Alshamma’a Department of Geology, College of Science, Basrah University, Basrah, Iraq Abstract: Recently, the environmental isotopes are adopted to figure out the hydrological processes, recharge areas, flow paths, groundwater origin and the interaction between different watery bodies. Currently, five samples of the rainwater have been collected since January to April 2012, as well as December 2011. Those sampling periods have highest amounts of precipitation events. Meantime, 25 samples of groundwater, 5 of the Lesser Zab River and 3 of overland flow have been picked up during the wet period. The dry sampling of groundwater and the Lesser Zab River has been achieved in summer 2011. The Local Meteoric Water Line lies between Global Meteoric Water Line (GMWL) and East Mediterranean Water Line (EMWL). The lowest, highest and average of δ18O in precipitation are -4.00‰, - 3.60‰ and -3.84‰, while δ2H equal to -17.20‰, -14.00‰ and -15.60‰ respectively. The ranges of δ18O and δ2H of the Lesser Zab River in dry period are - 3.12‰ to -2.82‰ and -12.80‰ to -12.00‰ sequentially. In the wet period, runoff samples are added to the Lesser Zab River. The lowest and highest of δ18O are - 5.30‰ and -4.87‰ respectively, while δ2H extends from -30.00‰ to -28.65‰. Groundwater samples have δ18O and δ2H increased with well depths somewhat.

The main reasons for this situation are the failure of the main Iraqi political parties to provide information on this sector of the population as well as the apparent inability of the Turkmen themselves to do so. For several decades, the Iraqi government has pursued a deliberate policy of misinformation concerning the Turkmen. In particular, so-called legitimate ‘sources’ of information have relied on the Iraqi government’s demographic ‘reports’ which, unfortunately, have been invariably distorted so as to present much-reduced figures for the total population of each distinctly ethnic group within Iraq. It is now well-documented how Saddam Hussein unleashed the defeated Iraqi army on certain sectors of the population after Iraq’s defeat in the Gulf War [give dates], with terrible ferocity. What has not been reported, however, is the fate of the Turkmen in this campaign of vindictiveness in the cities and towns where they constituted the majority of the population.

Despite its prominence, its legal status in international law can seem ill-understood. Conflicting statements from Kurdish and Iraqi officials, in addition to obfuscation and divergent understandings by states supplying the Peshmerga are the norm. In popular discourse the Peshmerga is generally treated as a separate Kurdish armed force, unrelated to Baghdad and the Iraqi armed forces, a position echoed by Kurdish officials. The confusion is compounded by the complexities of the political situation in Iraq, with the Kurdistan Region and its Peshmerga functioning almost entirely independently from the Iraqi federal government. Despite these factual complexities and the apparent divergence in understandings as to the Peshmerga’s legal status, this Note argues that the answers provided by international law are quite simple, if politi- cally controversial. As a matter of law, Iraq not only has State responsibility for the Kurdish Peshmerga, but in fact the Peshmerga must be understood to be a part of the Iraqi armed forces under international humanitarian law (“IHL”). This conclusion raises tensions and problems, which are explored in this Note. Iraq may have legal responsibility for an armed group (the Peshmerga) which is alleged to have committed significant IHL violations during the conflict against ISIS, and has previously deployed (without Iraq’s permission) into Syria.
