Introduction

1.1 Background

This report has been prepared by Nicola Stone MSc BSc (hons) on behalf of Ian Pick of Ian Pick Associates Ltd. It presents a shadow Habitats Regulations Assessments Screening as requested by Breckland Council during pre- application consultation advice.

1.2 Site Location

The proposed poultry unit is located on Land south of the A1066, Diss Road, near to Garboldisham, , Norfolk (TM01791 81061) shown in Figure 1.

1.3 Proposed Works

The proposal will provide four new poultry units, accommodating up to 200,000 broiler chickens. In order to operate the site will be permitted by the Environment Agency.

1.4 Aims and Objectives of the report

In accordance with Government policy, Breckland Council has to undertake a HRA assessment, as required by Regulation 61 of the Conservation of Habitats and Species Regulations 2017, in accordance with the EC Habitats Directive (Concil Direcie EEC before he concil as he compeen ahori nder he Reglaions can grant planning permission for a project.

Subject to certain exceptions, Breckland Council shall restrict or revoke permission where the integrity of a European (EU) Designated site would be adversely affected.

apT has been appointed to prepare a shadow Habitat Regulations Assessment for the installation of four new poultry units. The assessment will collate the information required to assess the implications of the project in relation to the European Site, and the sites conservation objectives.

1.5 Survey and Consultation

The shadow Habitat Regulations Assessment has been prepared by Nicola Stone who has over seven ears experience, as a professional ecologist within the planning system, undertaking complex Habitats Regulations Assessments.

1.6 Legislative and planning policy context

The process contribution of Ammonia & Nitrogen Deposition, from pre-application reference PE/00414/19, will be considered in line with:

The Conservation of Habitats and Species Regulations 2017 (which transposes the EC directive 92/43/EEC into UK law)1; The National Planning Policy Framework (NPPF) 2019; Natural DRAFT Air Quality Assessment Guideline Thresholds for Interim Use 2017/18 (provided by Ian Pick Associates Ltd); Environmental Permitting (England and Wales) Regulations 2016; Countryside and Rights of Way Act 2000; Natural Environment and Rural Communities Act 2006; Environmental Protection Act 1990; Wildlife and Countryside Act 1981; and Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999.

1.7 Constraints

A constraint to this Habitats Regulations Assessment is that there is currently conflicting advice from Natural England and the Environment Agency on how to screen the impact of ammonia from intensive livestock units on designated sites.

The Environment Agency in England, and Natural Resources Wales in Wales, assess impact from intensive livestock units on designated sites when determining Environmental Permits. The Environment Agency & Natural Resources Wales have a duty to consider the Habitat Regulations (2017) when issuing permits. The Environment Agency and Natural Resources Wales have reduced their screening distances to 5km for European Sites (gov.uk website). It can be inferred from this that the permitting bodies do not consider air pollution impacts o be significan more than 5km from the point source, and therefore screen out sites over 5km from the point source from further assessment.

Natural England through the planning system advise that screening to 10km for European Sites is still required.

For the sake of this shadow HRA apT has taken a precautionary view and has included, within the in- combination effects test, potential sources within 10km. One potential source has been identified which relates to another intensive poultry unit at Plantation Farm, Long Lane, Burton, Diss, Norfolk, IP22 5WA. Plantation Farm is 8.46km from Waveney and Little Ouse Valley Fens Special Area of Conservation SAC. An Environment Agency Permit, Reference: GP3936QC, has been issued for this site and is to be considered in-combination with the proposed new installation. Reference GP3936QC has not considered European sites within 10km either in the permitting process by the Environment Agency, or through the granting of planning permission, reference 2018/2601, when considered by Council. As ammonia screening for Waveney and Little Ouse Valley Fens Special Area of Conservation has not been undertaken for permit reference GP3936QC, and the information on the South Norfolk Council planning portal lacks detail on building design (which would allow an assessment of ammonia and nitrogen deposition to be undertaken), it has not been possible to undertake a realistic in-combination assessment. The assessment undertaken by apT is, therefore, over precautionary, and intentionally over estimates the impact of permit reference GP3936QC at Waveney and Little Ouse Valley Fens Special Area of Conservation.

