Letter dated 7 November 2014 from the Permanent Representative of to the United Nations addressed to the President of the Security Council

I have the honour to transmit herewith a communication of the Ministry of Foreign Affairs of Ukraine in which it protests the acts of aggression of the Russian Federation against Ukraine (see annex I) and the latest updates on the continued supply of military hardware and personnel from the territory of the Russian Federation into the territory of Ukraine (see annex II). I would also like to urge the Security Council to act now to diffuse the situation in the Donbas region of Ukraine. I urgently call upon the Security Council to meet its responsibilities under the Charter of the United Nations and to clearly demand that the Russian Federation and its backed illegal armed groups immediately and strictly comply with the Minsk arrangements of 5 September 2014, and that the Russian Federation withdraw its military forces from the territory of Ukraine. I should be grateful if you would circulate the present letter and its annexes as documents of the Security Council.

Annex I to the letter dated 7 November 2014 from the Permanent Representative of Ukraine to the United Nations addressed to the President of the Security Council

The Ministry of Foreign Affairs of Ukraine presents its compliments to the Ministry of Foreign Affairs of the Russian Federation and once again expresses its strong protest over the continuation of the Russian Federation’s aggression against Ukraine, including through supporting the terrorist groups of “Donetsk People’s Republic” and “ People’s Republic”, the further escalation of the situation in Ukraine, and the increased building up of the armed forces of the Russian Federation near the state border with Ukraine. Despite the agreements concluded in Minsk on 5 and 19 September 2014, the following facts were observed in certain territories of Ukraine during the period from 3 to 6 November 2014: • Continuation of the operation of the regular units of the Russian armed forces, together with illegal armed groups in the Donetsk and Luhansk regions, including: artillery and mortar attacks on the positions of the Ukrainian armed forces near Donetsk city, the settlements of Avdiivka, Vuhlehirsk, Hnutove, Horlivka, Hranitne, Debeltseve, Leninske, Kamyanka, Marinka, Nikishyne, Novohryhorivka, Novokalynove, Novolaspa, Ozeryanivka, Orlivka, Orlovo- Ivanivka, Pavlopil, Pisky, Sakhanka, Starohnativka, Talakivka and Taramchuk of the Donetsk region; and near the settlements of Vilhove, Hirske, Zholobok, , Krymske, Mius, Nyzhnie, Novotoshkivka, , Stanitsa Luhanska, Staryy Aydar, Triokhizbenka, Fashchivka, Frunze, Chornuhyne and Schastya of the Luhansk region. • Accumulation of military hardware and personnel of the Russian armed forces near the airport of Donetsk city (10 tanks and 10 “Kamaz” trucks with military personnel), near the settlements of Vodyane (self-propelled artillery), Makiyivka (20 tankers), Oleksievo-Heorhiyivka (10 tanks, 10 “Kamaz” trucks with ammunition and 3 trucks with military personnel) and Shakhtarsk (10 items of self-propelled artillery) of the Donetsk region; Anthracyt (heavy artiller y), Vesela Hora (heavy equipment and military personnel), Metalist (heavy artillery and military personnel), , Stanitsa Luhanska (tanks, heavy artillery and “Grad” multiple rocket launcher systems) and Schastya (military equipment and military personnel) of the Luhansk region; trains with military equipment moving through the city of Molodogvardiysk of the Luhansk region; and three launchers of tactical missile systems in the area of the settlement of Bezimenne of the Donetsk region. • Concentration of units of the Russian armed forces in the direction of Luhansk (several units from the 7th guard landing assault division); in the direction of Gorlivko-Donetsk (units from the 18th, 19th and 200th separate mechanized infantry teams, the 104th landing assault regiment, the 76th landing assault division, the 13th and 4th tank divisions); in the direction of Volnovasko- Telmanivsky (the 11th and 31st landing assault teams); in the direction of Novoazovsky (units from the 247th landing assault regiment and the 11th air assault brigade). • Deployment of a communications hub of the Russian armed forces in Donetsk.

