SHANG YANG 商鞅 AND LEGALIST 法家 REFORM IN THE ANCIENT CHINESE STATE OF QIN 秦 Daniel HAITAS Abstract Legalism has played a major role in the history of the Chinese legal and governmental tradition. One of the major exponents and formulators of this school of thought in ancient times was Shang Yang, an official in the state of Qin. Shang Yang oversaw a program of law reform in Qin in such areas as criminal law and the economic life of the country which aimed to strengthen the power of the state. This can be said to have had long term consequences for both Chinese and world history, in that the strengthening and reorganization of Qin along the lines of Legalist principles helped lead to its gaining preeminence amongst the other states vying for influence in the Warring States period, ultimately leading to the unification of China under the rule of the Qin dynasty. Chinese Civilization PREHISTORY Sources for the earliest history Until recently we were dependent for the beginnings of Chinese history on the written Chinese tradition. According to these sources China's history began either about 4000 B.C. or about 2700 B.C. with a succession of wise emperors who "invented" the elements of a civilization, such as clothing, the preparation of food, marriage, and a state system; they instructed their people in these things, and so brought China, as early as in the third millennium B.C., to an astonishingly high cultural level. However, all we know of the origin of civilizations makes this of itself entirely improbable; no other civilization in the world originated in any such way. As time went on, Chinese historians found more and more to say about primeval times. All these narratives were collected in the great imperial history that appeared at the beginning of the Manchu epoch. That book was translated into French, and all the works written in Western languages until recent years on Chinese history and civilization have been based in the last resort on that translation. The Peking Man Man makes his appearance in the Far East at a time when remains in other parts of the world are very rare and are disputed. He appears as the so-called "Peking Man", whose bones were found in caves of Chou-k'ou-tien south of Peking. Interpreting Social Credit System in Eight Dimensions 2 | 八个维度 解读社会信用体系 As 2020 is the last year of the five-year plan for the construction of a social credit system (SCS) under the Plan for Establishing a Social Credit System (2014– 2020) (the "Plan") issued by the State Council, 2019 has become a crucial year to achieve the goals of the Plan. Looking back, a series of policy documents and their consultation drafts that focus on top-level design and operational practices have been introduced intensively this year, proposing methodologies and roadmaps for social credit-based market monitoring modes and a governance model from multiple dimensions, such as collection and sharing of credit information, use of credit reports, joint rewards for compliance, joint sanctions on non-compliance, identification of sanctioned targets, management of joint sanction list, market and industry access prohibition, credit restoration mechanisms, credit information security and the protection of market players’ rights. Beneath the surface of China’s Social Credit System Author: Jacqueline Olsen Malmö University Supervisor: Mikael Spång Subject: Human Rights Bachelor thesis, spring 2020 1 Abstract China has developed a technological Social Credit System that monitors, collects, and analyses behavioural data from citizens and enterprises. The system categorises them trustworthy or untrustworthy according to their behaviour. This paper aims to investigate the technological elements of China’s Social Credit System and analyse its social functions. In doing so, I will address the human rights implications following from the system. The thesis uses a content analysis method and draws on three theoretical studies, including, dataveillance, social sorting and neoliberalism and subjectivity. The study shows that China intends to continue investing in immoral technological elements; might succeed to govern citizens in self-governing; and prioritises the system in front of scarce human rights regulations. The conclusion holds that China intends to continue developing and strengthening the Social Credit System to enhance the behaviour of their society, regardless of some human rights implications, to reach their desired outcome. INTRODUCTION For the past ten years China has been carrying out an ambi- tious program to keep its population under 1.2 billion by the year 2,000 by limiting most couples to one child.' The program is his- torically one of the most extensive exercises of state control over fertility and is especially significant in a society where the state has traditionally intervened in family matters only rarely and with much reluctance. Not surprisingly, the policy has encountered great resistance, particularly from rural areas, where roughly eighty percent of China's population lives. Pronatal norms have been tra- ditionally strong in the countryside, and these norms have been re- inforced by the recent introduction of economic policies that tend to encourage large families. Government policies have thus placed much of rural society in a dilemma. Couples may either reject the one-child limit and at- tempt to have more children, thereby increasing their net household income (but subjecting them to government sanctions); or they may obey the one-child limit and suffer the economic consequences of a smaller income. The Old Master
