9. BACKGROUND INFORMATION

9.1 Councillor Rams has requested consideration of the possibility of traffic calming measures in Mount Pleasant and to consider what options could be put in place to increase the safety for pedestrians and motorists. This was due to a number of constituents raising concerns and the police carrying out speed gun exercises and catching a large number of people breaking the speed limit.

9.2 The Director of Environment and Transport will provide an oral report at the meeting.

1. RECOMMENDATIONS 1.1 That the Director of Environment and Transport be instructed to implement the necessary works, including Traffic Orders, to introduce the traffic management measure prioritised in Appendix C of this report, subject to:-

i funds being available;

ii appropriate consultation with local residents/occupiers directly affected by the proposals, public transport operators and with the emergency services;

iii consultation with Ward Members; and

iv any unresolved material objections being dealt with following consultation with Ward Members by the Director of Environment and Transport under delegated powers in consultation with the Cabinet Member for Environment and Transport and the Chairman of this Sub-Committee.

1.2 That the Director of Environment and Transport be instructed to inform those people who submitted requests for traffic management measures via letters, Members and Members of Parliament of the Sub-Committee’s decisions.

2. RELEVANT PREVIOUS DECISIONS 2.1 Cabinet 22 July 2002, Decision 6 - Assessment and prioritisation methodology for traffic management budget funded schemes approved.

3. CORPORATE PRIORITIES AND POLICY CONSIDERATIONS

3.1 The ‘Traffic Management - Future Strategy’ report approved by Cabinet on 5 November 2002 seeks to achieve improvements in traffic movement on the major road network, thus reducing the attraction of alternative, less suitable local roads. Improvements at those junctions that experience heavy congestion, long delays and high levels of personal injury will provide the community with a comprehensive improvement.

3.2 The Sustainable Community Strategy for Barnet 2006-2016 has an ambition to keep Barnet moving.

3.3 The Council’s Corporate Plan 2008/09 –2011/12 confirms the Council’s commitment to improve transport traffic flow and roads, to reduce journey times and improve reliability, to improve the transport infrastructure to maximise movement opportunities and to provide a Clean, Green, Safe environment by reducing serious and fatal Personal Injury accidents in road collisions.

3.4 The Borough's adopted Unitary Development Plan May 2006 indicates that the Council will seek to improve facilities for pedestrians, to reduce walking times, improve the pedestrian environment and to minimise the risk of accidents to pedestrians, with particular attention to those groups most likely

to be at risk, such as the elderly, children and people with disabilities. The Council will encourage improvement of pedestrian facilities for crossing roads, at public transport interchanges and in shopping streets. (Policy M6.2). It also states that the pedestrian environment is important to the quality of life of those who live and work in the borough, in particular those who do not have access to a car or who have mobility problems.

4. RISK MANAGEMENT ISSUES

4.1 A risk assessment has been carried out and is attached as Appendix D.

5. EQUALITIES AND DIVERSITY ISSUES

5.1 The planned programme will include consultation, investigation and design stages and this process is ultimately intended to enhance the quality of life for all within the Borough. An open and fair consultation process will ensure the needs of all sections of the community are taken into consideration, whilst the investigation and design stages will involve the Council formulating solutions for all road users taking into account legislative and policy restrictions.

5.2 The outcomes of the consultation, investigation and design stages should result in a safer, more attractive area to live, work and visit, and provide an improved quality of service. However, irrespective of whether there is a scheme introduced or not in any previously consulted area, all those originally consulted would be advised of the Council’s decision.

6. USE OF RESOURCES IMPLICATIONS (Finance, Procurement, Performance & Value for Money, Staffing, IT, Property, Sustainability)

6.1 The 2008/9 budget for the implementation of traffic management measures at locations not included within the Council’s main capital programme initiatives is £46,080. This is equally divided between the areas served by the three Area Environment Sub-Committees, providing £15,360 to fund schemes within the area served by this Sub-Committee. £5,000 was committed at the last Area Environment Sub Committee in September 2008 leaving £10.360 for the area.

6.2 The cost of the schemes recommended in this report is estimated at £10,360 which accounts for the remainder of the overall revenue budget allocation for this year. On-going costs relating to maintenance of the measures are reviewed annually along with similar measures as appropriate when assessing annual budget requirements and are confined to Highway Group activities. The introduction of the schemes will be facilitated by the employment of existing staffing arrangements.

6.3 The introduction of the measures will meet customer expectations, demonstrating a commitment to listening to the community, and provide value for money by reducing the probability of accidents and ensures that limited resources are only directed to those locations where there is evidence of demand.

