REVIEW OF THE BOUNDARY BETWEEN THE COMMUNITIES OF BRECON AND LLANFRYNACH IN THE COUNTY OF POWYS

REPORT AND PROPOSALS

1. INTRODUCTION

1.1 Powys County Council have conducted a review of the boundary between the Communities of Brecon and Llanfrynach under Section 55(2) of the Local Government Act 1972 as amended by the Local Government (Wales) Act 1994 (the Act).

1.2 We have considered Powys County Council’s report in accordance with Section 55(3) of the Act and submit the following report on the County Council’s recommendations.

2. POWYS COUNTY COUNCIL’S PROPOSALS

2.1 Powys County Council were informed of an anomaly in the boundary between the Communities of Brecon and Llanfrynach whereby the property of White House in the village of is within the boundary of the Community of Brecon whilst the rest of the village of Groesffordd is in the ward of the Community of Llanfrynach. Powys County Council propose that the boundary between the Communities of Brecon (St Mary Ward) and Llanfrynach (Llanhamlach Ward) be modified accordingly.

2.2 Powys County Council’s proposals were submitted to the Commission on 7 February 2003. The Commission have not received any representations about the proposals.

3. THE COMMISSION’S CONSIDERATION

3.1 We first considered whether the County Council had conducted their review in accordance with the procedure set out in the Act. We then considered whether the proposals recommended were apt for securing effective and convenient local government.

4. PROCEDURE

4.1 We are satisfied that the Powys County Council have conducted the review in accordance with the procedure set out in Section 60 of the Act.

4.2 Powys County Council initially consulted Brecon Town Council, Llanfrynach Community Council, the local members of Powys County Council and the residents of White House. All of the consultees considered that it would be appropriate for the boundary between the two communities to be modified.

4.3 At the Board Meeting of Powys County Council on 25 June 2002 it was reported that:

“Powys County Council has conducted a small boundary review at Groesffordd where an anomaly came to light in relation to the precise boundary between the Communities of Brecon Town and Llanfrynach. The Council has completed the first stage of this review

1 by presenting its Draft Proposals for the revision of the boundary in question. Notice of the Draft Proposals was given, and although comments from interested parties had earlier been received, no further comments were had at this stage.”

4.4 As Powys County Council received no further comments during consultations on its Draft Proposals, Final Proposals were made, without modification, and submitted to the Commission on 7 February 2003.

5. DEFINING THE BOUNDARY

5.1 We noted that although Powys County Council’s proposals identified the property to be transferred, the line of the new boundary was not defined. The Council confirmed that it was content for the Commission to define the boundaries.

5.2 We agreed that in order to identify amendments to the boundaries it would be necessary to make a site visit to the area. Accordingly, officers of the Commission made a visit to the area in May 2003. As a result of this visit we made proposals for changes to the boundaries between the communities (Appendix 1). These proposals were sent to Powys County Council, Brecon Town Council, Llanfrynach Community Council and the residents involved for their comments.

5.4 In response to the proposals, all of the consultees informed the Commission that they were content with the suggested boundary.

6. PROPOSALS

6.1 We have noted the support for the proposed change to the boundary between the two community areas.

6.2 Members of the Commission’s Secretariat have visited the area and consider that the proposed boundary is both clearly defined and effectively marks the boundary between the two communities of Brecon and Llanfrynach.

6.3 We have considered Powys County Council’s proposals and have decided that they are apt for securing effective and convenient local government in the area. We have modified the proposals to define the amended boundary. Accordingly, we make the proposals as modified, to the National Assembly for Wales. A map showing the area under review can be found at Appendix 1.

7. CONSEQUENTIAL ARRANGEMENTS

7.1 Under Section 54(1) (e) of the Act, the Commission may make proposals for change of electoral arrangements for any local government area, which is consequential on any proposed change in local government areas.

7.2 The Brecon Community Ward of St. Mary forms the St. Mary electoral division and the Community of Llanfrynach with the Communities of and Talybont-on-Usk forms the Talybont-on-Usk electoral division. The proposed transfer of a single property with two electors from the Community of Brecon to the Community of Llanfrynach will not have a significant impact on the councillor:electorate ratio of either electoral division and therefore will not require a consequential change to the electoral arrangements for the County Council of Powys other than a change to the boundary between the St. Mary and Talybont-on-Usk electoral divisions.

7.3 In considering the consequential effects on the electoral arrangements for the Communities of Brecon and Llanfrynach we again noted the small number of electors involved and therefore propose no change to the electoral arrangements for the Community Councils other than the change to the boundaries of the St. Mary Ward of the Community of Brecon and the Llanhamlach Ward of the Community of Llanfrynach.

8. RESPONSES TO THIS REPORT

8.1 Having completed our consideration of the review of the boundary between the Communities of Brecon and Llanfrynach and submitted our recommendations to the National Assembly for Wales, we have fulfilled our statutory obligation under the Act.

8.2 It now falls to the National Assembly for Wales, if it thinks fit, to accept them or to direct the Commission to conduct a further review.

8.3 Any further representations concerning the matters in the report should be addressed to the National Assembly for Wales. They should be made as soon as possible, and in any event not later than six weeks from the date that the Commission’s recommendations are submitted to the National Assembly for Wales.
