4969. Motion in the name of Councillor Ciarán O’Moore

Firstly comhghairdeas to all involved in the commissioning the excellent sculpture in St. Annes Park. The work that went into the surrounding wall at the junction of the James Larking Road is a credit also. With this in mind the can the manager review the position of the grey power box / traffic light box that is on the path beside the wall and sculpture , it takes away from the over all visual aesthetics. I propose that it is reallocated to the far side of the road.

4970. Motion in the name of Councillor Damian O’Farrell

That this North Central Area Council believes that the proposed development on lands formally owned by the Vincentian Fathers at St Anne’s Park, Raheny is in material contravention of the Dublin City Development Plan 2011-2017 due to the abject failure of the proposed residential scheme to comply with the clearly stated zoning objective for the area, i.e. “To ensure the existing environmental amenities are protected in any future use of these lands.”

4971. Motion in the name of Councillor Damian O’Farrell

To ask the Area Manager whether or not DCC and/or DCC Parks where approached about the possibility of using parkland immediately inside the boundary of Fairview Park (carriageway side) for the Clontarf to Amiens St Cycleway project. If they were approached at the initial design stage of the project can I have a report on what talks took place between DCC and the project designers please and also the reasons why this space wasn’t included in the final design please? It would seem logical that an exploration / consideration of the use of this ‘park space’ would have taken place in order to create as much space as possible for the project and to help provide a cycleway which safely separates cyclists and motorists as much as possible as well as providing space for a much needed City BikeStation as well as a rest stop and /or other facilities. There are other environmental benefits this alternative route option may have brought to the project/area including the possibility of saving trees designated for destruction and further ‘opening up’ Fairview Park to the public by way of increased activity and passive security.

4972. Motion in the name of Councillor Damian O’Farrell

To ask the Area Manager for a report on the refurbishment and turning around of ‘Void’ residential units in our area please. I’m aware that DCC ‘Void’ refurbishments are carried out by outside contractors however internal DCC management and administration of procurement and /or contracts is vital for these ‘Voids’ to be turned around in a speedy manner. I’m asking the manager to comment on what effect internal office staffing levels have had on the turnaround of ‘Void’ properties please and would an increase in administration staff help with our backlog. Also have the staffing levels in the turnaround administration of ‘Void’ properties been increased in the last 12 months and could I have staffing figures for same please.

That the Manager refer to playground in St. Annes’ Park and say when any renewal of the surface will take place as parents of toddlers say there is a need for re-surfacing work to be carried out in the children’s playground area and also if he can outline future plans for the provision of a specific play area for very young children.

A special Joint meeting of the Central Area Committee and North Central Area Committee members was held on 8th September, 2015 at 12 noon

Item 1: To initiate the public consultation phase of the proposed Cycle Route from Clontarf to City Centre. ORDER: It was agreed to initiate the public consultation phase of the proposed Cycle Route from Clontarf to City Centre with the following amendments. (a) That any reference to the removal of Fairview Bridge is taken out of the report. (b) That the proposed new pedestrian crossing at the junction of Fairview Strand and the Malahide Road is not activated until further consultation with the Councillors.

North Housing crisis community

We have asked could we come here today to have the voices of the families and individuals that are effected by the housing crisis be heard. We understand and have sent many families to the councillors that sit within the council. We feel that these families and individuals cases are only heard on an individual bases and that nothing is being done for all effected by the crisis due to lack of information and access to services to help protect and reduce the risk of homelessness. We feel that our community needs to understand the 2020 social housing policy in a language that is easy to understand and made easily available. DCC might have to follow government policy to deliver the service they are employed to do and that the responsibility lies with DCC to ensure that everyone knows exactly what is available. The following topics are the ones that create the most uncertainty and with children becoming more vulnerable to the lack of housing this is why we need answers. The questions put forward are ones that have come out of a community public meeting and from a support group that we offer on a weekly basis.

You are the experts and have the knowledge that we feel is not being passed into our community. It appears that everyone is being told different information. This is unsettling due to the fact that nobody understands how DCC works and what they should expect from the services. This includes other community services that we have linked in to that also help many vulnerable families that are affected by the recession and poverty. As each of you are employed to deliver a better service to improve society we try not to blame those that work here but the system and policy that has failed. With not much input from those affected in any policies it is clear that the 2020 social housing strategy will also have the same problems. We feel that it is important to have the input from the community on what is needed in order to provide a good relationship and service that protects the most vulnerable.

It appears that no one wants to take responsibility for those that have slipped through the system. We met with Dick Brady earlier this year and he tried to reassure us the system was perfect. This is obviously not the case as we would not be standing here today. We believe that DCC needs to build there community relations so that the families effected can move on to a better standard of living. Children’s rights are being ignored; they are at risk of future mental health issues and social exclusion. We at NDB just want to ensure that all voices are heard and that the solutions put forward will benefit everyone. We understand that housing is a bigger issue with different elements that cannot be solved at council level. We have a set of demands that should be implemented and agreed on so together we can help ease the burden on these families and individuals.

Demands

Government and DCC must declare a housing homeless emergency NOW

No Evictions 1. No Economic evictions. Families and individuals in their primary residences are they social, private rental or owned property should not face eviction. Housing based on Need

2. All housing should be of a quality and affordability so that all can access it and live with dignity and decency

3. Housing provision should shift away from the market towards state, social, community and non-market based provision

4. Social Housing should be built immediate to accommodate need

5. Vacant property should be turned over based on need

6. NAMA properties should be immediate turned over to provide homes and community and public spaces and facilities Tenants Protection

7. Tenants Protection. Rent Controls should immediately be implemented 9

8. Tenants Protection. Tenants should have security of tenancy, no probation and secure and quality conditions as right.

9. Tenants Protection. Landlords should not be able to reject rent allowance, housing assistant payment or any other rent support.

10. Tenants Protection. A Tenants Union should not only be recognized but actively encouraged as a means of protecting and organizing tenants.

Squatting Rights 11. Squatting Rights. When spaces have been empty for 6months that there is a right to reclaim them for housing and community use.

12. Squatting Rights. When reclaimed homes and space have been put to use for 3 years they should owed by those who have lived and worked them

Homelessness 13. Homelessness. Homeless support funding should be increased and homeless support services should be an immediate right not an emergency last hope

14. Homelessness. Homelessness support service should exist based on the needs of local areas and communities not centralised to large urban centers. Housing as part of the Community

15. Homes exist in a community. Therefore the provision of housing must be met with adequate and accessible community’s resources, education and health, community facilitates and spaces to live and enjoy recreation time. The needs of families and children should be particularly met along with those most vulnerable in society.

There are many questions that are being raised and we hope that by building a relationship with the council that many can be answered that way we can ensure that all families and individuals have the right information, access to the education and supports they might need to understand how they can improve there housing situation. A home is very important for the development of our children and for those that need to interact back into society after the last couple of years of recession. People deserve answers and we hope that many will be answered without just being referred to the 2020 social housing strategy.

