TIF - Article 370, Federalism and the Basic Structure of the Constitution FAIZAN MUSTAFA July 5, 2019 Photo credit: Saktishree DM | Flickr (CC BY-ND 2.0) Article 370 is a permanent and not temporary provision of the Constitution that assures Jammu and Kashmir autonomy. Its content may have been hollowed out but it remains important for the people of Kashmir. Calls to scrap it are based on a misinterpretation. The Article 370 debate is back centre-stage. The new Union Home Minister, Amit Shah, has made a detailed statement on Article 370 after his return from Kashmir. In tune with his party’s ideological position, he has yet again termed this constitutional provision as “temporary”. At the same time he has been candid enough to confess for the first time that most elections in Kashmir had been rigged. The importance of Article 370 to Kashmir and the significance it holds in our Constitution are issues that need to be constantly reiterated to dispel the considerable misinterpretation and misunderstanding about this provision in the Constitution of India History of Article 370 The most important feature of federalism in the United States of America (USA) was the ”compact” between the Page 1 www.TheIndiaForum.in July 5, 2019 erstwhile 13 British colonies that constituted themselves first into a confederation and then into a federal polity under the 1791 constitution of the USA. Peer Noor ul Haq is a key prosecution witness, and police have reportedly threatened and harassed him and his family. Amnesty International believes their lives are in danger. Peer Noor ul Haq was arrested on 19 June 1999, after he lodged a complaint that certain police officers had taken bribes. He was detained for ten days, during which he was tortured. On the night of 23 June two other men, Ghulam Matto and Javid Shah, were put into the same cell as him. He heard screaming from another cell, which he took to be the sound of a third man being tortured. Shortly after the screaming stopped a senior police officer came and took away Ghulam Matto and Javid Shah. Neither man was seen alive again, and their bodies were found in a village 70 miles away. The body of the third man, Nazir Gilkar, was recovered from Dal Lake in Srinagar. A group of police officers have been charged with the killings. Since Peer Noor ul Haq came forward as a witness, police have threatened to kill him unless he decides not to testify. Both the State Human Rights Commission and the High Court of Jammu and Kashmir have ordered that he receive police protection, but no such protection has ever been provided.

RAMAKRISHNA MISSION VIDYALAYA NARENDRAPUR, KOLKATA-700103, WB, INDIA Email Id: [email protected] Website: www.rkmvnarendrapur.org Phone : (033) 2477-2201/2 /3, 2477-2206 VIDYALAYA NEWS (January 2019 to December 2019) The Ramakrishna Mission Vidyalaya is an integral part of the Ramakrishna Mission Ashrama, Narendrapur which has its Headquarters at Belur Math, Howrah, West Bengal. Since its opening on 22nd April 1958, it has been a residential school for boys established on the foundation of the high ideals of Swami Vivekananda, implementing the man-making and character-building ideals of education as propounded by him. The Vidyalaya is envisioned in the image of Indian Gurukul system where precious traditions and cherished values of the past and modern educational concepts have been integrated. It presents a synthesis of all that is best of the eastern and western models of education. It follows the trail as a paradigm of excellence to promote its culture and tradition. The lush green natural surroundings have given it a special identity. The Vidyalaya, its students and staff, all enjoy the blessings of Sri Ramakrishna, Sri Sarada devi and Swami Vivekananda. Till 1975, it was the only Multipurpose School in West Bengal which offered instructions in six streams, viz. Science, Humanities, Agriculture, Technical, Commerce and Fine Arts. Thereafter, in 1976 the Vidyalaya was converted into a Secondary School under the West Bengal Board of Secondary Education, with Bengali and English as medium of instructions. Students can choose either Bengali or Hindi as the first language. Since 2005, the Higher Secondary Course has been introduced in the Science stream only with Physics, Chemistry, Mathematics, Biology, Statistics along with compulsory subjects Bengali, Hindi and English.

THE HINDU DAILY ANALYSIS DATE – 10th June 2021 For Preliminary and Mains examination (Also useful for APSC and other government examinations) EDITORIALS • At home (GS 2 – Health) • Encouraging accord (GS 2 – International organisation) • Strong-arm tactics weaken democracy (GS 2 – Polity) • The promise and perils of digital justice delivery (GS 2 – Polity and governance) At home Context • Disasters may bring out the innate generosity of people, but sometimes even well-intentioned initiatives may go wrong. • Many believe that children orphaned by calamities are free for adoption and that growing with well-off adoptive parents will give them a shot at a better life than they can get from impoverished surviving relatives. • However, adoption can be an option only when the children’s safety and welfare can be ensured. By ordering that no adoption of children orphaned since last year should be permitted contrary to the Juvenile Justice Act, 2015, the Supreme Court has made one more benign intervention to mitigate the fallout of the COVID-19 pandemic. • It had earlier passed various orders on the economic and health aspects of the pandemic, including those aimed at the protection of migrant workers, prisoners and jail staff and the people at large. • When its attention was drawn to advertisements and messages inviting people to adopt children who have lost one or both parents to COVID-19, the court warned that no such adoption could be permitted without the involvement of the Central Adoption Resource Authority (CARA). • It is important that the order is adhered to, as past experience shows that the danger of children falling victim to traffickers under the guise of adoption is ever-present.
