Received: 05.04.2020 Revised: 12.05.2020 Accepted: 03.06.2020 Abstract This article deals with the history of the writing of Mabsut by Abu Bakr Muhammad ibn Ahmad Sarakhsi, a scholar of the Hanafi school of Islamic jurisprudence known as Shamsulaimma; the author’s style, the book’s importance in the Hanafi school, its definition, its confessions by other scholars, and the financial and property relations in it. In particular, the issues in the Book of Guarantees mentioned in Volume 20 of this work have been studied and supported by verses from the Qur'an, hadiths and intellectual evidence. The article also describes how he studied the warranty issues in the warranty book. In particular, Sarakhsi in his time pointed out that it is possible to deal with the issuance of a power of attorney instead of money, and through this to conduct trade operations. Based on this information, conclusions are given at the end of the article. This paper attempts to study international law of Islam and compare it with the international law notions of Roman law. It first evaluates claims of the Orientalists about the Islamic law in general and then compares International law of Islam with the Roman notions of international law. Muhaddith ibn Abi al-Dunya and ibn Asakir narrate that Durra, the daughter of Abu Lahab, once passed by a man who saw her and said: This girl is the daughter of Abu Lahab, the enemy of Allah. Durra radiyAllahu 'anha replied: Indeed Allah has mentioned my father due to his esteemed lineage whereas He has not mentioned your father due to his ignorance. She then told the Prophet sallAllahu 'alaihi wasallam of this, so the Prophet sallAllahu 'alaihi wasallam delivered a sermon saying: Do not taunt a Muslim because of a Kafir. The meaning of this advice is that do not mention the disbelievers in a way that is hurtful to the Muslims and due to which they feel sorrow. A Muslim must always be respected so much so that even if his close relatives are disbelievers, they must not be talked of in a way that would hurt the Muslim and cause him anger.

This paper finds out what Zina (fornication) is under Islamic law because in Islamic jurisprudence only coerced zina is regarded as rape. Thus, this paper is classifying rape in the same category as Zina. By classifying rape as a subset of Zina can only sort out the juridical issues that are emanating from coerced Zina.

To analyze the Muslim consumer utility, in addition to the Islamic economics heritage, we rely on the instruments and prevailing assumptions in economics. Shaibani’s (750-805 AD) analysis of earning/spending/utility is based on three successive layers of earning/spending/utility; namely, the imperative, recommended, and the permissible. In this paper, we firstly contribute to developing a measure of the overspending and underspending. Secondly, based on the social solidarity, we show that the marginal earning has an effect on the macro MPC and depends mostly on the first differences between the MPC of the lower and upper social groups. Thirdly, according to the social welfare function, the permissible marginal utility is related to the faith interaction driving to an efficient transfer of purchasing capabilities to the targeted group. The optimal faithful behavior of affluent group leads, in the worldly life, to an elasticity of marginal utility less than or equal to one.

It discusses his influence on Persian literature, his central role in the Naqshbandi Order, and his input in clarifying Ibn Arabi's thought. Jami spent most of his life in Herat, the main center for artistic ability and aptitude in the fifteenth century; the city where Jami grew up, studied, flourished and produced a variety of prose and poetry.

  • The Revival of Islam in Post-Soviet Independent Tajikistan
    Dr. Zubaidullo UBAIDULLOEV Senior Research Fellow, Rudaki Institute of Language, Literature, Oriental Studies and Written Heritage, Academy of Sciences of the Republic of Tajikistan The revival of Islam in post-Soviet independent Tajikistan Abstract: Islam has been present in Tajikistan for many centuries. Islam is regarded not only as a religion for most of the population of Tajikistan, but as a substantial and organic part of the history and culture of Tajik people. Therefore, despite the historical events and the situation in the country, Islam has always been present in the life of the population since its arrival in the seventh century. Islam survived in Tajikistan during the Soviet period in widely varied forms, because of the strength of an indigenous popular Islam quite apart from the Soviet-sanctioned Islamic administration. This paper analyses the revival of Islam in Tajikistan since its independence from the former USSR in 1991. It will focus on the following themes: a). Islam and politics in Tajikistan since independence; b). External influence in the country’s religious life; and c). Challenges and changes in religious life of the society; d). Resurgence of Ismailia (a branch of Shi’a sect) in Mountainous Badakhshan Autonomous Province. The role of Islamic thinking and the role of Islam itself are increasing in the modern political processes of Tajikistan since the independence. The emergence of an independent Tajikistan and other Central Asian nations after about 150 years of Russian and Soviet colonialism and rule has brought a whole region back into the world of Islam. The population of over sixty million people is part of a rich Muslim Central Asian tradition of high Islamic civilization in the Middle Ages are now discovering their roots, which the Soviet regime had been determined to eradicate.

The book discusses in detail the religious rulings concerning Muslim spies working for "the vicious Crusader campaign that is launched by the United States and its allies against Muslims and Islamic countries." The book contains an introduction by Ayman al-Zawahiri, Al-Qa'ida's second in command, who emphasizes the importance of the topic of the book and praises Al-Libi's "valuable, serious, scientific, and practical research on the Islamic judgment on spying." In the book, Al- Libi discusses in extensive detail all religious rulings concerning Muslim spies, emphasizing that they are "apostates" and therefore should be killed as they disclose "the shortcomings of Muslims." He also warns of their danger, saying: "One single piece of information transmitted to them, by one of their spies, is able to exasperate spirits, honor, and possessions in a way that thousands of their mobilized soldiers cannot do." The book was released and published by the Al-Fajr Media Center.
