I. Call to Order, Proof of Posting

Chairman Jacob Bell called the November 21, 2019 meeting of the MPO Policy Board and Technical Committee to order at 2:00 p.m.

Meeting agendas were posted at the McLennan County Courthouse on November 12, 2019 and at the City of Waco on November 12, 2019 for a possible quorum of the Waco City Council.

Chairman Bell provided directions to visitors wishing to address the Policy Board regarding any action or discussion item identified on this agenda in accordance with requirements identified in Section 551.007 of the Texas Government Code.

II. Approval of the September 19, 2019 meeting minutes

Chairman Bell asked for any changes to the minutes. No changes were voiced. Minutes were approved as submitted.

III. Presentation to the Waco MPO Policy Board Officers the 2019 National Award for Outstanding Overall Achievement for a Non Transportation Management Area by the Association of Metropolitan Planning Organizations.

Chairman Bell opened the meeting for visitors to address the Board regarding Item III. No visitors spoke for or against this item.

Mr. Jacob Bell, MPO Policy Board Chair and Mr. Chris Evilia, MPO Director, formally presented this award to the MPO Policy Board recognizing demonstrated significant achievement and performance excellence for the entire MPO organization. Chairman Bell and Director Evilia received the award on behalf of the MPO at the annual conference of the Association of MPOs on October 23, 2019 in Baltimore, Maryland.

IV. Review and Discussion regarding the draft of Connections 2045: The Waco Metropolitan Transportation Plan.

Chairman Bell opened the meeting for visitors to address the Board regarding Item IV. No visitors spoke for or against this item.

Mayor Deaver called the November 21, 2019 meeting of the City Council of the City of Waco to order at 2:05 p.m.

Background: • The Metropolitan Transportation Plan (MTP) identifies the regional transportation needs of the Waco Metropolitan Area through the planning horizon year of 2045. • In addition to all projects intending to utilize federal highway or public transportation funds, all regionally significant transportation projects regardless of mode or funding source must be included in the MTP.

Review of Recommended Projects: • Director Evilia presented staff recommendations from the draft of Connections 2045: The Waco Metropolitan Transportation Plan. The recommendations are categorized into 6 strategies which address a corresponding MTP guiding principle previously identified by the Policy Board. Individual projects are prioritized within each strategy based upon how well they address the primary goal of that strategy and anticipated availability of funding: 1.) Improve State of Good Repair 2.) Improve Safety and Security 3.) Improve System Efficiency 4.) Improve Regional Livability 5.) Address Demand for Future Mobility 6.) Provide Equal Access and Benefits • Most staff recommendations would address more than one strategy. • Projects that perform well at accomplishing multiple strategies are generally listed as higher priorities.

Review of Total Cost of Plan Recommendations: • The total cost of recommended projects the Waco MPO can realistically afford over next 25 years is approximately $2.2 billion. • Over half of the total cost of the plan is in the maintenance category, meaning the main focus over the next 25 years is in keeping the existing regional transportation system operating. • The majority of available funding mechanisms are generally geared for highways (federal and state) • High speed passenger transportation is an important priority for our region but because the Fort Worth to Laredo High Speed Transportation Study is still in progress, the MPO isn’t yet able to include costs for project recommendations.* • Total Cost of Plan Recommendations by Strategy:

Discussion was concentrated on the following topics: • Incorporating shifting priorities – The MTP is federally required to be updated every 5 years to account for shifts in priorities, strategies, and available funding mechanisms, as well as to account for other changes desired by Congress to be implemented during that time frame. It may be assumed the MTP will be amended 2 or 3 times during each 5 year period between MTP updates to accomplish this. (For example, the MTP will be amended next year to show how the Waco MPO incorporates a 5th performance measure, Transit Safety targets, into the required transportation planning process). • Incorporating changes in available funding - The draft MTP does not assume set-aside funds for which the MPO may be eligible if designated as a Transportation Management Area (TMA) as a result of the 2020 decennial census. Nor does the plan assume possible funding availability from impact fees currently being considered by the City of Waco. If funds from these or other sources are made available, modifications will be made to the MTP through an amendment process.

