Murkowski today appointed nine members to the newly formed Aviation Advisory Board to the Department of Transportation. Murkowski also named Richard Wien as Chair of the Aviation Board. The other members of the Board are Kenneth Lythgoe, James Dodson, Bob Jacobsen, Daniel Klaes, Paul Landis, Felix Maguire, Wilbur O’Brien and Michael Salazar. The Aviation Advisory Board was established as a temporary interim board by Administrative Orders 204 and 206. The Board’s job is to provide input on aviation issues to the Commissioner of Transportation Mike Barton. “While transportation for many Alaskans includes roads, it often times includes travel by air. The members of this advisory board have been tasked with an important duty, and will advise Commissioner Barton on the many issues that face Alaska aviation,” said Murkowski. “I am confident under the leadership of Richard Wien, whose family has helped build the foundation for air travel here, the board members will make a positive contribution to aviation transportation in Alaska.” Aviation Advisory Board Chair Richard Wien has a long and distinguished record with Alaska air transportation. Hailing from Fairbanks, Wien attended the University of Alaska, Fairbanks and has worked as pilot and director of bush operations for Wien Alaska Airlines. -

PenAir will start twice daily service between both Redding, CA and Arcata/Eureka, CA and Portland, OR. The addition of these two destinations expands PenAir’s offerings from Portland to four communities. In addition to Redding and Arcata/Eureka, PenAir also serves Crescent City, CA and North Bend, OR from their Portland hub. (“PenAir”) on five mainline routes in rural Alaska pursuant to 39 U.S.C. § 5402(g)(5)(c) (“§ 5402(g)(5)(C)”). This equitable tender is now being challenged by three mainline carriers – Northern Air Cargo (“NAC”), Tatonduk Outfitters Ltd d/b/a Everts Air Cargo (“Everts”), and Lynden Air Cargo LLC (“Lynden”) (collectively, “plaintiffs”). Specifically, plaintiffs challenge the Postal Service’s purportedly ultra vires determination that PenAir had satisfied the “Prior Service and Capacity Requirement” of 39 U.S.C. § 5402(g)(1)(A)(iv)(II) (“§ 5402(g)(1)(A)(iv)(II)”) as of Case 1:10-cv-02076-EGS Document 35 Filed 06/10/11 Page 2 of 25 December 3, 2010.1 Plaintiffs seek both declaratory and injunctive relief. See generally Compl. Pending before the Court is plaintiffs’ motion for summary judgment, as well as the cross-motions for summary judgment filed by Defendant Postal Service and Defendant-Intervenor PenAir (collectively, “defendants”). Upon consideration of the motions, the responses and replies thereto, the applicable law, the entire record, and for the following reasons, the Court hereby DENIES plaintiffs’ motion for summary judgment and GRANTS defendants’ cross-motions for summary judgment. -

INTRODUCTION – SUPPLEMENTAL AND OTHER COMPENSATIONS 1.1 The apocalyptic terrorist attack by the means of four hi-jacked planes committed against the World Trade Center in New York, NY , the Pentagon in Arlington, VA and the aborted flight ending in a crash in the rural area in Shankville, PA ON September 11th, 2001 is the only real time example that triggered this proposed Convention on Compensation for Damage to Third Parties from Acts of Unlawful Interference Involving Aircraft. 1.2 It is therefore important to look towards the post incident resolution of this tragedy in order to adequately and pro actively complete ONE new General Risk Convention (including compensation for ALL catastrophic damages) for the twenty first century. 2. DISCUSSION 2.1 Immediately after September 11th, 2001 – the Government and Congress met with all affected and interested parties resulting in the “Air Transportation Safety and System Stabilization Act” (Public Law 107-42-Sept. 22,2001). 2.2 This Law provided the basis for Rules and Regulations for: a) Airline Stabilization; b) Aviation Insurance; c) Tax Provisions; d) Victims Compensation; and e) Air Transportation Safety. DCCD Doc No. 28 - 2 - 2.3 The Airline Stabilization Act created the legislative vehicle needed to reimburse the air transport industry for their losses of income as a result of the flight interruption due to the 911 attack. -

Evaluation of the Alaska Interagency Aviation Safety Initiative Prepared for: National Institute for Occupational Safety and Health Matt Berman Stephanie Martin Alexandra Hill Institute of Social and Economic Research University of Alaska Anchorage September 2005 Evaluation of the Alaska Interagency Aviation Safety Initiative 1. Introduction Aviation crashes are the leading cause of occupational fatalities in Alaska. From 1990 through 1999, aviation crashes in Alaska caused 106 work-related pilot deaths. This rate is nearly five times the rate for U.S. pilots as a whole.1 In 2000, Congress passed legislation aimed at reducing the number of occupational aviation fatalities in Alaska by 50 percent for the years 2000 through 2009. This legislation created an interagency initiative—the Alaska Aviation Safety Initiative—to improve safety in Alaska through the combined efforts of the Federal Aviation Administration (FAA), the National Transportation and Safety Board (NTSB), the NOAAs National Weather Service (NWS), and the National Institute for Occupational Safety and Health (NIOSH).2 The original proposal for the initiative was developed in September 1999, at the invitation of Alaska’s Senator Ted Stevens and the recommendation of Jim Hall, Chairman of the National Transportation Safety Board (NTSB). The initiative began as a three-year renewable commitment (FY 2000-2002) with NIOSH acting as the lead agency. Congress appropriated approximately $800,000 per year to fund the initiative. The four agencies have designated senior staff to function as the Alaska leadership team for the initiative. The team meets quarterly to plan, coordinate, and evaluate programs.3 The objectives of the Alaska Aviation Safety Initiative (the Initiative) are: • To reduce the number of aircraft crashes and deaths; • To promote aviation safety within the air transportation industry in Alaska through epidemiologic risk analysis of aircraft crashes; and • To evaluate aviation safety interventions. -

The term umbrella, as it is used here, means the contents are intended to create high level objectives from which detailed work plans can be developed and accomplished. Each organization that accepts tasking under a particular objective or element takes with it the responsibility for developing a work plan, generating procedures for participants to use their element, and for recording and reporting the progress made toward validation. To accommodate future developments facilitated by the Capstone Program efforts, the number and the date of each successive program plan version is printed on the cover. This Capstone Program Plan version 3.0 is complimentary to Versions 1.0 and 2.0. These previous versions established the initial Capstone avionics and ground infrastructure. Version 3.0 documents the activities supporting the infrastructure in the Bethel/Yukon-Kuskokwim delta area, planning for expansion to Juneau/Southeast Alaska, and establishing ties to future implementation work, with the main focus on FY 2001. DRAFT EXECUTIVE SUMMARY The Capstone Program accelerates efforts to improve aviation safety and efficiency through a multi-year introduction of current and emerging concepts and technologies. According to information published by the National Institute for Occupational Safety and Health, accident rates in Alaska are elevated up to 400 percent above the national average. -
