The petitioner Thiru P.S. Kumaran, was present for today's (19-12-2012) enquiry. The Public Authority was represented by C. Muthelu, Public Information Officer/ Inspector of Police, AWPS, Kilpauk, Chennai.

2. The Commission perused the original documents filed by the Public Authority during today's enquiry. One Nancy David has filed a petition before the Deputy Commissioner of Police on 28-05-2012 raising objections to furnish any information relating to her especially in view of the alleged relationship between the appellant and the respondent. A perusal of the statements made by the individual D. Nancy Monica who is said to be one and the same as Nancy David on 17-12-2011 shows statements covering relationships are mentioned and if divulged it will tantamount to unwarranted invasion of privacy as defined in Section 8 (1) (j) of the R.T.I. Act, 2005. Hence the Commission holds that the denial of information on this count by the public authority is justified.

3. Regarding the "conclusion report of the W4 Inspector of Police" sought by the appellant, the Commission holds that the appellant being one of the parties involved, has a right to get to know the details of the conclusion arrived at by 2 the investigating authority and therefore no injustice will be caused by furnishing a copy of this conclusion report. The objection raised by Nancy David as mentioned in the earlier para is overruled in this particular item. The Public Authority is hereby ordered to give a copy of the conclusion report of the W4 Inspector of Police in CSR No.115/W4/2011 dt.17-12-2011. A copy of the same was furnished to the Appellant in the presence of the Commission today. The case is therefore closed as nothing else remains.
