ACTA DE LA SESION EXTRAORDINARIA DEL CONSEJO NACIONAL DE TELEVISION DEL DIA LUNES 22 DE JULIO DE 2013 Se inició la sesión a las 13:15 Hrs., con la asistencia del Presidente, Herman Chadwick; del Vicepresidente, Óscar Reyes; de las Consejeras María de Los Ángeles Covarrubias y María Elena Hermosilla; de los Consejeros Genaro Arriagada, Rodolfo Baier, Andrés Egaña, Jaime Gazmuri, Roberto Guerrero; y del Secretario General, Guillermo Laurent. Justificaron oportuna y suficientemente su inasistencia los Consejeros Gastón Gómez y Hernán Viguera. 1. APROBACIÓN DEL ACTA DE LA SESIÓN DE 8 DE JULIO DE 2013. Los Consejeros asistentes a la Sesión de 8 de julio de 2013 aprobaron el acta respectiva. 2. CUENTA DEL SEÑOR PRESIDENTE. a) El Presidente da cuenta al Consejo que, el día lunes 1º de julio de 2013, fueron recibidos los offline de los siguientes capítulos de “Homeless”, contenidos en tres discos, a saber: i) Disco 1: “Gran resaca”; “Campamento de inmigrantes”; “Cargamento de ron”; “La Carretera”¸”Ñuvidad”; “El Infierno de Jackie”; ii) Disco 2: “Mesías del Bálsamo” parte 1º; “Mesías del Bálsamo” parte 2º; iii) Disco 3: “Vacunación General”; “Mal de compras”; “Palomas”; “Pánico y locura en la vega” 1. El Consejero Oscar Reyes solicitó tener a la vista los referidos offline de “Homeless”. Se acuerda remitir a todos los Consejeros los offline de “Homeless” recibidos. b) El Presidente informa al Consejo que, afinado que fue el examen efectuado por los funcionarios del Departamento de Supervisión del CNTV, Sebastián Montenegro y Fernanda Errázuriz, de los capítulos del proyecto “Homeless” indicados en el literal anterior, éstos concluyeron que: “no existen en el estado actual de ‘Homeless’ elementos suficientes que eventualmente pudiesen configurar una conducta infraccional respecto de los bienes jurídicos protegidos por el artículo 1º de la Ley Nº18.838, en la medida que el programa “Homeless” sea transmitido en pantalla siempre después de las 22:00 Hrs.”. -
