DANGEROUSLY FREE: OUTLAWS AND NATION-MAKING IN LITERATURE OF THE INDIAN TERRITORY by Jenna Hunnef A thesis submitted in conformity with the requirements for the degree of Doctor of Philosophy Graduate Department of English University of Toronto © Copyright by Jenna Hunnef 2016 Dangerously Free: Outlaws and Nation-Making in Literature of the Indian Territory Jenna Hunnef Doctor of Philosophy Department of English University of Toronto 2016 Abstract In this dissertation, I examine how literary representations of outlaws and outlawry have contributed to the shaping of national identity in the United States. I analyze a series of texts set in the former Indian Territory (now part of the state of Oklahoma) for traces of what I call “outlaw rhetorics,” that is, the political expression in literature of marginalized realities and competing visions of nationhood. Outlaw rhetorics elicit new ways to think the nation differently—to imagine the nation otherwise; as such, I demonstrate that outlaw narratives are as capable of challenging the nation’s claims to territorial or imaginative title as they are of asserting them. Borrowing from Abenaki scholar Lisa Brooks’s definition of “nation” as “the multifaceted, lived experience of families who gather in particular places,” this dissertation draws an analogous relationship between outlaws and domestic spaces wherein they are both considered simultaneously exempt from and constitutive of civic life. In the same way that the outlaw’s alternately celebrated and marginal status endows him or her with the power to support and eschew the stories a nation tells about itself, so the liminality and centrality of domestic life have proven effective as a means of consolidating and dissenting from the status quo of the nation-state. -

But I was expecting to at least have a fun time, even if it was another film that portrayed real-life American Outlaw guys as the "heroes" of the movie. I'm not sure why, but this film was just bland most of the time, and the actors despite some talented ones in the parts just seemed to walk through the performances, American Outlaw if they were simply trying to just get the whole thing over with. Even the versatile Timothy Dalton seemed to be at a lost as to what to do. And the characters themselves were American Outlaw. By the end of the film, we still knew nothing about any of them. I like to have at least some understanding of the characters in a film. Whether they're the good guys or the bad guys, at least give me something about them to understand, sympathize with, or relate to. -

Underwood* When Professor Levine invited me to participate in the 2011 Bob Dylan and the Law Symposium,1 I was – bemused. Still, I felt that I was compelled to go. I had a good time in the big city, and was surprised by the number of high-powered presenters in attendance. The Symposium produced some interesting articles. I must admit that I struggled to find anything to say about “Bob Dylan and the Law.” I was a Dylan fan in the very early sixties when he was doing folk music;2 but I went into the Army at age twenty and did not return to “The World” until the early seventies, when I entered law school. -

E-mail: [email protected] Received: June 1, 2013 Accepted: June 17, 2013 Available online: June 24, 2013 doi:10.11114/ijsss.v1i2.158 URL: http://dx.doi.org/10.11114/ijsss.v1i2.158 Abstract An aspect of the diffusion of American popular culture is examined in this research drawing upon national survey data. Measuring Australians‟ knowledge of American and Australian outlaws, we found that Jesse James and Billy the Kid are better known in Australia than any of the local outlaws, or bushrangers, with the exception of Ned Kelly. While a relatively large proportion of Australians identified Ned Kelly, Ben Hall, Jesse James and Billy the Kid as outlaws, few identified other Australian „outlaws‟. Social background and political ideology is associated with greater knowledge of outlaws. Men, baby boomers and their predecessors, those born in Australia or the UK, those with a basic secondary level education and those identifying as left on the political spectrum are the most knowledgeable. This Australian study suggests that outlaws such as Jesse James and Billy the Kid are not just national folk heroes, but recognised globally. Promoted by visual and print media they have transcended their outlaw heritage to represent romanticised notions of freedom, loyalty and the „underdog‟, regardless of the historical facts surrounding their lives and deaths. -

When they do appear in these narratives, ethnic minorities typically occupy the roles of subservient sidekicks or stereotyped villains—whose main functions, respectively, are to aid the Anglo hero in his pursuits and to serve as cannon fodder in order to highlight his superiority. While few in number, the presence of ethnic minority heroes in popular culture narratives becomes important for examining and understanding the limitations and possibilities of positive portrayals by and about members of historically marginalized communities in the United States. Inventing the Latino/a Hero explores the historical representation of U.S. Latino/a heroic figures and heroism discourses in film, television, and comics. This study concentrates on hero narratives that directly explore, interrogate, or wrestled with the issue of legality, which is central to the construction of Latino/a heroes and their narratives’ relationship with ideology and power relations. In this regard, I contend that Latino/a heroes either challenge the dominant, often oppressive system of U.S. -

