Notice for the attention of the persons subject to the restrictive measures provided for in Council Decision 2013/255/CFSP and in Council Regulation (EU) No 36/2012 concerning restrictive measures in view of the situation in Syria (2016/C 398/06)
The following information is brought to the attention of the persons designated in Annex I to Council Decision 2013/255/CFSP (1), as implemented by Council Implementing Decision (CFSP) 2016/1897 (2), and in Annex II to Council Regulation (EU) No 36/2012 (3), as implemented by Council Implementing Regulation (EU) 2016/1893 (4), concerning restrictive measures in view of the situation in Syria. The Council of the European Union has decided that the persons that appear in the above mentioned Annexes should be included in the list of persons and entities in Annex I to Decision 2013/255/CFSP and Annex II to Regulation (EU) No 36/2012. The grounds for designation of those persons appear in the relevant entries in those Annexes. The attention of the persons concerned is drawn to the possibility of making an application to the competent authori ties of the relevant Member State(s) as indicated on the websites in Annex IIa to Regulation (EU) No 36/2012, in order to obtain an authorisation to use frozen funds for basic needs or specific payments (cf. Article 16 of the Regulation). The attention of data subjects is drawn to the following information in accordance with Article 12 of Regulation (EC) No 45/2001 of the European Parliament and of the Council (1): The legal basis for this processing operation is Council Regulation (EU) No 36/2012 (2), as implemented by Council Implementing Regulation (EU) 2016/1983 (3). The controller of this processing operation is the Council of the European Union represented by the Director-General of DG C (Foreign Affairs, Enlargement, Civil Protection) of the General Secretariat of the Council and the department entrusted with the processing operation is the Unit 1C of DG C that can be contacted at: Council of the European Union General Secretariat DG C 1C Rue de la Loi/Wetstraat 175 1048 Bruxelles/Brussel BELGIQUE/BELGIË Email: [email protected] The purpose of the processing operation is the establishment and updating of the list of persons subject to restrictive mea sures in accordance with Regulation (EU) No 36/2012, as implemented by Implementing Regulation (EU) 2016/1983. The data subjects are the natural persons who fulfil listing criteria as laid down in that Regulation. The personal data collected includes data necessary for the correct identification of the person concerned, the Statement of Reasons and any other data related thereto. The personal data collected may be shared as necessary with the European External Action Service and the Commission. Without prejudice to restrictions provided for in Article 20(1)(a) and (d) of Regulation (EC) No 45/2001, requests for access, as well as requests for rectification or objection will be answered in accordance with Section 5 of Council Decision 2004/644/EC (4). Personal data will be retained for 5 years from the moment the data subject has been removed from the list of persons subject to the asset freeze or the validity of the measure has expired, or for the duration of court proceedings in the event they had been started. Data subjects may have recourse to the European Data Protection Supervisor in accordance with Regulation (EC) No 45/2001.