Direction to Staff: • The MPO Policy Board and Technical Committee agreed the draft MTP is ready for public release. • Staff will begin the required 55 day public process to solicit comment regarding the draft plan and recommendations on November 22, 2019. Staff will conduct 2 public meetings in December 2019 and 2 in January 2020, and appropriate stakeholder consultations. • Once analyzed, input received may be incorporated into the draft MTP if appropriate and presented to the Policy Board on January 17, 2020. • Consideration of adoption by the Policy Board is scheduled for Friday, January 17, 2020.

V. Presentation and Discussion regarding draft consultant recommendations for the Fort Worth to Laredo High Speed Transportation Study.

Chairman Bell opened the meeting for visitors to address the Board regarding Item V. No visitors spoke for or against this item.

Background: • The Waco MPO, along with 5 other MPOs along the IH-35 corridor, jointly agreed to conduct a study of potential high speed transportation options from Fort Worth to Laredo. AECOM was selected for consultant assistance. • The intent of the study is to provide recommendations regarding the following: o Potential service corridors within each MPO area o Potential station locations within each MPO area o Identify the feasibility of different service technologies including Hyperloop • After receiving input from each region earlier this year, AECOM completed a set of draft recommendations and is in the process of presenting those to each MPO Policy Board that is participating in the study.

Presentation: • Mr. Steven Duong, Urban Planner from study consultant, AECOM, summarized the consultant’s analysis and preliminary findings. o Hyperloop technology stopping at all identified cities ranked as the highest technology and alignment combination along the IH-35 Corridor. . Potentials stops: Fort Worth, Waco, Killeen/Temple, Austin, San Antonio, and Laredo o Recommended alignment generally follows: . Traveling south from Fort Worth to Waco generally following a Utility Corridor . From Temple to San Antonio, generally following IH-35 . From San Antonio to Laredo in a greenfield corridor

Discussion was concentrated on the following topics: • Hyperloop technology and operation - Methodology behind speeds, dwell times, and security clearance periods used in analysis for Hyperloop technology, competition for location of 6-mile Hyperloop test facility in the US, and expected timeframe for results from test facilities already being constructed in other countries. • How chosen technology gets funded – No way to determine yet but can look to the privately funded Texas Central rail project between Dallas and Houston, and Maglev and High Speed Rail (HSR) projects in other states.

Direction to Staff: • MPO staff will solicit public comment on the consultant recommendations as part of the public process for the draft MTP. • MPO staff will incorporate those recommendations the MPO Policy Board agrees are appropriate for inclusion into the draft of Connections 2045: The Waco Metropolitan Transportation Plan. • Adoption of the MTP, scheduled for January 17, 2020, will represent Policy Board action regarding acceptance of the consultant recommendations.

VI. Discussion and Updates from the Texas Department of Transportation regarding significant highway construction within the Waco Metropolitan Area.

Chairman Bell opened the meeting for visitors to address the Board regarding Item VII. No visitors spoke for or against this item.

Background: A. The Waco District of TxDOT will provide a status briefing during each of the 2019 Policy Board meetings on each significant highway project within the Waco region.

Presentation: B. Mr. Clayton Zacha, Waco Area Engineer, TxDOT, Waco District, provided a status update on significant construction projects in the Waco region.

VII. Directors Report

A. Request for agenda items to be considered for future meetings. A. The next meeting of the Waco MPO Policy Board is scheduled for Friday, January 17, 2020 at 10:00am. No December meeting. B. Adoption of Connections 2045: The Waco Metropolitan Transportation Plan is scheduled for Friday, January 17, 2020 at 10:00am.

VIII. Public Hearing of visitors regarding any item of MPO business.

Chairman Bell opened the public hearing of visitors. No visitors approached the Board. Chairman Meek closed the public hearing of visitors.

IX. Adjournment

Chairman Bell adjourned the meeting at 3:59 p.m.

7 Waco Metropolitan Planning Organization Policy Board Meeting Date: January 17, 2020 Agenda Item: Consideration and Action regarding approval of Resolution 2020-1: Adoption of Connections 2045: The Waco Metropolitan Transportation Plan Comments: The Metropolitan Transportation Plan (MTP) identifies the regional transportation needs of the Waco Metropolitan Area through the planning horizon year of 2045. In addition to all projects intending to utilize federal highway or public transportation funds, all regionally significant transportation projects regardless of mode or funding source must be included in the MTP. MPO staff reviewed the draft MTP and project recommendations with both the Policy Board and MPO Technical Committee during a joint meeting on November 21, 2019.

