EXECUTIVE SUMMARY

County Environmental Engineering, Inc. has completed a Phase I Environmental Site Assessment (ESA) of property owned by Juliet Lunney located at 48 Main Street (Site) in Mars Hill, Maine, as described herein. The Site (0.23 acre) is developed with a 3,025-square foot commercial building. This Phase I ESA was completed for Rusty Johnston in accordance with ASTM International Standard Practice E 1527-13 and the scope of work outlined in Section 1. The purpose of this Phase I ESA was to identify recognized environmental conditions (RECs), as defined by ASTM Standard E 1527-13, associated with the Site through records review, site reconnaissance and interviews. Based upon the work completed within the scope of this Phase I ESA, we can report this summary of findings, opinion and conclusions in connection with the property.

Off-Site Sources of Contamination Brewer’s Service Station approximately 50 feet has been operated as a service garage since the late 1940s. Petroleum contamination was encountered at Brewer’s Service Station during underground storage tank removals in 1990 and 2008. Mars Hill Freshies approximately 100 feet southeast has been operated as a gas station since the early 1940s. Petroleum contamination was encountered at Mars Hill Freshies in 2017 and 2018. Sanborn maps from 1925 to 1948 illustrate a buried gas tank on the abutting property to the east across Main Street. The 1948 Sanborn map illustrates a dry cleaner approximately 250 feet southeast. A dry cleaner was previously operated at 83 Main Street approximately 300 feet northeast. The potential exists for contamination to migrate on Site from these off-site sources of petroleum and hazardous substance contamination in groundwater and soil gas. Off-site sources of contamination with the potential to impact the Site are a REC.

Non-Scope Considerations The on-site commercial building is currently unheated, vacant and in poor repair. Significant mold growth and deteriorated suspect asbestos-containing building materials (e.g., crumbling plaster) were noted throughout the building during site reconnaissance. A hazardous building material inventory was beyond the scope of services for this Phase I ESA.

1. PURPOSE AND SCOPE

1.1 Purpose

The purpose of this Phase I Environmental Site Assessment (ESA) was to identify recognized environmental conditions (RECs) associated with the property through records review, site reconnaissance and interviews. RECs are defined in ASTM Standard E 1527-13 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process as “the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.”

1.2 Scope of Work

The scope of work consisted of records review, site reconnaissance and interviews conducted in accordance with ASTM Standard E 1527-13, as described below.

1.2.1 Records Review

A review of standard environmental records, area maps and historical sources was completed to determine property ownership and use from the present to the 1895 when the property was developed as a residence (per Sanborn map).

1.2.2 Site Reconnaissance

Physical observation of the property was completed to identify RECs including, but not limited to:

• Transformers or other equipment with possible polychlorinated biphenyl (PCB) concentrations; • Underground and aboveground storage tanks; • The use, storage, handling, and disposal of hazardous substances and petroleum products; • Evidence of hazardous substance or petroleum product releases (i.e., stains or corrosion, stressed vegetation, pools of liquid, odors, damaged or improperly stored containers); • Contamination receptors, including basements, utility conduits, sewer lines, surface water bodies, , subsurface disposal systems, drainage ditches, floor drains, sumps, catch basins, dry wells, pits, ponds, or lagoons; • Surrounding land use, including proximity to water and other sensitive environments, and environmental problems from off-site sources.

The property owner and individuals familiar with the property and surrounding area were interviewed for information on RECs in connection with the property.

2. SITE DESCRIPTION

2.1 Site Location and Characterization

This Phase I ESA was completed for property owned by Juliet Lunney located at 48 Main Street (Site) in Mars Hill, Aroostook County, Maine. As shown on the attached Location Map (Figure 1, Appendix), the Site (0.23 acre) is located on the west side of Main Street (Route 1) in downtown Mars Hill. The Site is identified as Lot 3 on the Town of Mars Hill Tax Map 15 and zoned for commercial use. The Site is developed with a 3,025-square foot commercial building.

As shown on the attached Site Map (Figure 2, Appendix), the surrounding area consists of residential and commercial properties. The nearest surface water body is Prestile Stream approximately 800 feet northeast. General surface topography of the area is flat, gently sloping northeast. According to the Maine Office of GIS (MEGIS) wetland characterizations data layer, there are no mapped wetlands within the property boundaries of the Site. The Federal Emergency Management Agency (FEMA) Flood Map for the Town of Mars Hill indicates the Site is in Zone C for areas with minimal flooding.

According to the MEGIS bedrock geology units data layer, bedrock in the area is mapped as interbedded pelite and limestone and/or dolostone of the Carys Mills Formation (SOcm). According to the MEGIS surficial geology data layer, the primary surficial geologic unit in the area is stagnation moraine, consisting mostly of till, but also includes variable percentages of undifferentiated sand and gravel. According to the MEGIS aquifer polygons data layer, the Site is not located on a mapped sand and gravel aquifer.