2020 Social housing policy

•Privatisation of social housing needs to be publically announced so those effected are aware of the new HAP scheme and the way it will work when are DCC planning on informing the public •6,000 units delivered each year how many in Dublin Bay North? •Who will be delivering these units and will the original PPP system be used •Will those developers that helped create our first bust be re-employed via DCC? •Have DCC engaged with any local builders and construction workers to get a quote for the future build of these units? •When will this process actually start and how long will the tender be open for? What percentage will go towards social housing and can the developer buy out? •Will these units be under the HAP scheme or ear marked as social housing and who will be eligible? •What sites of land will be used? •Have DCC approached NAMA for some of there land? •When will those on the housing lists be informed of the new social housing plan? •Why did DCC refuse NAMA properties and say that the social class would be too much within one community? Affordable homes could have been allocated with the rejected properties? Once HAP has come into effect are tenants to be removed from housing list and put onto a transfer list? If so can you please clarify how this transfer list will work and will all landlords allow a transfer? What will be the procedure for the landlord to allow a transfer? Once you are housed under the HAP scheme and DCC is the housing body can a tenant take the land lord to the PRTB? Or how will the complaints procedure work? (Due to the lack of conditions, standards and regulations how is a tenant protected?)

Voluntary Housing •Understanding the 2020 policy voluntary housing will play a big part how many units will be available via housing associations in 2016 10

•Those with a criminal record are often refused what is the options available and supports that can be offered in helping allocate accommodation •Will the 50 % going to homeless still be in effect? •When are Voluntary associations going to be included in the PRTB • Voids •Not many voids in North Dublin Bay when will these be re opened and put back to use •How much will it cost to get all voids back in use? •Priory Hall : when will these units be available and how many are going to social housing( including affordable homes) •Voids around the country should be made available to those that want to move county ( there are many families willing to move today )

Renting •Serious problem in private sector in relation to tenant protections and that includes disputes with DCC properties (DCC & VH not in PRTB) •Threshold does not represent all cases in PRTB leaving vulnerable tenants in a legal battle with no supports / representation •Raising Rents pushing those who are employed into the emergency accommodation •Repossessions pushing homeowners back into rented sector •Demand of emergency accommodation cannot be calculated on day of homelessness new system needs to be applied Sofa Surfing •Over crowding and sofa surfing is because of lack of supply in private sector and social housing •How many families , individuals and children are counted as Sofa Surfing in DBN •How many families and individuals are counted as in over crowded situations? •What advice does DCC give those that are over crowded and must seek emergency accommodation as they are not allowed go on the floor of a home over crowded •Will over crowding and sofa surfing become a priority just like the homeless list? •Those on the ordinary lists are mainly stuck on rent allowance we are aware this is a dept of social protection issue with the restrictions that keeps families trapped and are at risk of homelessness ever become a priority . These families deserve to be able to return to work and generate an income many of these families are years on the waiting lists is the roll out of HAP the only option for them ? •The 6 month rule that you can only access Rent allowance after 6 months on the housing list needs to be lifted this is stopping families from leaving Dublin to find a better life in another county. The fear also that once you leave Dublin housing lists you will not be able to move back once again unless you have 6 months cash in your back pocket to rent. •Rural resettlement options need to be made available •If all councils are just implementing government policy why are there different rules in different counties?

Emergency Accommodation

•Only registering on day of homelessness how is this effective? •Projection are done on the previous months homelessness without taking into account those that are at risk of loosing there homes including the repossessions of many family homes. It is clear the courts have delayed these until the after the elections therefore how will DCC be able to accommodate as many are not included in the projections to date? •Self accommodation now hotels are refusing DCC card (Clayton/Metro) are examples of hotels that say they will have rooms but the mobile says different •Information on EA available and how to access it is not easily accessible •Need for homeless unit within the community of DBN •Free Phone number does not give name of who you are talking to why is this? •Free Phone number we were told is also an advice line for those at risk of homelessness why are some families not advised on how to save there home ( we have rang and not once told to check with threshold just to present ourselves on the day of homelessness) 11

•Some of the families have been informed that they will be housed within 8 months to a year once they enter emergency accommodation why is this timeline been given as this could generate more homeless families that feel it’s the only option to go if they will get housed quicker then especially if on the housing lists over 10 years and those on the list not as long skipping those that abide by the rules and restrictions of rent allowance?

Modular Units •Pros •Very attractive •Allows families to have access to facilities •Privacy •Sense of a normal Life • •Cons •Cost effective maintenance , pipes( water gas electricity) •Length of stay in the unit (6 Months)? where will families move into after this period if social housing is to be privatised and only 44 landlords have signed up in DCC for HAP •Locations especially in areas that are already socially disadvantaged the true public acceptance will only be seen in built up areas that would be seen as more advantaged including Artane , Beaumont, Clontarf as example • These ear marked only for hotels not sofa surfing/ over crowding •Stigma attached to units •Social division 2nd class housing •Not short term will actually be long term •Replace social housing

We need a public debate on these units it should be a community acceptance it should not just be the council who decides where these units are placed and all views should be respected.

What we need from DCC

•Information to be published and easily accessed via pamphlet / updated website with all different services and contact numbers for all situations that are putting families at risk of homelessness •Homeless liaison officer in the community so families can gather information before the day they are to be homeless •Build a better relationship with the council so the families in our community trust and can rely on the right information and services to be supplied •Answers to all the questions put forward if these cannot be answered then clearly there is no truth being told. For a community to have so many questions and not be able to access the information then we really believe we have a deeper problem.

Report on illegal encampment in Belcamp Lane / Newtown Court

Status as of Previous Report dated 15th June 2015:

”DCC put legal proceedings on hold to allow the Chair of the LTACC engage with all parties to try to agree a solution that would be acceptable to all parties. We acknowledge and welcome the considerable effort by the LTACC Chair, Councillors, Residents of Newtown Court and Traveller representatives but in the absence of an agreed solution, the issue has been referred back to the Law Agent.”

Current Status:

As the Housing Department has no further update from the previous meeting, there will not be a representative from the Housing Department on this occasion but an update of progress will be provided to the Area Manager as received from the Law Department and a representative of the Traveller Accommodation Unit can attend as required at NCA meetings. The Law Department is in regular contact with regard to this case and will keep the Housing Department and Area Manager advised of progress.

The area relating to the above is subject to statutory ,contractual and administrative procedures and as such, at this time it is not possible to furnish further details in relation to the possible resolution of same .The background information relates to copious history in relation to use and access to these lands and involves a number of residents . The City Council has noted all interests in relation to the area of dispute ,and will use whatever means within its disposal to make efforts to resolve the above. It may be possible at a later date, with successful resolution of the above to furnish the Council with a detailed report . Correspondence relating to the legal framework relating to these lands, is as always subject to confidentiality between the Council and parties involved.

The following draft proposals for car parking and access to the North Bull Island were put on public display in the Red Stables St Anne’s Park on the 18th July 2015 with a request that comments be forwarded to [email protected]

The Presentation and options displayed were as follows:

‘Informal parking has always been permitted to both sides of the Causeway road. The effect of this is that cars have parked parallel to both sides of the road for the entire length of the Causeway. In addition, parking was permitted on the beach with access to designated parking areas via roadways off the roundabout at the end of the Causeway Road.

There were issues with this arrangement not the least of which was cars getting stuck in the sand and requiring Council assistance to extract their vehicles from the beach. In times of peak demand during high season when large numbers attended the beach, traffic jams ensued with the result that there were extended delays for people trying both to access and leave the beach by car.