6.4 There are no other staffing, ICT or property implications.

8.1 Constitution Part 3 ‘Responsibility for Functions’ Para 3.10 Area Environment Sub-Committees performs functions that are the responsibility of the Executive relating to highways use and regulation.

9 BACKGROUND INFORMATION

9.1 Requests for various traffic management measures have been received via letters, Members and Members of Parliament requesting traffic management schemes in the Chipping Barnet Area.

9.2 All the requests have been assessed for funding against the agreed assessment criteria in Appendix A. Appendix B, Appraisal, details the schemes that have failed to meet the requirements of Stages 1 and 2 of the criteria together with the reasons why they are not recommended for funding and highlights those requests for schemes proceeding to Stage 3.

The Stage 3 Assessment is detailed in Appendix C to this report. The appendix sets out the level of justification for the schemes together with an officer recommendation for funding. The recommended schemes are:

- Galley Lane – Vehicle activated signs

- Totteridge Common – Double bend warning signs

- Barnet Lane – Review of pedestrian facilities and warnings

9.3 Detailed design of the measures will be progressed in discussion with local Ward Members prior to public consultation with residents/occupiers who are directly affected by the proposals, the emergency services and public transport operators. It is recommended any unresolved objections are dealt with by the Director of Environment and Transport under delegated powers in consultation with the Chairman of this Sub-Committee and the Cabinet Member for Environment and Transport following consultation with Ward Members.

9.4 Other appropriate maintenance and enhancement works to the physical fabric of the public highway at the recommended scheme locations will be carried out at the same time to maximise the benefit of the improvement and minimise any inconvenience to residents and local occupiers.

9.5 Members are requested to approve the action recommended in Appendix C of this report.

RECOMMENDATIONS 1.1 That, subject to the overall costs being contained within available budgets for the 2008/09 and 2009/10, the Sub-Committee approves the proposals for various waiting restrictions in the New Barnet area, as shown on drawing number 23932/2 and that the Director of Environment and Transport be authorised to:

(i) carry out a statutory consultation exercise on the proposed restrictions agreed under 1.1 above;

(ii) consider the results of the statutory consultation and address any objections and unresolved comments under his delegated powers, in consultation with the relevant Ward Councillors, the Cabinet Member for Environment and Transport and the Chairman of this Sub-Committee;

(iii) make Traffic Management Orders and implement all approved measures accordingly;

(iv) monitor the effectiveness of the agreed measures and continue to monitor traffic and parking conditions in the New Barnet area in light of the new restrictions and in light of the expected building/business developments in the area.

2. RELEVANT PREVIOUS DECISIONS 2.1 The introduction of charges into the East Barnet Road car parks, which was approved by the Chipping Barnet Area Environment Sub-Committee on 25 March 2003 Decision number 7.

2.2 The decision to carry out an investigation into parking related issues in an identified area of New Barnet made by the Chipping Barnet Area Environment Sub-Committee at its meeting on 19 July 2006

2.3 The decision to prepare measures to regulate on-street parking in the New Barnet area was made by the Chipping Barnet Area Environment Sub- Committee on 20 November 2007

An open and fair consultation process determined the parking and safety needs of all members and groups of the community who cared to respond to the consultation, whilst the investigation and design stages involved the Council formulating solutions for all road users taking into account legislative and policy restrictions.

5.2 If any identified measures are introduced, the outcomes of the consultation, investigation and design stages should result in a more safer, more attractive area to live, work and visit, and provide an improved quality of service. There are reviews carried out at documented stages after the implementation of any scheme to constantly review the needs of all users as their needs are not static. However, irrespective of whether any measures are introduced or not in any previously consulted area, all those originally consulted would be advised of the Council’s decision.

6. USE OF RESOURCES IMPLICATIONS (Finance, Procurement, Performance & Value for Money, Staffing, IT, Property, Sustainability)

6.1 Potential estimated capital costs of £60,000 could be funded from the Design Team’s 2008/09 and 2009/10 capital provision for Major Schemes, which is funded from net income in the Special Parking Account (SPA) and therefore provision would need to be made to allow for this amount in the Design Team’s capital allocation for the years 2008/09 and 2009/10. On-going costs relating to the maintenance of the measures are reviewed annually along with similar measures as appropriate when assessing annual budget requirements and are confined to Highway Group activities. The introduction of the scheme will be facilitated by the employment of existing staffing arrangements, and the ongoing enforcement of the measures will be through the deployment of existing Civil Enforcement Officers.

