3 1.0 Introduction

This Part A submission is made on behalf of Greater Shepparton City Council (Council). Council is the Planning Authority in respect of Amendment C205 (the Amendment) to the Greater Shepparton Planning Scheme (Planning Scheme).

This submission was prepared by Council in collaboration with Heritage Concepts Pty Ltd (Heritage Concepts).

The Draft Greater Shepparton Heritage Study Stage II 2019 (the Draft Study) seeks to consolidate and update the recommendations of the Greater Shepparton Heritage Study Stage IIB 2013 and the Greater Shepparton Heritage Study Stage IIC 2017 into one document. The Amendment seeks to give effect to the findings and recommendations of the Draft Study by applying a permanent Heritage Overlay to 178 places on a permanent basis where controls currently apply on an interim basis.

A total of 42 submissions were received by Council in response to the Amendment.

Council has sought to engage with all submitters and relevant stakeholders to resolve as many of the concerns raised in submissions to the Amendment.

As directed by Planning Panels (PPV), this Part A submission includes the following:

• background to the Amendment including a chronology of events; • strategic context and assessment; • identification of issues raised in submissions and Council officers’ response; and • proposed changes to the Amendment in response to submissions received and all other proposed changes.

On Friday, 18 October 2019, a Directions Hearing was held at Council offices at 90 Welsford Street, Shepparton. On Tuesday, 22 October 2019 the Panel issued written directions in relation to the proceedings of the Panel Hearing. A revised Directions Letter was sent to all parties on Tuesday, 29 October 2019.

The Panel has directed that Council circulate its Part A submission to the parties on the distribution list by 4.00pm on Friday, 22 November 2019.

The Panel has directed that Council’s Heritage Expert circulate their expert witness report to the parties on the distribution list by 4.00pm on Friday, 22 November 2019.

The Panel has directed that Council circulate its Part B submission to the parties on the distribution list on Monday, 2 December 2019 at the Panel Hearing.

Council’s submission to the Panel should be read in conjunction with the following documents: • Draft Greater Shepparton Heritage Study Stage II 2019 prepared by Heritage Concepts; • The Explanatory Report for Amendment C205 and the associated Amendment documentation; and

4 • The Expert Witness Statement from Heritage Concepts.

2.0 Background to the Amendment

2.1 Land Subject of the Amendment

The Amendment applies to all land currently within and proposed to be included in the Heritage Overlay of the Planning Scheme within the City of Greater Shepparton.

Specifically, the Amendment affects 1,089 properties in the City of Greater Shepparton municipality. There are:

• 619 properties of ‘individual’ heritage significance (including places in ‘group’ listings);

• 327 properties of ‘contributory’ heritage significance in heritage precincts; and

• 138 properties of ‘non-contributory’ heritage significance in heritage precincts.

A full list of the properties included in by the Amendment is outlined in Appendix 1 – Places affected by the Amendment.

2.2 Chronology of Events

The following information provides a timeline of the relevant strategic planning work for the Amendment.

• 2001: City of Greater Shepparton Heritage Study Stage I (HSI) undertaken by SOMA Design Partnership Pty Ltd in 2001 and 2002. 135 places of cultural heritage significance were identified. • 2004: Greater Shepparton Heritage Study Stage II (HSII) undertaken by Allom Lovell and Associates Pty Ltd (now Lovell Chen Pty Ltd). HSII included a comprehensive review of previously identified significant places and recommended that an additional 135 places, including two residential precincts (HO140 & HO141), be included within the Heritage Overlay. HSII also recommended 90 additional places be investigated as part of a follow up study. • 23 December 2004: Recommendations of HSII implemented on an interim basis through Amendment C49 to the Planning Scheme. • 27 September 2007: Amendment C50 approved by the Minister for Planning to introduce the findings and recommendations of HSII 2004 the Planning Scheme. • 2009 and 2010: Greater Shepparton Heritage Study Stage IIB (HSIIB) undertaken by Heritage Concepts. HSIIB identified gaps in previous studies and made recommendations for the conservation of places of post-European contact cultural heritage significance. HSIIB was adopted by Council at the Ordinary Council Meeting (OCM) held on 21 September 2010. • 23 October 2013: Amendment C110 approved and gazetted by the Minister for Planning. • 2016 – 2017: The Greater Shepparton Heritage Advisory Committee, Council officers and Council’s Heritage Advisor begin preparing the Greater Shepparton Heritage Study Stage IIC (HSIIC). HSIIC identified 180 places across Greater Shepparton to