Notice concerning the judgment of 30 June 2016 in case T-424/13 in relation to Council Implementing Regulation (EU) No 430/2013 imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of threaded tube or pipe cast fittings, of malleable cast iron, originating in the People's Republic of China and Thailand and terminating the proceeding with regard to Indonesia (2016/C 398/10)
Judgment In its judgment of 30 June 2016 in case T-424/13 Jinan Meide Casting Co. Ltd v Council (1), the General Court of the European Union (‘the General Court’) annulled Council Implementing Regulation (EU) No 430/2013 of 13 May 2013 imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of threaded tube or pipe cast fittings, of malleable cast iron, originating in, inter alia, the People's Republic of China (2), to the extent that it applies to the Chinese exporting producer Jinan Meide Casting Co. Ltd (or ‘the exporting producer concerned’).
The General Court ruled that the rights of defence of the exporting producer concerned were breached by the rejection of its request for disclosure of normal value calculations using confidential data of an analogue country producer in the investigation that led to the adoption of Implementing Regulation (EU) No 430/2013. In particular, the General Court found that the Commission was wrong to rely on the need to comply with the principle of equal treatment in order to reject this request. The General Court held that it could not be ruled out that if the request had been accepted, the outcome of the investigation could have been different.
Consequences In accordance with Article 266 TFEU, the Union's institutions must take the necessary steps to comply with the judg ment. Therefore, the request of the exporting producer concerned for disclosure of the normal value calculations using confidential data of the analogue country producer should be re-examined in the light of the particular circumstances relating to this exporting producer.
In cases where proceedings consist of several administrative steps, the annulment of one of those steps does not annul the complete proceeding (3). The anti-dumping investigation is an example of such a multi-step proceeding. The annul ment of Implementing Regulation (EU) No 430/2013 concerned one step of the administrative proceeding, namely the disclosure of information to the exporting producer. Accordingly, in complying with the General Court's judgment of 30 June 2016, the Commission has the possibility to remedy the aspects of the proceeding which led to the annulment, while leaving unchanged those parts which are not affected by the judgment (4). Therefore, findings reached in the con tested Regulation which were not contested within the time-limits for a challenge or which were contested but rejected by the General Court's judgment or not examined by the General Court and therefore did not lead to the annulment of Implementing Regulation (EU) No 430/2013, remain valid.

Reopening procedure In view of the above, the Commission reopens the anti-dumping investigation concerning imports of malleable fittings originating in the People' Republic of China that led to the adoption of Implementing Regulation (EU) No 430/2013 in so far as it concerns the exporting producer concerned and resumes it at the point at which the irregularity occurred by publishing this Notice in the Official Journal of the European Union.
The reopening is limited in scope to the implementation of the judgment of the General Court with regard to Jinan Meide Casting Co. Ltd.
Written submissions The exporting producer concerned and the Union industry are invited to make their views known, submit information and provide supporting evidence on issues pertaining to the reopening of the investigation. Unless otherwise specified, this information and supporting evidence must reach the Commission within 20 days of the date of publication of this Notice in the Official Journal of the European Union.
Possibility to be heard by the Commission investigation services The exporting producer concerned and the Union industry may request to be heard by the Commission investigation services. Any request to be heard should be made in writing and should specify the reasons for the request. For hearings on issues pertaining to the reopening of the investigation the request must be submitted within 15 days of the date of publication of this Notice in the Official Journal of the European Union. Thereafter, a request to be heard must be submit ted within the specific deadlines set by the Commission in its communication with these parties.
Instructions for making written submissions and sending correspondence Information submitted to the Commission for the purpose of trade defence investigations should be free from copyright. Interested parties, before submitting to the Commission information and/or data which is subject to third party copy right, must request specific permission to the copyright holder explicitly allowing (a) the Commission to use the infor mation and data for the purpose of this trade defence proceeding and (b) to provide the information and/or data to interested parties to this investigation in a form that allows them to exercise their rights of defence.
All written submissions and correspondence provided by interested parties for which confidential treatment is requested shall be labelled ‘Limited’ (1).
Interested parties providing ‘Limited ’ information are required to furnish non-confidential summaries of it pursuant to Article 19(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protec tion against dumped imports from countries not members of the European Union (2) (‘the basic Regulation’), which will be labelled ‘For inspection by interested parties’. Non-cooperation In cases where any interested party refuses access to or does not provide the necessary information within the time limits, or significantly impedes the investigation, findings, affirmative or negative, may be made on the basis of facts available, in accordance with Article 18 of the basic Regulation.
Where it is found that any interested party has supplied false or misleading information, the information shall be disre garded and use may be made of facts available.
If an interested party does not cooperate or cooperates only partially and findings are therefore based on facts available in accordance with Article 18 of the basic Regulation, the result may be less favourable to that party than if it had cooperated.
Failure to give a computerised response will not be deemed to constitute non-cooperation, provided that the interested party shows that presenting the response as requested would result in an unreasonable extra burden or unreasonable additional cost. The interested party should immediately contact the Commission.
Hearing Officer The exporting producer concerned and the Union industry may request the intervention of the Hearing Officer in trade proceedings. The Hearing Officer acts as an interface between the interested parties and the Commission investigation services. The Hearing Officer reviews requests for access to the file, disputes regarding the confidentiality of documents, requests for extension of time limits and requests by third parties to be heard. The Hearing Officer may organise a hearing with an individual interested party and mediate to ensure that the interested parties' rights of defence are being fully exercised.
A r equest for a hearing with the Hearing Officer should be made in writing and should specify the reasons for the request. For hearings on issues pertaining to the initial stage of the investigation the request must be submitted within 15 days of the date of publication of this Notice in the Official Journal of the European Union. Thereafter, a request to be heard must be submitted within specific deadlines set by the Commission in its communication with the parties.
The Hearing Officer will also provide opportunities for a hearing involving parties to take place which would allow different views to be presented and rebuttal arguments offered on issues pertaining, among other things, to the imple mentation of the judgment.

