Their business has been established for 30 years, well before the zoning changes in 2002. They are keen to extend their opening hours in line with community needs as well as the need to remain viable. Nillumbik council is refusing the extension to their opening hours as the property does not sit on 20 acres. My constituents have addressed objectors' concerns comprehensively and are happy to work with council to achieve the necessary outcomes.

Business changes are necessary as tourism and community needs change. The council has prepared a draft tourism strategy, and this business can be the key to so many initiatives. What advice can the minister provide to my constituents with regard to how it is possible to conduct and continue to grow appropriate business in their zone, which is rural conservation zone, the green wedge?

Answer: I understand the business you refer to is the Watsons Creek Anque Store on Eltham-Yarra Glen Road in Watsons Creek which is able to operate despite being a prohibited use within the Nillumbik Planning Scheme. This operaon was provided individual consent via a site specific planning scheme amendment in 1991 by the former Shire of Eltham. The amendment allowed the owners to apply to Council for planning approval to operate a café within certain parameters, including restricons on patron numbers and hours of operaon.

Council recently received an applicaon to amend the planning approval to increase the operang hours. Eight wrien objecons were received from neighbouring residents.

Council officers advised the applicant that the potenal noise impacts were of concern and did not meet the amenity consideraons of the Nillumbik Planning Scheme and therefore the applicaon was likely to be recommended for refusal.

Prior to the applicaon being reported to Council's Planning Commiee the applicant withdrew the planning applicaon. As such, there is no current planning applicaon with Council for consideraon.

After four years of neglect of education by the former coalition government, families in the Yan Yean electorate see an Andrews Labor government getting on with it and building and completing new schools, such as Mernda Central P–12, Mernda South, Hazel Glen and Wallan. These much-needed investments are welcomed by local families and will mean improved access to great state schools. Last week there was a fatal accident on the corner of McGregor Road and Cunningham Crescent in Pakenham. Statistics from car counting conducted by the Cardinia shire confirm that McGregor Road has approximately 15 000 vehicles per day travelling immediately north of the railway line. Immediately south of the railway line in the duplicated section we have 20 000 vehicles per day.

Whilst McGregor Road was substantially upgraded by the coalition government, the railway crossing itself continues to be a bottleneck. The road is a major link between the Princes Highway and the Pakenham bypass. When will the minister allocate funding to have the McGregor Road railway crossing widened to allow for a four-lane carriageway to pass through the crossing, enabling a better and safer flow of traffic through this area?

Answer: McGregor Road is currently a municipal road managed by the Cardinia Shire Council. The council has widened the secons of McGregor Road, north and south of the railway crossing.

VicRoads is aware of the constraints to through movement at the railway crossing and will connue to work with the council to monitor traffic condions and priorise future road infrastructure improvements in this growth corridor, including at the McGregor Road railway crossing.

Question: 1289 CONSTITUENCY QUESTION — Ms Kilkenny to ask the Minister for Sport — My constituency question is to the Minister for Sport. Can the minister outline what the government is doing to support and encourage women's participation in sport? Recently I met with Kate Gillespie-Jones, who is the captain of the Seaford women's football team. The weekend before, skipper Kate kicked a lazy 12 goals in her round 18 match and was named winner of the Victorian Women's Football League division 1 best and fairest.

Given all the recent publicity around male AFL achievements, it is time to congratulate Kate and all the other women players on their contribution to our beloved AFL. Kate and many other women and girls in my electorate of Carrum are keen to hear from the minister on what the Andrews Labor government is doing to support and encourage female participation in sport.

Answer: Firstly, I congratulate Kate Gillespie-Jones on her outstanding efforts, and I acknowledge and welcome the growing number of women participating in sport. The Victorian Government is leading the way in its strategy to provide opportunities for more women and girls to get and stay active. Earlier this year I announced an Inquiry into Women and Girls in Sport and Active Recreation and appointed an expert Advisory Panel to undertake the Inquiry. The Advisory Panel has been investigating how to enhance participation by women and girls in sport and active recreation and to identify ways to increase their engagement in leadership and governance roles. To help inform the Inquiry a series of community consultations have been held in regional centres and in Melbourne to better understand the case for change and to identify practical ideas and actions that could influence change.

The Advisory Panel is expected to deliver their final report, including recommendations and a practical action plan, to me in the coming months. This report will be one of a number of inputs which will help inform and guide Victoria's future investment into women and girls in sport and active recreation.

This year Victoria has invested approximately $450,000 towards the development and delivery of program initiatives to support greater inclusion and engagement of females in sport and active recreation in Victoria.

