Connie Payne, 54 Sorbie Road, Ardrossan has applied for Planning Permission for the continuation of use of building and yard for a car repair centre at 1A Park Road, Ardrossan. Objections have been received from Mr. J. Cameron and Mr. J. Mitchell, 1 Park Road, Mrs. A. Morrison, 2b Anderson Terrace, Mrs. E. McCart, 4a Anderson Terrace, Mr. J. Dodds, 23 Anderson Terrace, the residents of 1-7 (odd) Park Road (per McLennan, Adams and Davis, Solicitors, Alloway Place, Ayr), and the residents 6a, 8, 8b and 8g Park Road (per Mr. T. Connolly, 6a Park Road), all Ardrossan.

The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:-

1. That the proposed use represents a non-conforming use within a residentially allocated area and following a trial period of operation, has been demonstrated to adversely affect the residential amenity by reasons of noise, disturbance and on - street parking.

2.1 N/01/00010/OPP: Arran: Kildonan: Site to South West of Castle View

F. Anderson & Miss J. Thompson per Robert N. Brass, Invercloy House, , have applied for outline Planning Permission for the erection of a dwellinghouse on a site to the South West of Castle View, Kildonan, Isle of Arran. Objections have been received from Janice Robinson, Castle House, Kildonan, Hugh and Rosemary Hagan, 1 Coastguard House, Kildonan, Mr. P.A. Picken, Lenamhor, Kilmory, and Mrs. Edwardina Picken, Bruce Cottage, Lenamhor, Kilmory, Isle of Arran.

The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-

1. That the approval of Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced.

2. That effluent disposal arrangements shall comply with the current Code of Practice BS6297:1983, with any outfall pipe extended to 1 metre beyond the low water mark, to the satisfaction of North Ayrshire Council as Planning Authority.

2.2 N/01/00480/PP: Arran: Brodick: Kames Antiques and Jewellery

Illia Price, IP Engineering, Cladach, Brodick, Isle of Arran has applied for Planning Permission for alterations to form a rear dormer and a change of use from a jewellery workshop and sales area to living accommodation and workshop at Kames Antiques and Jewellery, Brodick, Isle of Arran.

The Sub Committee agreed to grant the application, subject to the following condition:-

1. That the planning permission hereby granted shall ensure not for the benefit of the land to which it relates but for the benefit of the applicant only.

2.3 N/01/00508/PP: Arran: : Ibrox Cottage

Mr. and Mrs. W P Stone, Ibrox Cottage, Whiting Bay, Isle of Arran have applied for Planning Permission for a two storey extension to form a lounge, two bedrooms and kitchen, utility and w.c. at that address.

Page 2 The Sub Committee agreed to grant the application, subject to the following conditions:-

1. That prior to work commencing on site, a detailed specification of the roofing material and colour finish of the external walls shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority.

2. That the developer shall secure the implementation of an archaeological watching brief (in accordance with terms of reference supplied by West of Archaeology Service) to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority; and the retained archaeological organisation shall be afforded access to the site at all reasonable times and allowed to record and recover items of interest and finds.

3. That not less than 14 days prior to the commencement of work on site, the name of the archaeological organisation intended to be retained by the developer shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority acting on the advice of West of Scotland Archaeology Service.

2.4 N/01/00523/PP: Arran: Corrie: Store to North of Seawinds

Gerald Hearns, 8 Murchland Way, Irvine has applied for Planning Permission for alterations to form a stairway to a store, stepped ramp to the rear, a rear dormer with access door to the ramp and repainting of the front elevation on a site to the north of Seawinds, Corrie, Isle of Arran. An objection has been received from N. Hamilton Bulger, Corrie Hotel, Corrie, Isle of Arran.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-

1. That within three months of the date of this permission the front wall of the property shall be repainted a colour which shall be agreed in writing with North Ayrshire Council as Planning Authority.

