The St. Bernard Parish Council, the Governing Authority, met in Regular Session on Tuesday, April 20, 2021 at three o’clock p.m. pursuant to notice given to each member and posted in the manner required by law.

The meeting convened at 3:03 p.m. Members present: Councilmembers: Council Chair Richard “Richie” Lewis, Gillis McCloskey,Joshua “Josh” Moran, Howard Luna, Wanda Alcon, Fred Everhardt, Jr., and Kerri Callais.

Also present were Roxanne Adams Clerk of Council, serving as official secretary of the Council, Parish President Guy McInnis CAO Ronnie Alonzo were representing Administration.

Councilmember Callais delivered the invocation and Councilmember Everhardt led the Pledge of Allegiance.

SECTION 1. The St. Bernard Parish Council, the Governing Authority, does hereby ordain that Chapter 22, Zoning; Section 22-9, Special Regulations; Sub-Section 22-9-6.9, Schedule Use Chart – Required Overlays of the St. Bernard Parish Code of Ordinances is hereby amended as per attached Exhibit “A”.

SECTION 2. Effective Date. This Ordinance shall become effective immediately upon authorizing signature by the Parish President. In the event of a presidential veto, this Ordinance shall become effective upon a two-thirds favorable vote of the total membership of the Council pursuant to Sections 2-11 and 2-13 of the St. Bernard Parish Home Rule Charter.

SECTION 3. Severability. If any section, clause, paragraph, provision or portion of this ordinance shall be held invalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect any other section, clause, paragraph, provision or portion of this Ordinance, the St. Bernard Parish Council hereby expresses and declares that it would have adopted the remaining portion this Ordinance with the invalid portions omitted.

BE IT RESOLVED by the Parish Council of the Parish of St. Bernard, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of St. Bernard, State of Louisiana (the "Parish"), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of St. Bernard, State of Louisiana, on SATURDAY, APRIL 24, 2021 (the “Election”), to authorize the levy of special taxes therein pursuant to the following propositions (the “Propositions”):

Shall the Parish of St. Bernard, State of Louisiana (the “Parish”), continue to levy a special tax of twenty and eighty-five hundredths (20.85) mills on all property subject to taxation within the Parish (an estimated $8,557,700 reasonably expected at this

This Governing Authority does further proceed to examine and canvass the returns of the Election thereof.

SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, (i) there was a total of 1,725 votes cast IN FAVOR OF Proposition No. 1 and a total of 1,185 votes cast AGAINST Proposition No. 1, resulting in a majority of 540 votes cast IN FAVOR OF Proposition No. 1; and (ii) there was a total of 1,828 votes cast IN FAVOR OF Proposition No. 2 and a total of 1,079 votes cast AGAINST Proposition No. 2, resulting in a majority of 749 votes cast IN FAVOR OF Proposition No. 2. The Propositions were therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Election.

SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the election, as required by Act 205 of the Regular Session of the Legislature of Louisiana for the year 2019.

SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law.

SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of St. Bernard, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

Pursuant to the provisions of a resolution adopted by the Parish Council of the Parish of St. Bernard, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of St. Bernard, State of Louisiana (the “Parish”), on January 5, 2021, NOTICE IS HEREBY GIVEN that a special election will be held within the Parish on SATURDAY, APRIL 24, 2021, and that at the said election there will be submitted to all registered voters in the Parish qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following propositions, to-wit:

Said special election will be held at each and every polling place in the Parish of St. Bernard, which polls will open at seven o'clock (7:00) a.m. and close at eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541.

The polling places at the precincts in the Parish are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.

The estimated cost of this election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $36,500.

Notice is further given that a portion of the monies collected from the taxes described in the Propositions shall be remitted to certain state and statewide retirement systems in the manner required by law.

The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Government Complex, 8201 W. Judge Perez Dr., Chalmette, Louisiana, on TUESDAY, MAY 4, 2021, at SEVEN O'CLOCK (7:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said special election. All registered voters of the Parish are entitled to vote at said special election and voting machines will be used.

A RESOLUTION STRONGLY OPPOSING SENATE BILL NO. 226, A MEASURE THAT SEEKS TO CREATE AND ESTABLISH THE SOUTHEAST LOUISIANA TAXING DISTRICT AND AUTHORIZES THE LEVY OF A SALES AND USE TAX TO REIMBURSE THE STATE FOR THE COSTS ASSOCIATED WITH THE HURRICANE AND STORM DAMAGE RISK REDUCTION SYSTEM (HSDRRS) INFASTRUCTURE IMPROVEMENTS.

