UK = United Kingdom (comprising England, Wales, Scotland and Northern Ireland) 4 CCPR/C/GBR/7 Foreword 1. The rights debate in the UK since 2001 has been about where to draw the line and how to set the balance between public security and individual rights. This debate has been invigorated by the new coalition government in the UK, which has committed itself to promoting a greater understanding of rights, as well as a progressive re-examination of many areas of its own rights policy. 2. Since the publication of the UK Government’s sixth report on the International Covenant on Civil and Political Rights, the coalition government’s reappraisal of rights has enabled it to address areas where it has felt the balance had shifted too far in a particular direction, or where recent events had revealed a gap in the protections offered or how the protections are given effect. The controversial control orders regime has thus been repealed and replaced with Terrorism Investigation and Prevention Measures, pre-trial detention has been reduced to 14 days from 28 days, identity cards were scrapped and the National Identity register was destroyed in February 2011, and a series of initiatives by a number of government departments, such as the anti-Muslim hatred work of the Department of Communities and Local Government, address discrimination against religious minorities, and in particular against Islam. 3. Other consequences to the response to terrorism continue to progress towards their respective resolutions. For instance, the police investigations against allegations of UK complicity in mistreatment of foreign nationals in third countries continue and are expected to be subject to a judge-led review once they have been completed. 4. In the time since the previous periodic report, the UK has also faced a number of challenging domestic incidents that have tested areas of its rights regime. In the summer of 2011 the civil disturbances in a number of cities across metropolitan UK marked a temporary rise in the numbers of young people being tried and sentenced in UK courts, but were also handled without invoking extraordinary measures or derogating rights. The protests related to the financial crisis that have characterised recent years were mostly handled without incident, though they have required reconsideration of certain police crowd management methods. 5. Building on the universal periodic report process, the UK government has engaged widely with non-governmental organisations, including the UK’s national human rights institutions, to enrich and balance the report. Their input confirmed our belief that monitoring the protection of civil and political rights is not merely about cataloguing restrictions to liberties and developments that only impact on small sections of the population and foreign groups. It is about explaining a much broader story, one which contains a great deal that the UK can be proud of. 6. For instance, the adoption and implementation of the Equalities Act 2010 is a significant extension and rationalisation of our equalities rights, placing as it does all protected characteristics under a common legislative framework for the first time in the UK. 7. Of great impact to the character of this report has been the increase in devolution of powers in areas of relevance to human rights in the devolved nations of Wales, Scotland and Northern Ireland. This article looks at legislative, executive and judicial attempts to limit such art.8 cases since 2000, a project led by successive Secretaries of State (SoS) for the Home Department, of whom there have been six Labour, one coalition Conservative and three Conservatives in the past 20 years. 2. It considers the following topics: the structure of art.8 in immigration cases; how the SoS might theoretically limit its effect in tribunals and courts; the failed attempt to do so through the Immigration Rules; the slightly more successful attempt to do so through statute; the mixed response of the senior judiciary; and future prospects.

    © 2018 Bruce Mennell (04/05/18) Immigration Law Affecting Commonwealth Citizens who entered the United Kingdom before 1973 Summary This article outlines the immigration law and practices of the United Kingdom applying to Commonwealth citizens who came to the UK before 1973, primarily those who had no ancestral links with the British Isles. It attempts to identify which Commonwealth citizens automatically acquired indefinite leave to enter or remain under the Immigration Act 1971, and what evidence may be available today. This article was inspired by the problems faced by many Commonwealth citizens who arrived in the UK in the 1950s and 1960s, who have not acquired British citizenship and who are now experiencing difficulty demonstrating that they have a right to remain in the United Kingdom under the current law of the “Hostile Environment”. In the ongoing media coverage, they are often described as the “Windrush Generation”, loosely suggesting those who came from the West Indies in about 1949. However, their position is fairly similar to that of other immigrants of the same era from other British territories and newly independent Commonwealth countries, which this article also tries to cover. Various conclusions arise. Home Office record keeping was always limited. The pre 1973 law and practice is more complex than generally realised. The status of pre-1973 migrants in the current law is sometimes ambiguous or unprovable. The transitional provisions of the Immigration Act 1971 did not intersect cleanly with the earlier law leaving uncertainty and gaps. An attempt had been made to identify categories of Commonwealth citizens who entered the UK before 1973 and acquired an automatic right to reside in the UK on 1 January 1973.