5 be of ‘individual’ heritage significance and recommended a Heritage Overlay apply to these properties as part of a future planning scheme amendment. • 18 July 2017: Council resolved to endorse and release HSIIC for public comment. 57 submissions were received during this time. • 10 December 2017: Council resolved to adopt HSIIC and prepare and exhibit a planning scheme amendment to include the findings and recommendations into the Planning Scheme. • Early to Mid-2018: After discussions with Department of Environment, Land, Water and Planning (DELWP) Council officers begin preparing the Amendment documentation for amendment C204 (Interim Heritage Controls). • 21 June 2018: Authorisation for Amendment C205 received from DELWP. • 20 November 2018: The Minister for Planning introduced Amendment C204 which applied interim heritage controls to 178 places including 5 precincts in Dookie and Murchison. The controls were scheduled to expire on 2 May 2019. • 2 May 2019: The Minister for Planning introduced Amendment C216 (Extension to Interim Heritage Controls) to extend the expiry date of interim heritage controls (until 1 May 2020) to allow Council further time to prepare Amendment C205 (Permanent Heritage Controls). • 11 June 2019: Land owners and occupiers of land, referral authorities and relevant ministers notified of exhibition of Amendment C205 via letter. • 13 June - 26 August 2019: Exhibition of Amendment C205. • 24 September 2019: Council officers under delegation request an Independent Planning Panel for the Amendment. • 18 October 2019: Directions Hearing for Amendment C205. • 2 December 2019: Planning Panel Hearing for Amendment C205.

2.3 Strategic Justification

Amendment C205 seeks to give effect to the findings and recommendations of the amalgamated Draft Study in the Planning Scheme.

Additionally, the Amendment is also required to implement recommendation 36 of the Planning Panel Report for Amendment C110 to the Planning Scheme, dated 26 April 2013, which recommended that a new incorporated plan be prepared to include all of the statements of significance for places in the Heritage Overlay to strengthen the level of protection afforded to these places.

The Amendment removes the Interim Heritage controls on 63, 65 and 67 Rea Street, Shepparton (HO406) and applies HO140 to these properties on a permanent basis. The Amendment proposes to apply an additional Heritage Overlay to 30 places of ‘Individual’ heritage significance in existing heritage precincts to appropriately reflect the significance of these places of ‘Individual’ significance and of ‘Contributory’ significance to the precinct.

The Amendment is required to make a number of mapping changes introduced through Amendment C204 to better ensure that all Heritage Overlays are applied with an appropriate curtilage. The Amendment also seeks to ensure consistency with reforms to the Heritage Overlay implemented through Amendment VC148 on 31 July 2018.

6 The places of ‘Individual’ and ‘Contributory’ significance were assessed against the standard criteria contained in Practice Note 01 Applying the Heritage Overlay (August 2018) and are considered to meet the requirements of local protection through the Heritage Overlay.

2.3.1 Environment, Economic and Social Effects of the Amendment

The Amendment has no significant effects on the environment. The Amendment provides a mechanism for the protection of the richness and diversity of the built and natural environment of Greater Shepparton.

The Amendment will have positive environmental impacts by protecting places of heritage significance.

The social and economic effects of the Amendment will be further detailed in Council’s Part B submission.

2.4 Public Exhibition and Engagement

The Amendment was exhibited in accordance with the Planning & Environment Act 1987 (the Act) from Thursday, 13 June 2019 to Monday, 26 August 2019 and the following notice was provided:

• Letters sent to land owners and occupiers of land on Monday, 10 June 2019; • Letters sent to relevant referral authorities on Monday, 10 June 2019; • Letters sent to prescribed ministers on Monday, 10 June 2019; • Notice in the Shepparton News on Tuesday, 11 June 2019; • Notice in the Victoria Government Gazette on Thursday, 13 June 2019; • One-to-one meetings with submitters on: o Tuesday, 2 July 2019; o Friday, 5 July 2019; o Wednesday, 10 July 2019; o Monday, 22 July 2019; o Friday, 9 August 2019; and o Tuesday, 13 August 2019. • Notice on Greater Shepparton City Council website; • Notice on DELWP’s website; and • A copy of the exhibition documentation was placed in the foyer of the Council offices at 90 Welsford Street, Shepparton.