A survey of the car parking capacity when cars were allowed to park on the beach was carried out which found that in the order of 798 could be accommodated at peak period both on the Causeway and beach (this excludes the access from the North Bull wall)

A number of options have been considered to accommodate such a peak level of parking, to regularise traffic movement and to provide safe and comfortable access to the beach for people on foot and of all abilities. These options also consider disabled access to the beach, access for emergency vehicles, disabled parking and improvements in the vicinity of the set down area including seating.

Option 1 – Linemarking with some Perpendicular Parking This option would allow for cars to park on the Causeway as they do at present but with road markings to optimise the number of spaces. In addition it would utilise the road surface at the section closest to Raheny where the Causeway is at its widest to accommodate some perpendicular parking ‘nose to kerb’ on one side. The potential car parking capacity in this layout would provide for 506 spaces including disabled.

Option 2 – Perpendicular parking to one side of Causeway Road In order to achieve perpendicular parking on one side of the roadway some of the roadside berm would need to be incorporated into the parking bays. This option would provide for 654 car spaces in total including disabled spaces.

Option 3 – Perpendicular parking to both sides of Causeway Road For Option 3, some of the berm from each side of the existing roadway would need to be incorporated to allow perpendicular parking ‘nose to kerb’ to both sides of the Causeway road. This would provide for in the order of 879 spaces, almost 100 more than the potential capacity when cars were permitted onto the beach.

Option 4 –Diagonal parking to both sides of Causeway Road.

1 It should be noted that, although the survey of existing parking practices recorded 23 no. vehicles using the roundabout for parking, this is poor practice in terms of current road safety design standards and it is proposed to discontinue this practice. 15

This option is a variation on Option 3 with the difference being that the perpendicular parking spaces to both sides of the roadway are changed to be diagonal parking spaces. This results in a loss of car spaces but it would facilitate easier parking and traffic movement.

We have also allowed for some disabled parking on the access road to the beach (adjacent to the interpretive centre).

It is considered that that Option 4 is the most reasonable option in terms of accommodating the peak number of cars, minimising traffic hazard and minimising impact on the island. Set down spaces are provided at the roundabout to allow people to be dropped before the driver parks the car at some location on Causeway Road. It is proposed to design a number of improvements into the area between the interpretive centre and the set down such as seating, a playground and tearooms at the ground floor of the interpretive centre to cater for the seasonal demand for refreshments. The public toilets will also be up-graded. A seasonal transport system such as that being trialled at present on the Causeway could also be part of an integrated traffic management plan for the future.

A core objective in any works to provide for car parking would be to remove the tar macadam road surface where parking bays are to be located and these areas would be surfaced in stone or a polypropylene grid in filled with sand to allow indigenous grasses to re-establish. This type of car park surface has successfully been used at Airfield, Dundrum; Farmleigh and Malahide Castle and it would allow the natural vegetation of the island to colonise parking bays which are only in seasonal demand.

A shared cycle and pedestrian pavement is also indicated on the drawing to link from the greenway under construction on the Howth road to the beach. Bicycle stands will be put in place to accommodate bicycles in the vicinity of the interpretive centre.’

Review

A clearly-marked system for parking of vehicles is needed in the interests of public safety and to conserve protected habitats of European importance while continuing to provide for enjoyment of the beach and the National Nature Reserve and National Special AmenityArea.

The parking arrangements in the past had included parking on the access road to the beach. This proved to be too onerous to manage, with many users refusing to comply with restrictions to maintain an emergency vehicle lane on one side. At peak times, this was a safety risk to all beach users, and we are not proposing any public parking here other than those with disabled parking permits clearly displayed. Furthermore, parking along the access road, roundabout and beach has caused encroachment of cars into the sand dunes complex, which DCC is legally obliged to protect from erosion.

The presentation was on display for nearly 3 months and the narrative was circulated to each Area Councillor . There were 12 responses, 5 of which were negative. Interestingly, none of the five addressed or commented on the proposals on display but wanted a return to parking on the beach. However, as stated above, this is not best practice and may incur liabilities for DCC both in terms of public safety and nature conservation requirements.

The other comments were positive with additional ideas on how the parking proposals could be further improved. These are being considered further by traffic management consultants. The consultants have been requested to increase the provision for disabled and elderly car parking close to the beach and in proximity to the interpretive centre where the toilets and rest facilities will be upgraded. This will be a significant improvement where, prior to 2014, no designated parking facilities for disabled users were provided at North Bull Island.

The replacement of the existing tarmacadam surface is another major improvement as it will:  Provide for improved drainage and safer surfaces  Attenuate road run-off to protect water quality of the environs of the beaches and the EU Special Protection Area for Birds  Improve the visual appearance of the entrance to the National Special Amenity Area  Provide a more pleasant walking environment for recreational visitors to the Island

This will fulfil policies of the current DCC Development Plan to provide for sustainable urban drainage systems.

A proposal for traffic management and parking for the North Bull Wall end of Dollymount beach is being prepared. This site is more constrained, as there are European designated habitats adjacent which are vulnerable to visitor impacts and which are subject to conservation management plans prepared by the National Parks and Wildlife Service. It is intended to provide some capacity for parking of vehicles in a sensitive manner with disabled and elderly car parking close to the toilets, subject to compliance with European legislation. A proposed boardwalk is being considered in order to improve access to the beach from the parking zone while minimising erosion of protected habitats. This layout will be further discussed with the Royal Dublin Golf Club, who have already been consulted on the matter.

All of the above proposals require detailed design and will be subject to a Part 8 planning consultation and Appropriate Assessment under the European Union Birds and Habitats Directives with a view to phased implementation commencing in 2016.

 20th & 21st October, Hell-Fire night time walks: As part of the Halloween build up a number of night time walks have been organised for the young teenage groups in Donnycarney.  6th Nov: Darndale Late Night League will start in Darndale Hall every Friday 8pm – 10pm for 5 weeks. This will lead to the Dublin finals on the 11th of December. Partners in this are Jason Brady, Community Gardaí and Youth Projects.  Tuesdays from 3 – 4pm: Over 55s Aqua at Coolock Pool, €2. Aqua aerobics and swimming to music for Senior Citizens.  Wednesdays at 10.30am: Over 55s Yoga at Donneycarney Active Retirement Centre, €2. Slow controlled movements designed to aid circulation and improve posture and muscle tone.  Wednesdays at 3.30pm: Under 10s Afterschool Sports Programme at Kilbarrack Community Development Project, no cost. Hand eye co ordination games for primary school children.  Thursdays at 5.30pm: Adults Fitness Classes at Glinn Sports Centre, €4. Circuit style class for men and women led by a qualified Instructor.  Halloween / mid-term activities: Working in partnership with Kilbarrack Youth Project a teenage group will be travelling to Belfast, another to Roscommon and another group will take part in a mountain bike trip in Blessington.  School visits to both Secondary and Primary schools by Cricket Development Officer – the main areas being targeted in October/November are Coolock, Kilbarrack, Drumcondra and Darndale.  New cricket program on Fridays from 12 – 2pm in OLI school, Darndale.  Mothers Group: This is a new group of women from Donnycarney who are interested in increasing their physical fitness and wellbeing through organised indoor and outdoor activities. The group will be utilizing the local parks, outdoor gym equipment and taking part in organised fitness classes and activities. This group will meet on Thursday mornings.  School Completion Programme: Started 30th September and takes place every Wednesday from 10am – 2.30pm for the next six weeks in the Oscar Traynor. Currently aimed at boys in 5th and 6th class who are having difficulties in school. It encourages the boys to be more confident, improve self-esteem and create awareness around bullying and involves a classroom session during the day based on these topics with an SCP Teacher.  KCDP outdoor activity programme: Every Friday afternoon 12 young people aged 9 – 12 years engage in outdoor activities in their local environment, e.g. Playgrounds, local parks, beaches etc.  Tag Rugby programme at St Mary’s NS, Marino with 5th and 6th class girls, St Brigid’s NS, Artane, starting with 3rd, 4th, 5th and 6th classes and with North Bay NS, Kilbarrack. This will be followed up with a Primary school blitz with other participating schools in the city.  1st and 2nd year Rugby programme at St Josephs, Fairview. This will lead into entry of U15 team into DCC Cup at U15 level which will take place over November, December and January.  U14 team from St Paul’s College, Raheny to play in Aviva Blitz. Team made up of non club players entered in Aviva Blitz with 32 schools from the four provinces who will have the opportunity to play a 15 aside game on main pitch in the Aviva Stadium. This is part of the IRFU RWC Impact initiative which aims to promote the game and help bridge players to clubs.

