The Lebanese Broadcasting Act of 1994 Dima Dabbous-Sensenig A thesis submitted in partial fulfilment of the requirements of Sheffield Hallam University for the degree of Doctor of Philosophy January 2003 COLDs^- £ s a l t e rl ABSTRACT Ending the War? The Lebanese Broadcasting Act of 1994 Soon after the end of the Civil War, Lebanon witnessed the birth of its first audio-visual law: the Broadcasting Act of 1994. This Act was, according to the Document of National Reconciliation that ushered in the end of the Civil War, considered to be crucial in ending civil strife in Lebanon. The 1994 Act was also the first legislation for private broadcasting to be passed in the Arab world. The introduction of the Act created great political upheaval. The present study documents the controversy created by the Act and seeks to understand the extent to which vehement criticism of the Act and of the government behind it were justified. I will seek to do so by examining the various phases of the Act: its inception as a draft; its final wording and the economic and political forces that shaped it; and its implementation, mainly through the creation of a new regulatory body, the National Audio-visual Council (or NAC) responsible for studying license applications. The present study will document the various stages of the new broadcasting law by relying almost exclusively on primary sources: i.e., archival material, most of which is inaccessible to the general public (e.g., application files); and personal interviews with high ranking government officials and media representatives. Finally, by relying on elite theory and an “evolutionary” theory of policy analysis, I will attempt to interpret the findings of the primary research, and to add to our understanding of media, law, and change in post-Civil War Lebanon.     ABSTRACT Title of dissertation: TELEVISION NEWS AND THE STATE IN LEBANON Jad P. Melki, Doctor of Philosophy, 2008 Dissertation directed by: Professor Susan D. Moeller College of Journalism This dissertation studies the relationship between television news and the state in Lebanon. It utilizes and reworks New Institutionalism theory by adding aspects of Mitchell’s state effect and other concepts devised from Carey and Foucault. The study starts with a macro-level analysis outlining the major cultural, economic and political factors that influenced the evolution of television news in that country. It then moves to a mezzo-level analysis of the institutional arrangements, routines and practices that dominated the news production process. Finally, it zooms in to a micro-level analysis of the final product of Lebanese broadcast news, focusing on the newscast, its rundown and scripts and the smaller elements that make up the television news story. The study concludes that the highly fragmented Lebanese society generated a similarly fragmented and deeply divided political/economic elite, which used its resources and access to the news media to solidify its status and, by doing so, recreated and confirmed the politico-sectarian divide in this country. In this vicious cycle, the institutionalized and instrumentalized television news played the role of mediator between the elites and their fragmented constituents, and simultaneously bolstered the political and economic power of the former while keeping the latter tightly held in their grip. The hard work and values of the individual journalist were systematically channeled through this powerful institutional mechanism and redirected to serve the top of the hierarchy.

Based on Lebanese media monitoring, a review of the Lebanese press, and interviews with media people in Lebanon, this study traces the development of broadcasting in prewar Lebanon, describes wartime changes, and discusses postwar broadcasting regulation in the country within the framework of civil society. Examining the factors that shaped regulation and the forces opposing it, this article calls for a more inclusive regulatory framework preserving national stability and media freedom. Jean‑Louis Halpérin1 Published online: 7 August 2019 © Springer Nature B.V. 2019 Abstract Many Asian and African constitutional and statutory texts use the phrase personal laws in order to determine the rules applicable to family matters such a marriage, divorce, maintenance and in some countries inheritance. However, this term is extremely vague and often without a clear defnition in the legal texts. This paper tries to show the high degree of un-determination of the statutory references to per- sonal laws. This chaotic situation can be explained by historical and political factors. Nevertheless, the paper proposes to stipulate a conventional defnition of personal laws in order to facilitate the comparison between the Asian and African countries with a plurality of personal laws. To begin with, it is a legal concept, but also an abstrac- tion used, at the same time, by ofcial statements in constitutions or statutory laws and by opinions of legal writers. As used in constitutional and statutory laws, the concept of the law is not defned and its various confgurations seem to be resistant to any unifed defni- tion as a concept of the science of law.

It investigates how the daily practices of urban warfare and the urban built fabric impacted on each other, and specifically how the violent targeting of the built fabric relates to contested discourses of power and identity enacted by the urban militias. The study is the result of residential fieldwork in Beirut, where I held in-depth interviews with former militia combatants, media representatives, academics and practitioners in urban studies and architecture, as well as conducting archival search into bibliographical, visual and microfilm sources in Arabic, English and French. Official geopolitical discourses in international diplomacy about the civil war between 1975 and 1976 focused on nation-state territoriality, and overlooked a number of complex specifications of a predominantly urban conflict. This led occasionally to an oversimplification of the war and of Beirut as chaos.

Civic spaces in Lebanon, and women’s activity within these spaces, is dictated by sectarian dynamics within its politics and society. This paper explores the evolution of the Lebanese state and sectarianized experiences of citizenship in relation to the external forces that shaped the “Lebanese System” in place today. Beginning in the late Ottoman and French Mandate periods, it identifies the key players in state formation both under colonial rule and later, as a sovereign state, a failing state in civil war, a post-conflict society. Finally, it frames Lebanon as a case study in 21st-century Middle East politics. It argues that the sectarian sociopolitical structure and gendered social and legal understandings of citizenship preclude any unified experience of public life across the Lebanese system, and thus prevents women from engaging fully in both Lebanese civic life and of their position as citizens in the global system. It is crucial to understand the ways in which gendered, sectarian civic spaces have formed and continue to evolve as it is within these spaces where civil societies develop.