Waveney and Little Ouse Valley Fens SAC is notified for its calcareous spring-fed valley fen systems and very extensive great fen-sedge Cladium mariscus beds. The SAC consists of several composite SSSIs of which Blo' Norton and Thelnetham Fens SSSI is one. Blo' Norton and Thelnetham Fens SSSI are of interest mainly because of the plant communities associated with the remaining areas of open fen.

The areas of fen least affected by drainage still support calcareous valley fen vegetation. A very large number of plant species are associated with these areas, including a number of locally significant mosses. In other parts of the fen, where there is some drying-out in summer, this type of vegetation is replaced by taller vegetation dominated by Phragmites australis (Common reed) and Filipendula ulmaria (Meadowsweet). This vegetation has a different range of associated species. Woodland and scrub have invaded quite large areas of all three fens. Beneath the woodland canopy, the ground flora is made up of a restricted range of fen plants and weedy species. In order to provide some control over the water table in the fen areas, the site boundary also encompasses several small fields and ditches. These are of some interest in their own right.

NE Protected sites – summary Natural England is currently satisfied, on the basis of the objective information which has so far been provided, that it can be concluded that the proposed plan or project will not have a significant effect on the Waveney and Little Ouse Valley Fens Special Area of Conservation SAC (SAC) when acting alone. However, in line with the Wealden judgement, Competent Authorities must assess the impacts of plans or projects alone and in combination with other plans or projects.

Description of the Under the proposal, four new poultry houses would be constructed on the green-field project and potential site to the south of the A1066, Diss Road. The proposed poultry houses would provide effect pathways: accommodation for up to 200,000 broiler chickens and would be ventilated by high speed ridge fans, each with a short chimney, with gable end fans providing supplementary ventilation during hot weather. The broiler chickens would be reared for up to 38 days and there would be approximately 7.6 flocks per annum.

The following effect pathway has been identified: 1. Air-borne Ammonia emissions (NH3): Possible impact of ammonia emissions from poultry rearing unit impacting on Waveney and Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI.

Nicola Stone has contacted Breckland Council to obtain details of application which fall under point 1 above. Planning Portal Output can be seen in appendix 1. Appendix 1 includes the information included within email dated 8th January 2020 from Nicola Stone to Simon Wood, Breckland Council Director of Planning and Building Control, and [email protected]. 54 planning applications were identified and were screened out of further assessment (the majority are storage buildings only).

2. Planning applications for livestock units that have planning permission but are not yet (fully) operating.

Nicola Stone has requested this information via email, example shown in appendix 2. No additional information has been provided by Beckland Council of applications which have planning permission but are not yet fully operational. No further consideration of point 2 has been undertaken.

3. Planning applications for livestock units that started operating after the most recen pdae of backgrond leels from APIS Janar

Nicola Stone has assessed the Environment Agency permit installations within 10km from the SAC, and requested the deails of he EA permis hich hae been varied/issued since the last update of APIS (January 2018). 11 EA permits were identified and assessed for an in-combination impact (appendix 3).

Of note:

Permit Reference XP3939GB for an addition of 31,000 broilers issued by the EA 24th March 2019. There has been no new planning application to facilitate the increase in bird number therefore this has not been included in the in-combination assessment as the building cannot be built and therefore is not functioning.

Permit Reference TP3130QY currently there are 2810 pigs under 30kg and 1990 pigs over 30kg. The EA permit has been varied dated 28th March 2019 to enable 3000 under 30kg and 3000 over 30kg. No new planning application has been submitted therefore the proposal has not been included in the in-combination assessment as the additional building cannot commence without it.

Permit Reference GP3936QC a new EA permit for 52,000 broiler breeder (layers) has been issued dated 9th December 2019. Planning permission has been granted by South Norfolk Council planning reference 2018/2601. Nicola Stone has requested the Ammonia Screening Tool output from the EA which was undertaken to assess impacts of air quality on designated sites during the permitting process (appendix 4). The EA has not assessed the impact on Waveney and Little Ouse Valley Fens SAC as they only screen European Designated sites within 5km of an installation (as per gov.uk).

This site will be considered in the in-combination assessment.

From the information on APIS, Waveney and Little Ouse Valley Fens SAC are in exceedance of the Nitrogen Critical Loads for H6410 Molinia meadows on calcareous, peaty or clayey-silt-laden soils (Molinion caeruleae).

Naral Englands Condiion Smmary lists the site as being in Favourable/Unfavourable-Recovering condition.