In June I announced the $100 million Community Sports Infrastructure Fund that includes a $10 million Female Friendly Facilities Fund which supports facility qon.parliament.vic.gov.au/PARLIAMENT/General/QoN/PROD/qonarchive.nsf/printAllQuestions.xsp 19/23 3/9/2021 Parliament of Victoria development to encourage greater participation by women and girls in sporting and recreational activities. In October the Ministers of Sport and Recreation from all states of met here in Melbourne. I initiated a discussion seeking a national approach to enhancing the engagement of women and girls in sport and active recreation. Ministers have now agreed to ask the Committee of Australian Sport and Recreation Officials to develop an options paper on approaches to improve women's participation in sport and leadership roles and the profile of women's sport.

Victoria's ongoing investment in sport and recreation actively seeks to ensure that both program and facility design provides benefits to all Victorians, and I am particularly proud of the focus that we have placed on providing more opportunities for women and girls.

Question: 1290 CONSTITUENCY QUESTION — Ms Sandell to ask the Minister for Housing, Disability and Ageing — My question is to the Minister for Housing, Disability and Ageing. My office has been approached by a number of tenants in public housing located in Sutton Street, North Melbourne. They are concerned about open drug use and the presence of non-tenants in common areas, rubbish being left in the building and poorly maintained facilities, including broken locks. Public housing tenants, like any other Victorians, have the right to live in dignity. These tenants are often in vulnerable situations, are newly arrived Australians or have refugee backgrounds, so there is an extra onus on the government to address the problems faced by them. However, I have found that the reality is often the opposite. I am informed that complaints about security and maintenance are routinely dismissed without records being kept. I ask the minister to describe any steps that he is taking to create responsive and accessible complaints mechanisms for these residents of public housing.

Answer: The Andrews Labor Government believes that all Victorians have the right to safe, affordable and secure housing. The Andrews Government appreciates and understands the nature of the public housing high rise towers, the vulnerability of the people we work with, and the challenges of ensuring safety and security amongst these diverse communities.

The Department of Health & Human Service's housing workers are professional public servants who have dedicated their careers to the safety, welfare and wellbeing of the people we house and care for. To claim that they routinely dismiss security and maintenance complaints without keeping records is a slur on hundreds of dedicated professionals.

The government manages 65,000 tenancies across Victoria, and consequently has a responsive and accessible complaints mechanism for residents of public housing who believe they were given an unsatisfactory service; did not receive enough information or choice; or were denied respect, dignity or privacy.

The mechanism involves three steps and is focussed on making every attempt to resolve the complaint at the local level. The first step to have the complaint resolved is to discuss the complaint with a staff member at the local office. Where this does not resolve the matter satisfactorily, the complaint is escalated to a senior manager at the local office. All concerns are taken seriously and provided due consideration. Tenants are provided with feedback and an update on their concerns which takes into account the privacy of all involved. The department can also provide assistance and support throughout the process of making a complaint, for example, arrange an interpreter to help with language services.

Public housing residents also have the option of taking a complaint to other organisations such as the Victorian Ombudsman or the Commissioner for Privacy and Data Protection.

Public housing residents who have concerns about maintenance contractors' service or quality of work, can direct complaints to the Housing Call Centre. If they are not satisfied with the outcome, they can lodge a formal complaint by contacting the central complaints unit on 1300 884 706 (cost of a local call). Residents can also seek advice from Consumer Affairs Victoria, other community service organisations or can apply for a matter to be heard at the Victorian Civil and Administrative Tribunal where there is a dispute between the landlord and tenant.

I will continue to engage directly with residents of Sutton St where issues arise to improve services, rather than engage with those who slag off housing workers to score cheap political points.

Question: 1291 CONSTITUENCY QUESTION — Mr Carroll to ask the Minister for Housing, Disability and Ageing — My constituency question is for the Minister for Housing, Disability and Ageing. I have been contacted by my constituent, Mr Paul Angel of Airport West, who is trying to improve car parking accessibility for disabled people. Mr Angel's wife, Margaret, and both adult children, Peter and Beck, live with the condition hereditary motor and sensory neuropathy type II and are unable to stand or walk, and therefore use wheelchairs. Mr Angel is concerned that designated parking bays in the municipalities are not built to the Australian standard and that permits are too easily obtained by people with no serious disability. I ask the minister to seek a review of the implementation of compliant disability parking bays and the eligibility of permit-holders.

Answer: In Victoria responsibility for the Disabled Persons Parking Scheme Code sits with the Minister for Roads and Road Safety. VicRoads has carriage of the Code, with Victoria's 79 local councils individually administering the scheme on their behalf.