Naming & Numbering Proposal for development on a site at 59/60 Clontarf Road

This is a development by Clondev Properties Limited on a site at 59/60 Clontarf Road Clontarf, Dublin 3. The development will consist of 1 retail unit which will retain the address 59 Clontarf Road, 4 apartments in the same block as the retail unit which will be numbered Apt. 1,2,3, & 4, 59 Clontarf Road and finally 15 new houses which will be officially named and numbered 1-15 Churchfield, Clontarf Road, Clontarf, Dublin 3. The development is indicated on the attached Drawing R.M. 36475B

The developer has requested the name and numbers 1-15 Churchfield for the new housing development due to the historic link between the local church (St. Anthony's) and the surrounding properties which were originally in agricultural fields. The original St Anthony’s Church fronting on to the Clontarf Road was built in the 1800’s as a community hall and in 1925 became a Roman Catholic Church. The St Anthony’s lands would have originally been part of the Vernon estate and in agricultural use historically. When developed in the 1800s the church property would have been located on much more extensive grounds than that seen today, to include the lands of the subject development, the lands of the new St Anthony's Church to the rear (1970’s) and the recreational centre further to the rear of the lands. Indeed additional lands were sold off for residential development in the past. Of the original lands there still remains the last remaining undeveloped field to the rear of St Anthony’s church (north of the subject site) which can be seen today and reflects the previous use of the lands. The developer believes that the proposed name reflects and pays tribute to the history of the lands in question. The Heritage Officer considers the proposed name appropriate

The name and numbers 1-15 Churchfield/ 1-15 Gort an Teampaill is considered suitable and is recommended for adoption.

An application has been received from Danielle Nolan to purchase a plot of ground to the rear of her property at No. 15 Brian Boru Street, Clontarf, Dublin 3. The plot of ground in question is shown coloured pink on Map Index No. SM- 2015-0808 and has an area of approx 58 sq m.

It is proposed to dispose of the City Council’s interest in the plot of ground to Danielle Nolan subject to the following terms and conditions:

1. The consideration shall be €1,000 (one thousand euro).

2. The purchaser shall be responsible for any costs involved in incorporating the plot into their garden.

3. The purchaser shall be responsible for her own legal costs in the matter and shall also pay approximately €500 (five hundred euro) plus VAT towards the Council’s costs.

4. The disposal is subject to receipt of the necessary statutory approvals and such terms and conditions as may be deemed appropriate by the Council’s Law Agent.

The dates for the performances of any of the requirements of the proposed agreement may be amended at the absolute discretion of the Executive Manager.

The disposal shall be subject to any such covenants and conditions as the Law Agent in his discretion shall stipulate.

No agreement enforceable at law is created or intended to be created until an exchange of contracts has taken place.

Firstly comhghairdeas to all involved in the commissioning the excellent sculpture in St. Annes Park. The work that went into the surrounding wall at the junction of the James Larking Road is a credit also. With this in mind the can the manager review the position of the grey power box / traffic light box that is on the path beside the wall and sculpture , it takes away from the over all visual aesthetics. I propose that it is reallocated to the far side of the road.

Reply:

There is a considerable cost related to moving this Traffic Controller Box on James Larkin Road. Dublin City Council Traffic Department do not have a budget to carry out this work at present. However, if funding is provided or becomes available we would be amenable to moving the Traffic Controller to facilitate the request.

We are looking at options to improve the appearance of the traffic box and to make it more aesthetically pleasing.

To ask the Area Manager whether or not DCC and/or DCC Parks where approached about the possibility of using parkland immediately inside the boundary of Fairview Park (carriageway side) for the Clontarf to Amiens St Cycleway project. If they were approached at the initial design stage of the project can I have a report on what talks took place between DCC and the project designers please and also the reasons why this space wasn’t included in the final design please? It would seem logical that an exploration / consideration of the use of this ‘park space’ would have taken place in order to create as much space as possible for the project and to help provide a cycleway which safely separates cyclists and motorists as much as possible as well as providing space for a much needed City BikeStation as well as a rest stop and /or other facilities. There are other environmental benefits this alternative route option may have brought to the project/area including the possibility of saving trees designated for destruction and further ‘opening up’ Fairview Park to the public by way of increased activity and passive security.

A “Concept Design and Option Selection Report” for the cycle route was undertaken by Roughan & O’Donovan Consulting Engineers in 2012. This report examined the existing route and cycle facilities and developed three options for improved cycle facilities. The existing cycle facilities along the route consisted mainly of shared use bus lanes and had a poor level of service due to the number of buses on this key route. The three cycle route options presented included: Option 1 – Retention of the cycle lanes on and provision of a two-way cycle track on the southbound side of North Strand Road to a two-way cycle track along the perimeter of Fairview Park Option 2 – Upgrade of the existing cycle lanes on each side of the road to cycle tracks where possible and filling in the gaps where no dedicated cycle facilities currently exist Option 3 – An alternative route via ‘back streets’ between Fairview Park and Strandville Avenue. The report examined each of these and concluded the following Quality of Service (QoS) could be achieved: Table 1 - QoS of Cycleway Options from “Concept Design and Option Selection Report” - Roughan O’Donovan 2012

Scheme Option QoS Description The existing cycle facilities are discontinuous and include sections of Do Nothing C shared use with buses along a busy traffic route. A combination of Option 1 two-way cycle track and a back street route, which provides a good degree of segregation but Option 3 C has a significant journey time delay as it is not along the main desire line and results is a longer route. Many cyclists would likely remain on North Strand Road.

The ranking is a 7 point scale, with +3 as highly positive, 0 as neutral and -3 as highly negative.

The report ranked all three Options the same in terms of environment and planning, economy, accessibility and social inclusion and integration. In terms of safety, Option 1 ranked the highest with a dedicated segregated cycle track and Option 3 the lowest, due to quiet back streets with low lighting and lacking in passive surveillance. In terms of integration, Option 1 was ranked higher than Option 2 and 3. Both Options 1 and 2 were considered to be consistent with the Dublin Cross City Premium Cycle Route and would be compatible with a proposed Cycleway. The report concluded that Option 1 would provide a better QoS.