• Regular violations of the Ukrainian airspace and aerial reconnaissance by helicopters and unmanned aircrafts (drones) of the Russian armed forces in the area of Mariupol city, the settlements of Kalynivka Novosilka, Novotroickoe, Pavlopil, Sartana and Talakivka of the Donetsk region; Trohizbenka of the Luhansk region, along the administrative and territorial borders between the Autonomous Republic of Crimea and the Kherson region, reconnaissance flights by Russian armed forces reconnaissance aircraft Su-24MR and IL-20 aircraft over the Sea of Azov. • Accumulation of Russian forces military weaponry in its regions bordering with Ukraine, particularly in the districts of Rostov-on-Don (Russian Federation) (50 units of automotive and armoured vehicles), the settlements of Donetsk (Russian Federation) (50 armoured personnel carriers), Kamensk- Shakhtynskyi (Russian Federation) (50 tanks and 10 command post machines), the Rostov region (Russian Federation) and Solontsi (“Grad” multiple rocket launchers, armoured personnel carriers and artillery) of the Belgorod region (Russian Federation). • Deployment in the Rostov region (Russian Federation) in its regions bordering with Ukraine, units of the 291st and 293rd artillery brigades of the southern military district of the Russian Federation and the 120th and 385th artillery brigades of the central military district of the Russian Federation. • Installation of towers for conducting radio interception near the town of Bila Berizka of the Bryansk region (Russian Federation) and a mobile thermal imaging system complex near the settlement of Rohalyk of the Rostov region (Russian Federation). The Ministry of Foreign Affairs of Ukraine once again draws attention to the above-mentioned facts of the use of the armed forces of the Russian Federation in cooperation with terrorist groups, against the sovereignty, territorial integrity and political independence of Ukraine as a gross violation of the Charter of the United Nations and the norms and principles of international law. The Russian Federation’s aggression against Ukraine, including providing assistance to acts of terrorist groups in Donetsk and Luhansk oblasts, constitutes a grave crime against international peace and security that entails international legal responsibility of the perpetrators of those crimes. The Ministry of Foreign Affairs of Ukraine urges the Russian Federation to immediately stop international wrongful acts, in particular the intervention of the Russian armed forces, including heavy military equipment into the territory of Ukraine, to withdraw all the armed forces from the territory of Ukraine, to stop violations of the air and land border between Ukraine and the Russian Federation and to stop providing arms and military equipment to mercenaries of the terrorist groups. Ukraine also urges the Russian Federation to withdraw its troops and armed forces from the Ukrainian-Russian state border, to ensure a proper border control regime on the territory adjacent to the Ukrainian-Russian border, to investigate all crimes committed on the territory of the Russian Federation, referred to in the present and previous notes verbales of the Ukrainian side, and to punish the perpetrators.

The Ministry of Foreign Affairs of Ukraine yet again urges the Russian side to provide to Ukraine adequate assurances and guarantees of non-repetition of the above-mentioned international wrongful acts and to make full reparations in respect of the damages caused as a result of these actions by the Russian Federation.

Annex II to the letter dated 7 November 2014 from the Permanent Representative of Ukraine to the United Nations addressed to the President of the Security Council

Updates on the situation in eastern Ukraine as of 7 November 2014

The Russian Federation continues to supply military equipment and manpower to the zone of the antiterrorist operation, in particular, as reported, 32 tanks, 16 D-30 howitzers and 30 Kamaz trucks with ammunition and manpower were moved on 6 November from the territory of the Russian Federation in the direction of the Ukrainian village of Krasny Luch (Luhansk region). A column of trucks, including three Kamaz trucks with radars, crossed the border from the Russian Federation to Ukraine through the town of Izvaryne. Redeployment of the Russian military equipment and mercenaries towards the front lines continues. Ukrainian forces are preparing for an adequate action in response to any hostile developments. In the direction of Pervomayskyi, Ukrainian positions near the towns of Frunze and Girske were fired upon by terrorists with “Grad” launchers. Mortars were used during the attack on Ukrainian positions near the village of Krimske and the pontoon crossing near the town of Nyzhnie. One Ukrainian soldier was killed at the crossing and one was wounded. Ukrainian paratroopers conducted a sweep of the area for gun-layers and saboteurs. Mortar units of the enemy were destroyed by targeted artillery fire. The enemy subversion group was destroyed and forced to step back. Seven Ukrainian soldiers were wounded by landmines. Terrorists have intensified their activity in the Donetsk area. They have fir ed at positions of the Ukrainian military at the airport twice using artillery mortars, rocket-propelled grenades and small arms. Near the village of Orlivka of the Yasinovatskiy area Ukrainian troops successfully repelled an attack by terrorists. Near the village of Tonenke, terrorists fired on positions of the Ukrainian Armed Forces with “Grad” rocket launchers and artillery and used mortars, rocket-propelled grenades and small arms against positions of the Ukrainian Armed Forces near the villages of Piski, Marinka, Slavne and Avdiivka. In the direction of Debaltsevo, militants fired using mortars and rocket- propelled grenades on Ukrainian positions near the towns of Nikishin, Orlovo - Ivanivka, Chornukhyne and Mius. In the Luhansk area, terrorists fired on the positions of the Ukrainian Armed Forces with mortars and small arms near Stanitsa Luhanska, Stariy Aydar and Sokolniki. In the direction of Mariupol, militants fired on positions of the Ukrainian Armed Forces near Lomakine, Granitne and Novolaspa. During the past 24 hours, 5 Ukrainian soldiers were killed and 16 were injured. On the border outside of the antiterrorism operation zone, no clashes with the Russian forces and terrorists were registered. Nonetheless, Russian drones continue to carry out flights of aerial reconnaissance. On 6 November 2014, the Ukrainian border patrol observed the flight of a Russian drone crossing the administrative border of the temporarily occupied territory of Crimea.

On 6 November, near the town of Blagodatne of the Donetsk region, Ukrainian border patrol noticed a prepared terrorist observation position and a cache with a “Shmel” flamethrower of Russian production. During the past 24 hours, near the village of Selidovo, Ukrainian border guards detained a truck with 18 tons of coal, which had travelled from the areas controlled by the terrorists. The shipping documents presented were approved by the invalid seal of “the Ministry of Income and Charges of the DNR”. The cargo and vehicle were transferred to the representatives of the Ukrainian Interior Ministry.
