SEC News Digest, 06-28-2000 -, J SEC NEWS DIGEST Issue 2000-123 June 28,2000 ENFORCEMENT PROCEEDINGS EAJA AWARD - KIRK MONTGOMERY Kirk Montgomery was awarded fees and expenses incurred in defending against charges brought against him in an administrative proceeding. The award was made pursuant to the Equal Access to Justice Act (EAJA), which allows small businesses and individuals of moderate means to recover expenses of defending against charges brought by the U.S. Government that are not substantially justified. An EAJA applicant must prevail in the Government's proceeding against him and also show that the Government's position was not reasonable in law or fact and thus not substantially justified. The purpose of the EAJA is to eliminate for the average person the financial disincentive to challenge unreasonable government action. Montgomery, formerly of FSC Securities of Atlanta, Georgia, had been charged with failure to supervise so as to prevent alleged mutual fund sales practice violations by a registered representative associated with FSC in the proceeding brought against both of them. Both were cleared of all charges after a hearing before an administrative law judge. In ruling on Montgomery's EAJA claim, the law judge concluded that the proceeding against him was not substantially justified and that he incurred the expenses he claimed for his defense. The amount awarded was reduced to comply with the $75 per hour cap on attorney fees that is provided in the Commission's Rules as authorized by the EAJA. (Initial Decision No. 168; File No. 3-9786) SELF-REGULATORY ORGANIZATIONS ACCELERATED APPROVAL OF PROPOSED RULE CHANGE The proposed rule change (SR-CHX-OO-14) filed by the Chicago Stock Exchange to amend its rules relating to the listing standards applicable to listing portfolio depository receipts and investment company units has become effective, as amended, under Section 19(b)(2) of the Securities Exchange Act of 1934. Publication of the notice is expected in the Federal Register during the week of June 26.
