Sudan: The Crisis in Darfur and Status of the North-South Peace Agreement Ted Dagne Specialist in African Affairs June 1, 2011 Congressional Research Service 7-5700 www.crs.gov RL33574 CRS Report for Congress Prepared for Members and Committees of Congress Sudan: The Crisis in Darfur and Status of the North-South Peace Agreement Summary Sudan, geographically the largest country in Africa, has been ravaged by civil war intermittently for four decades. More than 2 million people have died in Southern Sudan over the past two decades due to war-related causes and famine, and millions have been displaced from their homes. In July 2002, the Sudan government and the Sudan People’s Liberation Movement (SPLM) signed a peace framework agreement in Kenya. On May 26, 2004, the government of Sudan and the SPLM signed three protocols on Power Sharing, on the Nuba Mountains and Southern Blue Nile, and on the long disputed Abyei area. The signing of these protocols resolved all outstanding issues between the parties. On June 5, 2004, the parties signed “the Nairobi Declaration on the Final Phase of Peace in the Sudan.” On January 9, 2005, the government of Sudan and the SPLM signed the final peace agreement at a ceremony held in Nairobi, Kenya. In April 2010, Sudan held national and regional elections. In January 2011, South Sudan held a referendum to decide on unity or independence. Abyei was also expected to hold a referendum in January 2011 to decide whether to retain the current special administrative status or to be part of South Sudan. -

Joint press release III Preliminary statement by the EU Election Observation Mission 17 January 2007 PR\649046EN.doc PE 373.825 EN EN On 28 September 2006 the European Parliament’s Conference of Presidents decided on the basis of a recommendation by the election coordination group to send a delegation to Mauritania for the municipal and parliamentary elections on 19 and 26 November 2006. Parliament’s political groups followed their internal rules in appointing the following Members for the first round of elections: · Alain Hutchinson (PSE, Belgium) · Milan Horáček (Verts, Germany) · Ryszard Czarnecki (Europe des Nations, Poland) After some hesitation, the second round of elections was set for 3 December. The political groups had not appointed enough Members to send a delegation for the second round. The delegation met for the first time on 18 October 2006 in Brussels and appointed Alain Hutchinson as its head. It discussed the mission programme and had a meeting with a Commission representative and the Mauritanian ambassador in Brussels. The delegation visited Mauritania from 16 to 22 November 2006. It worked closely with the EU Election Observation Mission (EOM), particularly the Chief of Mission, Marie Anne Isler Béguin. The delegation met Mrs Isler Béguin on several occasions and her suggestions were duly incorporated into the preliminary statement. At the press conference after the first round of elections, the Head of Delegation published a joint press release with the EOM (Annex II). -

In principle, it offers platform for equitable representation of the ethnic majority, minority, marginalised and indigenous groups in public decision making bodies as well as ensuring that these groups benefit equally from development initiatives. In South Sudan, the exercise of inclusivity has been marred with contradictions between constitutional provisions and extant practices, for example, political parties are found to be the foci for rewarding the ‘warlords’ dubbed as freedom fighters at the expense of participatory civilian structures, the nerves of ethnic factionalism over nationalism, exercise of centralised nomination system, all of which breed disaffection and tensions among the citizenry. Moreover, the observed militarisation of public service, perception of ethnic favouritism in public employment and appointments, the ‘felt’ development marginalisation of regions outside Central Equitoria, and unequal share of national resources comprise practices that violate the foundations of inclusive governance. In effect, these malpractices around inclusivity have fermented call for federalism (return to 23 semi-autonomous colonial districts with federal mandates) as a viable inclusive development platform over the current constitutionally mandated decentralisation (where South Sudan is sub- divided into 10 states). -

Statelessness and the Democratic Transition in Mauritania The Situation of Mauritanian Expellees in Context April 2007 Institute for Human Rights and Development in Africa Open Society Justice Initiative 1 1. Executive Summary This is a key moment for Mauritania to break with its long-held policies of disrespect for human rights. In April 1989, approximately 75,000 black Mauritanians1 were stripped of their proof of citizenship and forcibly expelled to Senegal and Mali. These expulsions took place in the context of wider ethnic unrest and human rights violations in Mauritania, including extrajudicial executions, torture, and systematic ethnic discrimination. Over the last 18 years, some of these expellees have returned to Mauritania; some have been resettled, and some remain in ‘camps’2 in Senegal and Mali in a state of poverty and marginalization. In 2000, the African Commission on Human and Peoples’ Rights (hereinafter referred as ACHPR) found that the expellees had been arbitrarily deprived of their nationality and were entitled to return to Mauritania, receive valid proof of their citizenship and compensation for their lost land and goods. However, this decision has never been implemented: the government of Mohammed Ould Taya, which perpetrated the expulsions, remained in power until August of 2005, and maintained that the Commission’s decision had no validity. In August 2005, Ould Taya was overthrown in a coup d’etat. Since then, Mauritania has adopted a new constitution and held parliamentary, municipal and presidential elections. The final round of the presidential elections was held on 25 March 2007 and were accepted by the international community as free and fair. -

In July 2002, the Sudan government and the Sudan People’s Liberation Movement (SPLM) signed a peace framework agreement in Kenya. On January 9, 2005, the government of Sudan and the SPLM signed the final peace agreement at a ceremony held in Nairobi, Kenya. In April 2010, Sudan held national and regional elections. In January 2011, South Sudan held a referendum to decide on unity or independence. Abyei was also expected to hold a referendum in January 2011 to decide whether to retain the current special administrative status or to be part of South Sudan. The Abyei referendum did not take place. In the Southern referendum, 98.8% voted for independence and 1.17% for unity. In late May 2011, Sudan government forces dissolved the joint Abyei Administration and invaded the town, displacing more than 100,000 people in the Abyei area. The crisis in Darfur began in February 2003, when two rebel groups emerged to challenge the National Congress Party (NCP) government in Darfur.