MPO staff conducted a 45 day comment period on the draft MTP between November 22, 2019 and January 7, 2020. During that period, the MPO staff conducted a total of 4 public informational meetings, 2 in December and 2 in January. MPO staff also posted a video of the powerpoint presentation on the draft MTP on the MPO website for those who could not attend one of the informational meetings. A total of 32 persons attended one of the public informational meetings and 9 persons participated through the online forum. A total of 10 comments were received as part of the MPO public process. Analysis of their feedback is included in the meeting packet. There were 2 comments that MPO staff decided required a response. The first regarded a request to convert Waco Transit vehicles to electric. The second was feedback from the Waco City Council regarding proposed work for IH-35.

In response to the first comment, MPO staff discussed the concept with Waco Transit staff and concluded that electric bus technology does not currently meet the needs of our region due to insufficient vehicle range and that the cost is beyond available resources. MPO staff did acknowledge that this situation could change after 2025 as a result of technological advancements and new services such as the BRT. MPO staff recommends that studying the concept as part of those new services would be a better option.

In response to the second comment, MPO staff developed Alternative A for the Policy Board to consider project recommendations regarding Strategy 5 (attached). The synopsis of the comment is that the Waco City Council does not support additional construction for IH-35 prior to the year 2030.

The MPO Technical Committee will review the draft MTP along with Alternative A during their January 9th meeting. Their recommendation will be forwarded prior to the Policy Board meeting.

RESOLUTION 2020-1

WHEREAS, the Waco Metropolitan Planning Organization was established to identify and support the implementation of regionally significant transportation projects to address future mobility needs of the Waco Region; and,

WHEREAS, the Waco Metropolitan Planning Organization Policy Board is composed of representatives appointed by the elected City Councils and Counties located within the jurisdiction of the MPO as well as the Texas Department of Transportation; and,

WHEREAS, Section 134, Title 23, USC requires a comprehensive and continuing transportation planning process must be carried out cooperatively in order to ensure funds for transportation projects are effectively allocated to the Waco Metropolitan Area; and,

WHEREAS, Section 450, Title 23, USC requires the development of a Metropolitan Transportation Plan for the Waco Metropolitan Area to identify all regionally significant transportation needs and projects that can be reasonably funded within a minimum 20-year planning horizon; and,

WHEREAS, Section 450, Title 23, USC requires that the Metropolitan Transportation Plan be updated at least once every 5 years for urbanized areas that are designated as air quality attainment by the US EPA; and,

WHEREAS, the previous update of the Waco Metropolitan Transportation Plan was adopted on January 27, 2015; and,

WHEREAS, the Waco MPO staff produced a draft update of the Waco Metropolitan Transportation Plan with a planning horizon year of 2045 which addresses all federal and state requirements and reviewed said draft to a joint meeting of the Waco MPO Policy Board and MPO Technical Committee on November 21, 2019; and,

WHEREAS, the Waco MPO Policy Board authorized the release of the draft Metropolitan Transportation Plan at the aforementioned meeting for public review and comment; and,

WHEREAS, the MPO staff has conducted and completed a public review and comment process in accordance with the Waco MPO Public Participation Plan.

NOW, THEREFORE, BE IT RESOLVED BY THE POLICY BOARD OF THE WACO METROPOLITAN PLANNING ORGANIZATION:

That the Waco MPO Policy Board hereby adopts Connections 2045: The Waco Metropolitan Transportation Plan.

That it is hereby officially found and determined that the meeting at which this resolution is passed is open to the public and that public notice of the time, place and purpose of said meeting was given as required by law.

That all public participation requirements identified within the Waco MPO Public Participation Plan related to this action by the Policy Board were met and completed.

That the Waco MPO Policy Board additionally certifies this action complies with all applicable policies, procedures, and requirements identified within 23 CFR, Section 450, and Chapter 16 of Title 43 of the Texas Administrative Code.

Box 2570, Waco, TX 76702-2570 (254) 750-5651 www.waco-texas.com/cms-mpo [email protected] Waco Metropolitan Planning Organization Policy Board Meeting Date: January 17, 2020 Agenda Item: Consideration and Action regarding approval of Resolution 2020-2: Appointment of an MPO representative to the Heart of Texas Regional Transportation Coordination Council. Comments: To meet state requirements to coordinate public transportation services within the six county Heart of Texas region, the Heart of Texas Council of Governments has created the Regional Transportation Coordination Council. The RTCC is a formal policy recommending body making recommendations regarding public transportation projects and priorities for the region. According to the RTCC bylaws, the Waco MPO is provided one voting member. Voting members serve 2 year terms beginning in January. The Policy Board last appointed a member in January, 2017.