Therefore, the report recommended Option 1, a two-way cycle track on the southbound side of the road from Clontarf Road to North Strand Road at the Five Lamps junction as the preferred option. That said, the report suggested that south of the Five Lamps along Amiens Street there would be little benefit in continuing the two- way cycle track and recommended the existing cycle lanes be retained.

In October 2013, DCC appointed RPS Consulting Engineers to carry out engineering consultancy services including Document Review, Preliminary Design, Statutory Planning Process, Public Consultation, Detailed Design, Tender Evaluation and Designer and PSDP duties for the scheme. Part of the Document Review phase included the completion of an Options Review and Feasibility Report. This report included a review to confirm if the preferred Option 1 was the best option for this particular scheme and could achieve the desired QoS. All options were considered in this review, as described below.

REVIEW OF OPTION 1 Option 1 proposed the retention of the cycle lanes on Amiens Street and provision of a two-way cycle track on the southbound side of North Strand Road to a two-way cycle track along the perimeter of Fairview Park.

On review of Option 1, it was found that the number of conflicts was greater and in the range of 1-3, rather than the range 0-1 as previously assessed. In line with the criteria as per the NTA National Cycle Manual, ‘the Number of conflicts is a measure of the potential interruptions to a cyclist per 100m and may include bus stops, side-roads, driveways, entrances, junctions etc.’ The number of conflicts can vary considerably along the route, depending on the direction of travel and the side of the carriageway. Therefore on review it was considered that the number of conflicts for the whole scheme would be closer to the range of 1-3 rather than 0-1 as previously suggested. Following this, Option 1 scored a revised QoS A/B, as shown in table 3 below.

Following the assessment of Option 1, a number of issues were identified. The main issues raised include: . Does the route provide the same QoS for both inbound and outbound cyclists? . The route caters for a high proportion of commuting cyclists. Will commuter cyclists be reluctant to use a cycle track on the opposite side to which they are travelling? . The ease with which cyclists access a two-way cycle track needs careful consideration in terms of safety and the avoidance of unacceptable delay or inconvenience. There will be a need for extensive facilities for cyclists to cross from other routes and make use of the two-way cycle track. Such facilities have the potential to cause undue delay to cyclists, particularly commuting cyclists and thus may deter them from using the 2-way route. 61

. A safety concern would be cyclists taking chances and crossing the live traffic lanes, outside of crossings, to get access to the two-way cycle track. The carriageway width is wide and varies between 13m to 19m. . There is potential conflict with emerging traffic from side roads and a two way cycle track, whereby the traffic is not prepared for cyclists coming from both directions and hence another safety issue, . Is connectivity and accessibility adequately served along the route for both inbound and outbound cyclists? . In accordance with the NTA National Cycle Manual 2011, segregated cycle tracks are generally not recommended: . Where there are obstacles, frequent entrances or junctions that will impair cycling momentum, . Where there is a strong demand for frequent local access and egress by cyclists, . At junctions, unless there are specific issues such as turning HGVs, The above issues raised concern regarding the functionality of the two-way cycle track. North Strand Road is a multi- functional urban environment with the key question being, does the proposed two-way cycle track function well in this particular environment? Following the assessment of the two-way cycle track and considering in particular the existing environment, bus routes, schools, residential area, business and commercial premises with significant pedestrian movements, sizeable junctions, frequent access, heavy traffic volumes, wide carriageway widths, it was concluded that a two-way segregated cycle track would not adequately function for commuting cyclists in this busy environment.

REVIEW OF OPTION 2 Option 2 was the proposal to upgrade the existing cycle lanes to cycle tracks where possible and fill in the gaps where no dedicated cycle facilities currently exist. The existing facilities along the route consist mostly of shared use bus lanes and in some sections there are advisory and mandatory cycle lanes.

Assessment of Option 2 agreed with the findings of the Concept Report, in terms of QoS. During the assessment of the Option 2 a number of issues were identified, the main issues raised include:

. The existing cycle facilities along the route are advisory cycle lanes and / or shared use bus lanes, . The widths of the existing cycle lanes vary along the route of the scheme and in some cases are below the absolute minimum width of 1.5m. The outbound cycle lane opposite Fairview Park is 1.25m in width and this is a cycle lane between parking and a bus lane. The inbound cycle lane is 1.0m in places adjacent to the park, . The existing cycle lanes are on road, except for Annesley Bridge and adjacent to Fairview Park. There is no physical delineation between the cycle lane and the bus lanes which can make the environment feel unsafe and less appealing to cyclists, . Between Amiens Street and Five Lamps on the inbound side of the carriageway there is a suggestion to relocate the cycle lane between the footway and the existing parking as the footway is wide at this location, this would lead to conflicts with pedestrians crossing cyclists, . Existing links between adjacent cycle routes/side roads and crossings are limited, . The existing cycle track/shared footway adjacent to Fairview Park is currently not used by cyclists due to conflicts with pedestrians; cyclists tend to stay on the road in the bus lane. . This review of Option 2 considered that the option could be developed further. The ‘upgrade’ of the existing cycle lanes could be developed to raised cycle lanes, with increases in widths and improved crossings and connectivity. This would greatly improve safety, comfort and the QoS for Option 2. In accordance with the NTA National Cycle Manual, a raised cycle lane is appropriate ‘Along collector roads with frequent entrances and driveways where in a shelf arrangement the cyclist is slightly lower than the footpath and slightly higher than road’. A raised cycle lane reinforces the position of the cyclist on the road and there is a physical separation between the cycle lane and the bus lane. The cycle lane will have to drop down and become on road at bus stops, junctions and crossings but can be continuous. It visually improves safety and is legally part of the road dedicated to

62 cyclists. The proposed kerb heights are usually between 25mm and 50mm. Therefore it would be recommended to introduce raised cycle lanes, where possible. Therefore, on review of Option 2, in line with the criteria as mentioned under review of Option 1, a revised QoS of A/B was presented. The table below presents the QoS as for Option 2 from the Concept Report and for a revised Option 2.

The pavement condition can be improved and so the ranking here remains the same for both Option 2s. The number of adjacent cyclists will increase for the revised Option 2 as the width is proposed to be maximised and allow for a single file cycling with overtaking. The number of conflicts varies considerably along the route and in each direction, however it is expected that the conflicts are the same for both Option 2s. It is considered however, that the journey time delay and HGV influences can be reduced for Revised Option 2. The reason being that cyclists will have priority at the junctions with the main traffic, there will be improved crossing facilities and linking of the traffic signals would be expected. During peak hours, cyclists can also travel more freely than general traffic. According to Google Maps, for this route the current journey time for a cyclist is 9 minutes. This equates to a speed of 16.67km/hr, with the average speed of a cyclist assumed to be between 15km/hr to 20km/hr, there is minimum delay currently and this can only be improved with improved facilities. Therefore, the journey time delay is reduced to between 11-25% from the previous 26-50%. For the HGV influence, cyclists will have a dedicated cycle lane, adjacent to a bus lane and be separated from live traffic and so the influence from HGVs is considered to reduce to 2-5% from the previous 6-10%, but is not considered to be as low as Option 1, ranked at 0-5%. Therefore, it is considered that the overall QoS achievable is for Revised Option 2 is greater than previously presented and scores an improved QoS A/B. Therefore, for Option 2 the QoS achievable is considered to be the same as that for Option 1. REVIEW OF OPTION 3 Option 3 is a proposal for an alternative route via ‘back streets’ between Fairview Park and Strandville Avenue, the figure overleaf shows the proposed route. As stated in the “Concept Stage Design and Options Selection Report”, there is a record of a high percentage of accidents involving cyclists and so it is known that pedestrians and cyclists are particularly vulnerable along the North Strand Road-Fairview route. Therefore, and in line with design recommendations an alternative ‘back streets’ route was explored to take cyclists away from the main route to try to improve comfort, directness and safety. The proposed route is to utilise the existing tracks within Fairview Park. The route leaves North Strand Road and turns south onto Strandville Avenue to Stoney Road, and onto before crossing an existing pedestrian bridge into Fairview Park and continues on existing tracks within the park before exiting the park and joining the existing Clontarf Road.