Information to customs authorities The definitive anti-dumping duties paid pursuant to Implementing Regulation (EU) No 430/2013 on imports into the European Union of malleable fittings, currently falling within CN code ex 7307 19 10 (TARIC code 7307 19 10 10) and originating in the People's Republic of China, produced by Jinan Meide Casting Co. Ltd (TARIC additional code B336), and the provisional duties definitively collected in accordance with Article 2 of Implementing Regulation (EU) No 430/2013, should be repaid or remitted. The repayment or remission must be requested from national customs authorities in accordance with the applicable customs legislation.

Notice concerning the anti-dumping measures in force in respect of imports of certain prepared or preserved citrus fruits (namely mandarins, etc.) originating in the People’s Republic of China: modification of the name of a company subject to the cooperating exporting producers’ anti- dumping duty (2016/C 398/11)
Imports of certain prepared or preserved citrus fruits (namely mandarins, etc.) originating in the People’s Republic of China are subject to definitive anti-dumping duties, imposed by Commission Implementing Regulation (EU) No 1313/2014 (1). Zhejiang Xinchang Best Foods Co. Ltd, a company located in the People’s Republic of China, whose exports to the Union of certain prepared or preserved citrus fruits are subject to an anti-dumping duty of EUR 499,60 per tonne net product weight by the aforementioned Implementing Regulation, has informed the Commission that it has changed its name into Zhejiang Fomdas Foods Co., Ltd. The company has asked the Commission to confirm that the change of name does not affect the right of the company to benefit from the individual duty rate applied to the company under its previous name of Zhejiang Xinchang Best Foods Co. Ltd. The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Implementing Regulation (EU) No 1313/2014. Therefore, the reference in the Annex to Implementing Regulation (EU) No 1313/2014 to: ‘Zhejiang Xinchang Best Foods Co., Ltd’ should be read as: ‘Zhejiang Fomdas Foods Co., Ltd’. Zhejiang Fomdas Foods Co., Ltd shall be attributed the TARIC additional code A889 with the corresponding AD-duty amount of EUR 499,60 per tonne net product weight which was previously attributed to Zhejiang Xinchang Best Foods Co., Ltd.

On 21 October 2016, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the Canada Pension Plan Investment Board (‘CPPIB’, Canada) and Hammerson plc (‘Hammerson’, United Kingdom) acquire within the meaning of Article 3(1)(b) of the Merger Regulation joint control of a shopping centre called Grand Central (United Kingdom), currently solely controlled by Hammerson, by way of purchase of shares. 2. The business activities of the undertakings concerned are: — for CPPIB: professional investment management in real estate, public equities, private equities, infrastructure and fixed income instruments, — for Hammerson: commercial real estate ownership, management and development in Europe, including shopping centres in France and the United Kingdom, — for Grand Central: operation of a shopping centre in Birmingham, United Kingdom. 3. On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice. 4.
