First UA: 49/20 Index: ASA 20/2269/2020 India Date: 5 May 2020 URGENT ACTION PROTESTORS ARRESTED FOR OPPOSING BIGOTED LAW Meeran Haider, Shifa-Ur-Rehman and Safoora Zargar (who is three months pregnant) have been arrested for peacefully protesting the Citizenship Amendment Act (CAA), a law that legitimizes discrimination on the basis of religion and stands in clear violation of the Constitution of India and international human rights law. Detained under the repressive Unlawful Activities Prevention Act (UAPA), the three can be held without charge for up to 180 days - or even longer - a duration far exceeding international standards. With no provisions for adequate pre-trial safeguards against torture and other ill-treatment contained in the UAPA, as well as the imminent threat of a COVID-19 outbreak in the prison, there are grave concerns for the wellbeing of the three activists. Democracy in the United States The United States is a representative democracy. This means that our government is elected by citizens. Here, citizens vote for their government officials. These officials represent the citizens’ ideas and concerns in government. Voting is one way to participate in our democracy. Citizens can also contact their officials when they want to support or change a law. CHRI 2019 A USER GUIDE i Maharashtra Police Complaints Authorities A User Guide Commonwealth Human Rights Initiative The Commonwealth Human Rights Initiative (CHRI) is an independent, non-profit, non-partisan, international non-governmental organisation working in the area of human rights. In 1987, several Commonwealth professional associations founded CHRI, since there was little focus on human rights within the association of 53 nations although the Commonwealth provided member countries the basis of shared common laws. Through its reports and periodic investigations, CHRI continually draws attention to the progress and setbacks to human rights in Commonwealth countries. In advocating for approaches and measures to prevent human rights abuses, CHRI addresses the Commonwealth Secretariat, the United Nations Human Rights Council Maharashtra Police members, the media and civil society. It works on and collaborates around public education programmes, policy dialogues, comparative research, advocacy and networking on the issues of Access to Information and Complaints Authorities Access to Justice. CHRI seeks to promote adherence to the Universal Declaration of Human Rights, the Commonwealth Harare Principles and other internationally recognised human rights instruments, as well as domestic instruments supporting human rights in the Commonwealth. India’s Police Complaints Authorities: A Broken System with Fundamental Flaws A Legal Analysis CHRI Briefing Paper September 2020 Commonwealth Human Rights Initiative The Commonwealth Human Rights Initiative (CHRI) is an independent, non-governmental, non- profit organisation headquartered in New Delhi, with offices in London, United Kingdom, and Accra, Ghana. Since 1987, it has worked for the practical realization of human rights through strategic advocacy and engagement as well as mobilization around these issues in Commonwealth countries. CHRI’s specialisation in the areas of Access to Justice (ATJ) and Access to Information (ATI) are widely known. The ATJ programme has focussed on Police and Prison Reforms, to reduce arbitrariness and ensure transparency while holding duty bearers to account. CHRI looks at policy interventions, including legal remedies, building civil society coalitions and engaging with stakeholders. The ATI looks at Right to Information (RTI) and Freedom of Information laws across geographies, provides specialised advice, sheds light on challenging issues, processes for widespread use of transparency laws and develops capacity. CHRI reviews pressures on freedom of expression and media rights while a focus on Small States seeks to bring civil society voices to bear on the UN Human Rights Council and the Commonwealth Secretariat. A growing area of work is SDG 8.7 where advocacy, research and mobilization is built on tackling Contemporary Forms of Slavery and human trafficking through the Commonwealth 8.7 Network. CHRI has special consultative status with the UN Economic and Social Council and is accredited to the Commonwealth Secretariat. Recognised for its expertise by governments, oversight bodies and civil society, it is registered as a society in India, a trust in Ghana, and a public charity in the United Kingdom. -

Aurobindo Ghosh, “The Renaissance in India” (1918) Aurobindo Ghosh (later Sri Aurobindo) (1872–1950) was a central political, religious, and philosophical fi gure in the Indian renaissance. Bengali born and Cambridge-educated, he was trained in Victorian English literature, sat his Cambridge examinations in classics, and taught English at Baroda Col- lege. He became involved in radical politics and while imprisoned discovered Indian philosophy. He spent the remainder of his life at his ashram in Pondi- cherry, producing an enormous volume of religious and philosophical work, including his masterpiece The Life Divine. Many Indian philosophers of the colonial period visited him in Pondicherry, and his infl uence on Indian phi- losophy is considerable. In this essay he addresses the meaning of the Indian renaissance for India’s national identity. Aurobindo Ghosh 3 The Renaissance in India I There has been recently some talk of a Renaissance in India. A number of illuminating essays with that general title and subject have been given to us by a poet and subtle critic and thinker, Mr. James H. Cousins, and others have touched suggestively various sides of the growing movement towards a new life and a new thought that may well seem to justify the description. This Renais- sance, this new birth in India, if it is a fact, must become a thing of immense importance both to herself and the world, to herself because of all that is meant for her in the recovery or the change of her time-old spirit and national ideals, to the world because of the possibilities involved in the rearising of a force that is in many respects unlike any other and its genius very diff erent from the mentality and spirit that have hitherto governed the modern idea in mankind, although not so far away perhaps from that which is preparing to govern the future.