6.2 It is envisaged that the majority of costs will be incurred in 2009/10 with approximately £20,000 to be incurred in 2008/09.

9 BACKGROUND INFORMATION

9.1 The Chipping Barnet Area Environment Sub-Committee at the July 2006 meeting considered a report recommending investigation into possible parking related issues in the New/East Barnet, Whetstone and Oakleigh Park Station areas. It was decided by the Sub-Committee that the proposed investigation into on-street parking issues should be confined to an area of New Barnet – with the exact boundary subsequently established through dialogue with local ward members and the Chairman of this Sub-Committee. Officers subsequently carried out an informal audit of parking opinion in the area, through the distribution of a questionnaire, to identify the nature of parking problems experienced by the local community.

9.2 The analysis of the responses showed the roads in the consultation area fell into two broad categories, one of which appeared to experience high levels of parking demand where residents were competing with commuters, shoppers and businesses for limited road space and the other where residents and businesses were mainly content with the existing parking situation and required more minor or localised issues investigated, such as waiting restrictions at junctions or obstruction caused by inconsiderate parking.

9.3 The results of the consultation were reported to this Sub-Committee in November 2007 where it was acknowledged that at the very least attention should be paid to a number of locations throughout the area with a view to introducing measures that would improve safety and traffic flow, particularly at junctions, although it was acknowledged that this course of action would further increase the pressure on available parking space especially in those roads which already experience high levels of parking demand

9.4 Observations which were made by an Officer specifically tasked with investigating parking issues within the area indicate that high levels of parking is taking place throughout the area throughout the day. In particular, the residential streets immediately north and north-west of New Barnet Station suffer high levels of parking both sides of the road on a daily basis from motorists leaving their vehicles in order to commute, although it should be noted that this type of parking occurs on many roads throughout the area, and is not only limited to streets in the immediate vicinity of the station.

9.5 The presence of many businesses in the area has led to employees attempting to park in close proximity of their workplace, and a van hire company stores its fleet of vans in the surrounding residential roads creating further pressure for available kerbside space. Apart from causing inconvenience to local residents, this also results in vehicles parking obstructively on corners creating a safety concern for road users and pedestrians alike.

9.6 A summary of the parking problems highlighted by the informal consultation, and observed by Officers were reported to this Sub-Committee, and includes issues such as commuter parking, inadequate parking for users of local businesses, school pick-up and drop-off problems, high demand for resident parking and problematic parking and junctions.

9.7 In seeking to address the concerns raised through the audit of opinion, and the detailed investigative observations made by Officers, it is considered that two possible options present themselves.

9.8 Where there are instances of various parking issues/problems identified over a wide area, the most obvious action would be to propose a Controlled Parking Zone (CPZ), incorporating various restrictions designed to address these issues/problems. Such a scheme would deter commuters from parking in the area and therefore would reduce the competition for available kerbside space thus making it easier for residents wishing to park.

9.9 However, whilst a CPZ would address many of the issues which have been highlighted by the local community, it should be noted that there are currently building developments at various stages of progress in and around the New Barnet area. The pertinent proposed developments which are expected to impact on the area are for a new enlarged secondary school on the existing East Barnet School site, the redevelopment of the old gas works site for Asda and redevelopment of the old Optex site for Tesco. If these developments proceed and are implemented this would have a significant effect on traffic conditions and parking demand, which would undoubtedly increase in the area. It is envisaged that various Section 106 funding will be released as part of the relevant planning agreements for all three developments, although it is considered that if the Asda and Tesco developments proceed, they will have most impact on parking in the area. Therefore it would be prudent to defer any further consideration of CPZ proposals until at least the outcome of the planning applications are known, or until the developments are underway or are completed.

9.10 However, it is considered that specific actions should be progressed immediately to address concerns related to safety and traffic flow that have previously been identified, and as such consideration should be given to proceed with the implementation of ‘at any time’ waiting restrictions at certain junctions and strategic lengths of road in the area to prevent obstructive parking and to keep sightlines clear.

9.11 It should be noted that addressing the safety and traffic flow issues in the area through the provision of waiting restrictions would not resolve residents’ concerns with inadequate parking availability in some residential streets, and could make the parking situation in residential streets worse.

9.12 The estimated costs for the introduction of the restrictions are £60,000 and would be met from the Design Team’s 2008/2009 capital allocation, and subsequently the capital allocation for 2019/10.

9.13 Statutory consultation could occur on the agreed waiting restrictions by Spring 2009, and subject to no major issues arising which may delay progress, any finally agreed measures could be implemented by the middle of 2009.