The role of the RTCC is solely to advise and provide recommendations to policy makers regarding public transportation policy within the region. The MPO Policy Board retains its authority to determine public transportation policy as well as identifying and prioritizing public transportation projects within McLennan County.

The Policy Board has previously appointed the MPO Director, Chris Evilia as the MPO representative to the RTCC since 2007. RTCC members can be MPO staff, Policy Board members or another person the Policy Board feels will adequately represent the interests of the MPO.

Action Required: Nominate and appoint an MPO representative to the Regional Transportation Coordination Council.

• NBFR – Contractor is removing old pavement to allow for permanent drainage and pavement construction. Drainage work will begin picking up this Spring. Ongoing closure between 10th – 12th for next month.

• Mainlanes – Recent SB traffic switch to NBML from US 84 to south end of project. Contractor to demo SB U Parks, Brazos River, MLK, UPRR and US 77 bridges. In addition, contractor is continuing work on 11th/12th St and 4th/5th St overpasses. Contractor to pour LP 340 bridges by this Spring. SB exits to US 77 and U Parks closed.

• Cross Streets – Work continues on permanent EB pavement at both University Parks and US 84. Anticipate this work lasting at least another couple of months. Contractor has tied in portions of new pavement at 4th, 5th and University Parks. Dutton Ave scheduled to be reopened by Spring Break. Waco Metropolitan Planning Organization Policy Board Meeting Date: January 17, 2020 Agenda Item: Review of administrative clarification to the Waco MPO Public Participation Plan (PPP) regarding PPP use by Waco Transit to satisfy public participation requirements for the programming of Federal Transit funds. Comments: Waco Transit System, Inc. utilizes the MPO Public Participation Plan (PPP) to satisfy their public involvement requirements under federal law. Every 3 years the Federal Transit Administration (FTA) conducts a formal review of Waco Transit to identify anything that may need to be modified to maintain compliance with federal statute or regulation. The latest review took place during October / November of 2019. During that review FTA issued a finding to Waco Transit stating that although the MPO PPP does identify that this document is used to satisfy Waco Transit requirements for programming federal funds, it did not specifically mention FTA Section 5307 funds which FTA determined was a deficiency.

In response, Waco Transit requested MPO staff to perform an administrative clarification of the PPP to specifically identify the aforementioned funds. Since this does not alter the process that either the MPO of Waco Transit uses to solicit public comment, a formal amendment of the PPP is not required. The MPO is, however, required to brief the Policy Board regarding any corrections or modifications of the PPP.

Section 1 – Introduction

1.1 – MPO Background The Waco Metropolitan Planning Organization (MPO) was created in 1974 in order to comply with federal requirements that all areas over 50,000 population must incorporate local input into decisions involving federal highway or transit funds. Today the role of the MPO has expanded to identify all mobility needs for the Waco Region and determine regional transportation policy. Inherent within this role is the need to involve the citizens of McLennan County into the transportation planning process and incorporate their concerns into the various plans, programs and policies adopted by the MPO.

Governing the MPO is a 20-member policy board consisting of elected officials and other representatives from the 19 member cities, McLennan County and the Texas Department of Transportation (TxDOT) (See Appendix A for a map of the Waco Metropolitan Area). Assisting the Policy Board is the MPO staff, producing drafts of necessary plans and programs and providing policy recommendations to the board. The staff also administers the public involvement procedures for the MPO and ensures that public concerns are voiced to the MPO Policy Board.

1.2 – Purpose of Public Participation Plan The Fixing ’s Surface Transportation Act (FAST) and predecessor federal transportation acts require MPOs to develop a Public Participation Plan (PPP) to specify the MPO’s efforts to involve the public in the development of the Metropolitan Transportation Plan. Since public involvement is critical within the entire transportation planning process, the MPO has adopted this plan. Its primary purpose is to ensure that all policy actions of the MPO Policy Board are made only after the public and key transportation stakeholders have been informed about the issue and been given a reasonable opportunity to comment.

The MPO creates and amends many documents on a regular basis for adoption and approval by the Policy Board. The following narrative briefly describes these documents and Table 1.1 defines the associated policy actions.