The Site and surrounding area are served by municipal water and sewer. According to the MEGIS public drinking water wells data layer, there are no public drinking water supply wells within 2,500 feet of the Site. According to personnel from the Mars Hill and Blaine Water Company, there are several private water supply wells within 2,500 feet of the Site. The nearest wells are located approximately 900 feet northwest and 1,300 feet southeast. Private wells east of Prestile Stream were not considered.

2.2 Site History

The earliest record of the Site is a residence on Sanborn maps from 1895 to 1912. The existing on-site commercial building was constructed in 1923 and operated as a furniture store by John Shaw through 1945 and Roland Wight through 1979. As illustrated on Sanborn maps from 1925 to 1948, an ice house was previously located on the west side of the Site. The Site was acquired by Ronald Hallett in 1979, Scott Munson in 1989, Lester Harvey in 1995 and Curtis Lunney in 1999. Historic site use includes a doctor’s office and restaurant with apartments on the second floor. The property has been vacant for several years.

2.3 Adjoining Land Uses

Refer to the attached Site Map (Figure 2, Appendix) for the location of adjoining properties listed below. Location given is relative to the Site. Apparent use is per visual observation and information provided by the Town of Mars Hill.

Sanborn maps from 1925 to 1948 illustrate a buried gas tank on the abutting property to the east across Main Street. Although not adjoining, nearby Brewer’s Service Station approximately 50 feet south has been operated as a service garage since the late 1940s. Mars Hill Freshies approximately 100 feet southeast has been operated as a gas station since the early 1940s. The 1948 Sanborn map illustrates a dry cleaner approximately 250 feet southeast. A dry cleaner was previously operated at 83 Main Street approximately 300 feet northeast.

3. RECORDS REVIEW

Historical use and environmental records, including standard sources, were reviewed to help identify RECs in connection with the property. Some records reviewed pertained not just to the Site but also to properties within an approximate minimum search distance to help assess the likelihood of migrating hazardous substances or petroleum products on to the Site. Listed below are the approximate minimum search distances given in ASTM Standard E 1527-13. Information that is not reasonably ascertainable, meaning publicly available, obtainable within reasonable time and cost constraints, and practically reviewable, is not necessarily reviewed.

3.1 Historical Use Information

The purpose of reviewing historical sources is to determine past and present uses of the property and surrounding area that indicate RECs. The apparent site history is discussed in Section 2.2 and adjoining land uses in Section 2.3.

3.1.1 Mars Hill Municipal Office – Property assessment records and historical photographs were obtained from the Town of Mars Hill municipal office.

3.1.2 Environmental Data Resources Sanborn Maps – Sanborn maps covering the target property were obtained from Environmental Data Resources.

3.1.3 Southern Aroostook County Registry of Deeds – Deed records were obtained from the Southern Aroostook County Registry of Deeds.

3.1.4 Central Aroostook Soil and Water Conservation District – Historical aerial photographs were obtained from the Central Aroostook Soil and Water Conservation District office.

3.1.5 Google Earth – Historical aerial imagery was obtained from Google Earth.

3.1.6 Vintage Aerial – A historical photograph was obtained from the Vintage Aerial website (www.vintageaerial.com).

3.2 Federal Environmental Records

3.2.1 EPA National Priorities List Sites in Maine www.epa.gov/fedfac/federal-facilities-national-priorities-list-npl-your-area, last updated April 5, 2019.

Compiled by the U.S. Environmental Protection Agency (EPA), the National Priorities List (NPL) is the agency’s list of sites believed to pose environmental threats significant enough to warrant remedial action under Superfund and contains sites which have the highest priority for cleanup pursuant to EPA’s Hazard Ranking System. There were no NPL sites listed for Mars Hill.

3.2.2 SEMS Sites in Maine and Archived Superfund Sites www.epa.gov/enviro/sems-search, data extracted November 25, 2019.

Superfund Enterprise Management System (SEMS) sites are potential and confirmed hazardous waste sites at which the EPA Superfund Program is involved. There were no SEMS sites listed for Mars Hill.

3.2.3 EPA Resource Conservation and Recovery Act Information Database https://enviro.epa.gov/facts/rcrainfo/search.html, data extracted January 30, 2021.

The Resource Conservation and Recovery Act Information (RCRAInfo) database is used by the EPA to track entities regulated under RCRAInfo subtitle C (hazardous waste handlers). RCRAInfo includes data on general handler information, permit or closure status, compliance with federal and state regulations, and cleanup activities. There were no Treatment, Storage and Disposal facilities listed for the Town of Mars Hill. The Site and abutting properties were not listed as RCRA generators.