WHEREAS, following the devastation of , the United States Congress authorized the construction of the HSDRRS, a 100-year level risk reduction system, including levees, floodwalls, pumping stations, and canal closure structures; and,

WHEREAS, projects implemented from this system, though located in parishes in southeast Louisiana, provided protection to entire State of Louisiana, as such, the burden of the costs associated with this system should remain the responsibility of the State, as originally agreed upon, and should not be shifted to the constituents and businesses; and,

WHEREAS, upon authorization from Congress, the State of Louisiana contractually obligated to a cost-share for HSDRRS in the approximate amount of $1.2 billion plus interest; and,

WHEREAS, as a result of the efforts of Congressmen Garret Graves, Cedric Richmond, and Steve Scalise, the State was able to secure language in the 2020 Water Resources Development Act (WRDA) that allows the State to save over $600 million in accrued interest plus more than $800 million in future interest that would have otherwise been due on the system if left unaddressed ; and,

WHEREAS, the State of Louisiana, the proper party and legally obligated entity, should absorb the costs associated with the system, not the five parishes (Orleans, Jefferson, St. Bernard, St. Charles, and Plaquemines) in which structures of the systems are located; and,

WHEREAS, the Parish Council and Parish President are in opposition of Senate Bill No. 226 which essentially shift the burden of the costs of a system that provides long term protection for the assets of an entire State to the families and businesses of the southeast parishes; and,

NOW THEREFORE, BE IT RESOLVED, that the St. Bernard Parish Council, the Governing Authority, does hereby strongly oppose Senate Bill No. 226, a measure that seeks to create and establish the Southeast Louisiana Taxing District and authorizes the levy of a sales and use tax to reimburse the state for the costs associated with the Hurricane and Storm Damage Risk Reduction System (HSDRRS) infrastructure improvements.

On motion of XXXX, seconded by XXXX, it was moved to introduce the following ordinance:

AN ORDINANCE TO DECLARE THE PROPERTIES ON THE ATTACHED EXHIBIT “A” AS SURPLUS AND TO AUTHORIZE THE PARISH PRESIDENT TO EXECUTE ALL NECESSARY DOCUMENTS TO TRANSFER SAID PROPERTIES.

ST. BERNARD PARISH COUNCIL DOES HEREBY ORDAIN:

WHEREAS, the Parish considers the properties listed on the attached Exhibit “A” as surplus and these properties are not needed for a public purpose of the Parish; and,

WHEREAS, the Parish intends to transfer these properties in compliance with state law.

SECTION 1. The properties on the attached Exhibit “A” are hereby declared surplus and are not needed for any public purpose.

SECTION 2. The President of St. Bernard Parish Government is hereby authorized to execute any documents necessary to transfer the properties listed on the attached Exhibit “A” in compliance with state law.

SECTION 3. Effective Date. This Ordinance shall become effective immediately upon authorizing signature by the Parish President. In the event of a presidential veto, this Ordinance shall become effective upon a two-thirds favorable vote of the total membership of the Council pursuant to Sections 2-11 and 2-13 of the St. Bernard Parish Home Rule Charter.

SECTION 4. Severability. If any section, clause, paragraph, provision or portion of this ordinance shall be held invalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect any other section, clause, paragraph, provision or portion of this Ordinance, the St. Bernard Parish Council hereby expresses and declares that it would have adopted the remaining portion this Ordinance with the invalid portions omitted.

AN ORDINANCE TO AMEND ORDINANCE SBPC #2280-12-20, AN ORDINANCE TO ADOPT THE 2021 ST. BERNARD PARISH ANNUAL OPERATING AND CAPITAL BUDGET.

ST. BERNARD PARISH COUNCIL DOES HEREBY ORDAIN:

SECTION 1. That St. Bernard Parish Annual Operating and Capital Budget for 2021 is hereby adopted as per attached in Exhibit “A”.

WHEREAS, each department shall be treated as a separate fund for the purpose of the five percent (5%) budgetary compliance in accordance with the state law; and,

WHEREAS, no monies shall be moved from one fund or department without official action taken by the Parish Council; and,

WHEREAS, all revenues generated by a specific department shall be budgeted as a revenue within that department’s specific budget.

SECTION 2. Effective Date. This Ordinance shall become effective immediately upon authorizing signature by the Parish President.
