FRONT COVER 1 3 PEN INTERNATIONAL CHARTER The PEN Charter is based on resolutions passed at its International Congresses and may be summarised as follows: PEN affirms that: 1. Literature knows no frontiers and must remain common currency among people in spite of political or international upheavals. 2. In all circumstances, and particularly in time of war, works of art, the patrimony of humanity at large, should be left untouched by national or political passion. 3. Members of PEN should at all times use what influence they have in favour of good understanding and mutual respect between nations; they pledge themselves to do their utmost to dispel race, class and national hatreds, and to champion the ideal of one humanity living in peace in one world. 4. PEN stands for the principle of unhampered transmission of thought within each nation and between all nations, and members pledge themselves to oppose any form of suppression of freedom of expression in the country and community to which they belong, as well as throughout the world wherever this is possible. PEN declares for a free press and opposes arbitrary censorship in time of peace. It believes that the necessary advance of the world towards a more highly organised political and economic order renders a free criticism of governments, administrations and institutions imperative. And since freedom implies voluntary restraint, members pledge themselves to oppose such evils of a free press as mendacious publication, deliberate falsehood and distortion of facts for political and personal ends. Membership of PEN is open to all qualified writers, editors and translators who subscribe to these aims, without regard to nationality, ethnic origin, language, colour or religion. -

CHINA (INCLUDES TIBET, XINJIANG, HONG KONG, AND MACAU) 2019 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary Reports on Hong Kong, Macau, Tibet, and Xinjiang are appended at the end of this report. The constitution, which cites the leadership of the Chinese Communist Party and the guidance of Marxism-Leninism and Mao Zedong Thought, states that citizens have freedom of religious belief but limits protections for religious practice to “normal religious activities” and does not define “normal.” Despite Chairman Xi Jinping’s decree that all members of the Chinese Communist Party (CCP) must be “unyielding Marxist atheists,” the government continued to exercise control over religion and restrict the activities and personal freedom of religious adherents that it perceived as threatening state or CCP interests, according to religious groups, nongovernmental organizations (NGOs), and international media reports. The government recognizes five official religions – Buddhism, Taoism, Islam, Protestantism, and Catholicism. Only religious groups belonging to the five state- sanctioned “patriotic religious associations” representing these religions are permitted to register with the government and officially permitted to hold worship services. There continued to be reports of deaths in custody and that the government tortured, physically abused, arrested, detained, sentenced to prison, subjected to forced indoctrination in CCP ideology, or harassed adherents of both registered and unregistered religious groups for activities related to their religious beliefs and practices. There were several reports of individuals committing suicide in detention, or, according to sources, as a result of being threatened and surveilled. In December Pastor Wang Yi was tried in secret and sentenced to nine years in prison by a court in Chengdu, Sichuan Province, in connection to his peaceful advocacy for religious freedom. -

China Policy Institute Policy Paper 2012: No.3 A convergence of China’s political reform agendas Andreas Fulda Significance A ten-year plan for social and political reform touted by Chinese establishment intellectual Yu Jianrong is gaining traction both within and outside China’s party-state. Yu’s plan is the most notable reform agenda to emerge since the Charter 08. It signifies a willingness among party-state officials to engage in open-ended discussions about democracy and human rights in China. What we need to know While the issue of political reform has been notably absent from official proclamations during the first days of the Chinese Communist Party’s 18th Party Congress, China’s political future is being widely debated both in Chinese establishment and non-establishment circles alike. Although both reform camps agree on the need for political change they differ in their specific reform recommendations: while establishment figures call for a gradual evolution of China’s political system, anti-establishment intellectuals call for a complete overhaul of the Chinese body politic along liberal democratic lines. Despite such differences a convergence of China’s political reform agendas can be observed. One of China’s most renowned establishment intellectuals Yu Jianrong has touted a ten-year plan for social and political reform which strikingly resembles parts of China’s Charter 08. China’s Charter 08 was inspired by the Charter 77, a petition promulgated by anti-Soviet dissidents in Czechoslovakia, and calls for an end to one-party rule and the protection of human rights. It has been signed by more than two thousand citizens within China and supported by more than ten thousand signatories abroad. -

LAW A COMPILATION OF A SERIES OF ‘EXPERT ON TIBET PROGRAMS For RADIO FREE ASIA By WARREN SMITH 1 VOICES FROM TIBET Voices from Tibet is a recently published collection of articles about Tibet by Tsering Woeser and her husband Wang Lixiong. The articles were translated into English and published by a Chinese-American woman named Violet Law. Woeser is well-known to many Tibetans as a commentator on the political situation in Tibet. Wang Lixiong is a Chinese democracy activist and supporter of Tibetan human rights. They are based in Beijing. This is the first of a series of programs on their collected articles. The first article, “Freedom for Chinese, Autonomy for Tibetans,” was written by Woeser. Woeser writes about her excitement in October 2010 upon hearing that the Nobel Peace Prize was awarded to the Chinese democracy activist Liu Xiaobo. Lui was the first Chinese to win the Nobel Peace Prize, assuming, of course, that one does not consider the Dalai Lama, who won the Peace Prize in 1989, to be Chinese. Liu had been the organizer, in 2008, of Charter 08, which Woeser had signed, which called for human rights, democracy and the rule of law in China. It was modeled after Charter 77, which had originated in Czechoslovakia in 1977 and was credited to have begun the collapse of the Soviet Union and its empire. In response to the uprising in Tibet in 2008, Liu had organized a petition of 30 Chinese intellectuals calling on the Chinese Government to respect Tibetans’ rights, to cease the repression of their protests and to try to understand their grievances, and to allow them to exercise genuine autonomy as proposed by the Dalai Lama. -