Meeting Chipping Barnet Area Environment Sub Committee Date 2 December 2008 Subject Pymme’s Brook, - Baring Road , East Barnet Report of Director of Resources and Chief Finance Officer Summary To report the intention of the Council to dispose of a 99 year lease of part of the valley of Pymme’s Brook, to be used as the access road and bridge from Castlewood Road to the proposed JCOSS school and playing field for East Barnet School, and to report the results of the advertising pursuant to Section 123 (2A) of the Local Government Act 1972, of the Council’s intention to dispose of that lease. The Committee can then decide whether or not to make representations and refer the matter of the disposal back to the Executive.

1. RECOMMENDATIONS 1.1 That the Sub-Committee consider, pursuant to advertising under Section 123(2A) of the Local Government Act 1972, whether or not they wish to make representations to the Executive in respect of the letting of land forming part of the Pymme’s Brook Valley to enable the construction of the access road and bridge.

2. RELEVANT PREVIOUS DECISIONS 2.1 Cabinet Decision 23 October 2008. Agenda item 6, pages 36-92 Decision No. 6 Establishment of new voluntary aided Jewish Secondary School (JCoSS). Resolved: 1.1 That the proposals put forward by the Jewish Community Secondary School Trust to establish a new Voluntary Aided Jewish secondary school be approved. Recommendation 1.2: That the JCoSS Trustees be required to modify the proposed admission arrangements to comply with paragraph 1.16 of the School Admission Code 2007. 2.2 Planning and Environment Committee 8 August 2007 Decision No.7 1.4.1 Planning application N02587K/07 Subject to completion of a Unilateral Undertaking planning consent will be granted for “The demolition of buildings and erection of a new secondary school (six form entry) and special resources unit, external works including construction of new outdoor all weather sports pitches and games area, formation of new north east access driveway off Castlewood Road and use of existing access from Westbrook Crescent for emergency vehicles only, parking, landscaping and other enabling works”. 1.4.3 The planning consent will be subject to 44 conditions and other recommendations and additional comments, including the fact that a Unilateral Undertaking should be completed, to secure the payment by the applicant of £75,000 towards off site highway works including improvements to pedestrian facilities in the area and the payment of £5,000 towards the monitoring of the School Travel Plan.

3. CORPORATE PRIORITIES AND POLICY CONSIDERATIONS 3.1 Increasing the diversity of secondary provision in the borough will contribute to the corporate priorities of ‘A bright future for children and young people’ and ‘A successful city suburb’. The resourced provision for children with Autistic Spectrum Conditions will enhance the educational provision in Barnet for children with Special Educational Needs and will contribute to ‘Supporting the vulnerable’. 3.2 The new school will help to meet key priorities in the Children and Young People Plan, particularly ‘every school a good school for every child’ and ‘personalising services for children and young people in vulnerable groups’.

3.3 The Regeneration Service has been consulted and confirmed that the proposals in this report do not adversely impact upon any of the Council’s regeneration schemes.

4. RISK MANAGEMENT ISSUES 4.1 The lease of the school site is due to be completed shortly and building contractors are due to start on site during the first week of December. If the Chipping Barnet Area Environmental Sub Committee refers the matter to Cabinet Resources Committee, the matter cannot be heard by Cabinet Resources Committee until 19 January. This will cause a delay in the building programme and may impact on the cost and timetable for the completion of the project. 4.2 A delay in the building programme and a delay in being able to start building the access road over the Pymme’s Brook land will result in building contractors having to use the Westbrook Crescent access to the school site at the beginning of the building programme. This access way is the sole access to East Barnet upper school. The mix of young people and heavy construction plant using the same, relatively narrow access way should be avoided if at all possible, on Health and Safety grounds. The contractor’s principal access way would pass within a few metres of the school buildings. Public exams are due to be held in the buildings close to the access road, disturbance to the examination candidates needs to be minimised. With no delay to the construction programme the access road could be built across Pymme’s Brook, minimising these risks.

5. EQUALITY AND DIVERSITY ISSUES. 5.1 Barnet Council is committed to improving the quality of life and wider participation for all in the economic, educational, cultural, social and community life of the Borough. This proposal does this by providing a facility that will benefit all sections of the Jewish community, including those who may not be eligible for entry to other Jewish schools. 5.2 The special resourced provision for children with Autistic Spectrum Conditions will greatly improve the choice of provision available to these children and young people in Barnet, enabling them to attend a local mainstream school.

