PATTERNICITY AND PERSUASION: EVOLUTIONARY BIOLOGY AS A BRIDGE BETWEEN ECONOMIC AND NARRATIVE ANALYSIS IN THE LAW James D. Ridgway* ―We are not Homo sapiens, Wise Man . We are Pan narrans, the storytelling ape.‖1 A defining characteristic of humanity is our pervasive use of tools to solve problems. Legal theory is an endeavor with its own toolbox: methods of construction and deconstruction that are applied to a huge spectrum of problems. In recent years, economics has been one of the law‘s dominant analytical tools, and evolutionary biology has rapidly increased in its usage.2 Narrative theory—the study of storytelling and how it influences the decision-making process3—is far less discussed as a tool of legal analysis, but has its own adherents. Although these tools are clearly useful, their foundations and persuasive power have not been fully explored. As demonstrated by this article, evolutionary biology can now explain how human beings instinctively approach legal analysis and what features from economic and narrative analysis are rooted in the information processing functions of the brain. As a result, the most effective aspects of each can be synthesized into a new tool: analysis of the archetypal interactions that can be used to dissect any legal problem. On the surface, these tools may appear to be distinct. Yet, the connections between economics, narrative theory, and evolution run deep. He is a former professional cyclist, a professor at Claremont Graduate University in California, and the Executive Director of the Skeptics Society. It is in this last role as a professional unbeliever that Shermer has really made a name for himself. Raised within a household largely apathetic to religious issues, Shermer embraced Christianity as a teenager and pursued his new spirituality with gusto. But after some time Shermer‘s faith began to wane and ultimately guttered out. Now, armed with an education in experimental psychology and history, Shermer opposes belief in all things supernatural and paranormal by writing books on these issues, publishing a magazine entitled Skeptic, debating prominent believers, and standing in as the designated doubter in various media appearances. 1. CHRIS DORAN imaginethatwe have all had occasion to look up into the sky on a clear night, gaze at the countless stars, and think about how small we are in comparison to the enormity of the universe. For everyone except Ithe most strident atheist (although I suspect that even s/he has at one point considered the same feeling), staring into space can be a stark reminder that the universe is much grander than we could ever imagine, which may cause us to contemplate who or what might have put this universe together. Darwinism is dangerous because it infers that God did not directly and purposefully create us. It simply states that we evolved. They attempt to redefine science to encompass the supernatural as well as the natural world. They accept Darwin’s evolution, if an Intelligent Designer is (sometimes) substituted for natural selection. The Design Argument
The design argument The different versions of the cosmological argument we discussed over the last few weeks were arguments for the existence of God based on extremely abstract and general features of the universe, such as the fact that some things come into existence, and that there are some contingent things. The argument we’ll be discussing today is not like this. The basic idea of the argument is that if we pay close attention to the details of the universe in which we live, we’ll be able to see that that universe must have been created by an intelligent designer. This design argument, or, as its sometimes called, the teleological argument, has probably been the most influential argument for the existence of God throughout most of history. You will by now not be surprised that a version of the teleological argument can be found in the writings of Thomas Aquinas. You will by now not be surprised that a version of the teleological argument can be found in the writings of Thomas Aquinas. Aquinas is noting that things we observe in nature, like plants and animals, typically act in ways which are advantageous to themselves. Think, for example, of the way that many plants grow in the direction of light. Clearly, as Aquinas says, plants don’t do this because they know where the light is; as he says, they “lack knowledge.” But then how do they manage this? What does explain the fact that plants grow in the direction of light, if not knowledge? Aquinas’ answer to this question is that they must be “directed to their end” -- i.e., designed to be such as to grow toward the light -- by God. -

Carl Sagan’s “Baloney Detection Kit” In his 1995 book The Demon-Haunted World: Science as a Candle in the Dark, Carl Sagan provides a list of 20 common fallacies to watch out for (especially in religion and politics).
