider proposals for the best solution re parking schemes. An update will be given at the OSC on 18 March.

Further consideration could also be given to addressing the matchday parking problems through the wider work of the verge & other parking projects.

Before any further work is undertaken to determine the extent and nature of this proposed solution, the OSC is requested to confirm whether or not there is support in principle for work to continue on this matter and, if so, to agree a recommendation as appropriate.

Section 5 - Conclusions

Conclusions Based on the evidence provided throughout the investigation, the Panel concluded:

5.1 As the review progressed, it became clear that local supporters have entrenched parking habits. It was felt by numerous witnesses and stakeholders that it would be difficult to persuade supporters to break these habits in sufficient numbers to have a noticeable effect.

5.2 Nonetheless, it was felt that any action taken to encourage drivers to use alternative modes of transport would make a contribution to reducing the problems, and as such, initiatives to promote alternative transport should be pursued.

5.3 The survey on parking provided by CBC demonstrated that in certain locations parking issues exist throughout the week and not on match days alone. The issues are not just increased traffic but inconsiderate and dangerous parking. The increase in supporters’ vehicles on match days exacerbates these problems.

5.4 It was acknowledged that the new Chief Executive of Crawley Town FC is focussing on positive community engagement and on raising the quality of the match day experience for all.

5.5 The Panel wished to record their unanimous agreement that residents must not, under any circumstances, now or in the future, be directly subject to charges or fees connected with any schemes or recommendations made by the Panel. The Panel also expressly opposed the use of yellow lines as a solution as this would clearly expose residents to the same parking restrictions and potential penalties.

5.6 The Park and Ride scheme was closely considered, and views sought. The council asked an open-ended question about what solutions could be found, and some residents suggested a Park and Ride scheme as a solution, possibly from Pease Pottage. The residents who suggested it, however, made clear that they would only support it if it was likely to be effective and well-used. The panel also noted the clear and persuasive views of a CTFC supporter at one public meeting that if the Park and Ride scheme was sited too far away, supporters would still not use it. Based on the information collected by the panel, including advice from Metrobus and Sussex Police, it was considered that the scheme would be too expensive, and was unlikely to work as the main issue with parking did not appear to be caused by visiting away supporters.

4/9 5.7 It would not, therefore, have been an initiative that would change current parking habits and the council were likely to be left with a scheme which was heavily underused. In addition, there were safety concerns from WSCC over a lack of continuous footpath from Pease Pottage to the Broadfield Stadium which would have placed pedestrians at risk. In addition, the fact that the Tilgate Forest Business Park is much nearer Broadfield Stadium and is significantly underused, even when there are capacity crowds, it was not felt by the Panel this was a viable or cost-effective solution.

Section 6 - Recommendations

Recommendations

Transport 6.1 Improved public transport. It was acknowledged that full and permanent increases to the local public transport services would be unnecessary and costly, given that the number of supporters attending matches fluctuated widely according the prominence of the away team. The Panel therefore recommends that, with cooperation between CTFC and Metrobus, imminent home fixtures should be assessed and the crowd capacity estimated, and for services to be increased temporarily and accordingly, to meet the estimated increased demand.

6.2 Discounted public transport. While members decided that the panel would not make recommendations on discounted public transport itself, it was noted that the Travel Group was looking into this and discussions are being held between Crawley Town FC and Metrobus. It had also been noted at previous meetings of the panel that such arrangements were already in place at other Football Clubs. The Panel recommends in this regard, in consultation between CTFC and Metrobus, with the objective of promoting the attraction of affordable public transport and encouraging drivers to choose it as an alternative to travel by car.

Parking 6.3 Parking at schools, industrial estates and other facilities. The Panel recommends that currently unused school and industrial estate car parks be investigated and arrangements made so they can be available, in consultation between CBC and individual schools, and promoted as alternative nearby parking for supporters, in order to reduce problem parking in residential areas.

It should be noted that the schools that were contacted did not respond or attend any meetings.

Signage 6.4 Permanent signage at Crawley Railway station. The recommendation is for permanent signage to help direct visiting supporters to the appropriate bus stops to be erected by CBC, in consultation with Southern Rail, on the station concourse in order to aid travel to the stadium by bus, with the potential to reduce car travel.

