II. Evidence Mr. Hampton quotes 1974 and 1975 receipts for the alleged constituent service office of Mr. Wolpe but does not indicate the source of the information. The Howard Wolpe Campaign Committee registered with the FEC on October 10, 1975, and filed a report of receipts and expenditures on January 9, 1976. Dear Mr. McKay:

In response to your request of February 10, 19,76fo information which would clarify, explain and treat the matters raised in Mr. Hampton's letter, please be advised:

1. Howard Wolpe was first elected to the Michigan House of Representatives' 46th District in 1972. Shortly following his election,. the 46th District Service Office was organized to provide assistance on a non-partisan basis to individuals or groups having particular problems with agencies of state and local government, to inform citizens of legislative occurrences, to obtain citizen input regarding matters of state and local concern,. and to provide services to governmental and public service agencies. This office is, and at all times has been,9 maintained on a non-partisan basis completely separate from any campaign functions whatsoever. There is and has been a strict segregation between campaign and legislative service activities. The 46th District Service Office incorporated January 24,9 19 75 under an independant board of directors. The articles and bylaws of the corporation provide for continuation 0 h office irrespective of the individual holding the office or that individual's party affiliation. The Articles of Incorporation further provide that,, should the corporation be dissolved, the assets and all property of the 46th DistrVict Service Office, Inc. would become the property of the State of Michigan Department of Mental Health. A copy of the Articles of Incorporation are enclosed.

Money received from pledges, contributions and fund raising events was initially insufficient to maintain the office. In 1974,, Representative Wolpe had a surplus of campaign funds remaining after his election. With the consent of the contributors, a gift of $2,o734.21 of these unused funds was made to the 46th District Service Office. a. The 46th District Service Office, Inc.o does no.t provide office expenses for Representative Wolpe but is separate from his regular office as above indicated.

Sb. The 46th District Service Office, Inc. is removed and apart from the 46th District office holder's campaign and state legislative office expenses and is even more rem oved C7" from the campaign and/or office expenses of a candidate for the I";- Third Congressional District.

C c . The 46th District Service Office, Inc. does not provide a campaign office nor are any campaign activities N, conducted from this office. The Howard Wolpe Campaign rem.Committee has a separate mailing address and campaigh, correspondence is not channeled through the Service Office. d . Contributions and expenditures of the 46th District Service Office, Inc. are intended and used for that office and , thereforet do not influence the nomination for election, or election, of Howard Wolpe to federal office.

3. The 46th District Service Office, Inc.-, and not Repre- sentative Wolpe, was responsible for its office maintenance in 1975.
