True to its promise of disrupting the democratic process, the Taliban carried out a series candidates take polls head of deadly attacks recently, including a suicide bombing of a five-star hotel on March 2 that on killed a foreign election observer and eight other people, forcing two major international th election observer groups to pull out of Afghanistan. However, Afghan Independent Election Commission (IEC) officials have played down the absence of these groups, insisting that dozens more like them will stay to monitor the polls. IEC spokesman Noor Mohammad Noor says their panel has registered 14 international observer groups and the pullout of two missions would not disrupt the monitoring process, according to Pajhwok — an independent Afghan news agency.

    PREFACE PREFACE The National Economic Council (NEC) in its meeting held on 10th June 2020 approved Block Allocation of Rs. 15000 million in the Federal PSDP for Annual Development Program (ADP) of Gilgit-Baltistan for the year 2020-21. The Federal Government has kept GB share unchanged from the previous Financial Year, including Foreign Aid Component of Rs. 2000 million, despite the fact that the country has been ravaged by the outbreak of COVID- 19. The Foreign Aid Component has been provided for the Economic Transformation Initiative (ETI) in Gilgit-Baltistan. The ADP 2020-21 has been formulated with a vision to provide better facilities of life including access to energy, sanitation, basic health care, education, communication, and sustainable livelihood to the people of the region. Major intervention areas include essential health care services, new facilities for Covid-19 patients, roads and bridges across remote valleys, water supply and sanitation schemes, IT based learning projects, and generation and distribution projects in power sector. The Covid-19 crisis is the most serious crisis in our living memory hitting world economy, public health, tourism, and almost all facets of our public life. GB government has allocated substantial resources in ADP 2020-21 to tackle this crisis. We are also grateful to the federal government which has promised matching grant for all Covid related development expenditure. FY 2019-20 remained another successful year in the development history of Gilgit-Baltistan, as GB Government has been ahead of other provinces as far as utilization of the development funds are concerned. For the last five consecutive years, the GB Government has been achieving 100% utilization of development funds and we hope to achieve this goal in the current year too.

He dismissed the Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry, on the charges of corruption. This presidential move was not against the chief justice of Pakistan but against the judiciary. The executive intent to tarnish and erode judiciary’s image, integrity and authority was countered by a countrywide movement for the restoration of judiciary. A consolidated struggle of the bar and the bench lead to judicial revivalism in Pakistan. ______ Historical background Authoritarianism as a colonial legacy was incorporated in the political system of both Pakistan and India. From the very beginning India quite successfully tried to democratise itself. There ‘the rule of law was ever bent to subserve either executive action in the administration or the will of dominant elements of society’. On the other hand, Pakistan failed to make a worthwhile change to democratic rule after emerging from the debris of British colonialism. The colonial state was quickly replaced by authoritarian rulers, whether civilian or military. History of Pakistan has been defined by uneasy relationships between state institutions and civil society. In its executive-dominated state, the superior courts in particular have played unusually important part in determining the country’s political fate.1 The conflict between Pakistan’s executive orders and judicial authorities dates back to the era of Liaquat Ali Khan when the country was in its teething years.

Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime.

After the war of 1971, the people and leaders of Pakistan were forced to rethink the future of the remaining country.

(On appeal from the judgment/order, dated 31-12-1998 passed by High Court of Balochistan, Quetta in R.F.A. No.35 of 1998). (a) Benami transaction--- ----Determination of question as to whether transaction was Benami or not---Factors to be taken into consideration---Burden of proof---Principles. For determining the question, whether a transaction is a Benami transaction or not, inter alia the following factors are to be taken into consideration:- (i) source of consideration; (ii) from whose custody the original title deed and other documents came in evidence; (iii) who is in possession of the suit property; and (iv) motive for the Benami transaction. The initial burden of proof is on the party who alleges that an ostensible owner is a Benamidar for him and that the weakness in the defence evidence would not relieve a plaintiff from discharging the above burden of proof. However, the burden of proof may shift from one party to the other during the trial of a suit. Once the burden of proof is shifted from a plaintiff on a defendant and if he fails to discharge the burden of proof so shifted on him, the plaintiff shall succeed. The question whether a transaction is Benami in character or not has to be decided keeping in view a number of factors/considerations.
