Matthew 7:14 (King James) This Article will examine executive clemency decisions in capital cases, from 1977, the year of the first execution after the Supreme Court sanctioned the resumption of executions in Gregg v. Georgia,' until June of 2002, when Atkins v. Virginia2 was decided.3 The power of the executive to grant clemency to a capital defendant can be viewed as a gateway--one last chance to be spared capital punishment. The gateway to clemency has been exceedingly narrow in this quarter century era of capital punishment. Perhaps surprisingly, it has been very narrow indeed for the three classes of capital prisoners who are the focus of this Beyond Atkins Symposium,4 and who might be expected to be particularly suitable candidates for clemency, i.e., juveniles,5 the mentally retarded, and the mentally ill.

GEORGIA A report by the SOUTHERN CENTER for HUMAN RIGHTS These death sentences are cruel and unusual in the same way that being struck by lightning is cruel and unusual.... [T]he petitioners are among a capriciously selected random handful upon whom the sentence of death has in fact been imposed. - Justice Potter Stewart, Furman v. Georgia, June 29, 1972 Today, administration of the death penalty, far from being fair and consistent, is instead a haphazard maze of unfair prac- tices with no internal consistency. - American Bar Association's Report Regarding its Call for A Moratorium on Executions, February 1997 •••••••••••••••••••••••••••••••••••• CONTENTS INTRODUCTION 2 RACE 5 POVERTY 11 ARBITRARINESS 21 INNOCENCE 24 MENTAL RETARDATION 27 MENTAL ILLNESS 30 CHILDREN 33 INTRODUCTION From this day forward, I no longer shall tinker with the machinery of death. For more than 20 years, I have endeavored— indeed, I have struggled—along with a majority of this Court, to develop procedural and substantive rules that would lend more than the mere appearance of fairness to the death penalty endeavor. Rather than continue to coddle the Court's delusion that the desired level of fairness has been achieved and the need for regulation eviscerated, I feel morally and intellectually obligated simply to concede that the death penalty experiment has failed. - Justice Harry Blackmun, Callins v. ADVOCATE IN RESIDENCE THE DEATH PENALTY AS THE ANSWER TO CRIME: COSTLY, COUNTERPRODUCTIVE AND CORRUPTING Stephen B. Bright* I appreciate the opportunity to make some remarks about capital punishment and about the crime debate in our country today. Unfortunately, what is called a crime debate is really no debate at all, but an unseemly competition among politicians to show how tough they are on crime by support- ing harsher penalties and less due process. The death pen- alty and long prison sentences are being put forward as an answer to the problem of violent crime. This approach is ex- pensive and counterproductive. It is corrupting the courts and diverting our efforts from the important problems of ra- cial prejudice, poverty, violence and crime.

Civil Action No. 5:06-cv-00110-SWW-JFF LARRY NORRIS, et al., Defendants. APPLICATION FOR PRELIMINARY INJUNCTION Plaintiff, Don William Davis, is under a sentence of death. Mr. Davis moved to intervene in the instant action on May 4, 2006, and the Court granted the Motion on May 26, 2006. In the interim, on May 11, 2006, the Governor of the State of Arkansas scheduled Mr. Davis’ execution to take place on July 5, 2006. Mr. Davis seeks preliminary injunctive relief to prevent Defendants from executing him by their proposed means of lethal injection pending the resolution of this action. Mr. Davis alleges that the Arkansas Department of Correction’s lethal injection protocol, as described in Administrative Directive 96-06, which is attached hereto as Exhibit 1, constitutes cruel and unusual punishment in violation of the Eighth and Fourteenth Amendments because it creates a substantial and unnecessary risk that Mr. Davis will be fully conscious and in agonizing pain for the duration of the execution process This application for a preliminary injunction is made pursuant to Federal Rule of Civil Procedure 65, and Mr. Davis is entitled to the relief he seeks under Eighth Circuit precedent. Mr. 1 Case 5:06-cv-00110-SWW Document 21-1 Filed 06/12/2006 Page 2 of 31 Davis will sustain irreparable harm if injunctive relief is not granted preventing the Defendants from conducting his execution in accordance with Administrative Directive 96-06.