However I am advised work is progressing on the administrative arrangements to facilitate the introduction of the national scheme. Given its complexity in Victoria, the changes required to introduce the national scheme are being carefully considered to ensure that the full benefits of the scheme are realised.

Any consideration of the need for a review should be directed to the Minister for Roads and Road Safety.

I do however note the prospects of the State Disability Plan providing a further opportunity to consider a range of systemic issues, including issues related to transport, that impinge on the rights of people with disability.

Individual concerns regarding non-compliance or eligibility of permit-holders, should be brought to the attention of the local council in which the parking space is located.

Question: 1292 CONSTITUENCY QUESTION — Mrs Fyffe to ask the Minister for Education — My question is to the Minister for Education. In 2014 the now minister committed to reopen the Swinburne Lilydale campus and said:

"If elected, Victorian Labor will do whatever it takes to preserve the Swinburne Lilydale site for TAFE and university, including compulsory acquisition of the site if necessary."

In fact it was the Premier himself who said:

"We'll remove the padlocks, open the gate and give TAFE and university back to the community."

The expression-of-interest process finished a few months ago, yet there has been nothing but silence from the government, which is starting to anger the community. As the Minister for Education would be aware, this is the period that students look at tertiary institutions and need to submit applications for enrolment next year, yet our students do not know what courses will be available to them or what the providers will be. The Minister for Training and Skills announced that the site would be open early 2016, but we are no closer to finding out. I have had to ask this question a couple of time already because the community of Yarra Ranges still does not have clarity on this issue. I ask again, on behalf of students and parents, will the minister clarify what is happening?

Answer: Returning TAFE and higher educaon to this fantasc campus was a key elecon commitment of the Andrews Labor Government and although the commitment falls within the porolio of the Minister for Training and Skills, I have been working closely with Minister Herbert to make this happen.

Having aended the event you know that Premier Daniel Andrews, Minister Herbert and I, together with Swinburne's Vice Chancellor Professor Linda Kristjanson, had the privilege of announcing Box Hill Instute as the preferred bidder of the Request for Proposal Process. Box Hill Instute presented an innovave and excing vision for the future of the Lilydale campus, planning a community educaonal precinct which will provide access to on-site educaonal and training opportunies and community services across all ages for the region well into the future.

Box Hill already has a well-respected presence in the region and will be able to hit the ground running, progressively mobilising on-campus educaonal service delivery, together with its partners Deakin University and William Angliss, from first semester 2016.

This was a promise made and a promise kept - TAFE & higher educaon returns to Lilydale.

I ask the minister what available supports and resources the government has for people seeking to establish and maintain sustainable gardens? The reason that I ask is the example set by Pascoe Vale constituent Paul McKay, who has turned his weatherboard home on a suburban block in Pascoe Vale South into a truly amazing sustainable garden and environmentally friendly home. Just a few weeks ago his home was open to the public as part of the open house program sponsored by the Alternative Technology Association. Hundreds of people took great delight in learning about the aquaponics system in Paul's front yard, his home-grown trout and barramundi, how he grows enough watercress to make a year's supply of watercress pesto, his homemade honey from the bees he has in his backyard, the sweetness of his berries, the wood pellet heater that he intends to run with pellets made from lawn clippings and the straw and mud walls of his house. Lots of people are interested to know what supports are available.

Answer: I thank the member for the question. Encouraging sustainable use of resources such as water and energy is a key commitment of the Victorian Government. Sustainability Victoria works with businesses, local government, households and schools to help them use resources more efficiently to help minimise negative impacts on the environment.

Sustainability Victoria continues to deliver the ResourceSmart Schools program, and actively encourages schools to get involved in sustainable gardens by establishing vegetable and kitchen gardens, as well as planting native species to boost the biodiversity values of their school grounds and the local community.

Starting in 2008, Sustainability Victoria funded 11 Eco Living Centres across Victoria, giving community members a place to learn about sustainable living in their local area. Sustainability Victoria has also funded community garden projects, such as the one run by Gippsland Employment Skills Training, which received a grant of $11,305 in 2015 for its Recycle, Regrow and Reconnect Project.

Sustainability Victoria offers advice to households on how to make their homes and appliances more energy efficient - to help Victorians save energy, reduce bills and make their homes more comfortable. There are videos and how-to guides on the Sustainability Victoria website on topics including energy efficiency at home, purchasing energy efficient appliances and draft proofing your home. Advice and tools are also available for people renovating their homes, to help them improve the energy efficiency and sustainability of their homes.