Council conducted over 50 one-to-one consultation sessions with land owners affected by the Amendment and fielded over 50 telephone conversations to discuss any queries and concerns of those notified of the Amendment.

2.5 Submissions Received in Response to the Amendment

A total of 42 submissions have been received regarding the Amendment. Please refer to Figure 1 below.

Three (3) of the submissions (Submissions 1, 4 and 40) were received from referral authorities, which did not object to or request changes to the proposed Amendment. These referral authorities are:

1. Powercor; 2. Goulburn Broken Catchment Management Authority; and 3. Goulburn-Murray Water.

39 submissions (Submissions 2, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 41 and 42) were received that objected to and/or requested changes to the proposed Amendment.

2.6 Heritage Studies in Greater Shepparton

Over the past two decades, three heritage studies were undertaken by Council. Each heritage study assessed and identified places of cultural heritage significance and recommended that the Heritage Overlay apply to these places to conserve them and guide future development approvals.

2.6.1 City of Greater Shepparton Heritage Study Stage I 2001 (HSI)

HSI was prepared by SOMA Design Partnership Pty Ltd in 2001 and 2002. HSI identified 135 places of heritage significance taken in the context of a brief environmental thematic history. HSI did not include a data sheet for each place, nor were photographs of places provided.

8 2.6.2 Greater Shepparton Heritage Study Stage II 2004 (HSII)

Due to the ‘preliminary’ nature of HSI, Council engaged Allom Lovell and Associates Pty Ltd (now Lovell Chen Pty Ltd) in March 2002 to prepare HSII which involved reviewing the Thematic Environmental History (TEH) (which was drafted as part of HSI in 2000) and resurveying the 135 sites identified in HSI.

An assessment of an additional six (6) identified places was undertaken independently by Heritage Concepts while this study was in progress. The assessments were of five log structures (HO143 – Delaney’s Hut, HO146 – log structure, HO142 – log structures, HO144 – Snelling’s Property and HO145 log structure) and a scotch kiln (HO147), and have been incorporated as Volume Six of HSII. It was adopted by Council at the OCM held on 4 May 2004.

This Study also recommended that ninety (90) additional places of cultural heritage significance be investigated as part of a follow-up study.

Amendment C49 was gazetted on 23 December 2004, which applied the Heritage Overlay to all places identified in HSII on an interim basis. These controls were applied permanently until Amendment C50 which was approved by the Minister for Planning and gazetted on 27 September 2007.

2.6.3 Greater Shepparton Heritage Study Stage IIB 2019-2010 (HSIIB)

HSIIB was prepared by Heritage Concepts in 2009 and 2010.

HSIIB identified gaps in previous heritage studies and recommended that a list of places of cultural heritage significance should be considered as part of any future planning scheme amendment. HSIIB also makes recommendations for the conservation of places of post contact cultural heritage significance to the City of Greater Shepparton.

HSIIB was adopted by Council at the OCM held on 21 September 2010.

2.6.4 Greater Shepparton Heritage Study Stage IIC 2017 (HSIIC)

It was clear that a number of rural areas identified in the TEH had not been identified as part of previous heritage studies.

The key purpose of HSIIC was to document places of post-contact cultural heritage significance to the City of Greater Shepparton and to make recommendations for their conservation. HSIIC had a particular focus on places of local cultural heritage significance in rural areas. The places identified in HSIIC best represent the rich and diverse rural history of the City of Greater Shepparton. Additionally a number of places in Shepparton and were assessed and identified based on the recommendations of previous heritage studies. Collectively, such places reflect the socio-economic and cultural history of the municipality. Places of local cultural heritage significance also form an integral part of the State and Commonwealth’s heritage.

