REQUEST FOR PUBLIC COMMENT IN RESPECT OFTHE NORTH WEST YOUTH ENTREPRENEURSHIP SERVICE FUNDACT, REPEAL BILL, 2020 Request for public comment from interested parties in respect ofthe attached North West Youth Entrepreneurship ServiceFund Act, Repeal Bill, 2020, is hereby made. The Billseeks to repeal the North West Youth Entrepreneurship Service Fund Act,2016 (Act No 6 of 2016). The North West Youth Entrepreneurship Service Fundnever came into operationas a public entity, since the promulgationof the North West Youth Entrepreneurship Service FundAct, 2016.

Since the promulgation of the North West Youth EntrepreneurshipService Fund Act, 2016, funds appropriated for youth entrepreneurship initiatives have alwaysaccrued to the Office of the Premier, which has measures in place for the coordination ofyouth entrepreneurship in the Province.

In line with the recent recommendation of the GovernmentTechnical Advisory Centre and since the North West Youth Entrepreneurship Service Fundnever came into operation, the Provincial Executive Council has identified the need to repeal theNorth West Youth Entrepreneurship Service Fund Act, 2016, which is the legislation thatestablished the entity. The effect of such repeal is that the North West Youth EntrepreneurshipService Fund will be disestablished and upon such disestablishment, cease to existas a public entity and all assets, liabilities, rights, duties and obligations will vest in, the Officeof the Premier. The disestablishment willalso save potential operationalcosts of the North West Youth Entrepreneurship Service Fund, thereby ensuring that such operationalcosts are channelled to youth developmentprograms.

(PREMIER) BILL To provide for the repealof the North West Youth Entrepreneurship Service FundAct, 2016 (Act No 6 of 2016) and to providefor matters connected therewith. BE IT ENACTED by the Provincial Legislature of the North-West Province, as follows:- Definitions 1. In this Act, unless thecontext indicates otherwise- "Fund" means the North West Youth Entrepreneurship ServiceFund; "Department" means the Office of the Premier in the North WestProvince; "Gazette" means the official Provincial Gazette of the North-West Province; "Head of Department" means the most senior officer of theOffice of the Premier in the North West Province; "Provincial Treasury" means the Treasury established for North-West under section 17 of the Public Finance Management Act, 1999 (Act No. 1of 1999); "regulations" means regulations madein terms of section 4; "responsible Member" means the Premier of the North West Province;and "this Act" includes the regulationscontemplated in section 4.. Repeal of law 2. The North -West Youth Entrepreneurship Service Fund Act,2016 (Act No 6 of 2016), is hereby repealed.

Disestablishment of Fund and transitionalprovisions incidental thereto 3. (1) The Fund, is hereby disestablished. (2) On the date of the commencement of this Act, all assets, liabilities,rights, duties and obligations, including any unspent portion of any funds accruedor received under the repealed Act, of the disestablished Fund, are transferred to, and vest in,the Department. (3) The Department is, in respect of the assets, liabilities, rights,duties and obligations and funds referred to in subsection (2), for all purposes thesuccessor -in -law of the disestablished Fund. (4) The responsible Member must, subject to applicable labour law,address all issues relating to the employees of the disestablished Fund who were appointed in termsof the relevant provisions of the repealed North -West Youth Entrepreneurship Service FundAct, 2016. Responsible Member may makeregulations 4. The responsible Member may, if in the application of this Act, administrativeproblems are being experienced, by notice in the Gazette, make regulations to deal suchadministrative problems.

Validation 5. Any act, determination, designation, decision, matteror any other thing done, made, taken, executed or carriedout or purported to have been done, made, taken,executed or carried out by the Board ofthe disestablished Fund appointed in terms of therepealed North -West Youth Entrepreneurship Service Fund Act, 2016, interms of or in pursuance of the repealed North -West Youth Entrepreneurship ServiceFund Act, 2016, up to thedate of commencement of this Act, is not invalid by reason of the repealof the North -West Youth Entrepreneurship Service Fund Act,2016.

Short title 6. This Act is called the North -West Youth EntrepreneurshipService Fund Act, Repeal Act, 2020 and comes into operation on a date to be determined by theresponsible Member.

MEMORANDUM ON THE OBJECTSOF THE NORTH -WEST YOUTH ENTREPRENEURSHIP SERVICE Fund ACT REPEALBILL, 2020 1. BACKGROUND The Bill seeks to repeal the North West Youth EntrepreneurshipService Fund Act, 2016 (Act No 2016). The North West Youth Entrepreneurship Service Fundnever came into operation since the promulgation of the North West YouthEntrepreneurship Service Fund Act, 2016 (Act No 6 of2016). Since the promulgationof the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016) fundsappropriated for youth entrepreneurship initiatives have always accrued to the Office of the Premier,which used to have a directorate for youth entrepreneurship. In line with the recentrecommendation of the Government Technical Advisory Centre and since the North West YouthEntrepreneurship Service Fund never came into operation, the necessity hasarose to repeal the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of2016), which is the legislation that established the entity. The effect of the repeal the North WestYouth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016), is that the North WestYouth Entrepreneurship Service Fund will be disestablished and upon such disestablishment,cease to exist as a public entity and all assets, liabilities, rights, duties and obligationswill vest in, the Office of the Premier.

2. CLAUSE BY CLAUSEEXPLANATION In summary, the Bill providesas follows -

Clause 2: Clause 2 repeals the North West Youth EntrepreneurshipService Fund Act, 2016 (Act No6of2016).

Clause 3: Clause 3 provides for the disestablishment of the NorthWest Youth Entrepreneurship Service Fund as a public entity, and transitional provisionsincidental thereto. Clause 4:

Clause 4 accords theresponsible Member a power to make regulations toaddress such administrative problems which may arise on application of thisAct.

Clause 5: Clause 5 validates actions by the North West YouthEntrepreneurship Service Fund. Clause 6: Clause 6 provides for the short title and the coming intooperation of the Act.

3. ORGANISATIONAL AND PERSONNEL IMPLICATIONS FOR PROVINCIAL GOVERNMENT Since the North West Youth Entrepreneurship Service Fundas a public entity, nevercame into operation, no organisational and personnel implicationsare foreseen in as far as they affect the employment structures of the Office of thePremier.

4. FINANCIAL IMPLICATIONSFOR PROVINCIAL GOVERNMENT Since the North West Youth Entrepreneurship Service Fundas a public entity, nevercame into operation, no financialimplication in as far as the transfer of staff and assets fromthe North West Youth Entrepreneurship Service Fund, to the Office ofthe Premier. 5.
