“I’d like to be optimistic, but I do believe we will have to litigate this to get any changes,” Welsh said. “It’s like we have no voice with the water board.” Morrow added that the association’s lobbyist is working with other business groups to encourage a new formula for paying the water construction debt. “There have been some discussions about litigation to try to put a stop to it,” Morrow said. “If it comes down to it, this is something the Nevada association is willing to entertain with our limited budget to support those legal costs to help out our membership. We have no reservations about doing that at all, but this isn’t just a self storage issue.” Fighting the new surcharge legally would pose challenges, said Carlos Kaslow, attorney for the national Self Storage Association. “There is little recourse to an increase in the charge of water if the water board can relate it to a drop in revenue from other sources and that the fees are necessary to cover operating and capital expenses,” Kaslow said. “However, there may be a claim that basing the charge on the size of the connection and not actual water usage is an abuse of discretion.” Kaslow points out that the water board appears to have approved the fire meter surcharge so that commercial users would pay a greater share of the increase than resi- dential users, which could be grounds for an equal protec- tion claim. Meanwhile, operators are confronted with the challenge of absorbing the new costs or exploring the viability of passing those costs along to customers, which most agree is another obstacle. Welsh said Storage One has added a new Southern Nevada Infrastructure Surcharge fee of $8 to $12 per month at two of its Las Vegas-area facilities. “It’s a tough sell, and those two stores have had a hard time selling it to customers.” “We’re already giving them away and there’s lots of vacancy,” said Stephanie Storage’s Velasquez. “We can’t afford to pay it, but we have to.” Peppard said the local market is overbuilt and too weak to support a rent rate increase to help owners make up water costs. “People have moved away because they can’t find work, and the market is overbuilt with self storage,” he said. “You can’t pass this along or you’ll have even more vacancies. It’s just something we are going to have to eat.” v

The U-Haul brand has been a high-profile symbol of consumer mobility for more than six decades. According to the company, the annual mileage of North American U-Haul trucks, trailers and towing devices would move a family to the moon and back more than 20 times a day— every day of the year. Self storage has been a big part of its operation since the company began renting space back in 1974. With self storage available at 77 percent of U-Haul Centers and 28 percent of U-Haul independent dealerships, the company is obviously a major player in the industry. Shoen’s concern about government regulation motivated him to participate in SSA’s Legislative & Regulatory Advi- sory Committee. His involvement has helped him weigh in on and stay informed about important details of the Association’s government relations initiatives. What are his top priorities in that regard? “Self storage lien regulation fair statutes—and efficient, effective, affordable notification,” he said. U-Haul has survived many a recession over its lifetime, so Shoen has a time-tempered perspective on how the self storage industry can best weather this latest prolonged period of economic challenge. He offered three tips to survive and thrive. “First, focus on the customer,” he said. “Second, focus on being a cost-effective service provider. Third, maintain an effective and affordable electronic presence.” Pushing ahead in the face of tough economic headwinds isn’t easy, but that might be why Shoen and U-Haul take a long-term view—and why they remain laser-focused on the people they serve. “Customers will be out there looking for service,” Shoen said. “As always, the trick will be getting them to pick you.” v

Two of the four California bills specifi- cally included self storage facilities, while two were “spot bills”—possible vehicles for this purpose, though self storage had not been identified in language. In addition, there was a bi-partisan legislator working group on this issue. Working with the industry groups, a Sacramento-based lobbying firm successfully convinced one of the sponsors of AB 2540 to affirmatively exempt “self storage facilities” from its bill. He understood the distinction between a real estate rental transaction vs. the sales of a product or service. Yet another proposal, AB 1963, was much broader and expanded state sales tax to all perceived services, with a few exceptions. This bill was substantially amended, ulti- mately requiring the state’s Legislative Analyst’s (LAO) to undertake a future study and make recom- mendations on how to best broaden the state sales tax to services. In the past, the LAO has expressed support for broadening sales taxes to services; and while this was a victory for 2012, it remains a concern for the SSA moving forward. The other bills, AB 2215 and SB 1412, were not moved by their authors.