9 The places included within HSIIC provide tangible physical evidence of the development of the municipality.

The process for identification of places included within HSIIC is unique in that a number of places were recommended by members of the Greater Shepparton Heritage Advisory Committee and other nominations were received from members of the community. Where proposed places have met the thresholds for local significance, as deemed by Council’s Heritage Advisor, they were included within HSIIC.

After undertaking several months of consultation, at the OCM held on 17 December 2017, Council resolved to:

1. adopt the Greater Shepparton Heritage Study Stage IIC December 2017; and 2. prepare and exhibit a planning scheme amendment to include the findings and recommendations of the Greater Shepparton Heritage Study Stage IIC December 2017, and the outstanding recommendations from the Panel Report for Amendment C110, into the Greater Shepparton Planning Scheme.

2.7 Heritage Amendments in Greater Shepparton

2.7.1 Amendment C49

The recommendations of HSII were implemented on an interim basis through Amendment C49 to the Planning Scheme, which was approved and gazetted by the Minister for Planning on 23 December 2004.

The Amendment included 135 places (including two precincts) within the Heritage Overlay on an interim basis.

2.7.2 Amendment C51

On 8 July 2004, Amendment C51 applied interim heritage controls to land at 72 Orr Street, Shepparton within the proposed Shepparton Residential Precinct South (HO141).

2.7.3 Amendment C60

On 12 May 2005, Amendment C60 to the Planning Scheme applied interim heritage controls to land at 2 Archer Street, Mooroopna (HO148).

2.7.4 Amendment C67

On 22 December 2005, Amendment C67 to the Planning Scheme applied interim heritage controls to land at 22 McLennan Street, Mooroopna (HO149).

2.7.5 Amendment C50

Amendment C50 to the Planning Scheme applied permanent heritage controls to 135 places of ‘Individual’ heritage and two precincts (HO140 & HO141).

10 A Panel Hearing was held on 5, 6 and 7 December 2005. The Panel Report was received by Council in January 2006. The Panel Report to Amendment C50 contained a recommendation that a more comprehensive survey be conducted in relation to heritage controls in the Central Business District (CBD) of Shepparton.

The Amendment was adopted by Council on 7 February 2007 and approved by the Minister of Planning on 27 September 2007.

2.7.6 Amendment C106

On 13 November 2008, Amendment C160 applied interim heritage controls to land at:

• 305-311 Maude Street, Shepparton (HO152); and • 73, 75, 77 and 79-81 Wyndham Street, Shepparton (HO153); and • 248 Hogan Street, Tatura (HO154).

2.7.7 Amendment C120

On 29 January 2009, Amendment C120 applied interim heritage controls to land at 3, 5, 7, 9 and 11 Corio Avenue, Shepparton (HO155).

2.7.8 Amendment C103

On 12 July 2012, Amendment C103 made a number of changes to the provisions of the Planning Scheme. The Amendment reduced the area of Heritage Overlay at 47-61 Wyndham Street and 48-60 Maude Street, Shepparton (HO96)

2.7.9 Amendment C110

Amendment C110 applied the Heritage Overlay to 51 places of ‘Individual’ heritage significance and three heritage precincts, affecting 118 properties. The Amendment also introduced the Greater Shepparton Heritage Incorporated Plan (GSHIP), will provide permit exemptions from the need to seek a planning permit for a variety of minor buildings and works for places included within the Heritage Overlay.

The Amendment was exhibited from 12 April to 25 May 2012. Twenty submissions were received to the Amendment, ten of which requested changes.

A Panel Hearing was held in late-2012 to early-2013 and the Panel Report was received by Council in April 2013.

2.7.10 Amendment C143

Amendment C143 to the Planning Scheme corrected a number of anomalies in the Schedule to Clause 43.01 Heritage Overlay, added the Victorian Heritage Register reference (H2347) to the Schedule to Clause 43.01 Heritage Overlay for the German War Cemetery at 155 Winter Road, Tatura, and corrected mapping anomalies in the application of Heritage Overlay.

11 Amendment C143 was approved and gazetted by the Minister for Planning on 25 February 2016.

2.7.11 Amendment C145

Amongst other things, Amendment C145 to the Planning Scheme corrected a number of mapping anomalies for land within the Heritage Overlay at:

• 130 Rutherford Road, Toolamba (HO123); and • 75 Hoopers Road, Dookie (HO15).