INTRODUCTION Four main characteristics distinguish this book from other translations of Laozi. First, the base of my translation is the oldest existing edition of Laozi. It was excavated in 1973 from a tomb located in Mawangdui, the city of Changsha, Hunan Province of China, and is usually referred to as Text A of the Mawangdui Laozi because it is the older of the two texts of Laozi unearthed from it.1 Two facts prove that the text was written before 202 bce, when the first emperor of the Han dynasty began to rule over the entire China: it does not follow the naming taboo of the Han dynasty;2 its handwriting style is close to the seal script that was prevalent in the Qin dynasty (221–206 bce). Second, I have incorporated the recent archaeological discovery of Laozi-related documents, disentombed in 1993 in Jishan District’s tomb complex in the village of Guodian, near the city of Jingmen, Hubei Province of China. These documents include three bundles of bamboo slips written in the Chu script and contain passages related to the extant Laozi.3 Third, I have made extensive use of old commentaries on Laozi to provide the most comprehensive interpretations possible of each passage. Finally, I have examined myriad Chinese classic texts that are closely associated with the formation of Laozi, such as Zhuangzi, Lüshi Chunqiu (Spring and Autumn Annals of Mr. Lü), Han Feizi, and Huainanzi, to understand the intellectual and historical context of Laozi’s ideas. In addition to these characteristics, this book introduces several new interpretations of Laozi. -

Elman and Martin Kern CHAPTER FOUR CENTERING THE REALM: WANG MANG, THE ZHOULI, AND EARLY CHINESE STATECRAFT Michael Puett, Harvard University In this chapter I address a basic problem: why would a text like the Rituals of Zhou (Zhouli !"), which purports to describe the adminis- trative structure of the Western Zhou ! dynasty (ca. 1050–771 BCE), come to be employed by Wang Mang #$ (45 BCE–23 CE) and, later, Wang Anshi #%& (1021–1086) in projects of strong state cen- tralization? Answering this question for the case of Wang Mang, how- ever, is no easy task. In contrast to what we have later for Wang Anshi, there are almost no sources to help us understand precisely how Wang Mang used, appropriated, and presented the Zhouli. We are told in the History of the [Western] Han (Hanshu '() that Wang Mang em- ployed the Zhouli, but we possess no commentaries on the text by ei- ther Wang Mang or one of his associates. In fact, we have no full commentary until Zheng Xuan )* (127–200 CE), who was far re- moved from the events of Wang Mang’s time and was concerned with different issues. Even the statements in the Hanshu about the uses of the Zhouli— referred to as the Offices of Zhou (Zhouguan !+) by Wang Mang— are brief. We are told that Wang Mang changed the ritual system of the time to follow that of the Zhouguan,1 that he used the Zhouguan for the taxation system,2 and that he used the Zhouguan, along with the “The Regulations of the King” (“Wangzhi” #,) chapter of the Records of Ritual (Liji "-), to organize state offices.3 I propose to tackle this problem in a way that is admittedly highly speculative. -

Winter 2017 Tues. and Weds 9:00-10:40 Location TBA HISTORY OF CHINESE PHILOSOPHY: ANTIQUITY TO 1200 Tracing its beginnings back to the time of the pre-Socratics, the Chinese philosophical tradition is marked by a diversity and sophistication that makes it interesting not only in its own right, but also as a point of comparative reference: it offers an alternative conceptual and moral space from which to think about basic ideas and questions, and to interrogate the very foundations of philosophical inquiry. This course introduces the maJor texts of the Chinese philosophical tradition from its beginnings c. 6th century BCE to around 1200 CE. The first half will be devoted to key early texts – those connected to the figures of Confucius, Mozi, Mencius, Xunzi, Laozi, Zhuangzi, Han Feizi and others. We will learn about the distinctive concerns and approaches of each of these texts, and the positions they represented within the cosmological, ethical and political debates that ensued during the period of the Warring States (4th-3rd centuries BCE). In the second half of the course, we will learn about new styles of inquiry that accompanied the rise and consolidation of the first empires in China, as well as those that emerged in the wake of imperial collapse in the 3rd century CE. In this part we will study texts connected to the cosmological synthesis of the Han empire; Buddhist hermeneutics and metaphysics; the “Learning of the Mystery”; medieval Daoist self-cultivation; literary theory; and Neo-Confucianism. Han Fei and the Han Feizi
Introduction: Han Fei and the Han Feizi Paul R. Goldin Han Fei 韓非 was the name of a proli fi c Chinese philosopher who (according to the scanty records available to us) was executed on trumped up charges in 233 B.C.E. Han Feizi 韓非子, meaning Master Han Fei , is the name of the book purported to contain his writings. In this volume, we distinguish rigorously between Han Fei (the man) and Han Feizi (the book) for two main reasons. First, the authenticity of the Han Feizi —or at least of parts of it—has long been doubted (the best studies remain Lundahl 1992 and Zheng Liangshu 1993 ) . This issue will be revisited below; for now, suffi ce to it to say that although the contributors to this volume accept the bulk of it as genuine, one cannot simply assume that Han Fei was the author of everything in the Han Feizi . Indeed, there is a memorial explic- itly attributed to Han Fei’s rival Li Si 李斯 (ca. 280–208 B.C.E.) in the pages of the Han Feizi ( Chen Qiyou 陳奇猷 2000 : 1.2.42–47); some scholars fear that other material in the text might also be the work of people other than Han Fei. Second, and no less importantly, even if Han Fei is responsible for the lion’s share of the extant Han Feizi , a reader must be careful not to identify the philosophy of Han Fei himself with the philosophy (or philosophies) advanced in the Han Feizi , as though these were necessarily the same thing.
