Notes Google—Do Not Pass Go, Do Not Collect $200: Why the Tech Giant Is a “Bad” Monopoly † ALICIA GINSBERG Congress enacted the Sherman Act in 1890 to promote competition and creativity in the marketplace. The Sherman Act prohibits agreements that restrain trade and lays out rules regarding monopoly power. This Note explores three distinct theories under which Google, one of the most successful technology companies in the world, could be found to have violated the Sherman Act. Specifically, in violation of Sections 1 and 2 of the Sherman Act, Google “ties” its products together and forces mobile device manufacturers to sign exclusive dealing agreements preventing them from purchasing products from Google’s competitors. Further, Google’s systematic obstruction of competing Android operating systems is a form of anticompetitive conduct in violation of Section 2 of the Sherman Act. -

SUMMARY The Department of Commerce (Commerce) preliminarily determines that certain quartz surface products (QSP) from the People’s Republic of China (China) are being, or are likely to be, sold in the United States at less than fair value (LTFV), as provided in section 733 of the Tariff Act of 1930, as amended (the Act). The period of investigation (POI) is October 1, 2017, through March 31, 2018. The estimated margins of sales at LTFV are shown in the accompanying Federal Register notice. II. Muris Although Microsoft has attracted much more attention, recent developments at the FTC may have a greater impact on the law of monopolization. From recent pronouncements, the agency appears to believe that in monopolization cases government proof of anticompetitive effect is unnecessary. In one case, the Commission staff argued that defendants should not even be permitted to argue that its conduct lacks an anticompetitive impact. This article argues that the FTC's position is wrong on the law, on policy, and on the facts. Courts have traditionally required full analysis, including consideration of whether the practice in fact has an anticompetitive impact. Even with such analysis, the courts have condemned practices that in retrospect appear not to have been anticompetitive. Given our ignorance about the sources of a firm's success, monopolization cases must necessarily be wide-ranging in their search for whether the conduct at issue in fact created, enhanced, or preserved monopoly power, whether efficiency justifications explain such behavior, and all other relevant issues.
