Its detailed yet user-friendly description and analysis covers the UN Framework Convention on Climate Change, the Kyoto Protocol, and all decisions taken by the Conference of the Parties up to 2003, including the landmark Marrakesh Accords. Mitigation commitments, adaptation, the flexibility mechanisms, reporting and review, compliance, education and public awareness, technology transfer, financial assistance and climate research are just some of the areas that are reviewed. The book also explains how the regime works, including a discussion of its political coalitions, institutional structure, negotiation process, administrative base, and linkages with other international regimes. In short, this book is the only current work that covers all areas of the climate change regime in such depth, yet in such a uniquely accessible and objective way. Farhana Yamin is a Fellow in Environment at the Institute of Development Studies (IDS), University of Sussex, England, specialising in global environmental issues with particular reference to climate change. Before joining IDS in 2002, she was Director of the Foundation for International Environmental Law and Development (FIELD) and led its Climate Change and Energy Programme from 1992 to 2001. She has coordinated several multi-partner research and policy collaborations for a number of governments and international organisations, including leading the team that advised the European Commission on the policy and legal framework for the European Emissions Trading Directive. -

Climate Governance After the Paris Agreement
CLIMATE GOVERNANCE AFTER THE PARIS AGREEMENT WORKSHOP REPORT * In November 2016, UCL’s Global Governance Institute (GGI) hosted over 30 leading international practitioners and scholars in the field of climate change law, governance and policy for a workshop on the Paris Agreement and its potential to drive forward effective climate governance. The event was supported by the French Embassy in London as part of its Conference-Débat series. UCL Grand Challenge and the UCL Centre for Law and Environment co-hosted the public evening panel. This report serves as a summary of the workshop’s discussions, which were held under Chatham House Rule. Following years of deadlock, the Paris Agreement adopted in December 2015 marks a dramatic breakthrough in multilateral climate negotiation. Anne-Marie Slaughter hailed it as “a model for effective global governance in the twenty-first century”.1 Indeed, the Pars Agreement embodies a new, more flexible governance approach: a hybrid of hard, soft and non-law, bottom-up and top- down mechanisms. A spirit of pragmatism – ‘don’t let the perfect be the enemy of the good’ – brought negotiations in Paris to a successful conclusion. As a result, however, many of the provisions thrashed out in Paris are purposely framed in order to accelerate implementation action, leaving many questions unanswered. Considerable debate surrounds the legal, operational and normative status of provisions within the Agreement, and the potential of innovative global mechanisms, such as the global stocktake, to enable new avenues for legal and political mobilisation. Given the Agreement’s bottom-up nature it is essential that it connects with domestic governance arrangements and policy activities. -

The contributions in this part focus on a number of key policy processes at different levels that all play a role in devising the overarching policy frameworks that will shape the global response to climate change. Process matters. The extent to which climate policy-making is organized to be transparent, accountable and inclusive determines how affected by policy capture, undue influence or corruption the eventual policies are likely to be. The analysis shows clearly that despite disproportionate attention to global climate summits, other important decisions are being taken from global to local level. This patchwork of institutions and forums for climate governance is mirrored by a proliferation of collective agreements, estimated to have surpassed 500 over the last 30 years.1 The opening contribution by Peter Newell sets the scene and traces the evolution of the most visible segment of global climate policy-making, the series of international summits that gave rise to the United Nations Framework Convention on Climate Change (UNFCCC), the Kyoto Protocol and, more recently the Copenhagen Accord. Newell probes the inclusiveness of the process, the capability of different actors to engage in a meaningful way and – with a view to the events in Copenhagen – discusses the tension between inclusiveness and manageability.
