No further action is required. In addition, no natural or mining related hazards have been identified in the immediate vicinity of the Site. Although outside the scope of this assessment we would draw your attention to the Additional Considerations detailed later in this section of the report. We have been informed by the client that the Site is currently in office/retail use and that it will continue in this use without redevelopment. The historic and current use of the Site therefore presents a low risk. Regulatory Compliance No authorisations, licences, consents or enforcements have been identified at or within 25m of the Site. Surrounding area use A limited number of historic or current potentially contaminative uses were identified in proximity to the Site. These relate to a small garage 100m north, that was in unspecified use circa 1931 and marked as ‘Dreadnought Garage’ in 1951 to 1968. This garage was redeveloped post 1973 for commercial use. Current surrounding properties appear to be predominantly in office/retail use According to trade directories, current or recent operations in proximity to the Site include printers and confectionery manufacturers. The historic and current use of the surrounding area is therefore considered to present a low to moderate risk to the Site. Environmental sensitivity Soils of high (urban) leaching potential and a major aquifer have been identified beneath the Site associated with Chalk solid geology. Six licenced abstractions are located within 1km. The closest two (385m west) are held by Brighton Borough Council for spray irrigation. The English Channel is located approximately 50m south and no residential properties or other sensitive land uses are located in proximity to the Site. In addition no ecologically significant habitats were identified. The Site is therefore considered to have a moderate to high environmental sensitivity. Conclusion In our opinion, there is a low risk of soil and groundwater contamination from on-site sources. As regards off-site sources, the risk is considered as low to moderate. These potential sources of contamination have been considered in light of the Site’s moderate to high environmental sensitivity. In conclusion, in the context of this assessment and assuming a non-sensitive end-use, no Liabilities have been identified in relation to soil and groundwater issues. No further action is required. Sources of Information No additional materials have been used in this assessment. www.argyllenvironmental.com 0845 458 5250 Intelligent Due Diligence iv Additional Considerations Whilst this assessment is primarily a desktop assessment of potential soil and groundwater liabilities, the following potential liability considerations that fall outside the scope of the Risk Analysis Methodology have been identified: Asbestos If the buildings at the Site were constructed or renovated during the period between 1950 and 1999, then the fabric of these buildings may contain asbestos in a variety of forms. Buildings constructed from 1950 to 1970 are most at risk. The Control of Asbestos at Work Regulations 2002 and HSE Guidance note MDHS 100, in respect of non-domestic premises, require the confirmation of the absence of asbestos or the management of asbestos through an Asbestos Register that records the location, type, condition, inspection regime and responsible persons. Such action was required by 21st May 2004. The maximum penalties for non-compliance are an unlimited fine and/or up to two years imprisonment. A Type II Asbestos Survey may therefore be required. Please contact us for a quotation. Air Conditioning/ Air conditioning and refrigeration equipment contains heat transfer fluid. This fluid may be an ozone depleting substance (ODS). Any fluid in a halon fire-extinguishing system is also a Refrigeration ODS.The use and reuse of ODSs (CFCs, HCFCs) and halons has been banned or severely Equipment restricted under The Environmental Protection (Controls on Ozone-Depleting Substances) Regulations 2002. It would be prudent to inspect the maintenance records for any such equipment at the Site and arrange removal of banned substances if necessary. The report is a desktop assessment of Liabilities which could arise under Part IIA of the Environmental Protection Act 1990 and/or the Water Resources Act 1991. If a risk is identified, then a number of options for managing the risk or transferring the risk are proposed. The focus of the report is to identify Liabilities that may affect the owner/occupier of the Site. The assessment of environmental liability under the Relevant Legislation (either Part IIA of the Environmental Protection Act 1990 (or where appropriate, equivalent requirements under the planning regime) and/or the Water Resources Act 1991) is based upon the principle of determining the presence of a potential source-pathway-receptor relationship. Where a ‘source’ is a source of contamination, a ‘pathway’ a medium through which the contamination can mobilise and ‘a receptor’ a person or entity