2. That the premises shall be used for the purposes of garage, store and access stair and for no other purpose.

2.5 N/01/00762/PP: Arran: Corrie: Store to North of Seawinds

James Lees, Cir Mhor, , Isle of Arran has applied for Planning Permission for a change of use from a workshop to a display area and store for the adjacent Corrie Craft and Antiques Shop and external painting on a site to the north of Seawinds, Corrie, Isle of Arran.

2.6 N/01/00816/PP: Arran: : 72 Murray Crescent

G. Nicholson, 72 Murray Crescent, Lamlash, Isle of Arran has applied for Planning Permission for a one and a half storey extension to form a lounge, a bedroom and shower room on the ground floor and a bedroom and shower room on the first floor at that address. An objection has been received from J K Williams, 73 Murray Crescent, Lamlash, Isle of Arran.

The Sub Committee, having considered the terms of the objection, agreed to grant the application.

3. Garnock Valley Local Plan Area

N/01/00877/PP: Dalry: Site to South of 24 James Street

BT Cellnet Ltd., 260 Bath Road, Slough have applied for Planning Permission for the erection of a telecommunications mast, cabin, antennae, fence and ancillary equipment on a site to the south of 24 James Street, Dalry. Objections have been received from S. Stewart, 41b Sharon Street, J. McKechnie, Head Teacher, Dalry Primary School, Sharon Street, A. Kerr, 13 James Street and Mr. and Mrs. J. Russell, 41c Sharon Street, all Dalry.

The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:-

1. That the proposal would be contrary to Policy INF 9 of the adopted Garnock Valley Local Plan, in that it would be visually dominant when viewed from neighbouring residential property and thereby detrimental to their residential amenity.

4. Irvine/ Local Plan Area

N/02/00003/LBC: Irvine: 67 - 69 High Street

The Royal Bank of Scotland have applied for Listed Building Consent for internal and external alterations including the formation of a new interview room, new external lighting and a new ramp, landing platt, steps and power assisted entry doors to the front elevation at 67-69 High Street, Irvine.

Page 4 The Sub Committee agreed, subject to Section 12 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997, to grant Listed Building Consent subject to the following conditions:-

1. That a sample of the stone proposed for the ramp shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority prior to the commencement of any works.

2. That the proposed lights shown on the frieze above the doors shall be re-sited at a position to be agreed in writing with North Ayrshire Council as Planning Authority.

3. That the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority, during development work. The retained archaeological organisation shall be afforded access at all reasonable times and allowed to record and recover items of interest and finds. Terms of Reference for the watching brief will be supplied by West of Scotland Archaeology Service. The name of the archaeological organisation retained by the developer shall be given to North Ayrshire Council as Planning Authority and to the West of Scotland Archaeology Service in writing not less than 14 days before the development commences.

5. North Coast and Cumbraes Local Plan Area

5.1 N/01/00819/PP: : 10 Jacks View

Mr. and Mrs. G. McAloon, 10 Jacks View, West Kilbride have applied for Planning Permission for the erection of a conservatory and double garage at that address. Objections have been received from Mrs. Helen McQueen, no. 8, James Pattie, no. 14, Mr. J. Duncan, no. 16, Doreen Cooper, no. 18, R T Wilson, no. 6, Hugh Brownlie, no. 11, James Riddet, no. 20 and Roger Cooper, no. 18, all of Jacks View, West Kilbride.

The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:-

1. That the proposed development would be contrary to Policy HOU8 in the adopted North Coast and Cumbraes Local Plan in that by reason of its siting, design and external appearance, it would detract from the appearance of the house and result in development within the open plan front garden of the property which would be detrimental to the amenity and appearance of the residential area.

Mr. and Mrs. J. Hillhouse, 9 Warren Park Mews, Largs have applied for Planning Permission for alterations to windows to form an external access door at that address. An objection has been received from Malcolm F. Campbell, 13 Warren Park Mews, Largs.

The Sub Committee, having considered the terms of the objection, agreed to grant the application.