6. USE OF RESOURCES IMPLICATIONS (Finance, Procurement, Performance & Value for Money, Staffing, IT, Property, Sustainability) 6.1 The cost of the press advertisements and payment to the Council in respect of its officer’s time in dealing with the matter will be paid for by the prospective tenant. 6.2 There are no procurement, performance and value for money, staffing, IT or sustainability implications arising from the recommendation. The property issues are those set out in 9 below.

7. LEGAL ISSUES 7.1 The disposal by a local authority of land consisting or forming part of an open space, is permissible subject to the proposed disposal first being advertised in accordance with the provisions of Section 123 (2A) of the Local Government Act 1972, and any objections to the proposed disposal being considered.

8. CONSTITUTIONAL POWERS 8.1 Constitution Part 3 - Responsibility for Functions - Paragraph 3.10 lists the Executive functions of the Area Environment Sub-Committees, which includes the day to day promotion, management and development of open space land. 8.2 Constitution Part 4 - Management of Real Estate, Property and Land, Paragraph 7 (i) - Whenever a decision is taken by the Executive or the Executive Director for Resources acting under his delegated powers to advertise the possible disposal or appropriation of open space land, the Executive Director for Resources or designated officer shall report the matter to the next relevant Area Environment Sub-Committee to enable it to decide whether it wishes to make representations to the Executive in relation to the disposal of the open space land. Constitution, Part 4 Para 7 (ii) – In the event that the Executive Director for resources confirms that there is insufficient time to report to the Area Environment Committee (AESC) as above because of the timing of the committee cycle and the need to progress the disposal expeditiously the decision to advertise may be circulated to all members of the AESC and to the relevant ward members to give them the opportunity to make representations to the Executive on the proposed disposal.

9 BACKGROUND INFORMATION 9.1 Drawing number 23928/9 shows the location and extent of the access road and bridge which is proposed to be built over the Pymme’s Brook Valley, (see Appendix B). 9.2 Planning Consent for the whole school development including the access road has been obtained conditionally, upon completion of a unilateral undertaking by JCoSS concerning planning conditions to be complied with. 9.3 Details of the lease of the proposed school have been agreed and a Delegated Powers report was published on 14 November 2008, setting out these details. 9.4 As required by S123 (2A) of the Local Government Act 1972, the advertisements detailing the proposed grant of a lease was placed in the Barnet Press for two weeks from 18 September 2008. A copy of the advertisement is attached as Appendix A and Appendix B. Although not required by law, the notice and site plan were also posted in two locations on either side of the southern end of the subject land and they were also posted on the kissing gate at the northern end of the land. A notice and site plan were made available to the public at North London Business Park and Chipping Barnet library.

9.5 Representations have been received which have been tabulated and are set out in Appendix D. The objections have been précised. Copies of the original objections in full can be obtained from the author of this report. Many points raised by the objectors were raised during the planning process. 9.6 There is a common misconception that the subject part of the Pymme’s Brook valley is classified as Green Belt land. This is not the case. Green Belt classification commences to the north with Hadley Woods. From drawing 23928/9 it will be noted that planting will take place on both sides of the new construction which will provide for wildlife. 9.7 The footpath which runs parallel to the eastern boundary of Livingstone school is not a formal footpath, but most of the objectors are concerned about it being disrupted by the new road. However, what is planned, is for the footpath to be regraded to gently rise up to the new access road both from the north and the south. People using the footpath will walk over the access road surface. The crossing will be suitably signed for safety reasons. 9.8 A temporary diversion of the footpath is shown on Appendix C of this report, Drawing 23928/10. The process of the diversion will be implemented by the Council’s Highways team. The diversion will only be necessary during part of the construction phase, until it is safe for the public to use the regraded footpath route. Relevant notices will be published and directional signs will be provided.

NOTICE IS HEREBY GIVEN that the Council is proposing to grant a long leasehold interest in land forming part of the Pymme’s Brook Valley between Monken Hadley Common and Baring Road, East Barnet, to be used as part of the access road to the proposed Jewish Community Secondary School.

Drawing 23928/9 showing the location and extent of the property, may be inspected at the Council’s offices, Property Services Team, Building 4, North London Business Park, Oakleigh Road South, London N11 1NP between the hours of 9.00am to 5.00pm Mondays to Fridays (excluding public holidays). The drawing may also be inspected at the same time and days of the week at the ground floor reception desk of Building 4 North London Business Park, Oakleigh Road South, London N11 1NP and at Chipping Barnet Library, Stapylton Road, High Barnet during Library opening hours.

Before making any further decision on the proposal, the Council will consider any written representations received.