Communications 6.5 Communications. The Panel recommended that a number of free or very low cost initiatives could be employed by CTFC and CBC to capitalise on captive audiences, and large numbers of supporters and residents, to publicise the problems associated with inconsiderate and/or dangerous, obstructive parking. These are:

i) Tannoy announcements & ‘screen flash’ messages at home matches (CTFC to undertake)

ii) Improved CTFC website information on parking, additional parking facilities (if approved), walking distance from car parks, alternative travel etc., including promotion of PlusBus for away supporters (CTFC to undertake)

4/10 iii) Information circulated with programmes, season tickets etc (CTFC inserted a small article in its 26/02/13 Brentford match programme encouraging considerate parking) (CTFC to undertake)

iv) Tannoy announcements & ‘screen flash’ messages at home matches

v) Improved CTFC website information on parking, additional parking facilities (if approved), walking distance from car parks, alternative travel etc., including promotion of PlusBus for away supporters

vi) Information on the above circulated with programmes, season tickets etc (CTFC published a small article on parking in its 26/02/13 Brentford match programme).

iv) CBC to coordinate a 2-page publicity feature in Crawley Live, which would be cost neutral. The Panel voted in favour of the Chair, M G Jones, to lead on this and will pass on the views of the Panel upon publication of the Final Report, including useful information on alternative travel, and also promoting alternative non-residential parking based on the information this scrutiny panel has collected in the course of this investigation. (CBC to undertake).

Match day residents’ parking scheme 6.6 The Panel recommends the principle of a match day residents’ parking scheme, with free match day permits for residents. This would encompass the roads referenced during the consultation process and be a wide enough area to ensure alternative parking facilities for supporters fall within the permit zone. This recommendation has two stipulations, which are:

i) The Panel’s unanimous agreement that under any such scheme, residents in the area covered by the scheme must not, under any circumstances, now or in the future, be subject to charges or fees connected with its implementation or future operation.

ii) The Panel recommends that costs incurred in setting up the scheme, or any annual costs (renewal of permits etc) be met jointly by:

- CBC – as owners of the stadium - CTFC – as their activities and promotion have partly contributed to the issues - WSCC – in their capacity as Highways Authority, with a duty to address the problems

The cost of such a scheme would be in the region of £14k per annum which covers the cost of permits and of enforcement in a typical sub-zone (approximately 20 – 30 roads), with signs costing £100 each, and lines at £1 per metre.

West Sussex County Council N.B: Since the recommendations were agreed on 21 February, further information has been received from WSCC on CPZs.

It is WSCC policy that such schemes should be self-financing. They strongly recommend that residents pay for their permits (£40 for the first permit and £80 for the second, per household, per year) for reasons of demand management.

For the sake of clarity, the above response from WSCC notwithstanding, the Panel wishes to make it clear that there was no support from its members for residents in the affected zone to be required pay under any circumstances.

Crawley Town Football Club Following being informed of the decisions of the Panel, the Club replied with their views, as follows:

Whilst CTFC sees great value in this Report and in the process, and acknowledges the recommendation of the Panel to implement a match day parking scheme, it feels that this 4/11 response would be disproportionate to the parking problems, especially as the recent survey indicated problems exist outside match days. The club has stated it has a duty to help resolve issues which affect residents as part of its commitment to community engagement but feels the other, less costly solutions and initiatives that have been recommended would be more proportionate and financially viable. (These views were conveyed after the Panel had agreed its recommendations on 21 February, and immediately before this Report was finalised).

The Panel recognises and welcomes any responses received from stakeholders like the football club. It welcomes that the club recognised the value in the review and the process. The Panel also recognises that the proposals made may have financial implications for the club, which would understandably be received with concern.

However, Panel members are satisfied that their recommendations were reached after a large number of submissions over a significant period of time gathering evidence.

Panel members are satisfied that their conclusions are proportionate to the scale of the issues identified based on other representations made. However, the Overview and Scrutiny Commission at its forthcoming meeting will be able to consider the conflicting view of the Club, and will be able to give the final say whether this should be pursued

Yellow lines 6.7 The Panel agreed that the introduction of yellow lines on both sides in the area directly covering the junction of Downland Drive and Brighton Road, from the junction to the bus stop(s) by Wensleydale, to reduce the incidents of dangerous/obstructive parking currently experienced at this location. The Panel requests that this be recommended to the Crawley County Local Committee to take forward.