Metropolitan Transportation Plan (MTP): A document, also known as the Long-Range Transportation Plan, which identifies existing and future transportation deficiencies and needs, as well as network improvements needed to meet mobility requirements over at least a twenty five year time period. To receive federal funding, a transportation project must be included in the MTP and the TIP.

Transportation Improvement Plan (TIP): A four-year transportation investment strategy, required at the metropolitan level which addresses the goals of the long-range plans and lists priority projects and activities for the region.

Unified Planning Work Program (UPWP): Biennial report or budget document prepared by the Waco MPO describing transportation planning activities which will be performed by the MPO staff. Thoroughfare Plan: A plan which outlines the functional classification of existing streets and roadways within the Metropolitan Area based on levels of mobility and access as well as proposes long-range facility improvements.

Transportation System Performance Reports: A series of 4 reports required by the FAST Act which monitor various performance metrics of the transportation system and compares

Waco MPO Public Participation Plan Page 1 progress towards meeting targets established by the State of Texas, Waco Transit or the Waco MPO. These reports include the following metrics: Safety (Fatalities & Serious Injuries), Transit Asset Condition, Pavement & Bridge Condition and Travel Time Reliability. Performance updates on these metrics are also incorporated into the MTP.

Active Transportation Plan: A plan which focuses on the improvement and maintenance of non- motorized transportation facilities, primarily bicycle and pedestrian modes, as alternative modes of transportation.

Annual Listing of Federal Projects (APL): A listing of projects for which federal funding was obligated in the previous fiscal year. The APL also provides a record of project delivery and is intended to increase awareness of government spending on transportation projects. Note that per federal statute, the APL cannot be released for public review until approved by USDOT. As such, there is no action taken by the MPO Policy Board and the only public involvement for this document is the opportunity to review after USDOT approval.

Annual Performance and Expenditure Report (APER): Annual Performance Expenditure Report (APER) is an annual work performance review of all proposed transportation planning and related activities of the Waco MPO as submitted in the Unified Planning Work Program. Note that per federal statute, the APER cannot be released for public review until approved by USDOT. As such, there is no action taken by the MPO Policy Board and the only public involvement for this document is the opportunity to review after USDOT approval.

*The APL and APER are approved by USDOT and not by the MPO Policy Board. This type of correction does not require Policy Board action.

Waco MPO Public Participation Plan Page 2 Consistency with Public Transportation Planning Activities Many of the planning activities of Waco Transit overlap with the activities of the MPO. Similarly all significant public transportation projects or services are incorporated within the documents produced by the MPO. As a result, this public participation plan will be used to meet Federal Transit Administration public participation requirements for the City of Waco and Waco Transit for Federal Transit Administration Section 5307 funds.

The Waco MPO’s public participation process satisfies the public participation process for the Program of Projects (POP), and the public notice for public involvement activities and time established for public review of and comments on the TIP will satisfy the POP requirements for Waco Transit System, Inc., the public transit provider for the City of Waco.

1.3 - Public Involvement Goals In addition to the listing types of policy actions, this plan also defines the tasks the MPO staff will undertake to incorporate public comment into the various activities undertaken by the MPO.

To accomplish this mission, the Waco MPO has adopted the following goals to incorporate public opinion into the transportation planning process.

Goal 1: Educate and Inform the Public The Waco MPO staff shall educate and present information about the transportation planning process, including the sources of funding and impacts of regional planning decisions. The MPO staff shall also explain the specific tasks and goals of the Waco MPO, as well as related tasks that are not in the MPO’s authority to perform. The MPO staff shall also disseminate information regarding upcoming decisions involving federal highway or transit funds within McLennan County.

Goal 2: Solicit Input from the General Public The Waco MPO shall gather representative input from the public to identify mobility needs, desires, issues and concerns. The Waco MPO shall continuously seek comment from the public throughout the transportation planning process, at key decision points and when final product drafts are issued. The MPO staff will also closely monitor public input received through major project development and corridor studies.

A vital aspect of this goal is the provision of opportunities for involvement to a wide range of members of the public; (i.e., citizens with different interests). The Waco MPO will coordinate with individuals, institutions or organizations to use community-based public involvement strategies that will reach out to members of the disabled, minority, special needs and low-income communities.