  • The Death Penalty
2 CASE STUDY 1 NARRATIVE SHIFT AND THE DEATH PENALTY In this case study, The Opportunity Agenda explores a narrative shift that transpired over a period of almost 50 years—from 1972, a time when the death penalty was widely supported by the American public, to the present, a time of growing concern about its application and a significant drop in support. It tells the story of how a small, under-resourced group of death penalty abolitionists came together and developed a communications strategy designed to raise doubts in people’s minds about the system’s fairness that would cause them to reconsider their views. In its early days, the abolition movement was composed of civil liberties and civil rights organizations, death pen- alty litigators, academics, and religious groups and individuals. Later, new and influential voices joined who were directly impacted by the death penalty, including family members of murder victims and death row exonerees. Key players used a combination of tactics, including coalition building—which brought together litigators and grass- roots organizers—protests and conferences, data collection, storage, and dissemination, original research fol- lowed by strategic media placements, and original public opinion research. This case study highlights the importance of several factors necessary in bringing about narrative shift. Key find- ings include: It can be a long haul. In the case of issues like the death penalty, with its heavy symbolic and racialized 1. associations, change happens incrementally, and patience and persistence on the part of advocates are critical. Research matters. Although limited to a few focus groups, the public opinion research undertaken in 2.

AMNESTY INTERNATIONAL, HUMAN RIGHTS & U.S. POLICY Maria Baldwin A Dissertation Submitted to the Graduate College of Bowling Green State University in partial fulfillment of the requirements for the degree of DOCTOR OF PHILOSOPHY December 2006 Committee: Gary R. Hess, Advisor Franklin W. Goza Graduate Faculty Representative Robert Buffington Douglas Forsyth ii ABSTRACT Gary R. Hess, Advisor This dissertation assesses Amnesty International’s ability to influence U.S. foreign policy through an examination of its human rights campaigns in three different nations—Guatemala, the United States and the People’s Republic of China. While these nations are quite different from one another, according to Amnesty International they share an important characteristic; each nation has violated their citizens’ human rights. Sometimes the human rights violations, which provoked Amnesty International’s involvement occurred on a large scale; such as the “disappearances” connected with Guatemala’s long civil war or the imprisonment of political dissidents in the PRC. Other times the human rights violations that spurred Amnesty International’s involvement occurred on a smaller-scale but still undermined the Universal Declaration of Human Rights; such as the United States use of capital punishment. During the Guatemalan and Chinese campaigns Amnesty International attempted to influence the United States relations with these countries by pressuring U.S. policymakers to construct foreign policies that reflected a grave concern for institutionalized human rights abuse and demanded its end. Similarly during its campaign against the United States use of the death penalty Amnesty International attempted to make it a foreign policy liability for the United States. How effective Amnesty International has been in achieving these goals is the subject of this dissertation.

  • Capital Punishment: Race, Poverty & Disadvantage
CAPITAL PUNISHMENT: RACE, POVERTY & DISADVANTAGE Professor Stephen B. Bright Yale Law School Class One - Part One (Rector.pdf) THE PROCESS OF IMPOSING DEATH [C]apital punishment is an expression of society’s moral outrage at particularly offensive conduct. * * * [T]he decision that capital punishment may be the appropriate sanction in extreme cases is an expression of the community’s belief that certain crimes are themselves so grievous an affront to humanity that the only adequate response may be the penalty of death. - Justice Potter Stewart (joined by Powell and Stevens, JJ.), upholding the death penalty in Gregg v. Georgia, 428 U.S. 153, 183, 184 (1976) Capital punishment is at once the best and worst subject for legal rules. The state’s decision to kill is so serious, and the cost of error so high, that we feel impelled to discipline the human power of the death sentence with rational legal rules. Yet a judge or jury’s decision to kill is an intensely moral, subjective matter that seems to defy the designers of general formulas for legal decision. - Robert Weisberg, Deregulating Death, 1983 SUP. CT. REV. 305 When the law punishes by death, it risks its own sudden descent into brutality, transgressing the constitutional commitment to decency and restraint. - Kennedy v. Louisiana, 554 U.S. 407, 420 (2008) Capital punishment is to the rest of the law as surrealism is to realism. It destroys the logic of the profession. - Norman Mailer, THE EXECUTIONER’S SONG (1980) Someday we will look back upon our criminal and penal process with the same horrified wonder as we now look back upon the Spanish Inquisition.

If nothing else, writing this has affirmed for me that through Him all things are possible. To God be the glory. Second, thank you to everyone who contributed to my research, especially my advisor. It would take far too long for me to name all of you, and I would hate to forget someone, so I hope it will suffice to say that I am indebted to you for the time and effort you expended on my behalf. Third, I have to give a shout-out to my friends. I have neglected you in the worst way this year, but I am so grateful for the distractions from the misery of work, your attempts to stay up as late as I do (nice try), and most of all your understanding.