Review of this option agreed with the findings of the Concept Report, in terms of QoS. The report identified a number of issues with this option and the main issues include: . By utilising the existing tracks within the park, there are limited ‘back street’ options and locations to connect and join the main route, . Any proposed route is constrained by railway lines and crossing the and the Royal Canal, . The proposed streets, Strandville Avenue, Stoney Road and East Wall Road are narrow quiet residential streets. There would be need for improvements to pavement, lighting, signage and passive surveillance, . The existing underbridge for the railway line on Strandville Avenue has restricted headroom and would need to be increased to be a feasible option for cyclists, . The existing pedestrian bridge over the River Tolka is 2m wide and would need to be widened for shared use between pedestrians and cyclists, . The park is poorly lit and safety is an issue, . The tracks within the park would need to be upgraded and access and connection points improved, . Fairview Park closes at night-time and as such a significant part of the route will be inaccessible at such times. . The route is longer in length when compared to the main route, . Does the route provide the same QoS for both southbound and northbound cyclists? It is concluded that Option 3 provides a good degree of separation but has significant journey time increase and is not considered to be along the desire line of the route. It is considered then that many cyclists would more than likely stay on North Strand Road, particularly commuting cyclists. Therefore Option 3 is discounted from further consideration.

APPRAISAL OF OPTIONS The 3 Options were re-appraised. The appraisal is based on the Department of Transport Project Appraisal Balance Sheet and as per the NTA Project Appraisal Guidelines. The assessment is of the route as a whole. All road users were considered and not cyclists alone. The five criteria for the appraisal included Environment, Economy, Safety, Accessibility and Integration. 64

Environment An overview of the environmental impacts of the 3 Options was undertaken. Firstly, the route corridor is an existing transportation corridor and the works will be an alteration to this existing transportation route. Therefore in terms of air quality, noise, architectural and archaeological heritage, soils and geology, hydrology and hydrogeology, the impacts are considered to be minimal and similar for all 3 Options. In terms of biodiversity or the natural environment and landscape and visual, an impact is expected to the existing trees and to Fairview Park. The impact is considered to be similar for all 3 Options and to be slightly negative. To mitigate against a negative impact, a landscape plan and public realm proposals are proposed to be developed for the preferred route.

Economy The economic assessment is considered to be the relative welfare gain of the overall scheme. The scheme will improve cycle and pedestrian facilities, encouraging a shift towards sustainable transport and offers regeneration to the area. Therefore the scheme is positive in terms of welfare gain and equal for all 3 Options Safety The safety assessment is considered in terms of the possible reduction in accidents and security of road users. The scheme will improve cycle and pedestrian facilities, aims to reduce traffic speeds and encourage a shift towards more sustainable transport. Therefore the scheme is positive in terms of safety. Option 2 is considered the safer option, Option 1 will be positive but lower compared to Option 2 as cyclists will need to cross the carriageway to access/egress the two-way cycle track more compared to the two by one-way cycle lanes. Also Option 1 has the additional cyclist safety risk at side road conflicts due to the unexpected contra-flow cyclist movement. Option 3 is considered the lowest in terms of safety due the poor security by the quiet back streets. Accessibility and Social Inclusion Accessibility and social inclusion is measured on the improvement of accessibility to employment, education and essential services and amenities. Overall the scheme will be improving cycling and pedestrian facilities and to an extent will regenerate the area. Therefore the assessment concludes that all 3 Options will have a similar and equally positive impact in terms of accessibility and social inclusion. Integration The integration assessment is based on transportation, land use and geographical integration. The proposed scheme is aligned with current Transportation Policy in Dublin City as described in the NTA Draft Transport Strategy for the Greater Dublin Area 2011 – 2030. Overall the scheme will transport efficiency for cyclists on this very important corridor and it will improve connectivity between transport modes, support sustainable transport and connectivity to cycle routes such as the Clontarf Seafront, the Royal Canal, and Alfie Byrne Road. The scheme takes cognisance of the Dublin Development Plan and local environmental improvement plans (Fairview Marino). The assessment concludes that all Options rank positively in terms of integration, Options 1 and 2 are considered higher as they follow the existing route corridor and integrate better with existing Transportation Plans and Policy compared to Option 3, the quiet back streets option. Option 2 is ranked slightly higher than Option 1 as it caters better for outbound commuter cyclists by providing facilities on the outbound carriageway which is a bit more natural and expected for these cyclists.

In terms of safety, Option 2 is considered higher as it caters for cyclists on both sides of the carriageway. In terms of integration, Option 1 and 2 ranked higher than Option 3. The table above shows that all options are ranked positively. Option 2 the highest out of the three options.

CONCLUSIONS OF REVIEW OF CONCEPT STAGE DESIGN REPORT

It would appear that both Option 1, a proposed two-way cycle track and Option 2, upgrade of the existing cycle lanes on each side of the road, would provide a much improved QoS, ranking between A and B. However, Option 1 is unlikely to adequately function for commuting cyclists for this cycle route. The appraisal, under the criteria of environment, economy, safety, accessibility and social inclusion and integration, ranked all options positively with Option 2 ranking the highest.

Therefore, following the review of the concept design stage, Option 2, upgrade of the existing cycle lanes on each side of the road, is emerging as the preferred option. The feasibility cost estimates previously prepared for Option 1 and 2 indicate that the difference in cost between these options would be negligible, with less than 3% of a difference. Therefore, these options are considered to be similar in terms of cost. The feasible cost estimate for the emerging preferred route is examined later in this report. It should be noted, that the implementation of any new cycle facilities along the route will have significant impacts on the existing road and infrastructure, primarily due to the urban environment and the availability of space. Prior to assessing the impacts of a preferred route, a route assessment is carried out, this is in order to identify the ideal scenario, as per the current design standards, and to establish the possible achievable scenario, taking into account constraints, existing bridges and so forth. The next section of this report presents an assessment of the route for the emerging preferred option, upgrading the existing cycle lanes. The ideal and achievable cross sections along each section of the route are presented. Following this assessment the main constraints and impacts are identified, these are explored for Option 1 and Option 2, for comparison purposes and to highlight the impacts for both options will be significant but are similar overall.

To ask the Area Manager for a report on the refurbishment and turning around of ‘Void’ residential units in our area please. I’m aware that DCC ‘Void’ refurbishments are carried out by outside contractors however internal DCC management and administration of procurement and /or contracts is vital for these ‘Voids’ to be turned around in a speedy manner. I’m asking the manager to comment on what effect internal office staffing levels have had on the turnaround of ‘Void’ properties please and would an increase in administration staff help with our backlog. Also have the staffing levels in the turnaround administration of ‘Void’ properties been increased in the last 12 months and could I have staffing figures for same please.