3.2.4 EPA Facility Registry System www.epa.gov/frs/frs-query, last updated February 23, 2021.

The EPA Facility Registry System (FRS) is a centrally managed database that identifies facilities, sites or places subject to environmental regulations or of environmental interest. The Site and abutting properties were not listed on the EPA FRS.

3.3 State Environmental Records

3.3.1 MEDEP Division of Remediation Sites List www.maine.gov/dep/gis/datamaps/brwm_remediation_sites/rpt_rem_site_list.pdf, updated March 26, 2021.

This most recent public record of all past and current sites in the Superfund, Federal Facilities, Landfill Closure, Uncontrolled Sites, Brownfields and/or Voluntary Response Action Program (VRAP) was reviewed, including sites which are being actively worked on, sites which may pose a threat to public health and require further investigation, sites which have been investigated and found to have no evidence of hazardous substances, or sites which require no further action.

The Site was not listed on the MEDEP Division of Remediation Sites List. Four properties were listed within 2,500 feet of the Site, including the Caldwell property (REM02146) 350 feet south, Mars Hill On the Run (REM02904) 600 feet north, Mars Hill Community Center (REM02476) 1,300 feet southwest and former Mars Hill municipal landfill (REM00213) 2,500 feet southeast.

State lists were reviewed for landfill and/or solid waste disposal sites. There are no active landfills, processing facilities or transfer stations listed within one-half mile of the Site.

The MEDEP Registered Underground Storage Tank (UST) database was reviewed for registered tanks at the Site and abutting properties. There were no tanks listed for the Site or abutting properties.

3.3.4 MEDEP Spill Report Master List www.maine.gov/dep/ftp/reports/spills.pdf, updated March 16, 2021.

The MEDEP Spill Report Master List includes all responses to spills or releases of hazardous substances or petroleum products, including leaking underground storage tanks (LUSTs). Maine law requires the immediate reporting of discharges of hazardous matter to the MEDEP, unless the discharge is covered by an approved written spill prevention, control and countermeasure (SPCC) plan and does not extend beyond the area covered by the plan. There were no spill reports for the Site. Spill reports for abutting or nearby properties with the potential to impact the Site are summarized below.

Spill #I-125-1990. Petroleum contamination was encountered at Brewer’s Service Station approximately 50 feet south when USTs were removed in 1990. According to the spill narrative, approximately 40 cubic yards of contaminated soil was removed for off-site disposal.

Spill #I-139-2008. Petroleum contamination was encountered at Brewer’s Service Station when USTs were removed in 2008. Approximately 12 cubic yards of contaminated soil was removed for off-site disposal.

Spill #I-267-2017. Petroleum contamination was encountered at Mars Hill Freshies approximately 100 feet southeast when USTs were removed in 2017. Contamination was left in place due to cleanup goals.

Spill #I-138-2018. Petroleum contamination was encountered at Mars Hill Freshies during earthwork for new UST installations in 2018. Excess soils were transported to an off-site landspread area.

3.3.5 Maine Environmental and Geographic Analysis Database https://www.maine.gov/dep/maps-data/egad/, results through April 6, 2021.

The Maine Environmental and Geographic Analysis Database (EGAD) includes sites with threats to groundwater and environmental monitoring. The Site was not listed in EGAD.

3.3.6 MEDEP File Room Database www.maine.gov/dep/search/fileroom, results through April 6, 2021.

The MEDEP Bureau of Remediation and Waste Management file room records database includes project, solid waste and landfill files. The Site was not listed in the MEDEP File Room database.

4. SITE RECONNAISSANCE

A site visit was completed on March 29, 2021 by Craig Brescia of County Environmental Engineering, Inc. to help identify RECs in connection with the Site. Site reconnaissance included, but was not limited to, investigation of the following conditions:

• Evidence of USTs and ASTs, including vent pipes, fill pipes, or access ways indicating a fill pipe • The use, storage, handling, and disposal of hazardous substances and petroleum products • Evidence of hazardous substance or petroleum product releases (i.e., stains or corrosion, stressed vegetation, stained or contaminated soil, pools of liquid, odors, damaged or improperly stored drums, chemical sacks or other containers) • Evidence of past or present uses of the property as a frequently polluting industry (i.e., gasoline station, motor repair facility, commercial printing facility, dry cleaners, photo developing facility, junkyard, or waste handling facility) • Evidence that hazardous substances or petroleum products, unidentified waste materials, tires, automotive or industrial batteries or any other waste materials had been dumped above grade, buried, and/or burned on the property • The location of contamination receptors, including basements, utility conduits, sewer lines, surface water bodies, wells, subsurface disposal systems, drainage ditches, floor drains, sumps, catch basins, dry wells, pits, ponds, or lagoons • Transformers or other equipment with possible PCB concentrations • Surrounding land use, including proximity to water and other sensitive environments, and problems from off-site sources.