Each of these entities includes very different territories, with different legal statuses and varying forms of self-administration and constitutional linkages with the UK. However, they also share similarities and challenges that enable an analysis of these territories as a complete set. The incomplete sovereignty of the Crown Dependencies and BOTs has entailed that all these territories (except Gibraltar) have not been allowed to participate in the 2016 Brexit referendum or in the withdrawal negotiations with the EU. Moreover, it is reasonable to assume that Brexit is not an exceptional situation. In the future there will be more and more relevant international issues for these territories which will remain outside of their direct control, but will have a direct impact on them. Thus, if no adjustments are made to their statuses, these territories will have to keep trusting that the UK will be able to represent their interests at the same level as its own interests.     Dawes: Brecqhou’s Autonomy BRECQHOU’S AUTONOMY A Response to Henry Johnson’s ‘Sark and Brecqhou: Space, Politics and Power’ (2014) GORDON DAWES Mourant Ozanes <[email protected]> Key Words: Brecqhou, Sark, Barclay Brothers As detailed below, Henry Johnson’s article ‘Sark and Brecqhou, Space Politics and Power’ (2014) published in Shima v8 n1: 9-33 contains a number of factual errors and erroneous interpretations of the issues concerned. There is also a significant problem with the comparators used to refer to matters concerning Sark and Brecqhou since the micronations selected are bogus, recent conceits, as opposed to islands with ancient histories and real status, such as Sark and, separately, Brecqhou. The crucial distinction is that there is no external challenge to the status of either Sark or Brecqhou. The principal shortcomings of Johnson’s chacterisations and argument are as follows: Page 10 – Johnson states that Sark and Brecqhou form one jurisdiction. This is too simplistic a statement. Brecqhou is certainly not a part of Sark, and I return to this issue later. Sark's parliament and court claim jurisdiction over Brecqhou. However, that jurisdiction is itself contentious and the concession made in a statement to the Royal Court of Guernsey in private law proceedings in 2000 referred to by Johnson was itself wrongly made and/or not binding as a matter of public law. In practice the jurisdiction is rarely exercised and, when it is, dispute generally follows. Whatever legislative jurisdiction is claimed is itself limited by convention as to how it is exercised and when. Page 12 – Johnson states that Sir Frederick and Sir David Barclay are tenants of La Moinerie de Haut, one of the original Sark tenements, and repeats a claim that Brecqhou became a tenement of Sark in 1929 when Dame Sybil Hathaway sold Brecqhou to one Angelo Clarke.

The current historical consensus is that the suspension was a result of the state's need to finance the war, France’s remonetization, a loss of confidence in the English country banks, and a run on the Bank of England’s reserves following a landing of French troops in Wales. We argue that while these factors help us understand the timing of the Restriction period, they cannot explain its success. We deploy new long-term data which leads us to a complementary explanation: the policy succeeded thanks to the reputation of the Bank of England, achieved through a century of prudential collaboration between the Bank and the Treasury.     The Governor Genera. and the Head of State Functions THOMAS FRANCK* Lincoln, Nebraska In most, though by no means all democratic states,' the "Head o£ State" is a convenient legal and political fiction the purpose of which is to personify the complex political functions of govern- ment. What distinguishes the operations of this fiction in Canada is the fact that the functions of head of state are not discharged by any one person. Some, by legislative enactment, are vested in the Governor General. Others are delegated to the Governor General by the Crown. Still others are exercised by the Queen in person. A survey of these functions will reveal, however, that many more of the duties of the Canadian head of state are to-day dis- charged by the Governor General than are performed by the Queen. Indeed, it will reveal that some of the functions cannot be dis- charged by anyone else. It is essential that we become aware of this development in Canadian constitutional practice and take legal cognizance of the consequently increasing stature and importance of the Queen's representative in Canada. Formal Vesting of Head of State Functions in Constitutional Governments ofthe Commonnealth Reahns In most of the realms of the Commonwealth, the basic constitut- ional documents formally vest executive power in the Queen.