5.3 N/01/00875/PP & 01/00876/LBC: Largs: 1 Anthony Road

Henry Jagielko, 1 Anthony Road, Largs has applied for Planning Permission and Listed Building Consent to dismantle the existing carport and erect an extension to the existing house comprising conservatory, swimming pool, gymnasium, garage and carport, and the erection of a fence and formation of vehicular access at that address.

The Sub Committee agreed (a) to grant the application for Planning Permission subject to the following condition:-

1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority, exact details or samples of the external finishes to the extension, the material to be used to increase the height of the existing wall adjoining Anthony Road and form the new curved entrance walls, the finish to the proposed timber gates and fencing and the colour of the render finish to the new gate posts at the proposed vehicle entrance; and (b) subject to Section 12 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 to grant Listed Building consent subject to the following condition: -

1. Mr. and Mrs. A. Clark, 2 Holmwood Court, Greenock Road, Largs have applied for Planning Permission for an extension to a dwellinghouse to form an enlarged kitchen, breakfast room and bedroom with en-suite accommodation at that address. An objection has been received from Mr. and Mrs. F. W. G. Cunningham, 3 Holmwood Court, Largs.

6. Scottish Executive Development Department Consultation Paper: Getting Involved in Planning

Submitted report by the Assistant Chief Executive (Development and Promotion) on the Council's proposed response to the Scottish Executive Development Department's Consultation Paper: "Getting Involved in Planning", which has been produced following a review of existing arrangements for public involvement in planning issues. Comments are invited by 31 March 2002.

The Consultation Paper examines the effectiveness of existing arrangements and considers the scope for improvements, through promoting best practice, by highlighting the benefits of new technology and by considering legislative changes. The Council's proposed response to the 32 questions in the consultation document covering areas such as neighbour notification, local plan inquiries and the period for making representations was appended to the report.

The Sub Committee agreed (a) to approve the proposed response for submission to the Scottish Executive by 31 March 2002; and (b) that Council observations include that Scottish Executive proposals meet Best Value criteria.

7. Water Framework Directive: The Future for Scotland's Water: Proposals for Legislation

Submitted report by the Assistant Chief Executive (Development and Promotion) on the Council's proposed response to the Scottish Executive's Consultation Paper ''The Future of Scotland's Waters - Proposals for Legislation''.

This consultation paper describes primary legislative intentions for the environment component of the Water Environment and Water Services Bill which is planned to be introduced in the Scottish Parliament in May 2002.

The European Water Framework Directive which came into force on 22 December 2000 requires the Scottish Executive to bring forward legislation to protect Scotland's natural water environment within 3 years. The proposed Water Services Bill will enact the European Directive and transpose it into law.

The Scottish Executive intends to deliver the Directive through River Basin Management Plans (RBMP's). The proposed Bill will give the Scottish Environmental Protection Agency (SEPA) several areas of responsibility including the lead role in river basin management planning.

Page 7 The proposed response covers 5 key areas of concern which require clarification (i) the status of RBMP's and their relationship to other plans; (ii) the duty for SEPA to have regard to social and economic considerations; (iii) dealing with competing interests; (iv) the arrangements for preparation, consultation and participation; and (v) the proposed River Basin areas.

The Sub Committee agreed (a) to approve the proposed response contained within the report for submission to the Scottish Executive by 5 April 2002; and (b) to provide a copy of the submission to the Convention of Scottish Local Authorities (COSLA) for information.

8. Urgent Item

The Chair agreed that the following item of business be considered as a matter of urgency in order that postal addresses can be assigned to householders as they take up residence.

9. Naming of New Housing Development by Kirkcare Housing Association, off Torrlinn Terrace, Kilmory, Isle of Arran

Submitted report by the Assistant Chief Executive (Development and Promotion) on the naming of a new housing development off Torrlinn Terrace, Kilmory, Isle of Arran.

The Sub Committee agreed that the development be named "Torrlinn Place" in accordance with the recommendation of the local member.