The introductory chapter will explain the public’s perception of outlaws. Richard Aquila argues that the public believes that outlaws represent both honorable and dishonorable aspects of the West. This thesis will argue that the nineteenth-century’s perception of outlawry affected the twentieth and twenty-first century’s perceptions. The stereotypes related to outlawry are not new. The thesis will specifically assert that actual outlaws were more complex than the “noble criminal” or “bad men” stereotypes. Many outlaws were “noble criminals” and “bad men” at the same time. The Cherokee Strip’s outlaws provide an excellent case study for the complex nature of outlawry. Outlaws who operated outside the Cherokee Strip were similar to the Cherokee Strip outlaws in many ways. -

In this study the outlaw figure is de-heroicized and expanded upon in its historical (Jesse James, Billy the Kid), folk (John Henry, Stagolee), and social (tramps, hoboes) forms in order to emphasize the disruptive possibilities of a marginal or outcast existence in performative acts that improvise on tradition. Because the outlaw voice has been most prominent in folk performance since the late nineteenth century, this study focuses on the works and personae of Lead Belly, Woody Guthrie, and Bob Dylan. The performative outlaw is a cultural persona that is invested in outlaw tradition and conflates the historic, folkloric, and social in a cultural act. Religion and Violence in Jesse James Films, 1972–2010 Abstract This essay analyzes recent depictions of Jesse James in cinema, examining filmic portrayals of the figure between the years of 1972 and 2010. Working from the intersection of the anthropology of film and religious studies approaches to popular culture, the essay fills significant gaps in the study of James folklore. As no substantial examinations of the religious aspects of the James myths exist, I hone in on the legend’s religiosity as contested in filmic form. Films, including revisionist Westerns, are not unlike oral-history statements recorded and analyzed by anthropologists, folklorists, and ethnographers. Jesse James movies, in other words, have much to do with the construction of American identity. Employing theorist Roland Barthes’s textual codes implicit within narrative accounts, I argue that these Revisionist Western films use religion as an intentional trope in their negotiated deconstructions and re-appropriations of the American legend. -

American Civil War an Official History: The Kansas “Red Legs” as Missouri’s Dark Underbelly Donald L. Gilmore The Kansas-Missouri Border 1861-1862: Guerrilla Warfare The passing of the Kansas-Nebraska Act of 1854 was the beginning of constant political debates about the status of a number of new states of the Union, to be split into Proslavery or Free states as demanded by Congress. Slowly the arguments shifted into armed conflict before the Civil War, and became a guerrilla war in Missouri in 1861. In February 1861, Missouri had decided to remain in the Union, but Governor Jackson wanted to join the Confederacy (CSA), creating a split military, part Pro-Union, the rest pro-Confederate Missouri State Guard, now driven into the Southern part of the state. A number of fights between 1 regular units and pro-Southern ones in 1861/62 ended with the defeat of Confederate forces in parts of Missouri. The subject of terrorism - the use of extremely violent measures by adversarial groups or armies on the world stage against their more powerful enemies - dominates military-political discussions today, but in past struggles, dominant powers have often used terrorism themselves. One such conflict was the Union Army’s struggle against guerrillas in the Trans- Mississippi West during the Civil War, especially in Missouri. The problem of the border states was their status of being partially pro- Union and also pro-CSA or partially pro-slavery (Missouri, Kentucky and Mayland were slave-holding states but remained with the union). This necessitated abolitionists often living door to door with their pro-slavery opponents. -

Abstract: The myth of the Wild West or the frontier myth is one of the significant myths in American nation and culture. The frontier is the line that divided the civilized and non-civilized during the colonial expansion towards the West of the America. The American frontier existed throughout the colonial expansion in America and the literature, art and films developed it a romanticized myth of American history. There are two variations of the Wild West of America – the historical West in which farmers, prostitutes and criminals followed their happiness and the mythic West that was created as a result of American popular hero imagination. Many legendry outlaws of the West were made romanticized heroes of the American popular culture and literature. One of the popular heroes of Wild West is Jesse James who has been represented in various films, biopics, novels and biographical literature as a legendry outlaw of the West.