Initial screening for likelihood of significant effects on European Sites:

Air-borne Ammonia emissions (NH3): Large numbers of birds generate air borne ammonia which is highly soluble and will be deposited on surrounding habitat. Further information is required to determine the significance of additional ammonia from sources within 10km of the SAC.

An Appropriate Assessment is required.

HRA Stage 2 – Appropriate Assessment - Detailed analysis of further information

Effect pathway: Ammonia and Nitrogen Deposition

The following supporting information has been considered - A Report on the Modelling of the Dispersion and Deposition of Ammonia from the proposed broiler chicken rearing houses on land south of the A1066, Diss Road, near to Garboldisham, Therford, Norfolk prepared by Phil Edgington AS Modelling & Data Ltd dated 1st May 2020.

The AS Modelling & Data Ltd report sets out the critical levels and loads used during the modelling process and details the process contribution resulting from the proposed development upon the European Site.

The EA screening output above would screen out EU sites over a distance of 4188m from a point source. For example, folloing he EAs screening hresholds in order to screen out a point source from requiring further detailed modelling the process contribution would need to fall below 4% of the sites critical level and therefore be over 4188m from the EU designated site. The EA have updated their screening distances and no longer assess EU sites over 5km from a source.

The documents on the South Norfolk Planning portal for planning reference 2018/2601 lack detail. Ammonia modelling has not been undertaken, and there is not enough information to allow apT to undertake an ammonia assessment using Simple Calculation of Atmospheric Impact Limits (SCAIL) modelling.

As an over precaution, and as per the EA screening criteria above, if it is assumed that at 4188m a worst case scenario of PC Cle of 4% could be expected. Therefore at 4188m from the site this equates to the PC being 0.04 ug/m3. This assessment is over-precautionary and assuming the worst case at every step.

In order to convert NH3 concentration (µgm-3) to dry N-deposition (kgN ha-1yr-1) the following formula is used, this allows a nutrient Nitrogen critical load assessment to be carried out:

Dry deposition Ground level Deposition flux = concentration × velocity

Dry N-deposition resulting from environmental permit GP3936QC = 0.208 kgN ha-1yr-1 i.e. 1.38% of the sites Critical Load (Critical Load 15kgN ha-1yr). This will be assessed in-combination with the current application.

The Process Contribution resulting from the proposed scheme, plus the in-combination contribution from additional sources (calculated using an over precautionary methodology) results in an increase of 2.4% of the Critical Load of ammonia at Waveney and Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI. This is equivalent to 0.367 kg (367g) nitrogen deposition per hectare per year.

Referring to Natural England Research Report NECR210, specifically Table 21 Smma of elaionhip beeen long-term nitrogen deposition and species richness by habitat expressed as the amount of incremental N deposition (in kg N ha-1 yr-1 ) associated with a reduction in species richness of one species along the survey gradient sites. Modelled relationship only applied over N deposition range in which survey sites occurred; where no sites were eed a a gien N depoiion leel An increment of 0.367 kg/N, with a background level of 25.8 Kg/N will not, according to Natural Englands assessmens of sensitive sites within that report, have impact the integrity of the designated site Waveney And Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI.

Conclusions taking into account counteracting measures

In view of the above, and providing the development is carried out according to the details submitted, the proposal will not lead to significantly increased concentrations of ammonia and nitrogen deposition at Waveney And Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI. There will be no adverse effect on the integrity of Waveney and Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI through this development, either alone or in combination.

The Significance test apT had identified that the proposed works to provide 4 new poultry units, accommodating up to 200,000 broiler chickens, at Land south of the A1066, Diss Road, near to Garboldisham, Thetford, Norfolk (TM01791 81061), may have a significant effect on Waveney And Little Ouse Velley Fens SAC/Blo' Norton and Thelnetham Fens SSSI by an increase in nitrogen deposition. The Habitats Regulations Assessment process could not be satisfied, further information and analysis was required and it was considered that an Appropriate Assessment was needed.

The Integrity test apT has undertaken an Appropriate Assessment and can conclude, with sufficient certainty to enable a conclusion, that the development will not adversely affect the integrity of the European Designated Site.

Conclusions apT has not identified a legal barrier, under the Habitat Regulation Assessment process, to planning permission being granted in this case. The Local Planning Authority must formally consult Natural England and take their comments into consideration prior to a planning decision being made.