4.1 Exterior Observations

The Site (0.23 acre) is developed with a 3,025-square foot commercial building on the east side of the property near Main Street. The Site is served by overhead electric with a utility pole off the northeast corner of the building. There are no pole or pad-mounted transformers at the Site. A gravel drive extends along the northern property boundary to a gravel yard on the west side of the Site. Visual observation of the ground surface was limited during site reconnaissance due to snow cover.

4.2 Interior Observations

The commercial building is a two-story wood-framed structure with a full concrete basement. The first floor of the building was previously occupied as a restaurant and store with residential apartments on the second floor. The building is currently unheated, vacant and in poor repair. Electricity, municipal water and sewer services are available at the Site, but none of the utilities are currently active.

Significant mold growth and deteriorated suspect asbestos-containing building materials (e.g., crumbling plaster) were noted throughout the building during site reconnaissance. The basement was flooded and standing water was observed on the first floor. Two manifolded fuel oil tanks are located near the southwest corner of the basement with fill and vent pipes extending to the building exterior. Visual observation of basement floor was limited due to water, ice and debris.

4.3 Surrounding Properties

The adjoining and surrounding properties were inspected by driving and walking around the area. No other RECs were observed on any adjoining properties.

5. INTERVIEWS

The following individuals were interviewed for this Phase I ESA. Pertinent information provided by the individuals below has been included in previous sections of this report.

Juliet Lunney, current property owner, was interviewed for this assessment and provided information regarding site use and history.

Curtis Lunney, property manager, was interviewed for this assessment and provided information regarding site use and history.

Rusty Johnston, Mars Hill resident, was interviewed for this assessment and answered questions regarding site use and history. Mr. Johnston completed the Phase I ESA environmental questionnaire.

6. FINDINGS AND OPINION

Based upon the work completed within the scope of this Phase I ESA, we can report this summary of findings and opinion in connection with the property.

6.1 Off-Site Sources of Contamination

7. CONCLUSIONS

The purpose of this Phase I ESA was to identify RECs associated with the property through records review, site reconnaissance and interviews. RECs are defined by ASTM Standard E 1527-13 as “the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.”

We have performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527 of property owned by Juliet Lunney located at 48 Main Street in Mars Hill, Maine. Any exceptions to, or deletions from, this practice are described in the Limitations Section of this report. This assessment has revealed no evidence of RECs in connection with the property except for the following: off-site sources of contamination.

8. LIMITATIONS

This Phase I Environmental Site Assessment has been completed in accordance with ASTM Standard E 1527-13 for specific application to property owned by Juliet Lunney located at 48 Main Street in Mars Hill, Maine and described herein. No warranty, expressed or implied, is made. County Environmental Engineering, Inc. (CEE) cannot be responsible for the actions of others taken in reliance on this report, nor for any consequential or incidental damages arising or resulting from this report.

This report is based on the records review, site reconnaissance and interviews completed by CEE as outlined in the scope of work and our professional judgment. As such it does not represent scientific certainties. CEE does not represent that the Site contains no hazardous material or other potential condition beyond that detected during this environmental site assessment. Should any additional information subsequently become available, CEE requests the opportunity to review the new data and modify, if appropriate, the assessments, findings, conclusions and opinions given in this report.

Visual observation of the ground surface was limited during site reconnaissance due to snow cover. Visual observation of the basement floor was limited due to water, ice and debris. These limitations may be considered significant data gaps. This report is based in part on information provided by others who are knowledgeable about the Site and/or other pertinent matters, and in part on public records. CEE cannot guarantee that the information provided to us is accurate. Whenever standard sources were not reasonably ascertainable, alternatives similar or better in reliability and detail were reviewed, including personal knowledge of persons interviewed. Current (within 90 days) sources of standard information were reviewed, whenever reasonably ascertainable.

The past use and/or ownership of the Site was determined to 1895 when the property was developed as a residence (per Sanborn map). CEE has made no attempt to verify the compliance of past or present owners or occupants of the property with local, state or federal laws and regulations. This site assessment was not an environmental audit of the operations of owners or occupants, but rather an assessment of recognized environmental conditions in connection with the property from records review, site reconnaissance and interviews.

Environmental Professional Statement. I declare that, to the best of my professional knowledge and belief, I meet the definition of Environmental professional as defined in §312.10 of 40 CFR 312 and I have the specific qualifications based on education, training, and experience to assess a property of the nature, history, and setting of the subject property. I have developed and performed the all appropriate inquiries in conformance with the standards and practices set forth in 40 CFR Part 312.