Testimony before the U.S.-China Economic and Security Review Commission Perry Link University of California, Riverside Hearing on “China’s Media and Information Controls: The Impact in China and the United States”, September 10, 2009 “Media Response to the Appearance of Charter 08” Charter 08 is a citizens’ manifesto that calls for constitutional democracy, human rights, rule of law and republican government that observes a tri-partite separation of powers. It was the first public statement in the history of the People’s Republic of China to call for an end to one- party rule. Its drafters were inspired by the example of Charter 77 in Czechoslovakia, but their writing also shows influences from the U.S. Constitution, the French Declaration of the Rights of Man, the democratic movement in Taiwan in the 1980s, and the Truth and Reconciliation Commission in South Africa. The Charter was announced on December 9, 2009, the eve of the 60th anniversary of the United Nations’ promulgation of the Universal Declaration of Human Rights. After it was unveiled, the Charter received considerable notice around the world from governments, human rights organizations, and newspaper editorial boards. It drew praise from prominent political, religious, and literary leaders including Vaclav Havel, the Dalai Lama, Nadine Gordimer, Seamus Heaney, Wole Soyinka, Yu Ying-shih, Ha Jin, Zheng Yi, and many others. More than eight thousand people inside China have signed the Charter, and countless others have read it but feared to consider signing. Attention from the world’s media--outside of China--has been considerable. Inside China, the topic has been banned from the state-controlled media except for some minor and indirect instances in which the state itself has chosen to comment. -

Charter 08 is an open letter issued on 9 December 2008 by a group of 303 Chinese individuals including “writers, intellectuals, lawyers, journalists, retired Party officials, workers, peasants, and businessman”. Charter 08 calls for legal reforms, democracy and protection of human rights in China. A translation of Charter 08 into English by Human Rights in China (HRIC) is included as Attachment 1: This year is the 100th year of China’s Constitution, the 60th anniversary of the Universal Declaration of Human Rights, the 30th anniversary of the birth of the Democracy Wall, and the 10th year since China signed the International Covenant of Civil and Political Rights. -

Charter 08 Calling for Democracy in China Vision and Motivation Having witnessed the political liberalization that Mikhail Gorbachev undertook in the Soviet Union in the late 1980s, many Chinese were hoping for similar reforms at home. After the Soviet Union collapsed with the fall of the Berlin Wall in 1989, the Chinese became even more eager for change. When the Communist leadership in Beijing failed to deliver any reforms, over 100,000 Chinese citizens gathered in protest at Tiananmen Square in 1989, in what became known as the June 4th Incident. After being repressively silenced by the regime's military power, the Chinese opposition spent a significant portion of the 1990s and 2000s developing new strategies through which to address their grievances to the state and organize for democratic change. Understanding that they need not be limited by their Marxist philosophies, members of the Tiananmen protests reframed their idea of democracy in a post-Cold War world. In the spring of 2008, Nobel Laureate Liu Xiaobo, alongside fellow Chinese opposition members, began working on a political document modeled after the Czech Charter 77, a declaration by Vaclav Havel and the Czech opposition that called on the Communist government to accept all prior United Nations human rights conventions. Like the original Charter 77, whose signatories included an array of civil society members, the authors behind Charter 08 demand that the regime ratify the United Nations International Convention on Civil and Political Rights. GE.06-11626 E/CN.4/2006/NGO/217 page 2 TIBET : Women’s health under threath “There is indeed a high incidences of STDs, and health workers see a high risk of an HIV/AIDS epidemic developing in the TAR, but the participation of the Tibetan prostitutes in STDs prevention campaigns in Tibet is much lower, since much more than the Chinese sex workers, they fear public ‘outing’ and following ostracism.” – Tibet Information Network Between 1959-1979, the Communist campaign against the “four olds” also targeted the traditional Tibetan healing system. Tibetan medical institutes were closed down. Traditional medical professionals, who had honed their skills over a lifetime, were replaced by “barefoot doctors”, who had only six months to one year of training. Most of these paramedics—between the age group of 15-19 —had no formal education before their training.1 Foreign visitors to Tibet during that period recorded an increase in the incidence of cancer, dysentery and diarrhoea.2 After the economic liberalisation in 1979, there has been a noticeable improvement in health care facilities, at least in urban areas. -