Reply:

In 2013, 79 units were turned around in the North Central Area at a cost of €1.58m. In 2014, 63 units were turned around in the North Central Area at a cost of €1.06m. To date in 2015, 53 units have been turned around in this area at a cost of €1.32m and refurbishment work is in progress on 22 units which will be completed and available for letting by late November. A further 17 units have been identified for refurbishment and task orders will be issued for these in due course. Internal staffing levels are both adequate and efficient, and have assured that these works have been completed in a timely manner.

Reply:

The surface of the play ground is a loose engineered wood fibre and meets all safety requirements of the latest safety audit. The railed area of the playground is for younger children. Older children are catered for outside the railed playground to this end a Zip line and Climbing net and Rope Swing have been provided. It is not the intention of this Service to further segregate the original railed area any further.

1.Public Lighting Services took the existing public lights in (details supplied) in charge in October 2013 and took over the maintenance of these lights at that time.

When the lights were taken in charge, the provision of additional lighting at the (details supplied) Road end was considered for inclusion in the 2014 public lighting improvements programme, but unfortunately, due to the lack of available finances, there has been no public lighting improvements programme in 2014 or in 2015.

The provision of additional lighting in (details supplied) will be considered for inclusion on a future public lighting improvements programme, subject to the necessary finances being made available.

The weed spraying programme has been completed in this area.

The (details supplied) Scheme is now closed. This scheme originally involved 51 apartments in Herberton, Parkview and Prospect Hill which were let to prospective purchasers for a three year period with an option to buy thereafter with the rent they paid over the three year period being deducted from the sale price. These apartments had remained unsold under the Affordable Scheme and were available for offer under the (details supplied) Scheme. They were allocated in late 2010 and early 2011. The three year rental period has since ended in all cases and a number of sales have since being completed – all in Herberton.

The scheme proved popular but it is not envisaged that it will be repeated as there will be no apartments or houses available for letting and sale for the foreseeable future.

The proposed method of closure is by means of a rendered block wall at each end. There is a 300mm pipeline and a manhole located within the underpass.

The Developer has given a commitment that a 900mm steel door will be included in the reinforced concrete wall to which Drainage and Waste Water Division will be given a key in order to facilitate access. It is intended that the ramp to the underpass from Northside Shopping Centre car park will be demolished and backfilled and the area resurfaced and marked out as access road and car parking .

Due to increases in tide levels and a slight reduction in the wave height associated with the estimated 200 year tide level further computer modelling has been commissioned by Dublin City Council. This extra modelling incorporates wave over topping modelling of the existing sea wall on the (details supplied) Promenade and modelling of the filling up of the promenade in an extreme tidal flood event.

These further computer simulations will estimate the required proposed heights of proposed new flood walls for further discussion.

The programme for delivery of these further model runs and assessment of the outcomes of them is late February 2016.

The proper Part VIII consultation procedures were followed. The proposed scheme was advertised on the Dublin City Council website and also in the Irish Times on Friday 14th December 2012. A total of 14 site notices were erected at key locations from just south of Wooden Bridge to just north of Causeway Road including at all major traffic junctions along that route.

Plans and particulars of the proposed scheme were available for public inspection for a six week period up to and including Monday 4th February 2013 at the following locations and times: 1. Dublin City Council, Public Counter, Planning Department, Block 4, Ground Floor, Civic Offices, Wood Quay, Dublin 8, Monday-Friday 9.00am-4.30pm. 2. Raheny Library, Howth Road, Dublin 5 between the hours of 10.00am-8.00pm Monday to Thursday, and 10.00am-5.00pm on Friday and Saturday.

The proposal was presented to the North Central Area Committee on 17th September 2012 and on 19th November 2012. A public information meeting was held on Tuesday 15th January at 7.30 p.m. in Belgrove Girls School Hall, Seafield Road. This meeting was hosted by the Clontarf Residents Association and was attended by circa 180 people. A follow-up meeting was also held at 3pm on Friday 10th May 2013 in Conference Room 2, Northside Civic Centre, Bunratty Road, Coolock, Dublin 17. The NTA and their project consultants Roughan & O’Donovan were present and dealt with any additional or new queries that had not been addressed in the already comprehensive consultation process.

Planning approval was granted on Monday 13th May 2013.

Speed ramps have been provided on (details supplied) to combat speeding, they have been located in the optimum position with regard to reducing speeds to 50k/hr or less. The ramps have been positioned in accordance with current best practice. The factors taken into consideration in locating ramps include, spacing between ramps, street lighting, location of driveways and proximity of junctions. Ramps are spaced about 80 to 100 metres apart, the profile resulting in more even speeds of 35 – 42 kph along the road, and less braking and acceleration, thereby reducing noise levels in built up areas.

With regard to rat running, the provision of turn bans would be the normal measure to prevent this, however a turn ban in this instance would cause undue inconvenience with regard to access for local residents and adverse conditions where traffic is rerouted.

Under the Control of Dogs Act, dogs are required to be on a lead at all times at North Bull Island. When dogs are found to be off leads on the Island staff will inform and instruct dog owners to put their animals back on leads. However if the dog owners do not comply, Parks staff where it is considered appropriate, advise the Gardaí. Dog wardens call into the North Bull Island and adjoining St. Anne’s Park on their rota of visits and interact with the public to remind dog owners of their responsibilities. However as the level of resources available for the Dog Warden Service is limited, their attendance at the island is not at a frequency that that is desirable. Parks and Landscape Services is currently consulting with other stakeholder departments of Dublin City Council to compile develop a broad dog management plan to address and recognise the use of the public domain and public open space by dog owners and their dogs and to develop a more responsible approach by dog owners to that activity.

At this meeting the plans for the 2 into 1 redevelopment were outlined and the architect responsible for the design/development answered queries. Queries with regard to the allocations process were taken back to Housing Development for consideration. At the September 2015 Area Committee Meeting the proposed allocations process was outlined to the Committee. The Councillors made some comments and alternative proposals at this meeting which were to be brought back to Housing Management for further consideration. Until these proposals are reviewed, it would be inappropriate to meet residents again to discuss them. Under the Planning and Development Regulations, 2001, planning permission is required for the creation of, widening of a vehicular access to a domestic dwelling. A copy of the grant of planning permission should be submitted with any request for a dishing.

However, where no planning permission exists and the new entrance has clearly been in existence for a long time it will be necessary for you to prove by sworn affidavit that the entrance has been in use as a vehicular access for a period of seven years. The Council’s parking enforcement contractor, Dublin Street Parking Services (DSPS) cannot prevent motorists residing in the (details supplied) development parking on (details supplied) Crescent as there are no paid parking controls on (details supplied) Crescent. DSPS have patrolled the location on the 5th, 7th and 9th October and issued two warning notices where parked vehicles may have been endangering other traffic. The location will continue to be monitored and enforced as necessary. From an enforcement point of view the only solution would be either installing double yellow lines or introducing a residential parking scheme on the Crescent.

The Traffic Advisory Group, at its meeting of 25th February, 2014, reported that (details supplied) has been traffic calmed with a series of speed ramps and mini-roundabouts. The ramps have been located in the optimum position with regard to reducing speeds to 50km/h or less, and have been positioned in accordance with current best practice. The factors taken into consideration in locating ramps include spacing between ramps, street lighting, location of driveways and proximity of junctions. Ramps are spaced about 80 to 100 metres apart, the profile resulting in more even speeds of 35 – 42 km/h along the road, and less braking and acceleration, thereby reducing noise levels in built up areas. The provision of further measures would be outside the scope of best practice and are therefore not recommended.