Goal 3: Facilitate Information Flow between the Public and Policy-Makers The Waco MPO staff is responsible for compiling public issues, comments and concerns into complete and concise documents for presentation to the MPO Policy Board. The MPO staff shall also schedule and organize meetings where the public can present concerns to the staff or the Policy Board.

Goal 4: Consider Public Concerns in Decision Making The MPO Policy Board shall consider, and when appropriate respond to, the public concerns that are presented to them by the MPO staff as well as those presented to them by individual persons at public meetings. The Waco MPO staff shall also consider public concerns as it prepares draft planning documents.

Goal 5: Provide Visual Representations of Proposed Actions In addition to verbal descriptions, all proposed actions by the MPO Policy Board that impact specific transportation projects will, when appropriate, provide cartographic, photographic and / or artistic representations to show approximate location, design considerations, possible environmental impacts and potential aesthetic considerations.

Goal 6: Meet Legal Requirements The Waco MPO will meet all legal requirements for noticing meetings and providing opportunities for the public to comment on proposed actions of the MPO.

Waco MPO Public Participation Plan Page 4 Section 2 – Outreach Activities In order to achieve the Public Involvement Goals outlined in Section 1, the MPO has identified seven activities that are intended to solicit input into transportation policy decisions. Each activity is identified in the approximate order upon which they will be put into action.

Each Outreach Activity specifies the type of task that will accomplish the goal of public outreach and inclusion in the transportation planning process. Notification prior to any MPO Policy Board action is required and the timeline for notification is outlined with each activity. In addition, each activity is rated by its ability to accomplish the six Public Involvement Goals. 2.1 - Activity 1: Survey on Transportation Issues What: Survey to determine public opinion on important policy decisions facing the MPO Policy Board.

Who: Participants may either be McLennan County residents chosen at random or persons with specific interest in a particular topic.

When: May be used for any plan or study conducted by the MPO, but required prior to the development of the Metropolitan Transportation Plan (MTP).

Notification: Results will be posted to the MPO website within 6 months of the conclusion of the survey (www.waco-texas.com/cms-mpo/) Press release will be issued on the day of web posting. Results will be presented at the next MPO Technical Committee and Policy Board meetings after web posting.

2.2 - Activity 2: Community Workshops What: Workshops are events that provide the public “hands-on” involvement in the development of plans or programs. “Hands-on” involvement brings together professionals and citizens alike. During these workshops, the public will be invited to identify transportation needs and to propose ideas, concepts or solutions to those or other previously identified needs. A variety of visioning tools and techniques will be used to envision different tradeoffs and public preferences. The result of the workshops will be an agreed upon scenario or solution. The consensus will then lead to a policy framework that, in turn, will be used to guide transportation & land- use decision making.

Not every meeting conducted by the Waco MPO will contain major or minor policy actions. Nevertheless the public will be afforded opportunities to participate regardless of the topic of discussion. This section details these opportunities and outlines the format of the various board and committee meetings conducted by the MPO.

3.1 - MPO Policy Board Meetings What: 20-member Board consisting of elected officials and other representatives of member cities, McLennan County and TxDOT.

Actions: Approves adoption and amendment of all plans and programs for the MPO, adopts all transportation policy for the region.

Who: Open to the general public.

When: Scheduled as needed, but not less than quarterly.

Where: Various locations, but no further than 0.25 miles of a published fixed route for Waco Transit.

Participation: General Hearing: The meeting will begin with an opportunity for all persons to address the Policy Board regardless of whether the topic is on the agenda or not. The Policy Board, however, cannot respond if the topic is not on the agenda.

Policy Actions: Additional hearings will be provided on the meeting agenda for any policy action (see page 10).

Hearing Policy: All persons are given 3 minutes to speak, longer if the Policy Board chair permits. If representing a group of persons or an official association recognized by the Policy Board, then the person may speak up to 10 minutes, longer if the Policy Board chair permits.

3.5 - Executive Sessions What: The MPO Policy Board may call executive sessions in order to discuss the following items: 1. Pending or contemplated litigation; 2. A settlement offer; 3. An attorney/client privilege/relationship; 4. The purchase, exchange, lease, or value of real property; 5. A gift and/or donation; or 6. The appointment, employment, evaluation, reassignment, duties, discipline or dismissal of the MPO director or subordinate staff.

Who: Executive sessions are closed to the public.

When: Scheduled as needed.

Where: Various locations.