1. The Traffic Advisory Group at its meeting of 24th October, 2013, did not recommend a Children Crossing sign on (details supplied) Grove as a Children Crossing sign has been provided at the junction of (details supplied) Road and Grange Road which is the entrance to a housing estate from a main traffic route. The existing sign is sufficient to cover (details supplied) Grove.

2. The criteria used to determine the need for traffic calming measures are as follows:  The road should have a straight run of approximately 200 metres.  The 85th percentile speed (speed exceeded by 15% of vehicles) should exceed 50km/h.  Traffic volumes should exceed 60 vehicles per hour.  There should be genuine road safety concerns based on accident statistics or observed road safety patterns or a written report from an Inspector in the Garda Traffic Division, Dublin Castle, relating to an issue of safety.

The Traffic Advisory Group, at its meeting of 21st March, 2013, reported that speed checks carried out on 27th February, 2013 showed that the 85th percentile speed was 28km/h, which is below the warrant required.

The Area Traffic Engineer has advised also that (details supplied) Grove would not meet the criteria for speed ramps due to the short stretches of road involved, which do not involve a straight run of approximately 200 metres.

We have no plans to install additional lighting in this park at present.

Following a request from the developer or the majority of the residents in a development the process of taking a development in charge commences. This will involve an inspection of the services listed above to ensure that they have been completed to the required standard. In the event that remedial work is required to bring the services up to the required standards then the security bond is invoked. Currently there are bonds in place in respect of the permissions granted for the development completed to date. It will be possible to use the bonds on hand to complete any remedial work that may be required to the value of those bonds.

Parks and Landscape Services staff carry out daily cleaning of the park including the playground areas and the play equipment is also examined daily. A weekly written checklist of the play equipment is completed. When the park is opened every day the park is checked and any litter removed based on available staff resources.

The grass areas and playing pitches are mown on a weekly basis during the growing season. Flower beds are maintained and seasonal flower bedding displays are changed twice yearly. Trees are maintained and replanted as necessary. This service also interacts with various infrastructural projects when such works are taking place in the park to minimise impacts by condition and supervision on the parks facilities for the duration of the presence of such projects. The current such project at this park is the North Arterial Water Main project.

Under the Planning and Development Regulations, 2001, planning permission is required for the creation of, widening of a vehicular access to a domestic dwelling. A copy of the grant of planning permission should be submitted with any request for a dishing.

However, where no planning permission exists and the new entrance has clearly been in existence for a long time it will be necessary for you to prove by sworn affidavit that the entrance has been in use as a vehicular access for a period of seven years. Please note that a sworn affidavit is a letter of declaration signed / witnessed by a solicitor or peace commissioner.

A fee applies to the installation of all vehicular dishing. Applicants should contact Road Maintenance Services at 2222507 to arrange for an inspector to call to the property to provide a quotation.

Under The Road Traffic (Traffic and Parking) Regulations 1997, Section 36, Paragraph 2 (i), it is illegal to park “on a footway, a grass margin or a median strip”. It is also illegal to park in such a manner as to obstruct an entrance or an exit for vehicles to or from a premises, save with the consent of the occupier of such premises (Section 36 2(g)). In view of this, it is not recommended to introduce parking restrictions where restrictions are already covered under the Road Traffic Regulations, such as providing bollards on footpaths, as this would lead to a proliferation of same and additional expense due to maintenance etc.

Instances of illegal parking should be referred to Dublin Street Parking Services at 602 2500 for enforcement under the Regulations.

Public Lighting Services took the existing public lights in (details supplied) in charge in October 2013 and took over the maintenance of these lights at that time.

When the lights were taken in charge, the provision of additional lighting at the (details supplied) Road end was considered for inclusion in the 2014 public lighting improvements programme, but unfortunately, due to the lack of available finances, there has been no public lighting improvements programme in 2014 or in 2015.

The provision of additional lighting in (details supplied) will be considered for inclusion on a future public lighting improvements programme, subject to the necessary finances being made available.

Please note that NO new public lights have been installed in (details supplied) since the public lighting was taken into our charge in October 2013. Only repairs on an existing light that was faulty and routine maintenance work have been carried out.

Reply:

Overall NAMA offered 828 properties for social housing in the Dublin City Council area. 360 of these were in the North Central Area. NAMA subsequently withdrew 8 of these properties. 191 units were accepted and have completed in Belmayne, Clare Hall and Calderwood. These units are now completed and allocated. 161 units were turned down in three developments on grounds of over concentration of social housing. There is still confirmed demand for 4 units in Northern Cross that have yet to complete.

“To ask the manager to provide this councillor with all the information that the North Central area office has received to date regarding all aspects of the proposed modular housing units.”

Reply:

At its meeting of 29 September, Government noted the latest homelessness data and trends. It approved the immediate initiation of a programme for the early delivery of 500 units of modular housing on sites in each of the four Dublin local authority areas. These units will be delivered in two tranches of 150 and 350.

The first 150 units are to be delivered within four months on sites in the Dublin City Council area utilising the most expeditious procurement and planning provisions.

A parallel process to develop a National Framework will be overseen by the Office for Government Procurement and this Framework will be used to deliver the tranche of 350 units.

The Framework will also be available to any local authority to procure further modular housing on sites selected by them for pressing accommodation needs, including for homeless families or for meeting additional demands arising from current or future refugee programme commitments.

The Minister for the Environment, Community and Local Government undertook to revert to Government on 20 October with the outcome of the site selection process and with the detailed approach to procurement and planning.

The Department of the Environment, Community and Local Government has convened a working group to progress the various issues associated with the delivery of these units within this challenging timeframe. This group consists of senior officials from Dublin City Council, the Office of Government Procurement, the Chief State Solicitor’s Office, the Attorney General’s Office and the Department of the Environment, Community and Local Government. The group met on 30 September will be meeting again to advance a proposal for modular housing.

The costs of the units will be met from the Department’s Housing Capital Funding under the Social Housing Strategy.

The City Council will arrange a briefing on modular housing for the elected members following on from the report to Government on 20th October 2015.

“To ask the manager to how often does DCC carry out health and safety inspections on the hotels, B& Bs and hostels used as emergency accommodation? Also request a copy of these reports.”

Reply:

Dublin City Council’s Homeless Services Facilities Management work to ensure that all homeless service providers meet the necessary standards to make certain that the welfare and safety requirements of residents are managed.

Each accommodation unit must meet health standards as outlined by the Environmental Health Officer (EHO). This includes the approval of the number of persons who can occupy the unit.

The Facilities Management also work to ensure that all accommodation providers are compliant with all health and safety regulations including fire safety. Inspections are also conducted on a routine basis to ensure that the accommodation provided complies with the standards as outlined by the EHO.

There is an official complaints process in place, which is managed by the Dublin Region Homeless Executive, on behalf of the four Dublin local authorities. Details in relation to complaints should be forwarded to the local authority via [email protected] and Homeless Services Facilities Management will examine any issue. When a complaint is received by the local authority in relation to the physical standards of a building or if a service is found to be substandard, these are immediately followed up by Dublin City Council Homeless Facilities Management.