Participation: Only persons invited by the Policy Board may attend or participate in executive sessions.

Notification: 3 days prior: Post notice of executive session on MPO web site and bulletin boards of the Waco City Hall and McLennan County Courthouse.

3.6 - Note on Meeting Cancellations From time to time, MPO Policy Board and Technical Committee meetings will need to be cancelled. Should the need to cancel a meeting arise, except for the lack of a quorum, the MPO will post a notice of cancellation at the meeting location, the McLennan County Courthouse no less than 24 hours prior to the scheduled meeting time. In addition, a notice of cancellation shall be announced via press release at the applicable time. For disasters, states of emergency or other situations in which travel is considered unusually hazardous, notice of cancellation will be announced via press release no less than one hour prior to the scheduled meeting time.

In the case that a quorum of members should not be achieved for an MPO Policy Board meeting, the Policy Board chair may officially cancel the meeting 30 minutes after the scheduled meeting time. Without action, the meeting is cancelled one hour after the scheduled meeting time should a quorum not be achieved at that time. Subcommittee or Technical Committee meetings are not subject to quorum requirements.

Waco MPO Public Participation Plan Page 15 Section 4 – Future Revisions

4.1 - 5 Year Review of the Public Participation Plan These public involvement procedures shall be reviewed by the MPO staff at least once every 5 years to ensure compliance with existing federal and state law and to provide an analysis of effectiveness. The results of any review and any recommended changes shall be made available for public review for a minimum of 45 calendar days. A digital copy of the review and proposed changes shall be made available for viewing by the public on the MPO web site (www.waco-texas.com/cms-mpo/). One hard copy of the review and proposed changes shall be made available at the MPO offices. The public review period shall be posted at the McLennan County Courthouse and the Waco City hall, posted on the MPO web site (www.waco- texas.com/cms-mpo), advertised in the Waco Tribune-Herald and announced via press release. Announcements shall also be E-mailed (postcard will be sent if E-Mail is unavailable) to the MPO list of interested or affected parties. All announcements shall mention the locations and times that the review and proposed changes may be viewed and shall also mention how and where to send comments.

Once the public review period has ended, the staff will review all public comments. All public comments and staff recommendations shall be presented to the MPO Policy Board for review and appropriate action. This meeting of the MPO Policy Board shall adhere to the requirements identified for Policy Board meetings in Section 3.

4.2 - Interim Amendments to the Public Participation Plan Interim amendments are defined as any change to the public involvement requirements outside of corrections due to grammar, spelling or other typographic errors.

Interim amendments may be recommended by the MPO staff or the MPO Policy Board provided a minimum 45-day public review period be completed prior to Policy Board action. The requirements for public review shall be identical to that for the 5-year review of these procedures.

Waco MPO Public Participation Plan Page 16 Section 5 – Revision Process for April, 2018 Amendment (This section to be updated after action by Policy Board)

The review and draft document were completed and released for public review on January 24, 2018. At this time the 45-day public comment period commenced. The draft document was then submitted to the MPO Policy Board for discussion at its regularly scheduled meeting on April 19, 2018. Digital copies of the final draft were made available online at the MPO web site. Paper copies of the final draft were made available for viewing at the MPO offices as well as one other location within the Metropolitan Area. This comment period was posted on the MPO web site (www.waco-texas.com/cms-mpo), advertised in publications for English speakers as specified by City of Waco policy, advertised in publications for Spanish speakers as determined in periodic review with Hispanic community stakeholders, and announced via press release. All notices mentioned when and where copies of the draft documents were available for viewing and also mentioned how and where to send comments.

Three public informational meetings were conducted on January 29, 2018 and January 30, 2018, both at 6:00 PM, and a third on January 29, 2018 at 12:00 PM. The January 29, 2018 meetings were conducted at the Waco Transit System Administration Building and the January 30, 2018 meeting at the South Waco Community Center. These hearings were posted on the MPO web site (www.waco-texas.com/cms-mpo), posted at the McLennan County Courthouse and the Waco City hall, advertised in the Waco Tribune-Herald and announced via press release. The MPO Policy Board met on April 19, 2018 and adopted the amended Public Participation Plan. A public hearing was conducted during the meeting prior to Policy Board action. The hearing was posted on the MPO web site, advertised in the Waco Tribune-Herald and announced via press release. All comments received during the public comment period were forwarded to the Policy Board prior to this meeting.