The Amendment was approved and gazetted by the Minister for Planning on 20 June 2013.

2.7.12 Amendment C197

Amendment C197 to the Planning Scheme made a number of changes to the Planning Scheme. Specifically, the Amendment made the following changes:

• amended the Schedule to Clause 43.01 Heritage Overlay to apply the Greater Shepparton Heritage Incorporated Plan to the Central Business Area Precinct (HO160); and • removed the Heritage Overlay (HO141) from land within the road reserve adjacent to 52 Orr Street, Shepparton.

The Amendment was approved and gazetted by the Minister for Planning on 7 June 2018.

2.7.13 Amendment C204

In March 2017, the Minister for Planning wrote to all councils outlining his support the use of interim heritage controls in certain instances.

On 2 March 2018, a request was made to the Minister for Planning to prepare and approve Amendment C204 to the Planning Scheme under Section 20(4) of the Act.

On 20 November 2018, the Minister for Planning introduced Amendment C204 to the Planning Scheme.

Interim heritage controls were only applied to 178 places of the 180 places as recommended HSIIC. 215 Corio Street, Shepparton (previously identified as HO350) was demolished prior to the application of interim heritage controls and Bill’s Water Trough in (previously identified as HO292) is located in a local museum and does not meet the requirements of Planning Practice Note 01 Applying the Heritage Overlay to warrant the application of the Heritage Overlay. The interim heritage controls were scheduled to expire on 2 May 2019. Council is seeking to apply these controls on a permanent basis through Amendment C205 to the Planning Scheme.

In accordance with Section 19(1)(b) and (c) of the Act, Council notified all land owners, occupiers of land and referral authorities of the approval and gazettal of Amendment C204.

12 The letter also provided notice of the process being undertaken and an indicative timeframe for the exhibition of Amendment C205.

2.7.14 Amendment C216

In order to allow Council officers further time to prepare Amendment C205 to the Planning Scheme, Council requested that the Minister for Planning prepare an additional planning scheme amendment (Amendment C216) to extend the expiry date of the interim heritage controls. Amendment C216 extended the expiry date of interim heritage controls identified in Amendment C204 to the Planning Scheme from 20 May 2019 to 1 May 2020.

Similarly to Amendment C204, all relevant parties were notified of Amendment C216 in accordance with Section 19(1)(b) and (c) of the Act and updated indicative timeframes for the exhibition of Amendment C205 were included in the letter.

2.8 Thematic Environmental History

A brief Thematic Environment History (TEH) was prepared as part of HSI in 2000 and 2001. The TEH was subsequently updated as part of HSII in 2004 and later as part of HSIIB in 2009-2010 to include a contextual history of Tatura.

This TEH discusses how the landscape has evolved and how the themes – of settlement and migration, utilising natural resources; and developing primary and secondary industries – are integral to the development of the municipality post-European contact.

3.0 Strategic Context and Assessment

3.1 Purpose of the Heritage Overlay

The Heritage Overlay is a statutory planning tool that identifies places of local cultural heritage significance. The specific planning controls that apply to each place listed within the Heritage Overlay are set-out in Clause 43.01 Heritage Overlay of the Planning Scheme. The Heritage Overlay seeks to protect and conserve all places of local cultural heritage significance, and seeks to ensure that any proposed development does not adversely affect the significance of the place.

3.2 Why is the Amendment required?

As indicated in the Explanatory Report, the Amendment consolidates the recommendations of the previous heritage studies into the Draft Study. The Amendment seeks to apply permanent heritage controls to all of the 178 places identified in Amendments C204 and C216, and to apply a Heritage Overlay to three additional places 36 Welsford Street, Shepparton (HO427), and 18 and 20 Thomson Street, Tatura (HO430 and HO431), and additional properties erroneously excluded from the Kialla Village Settlement.

The Amendment also revises controls and mapping that apply to places included in the Heritage Overlay implemented as part of previous heritage studies, and makes subsequent changes to the Schedule to Clause 43.01 Heritage Overlay of the Planning Scheme.

13 The Amendment affects approximately 1,089 properties in Greater Shepparton (a full list of places affected can be found in Tables 1 & 2 of the associated Explanatory Report). Of this total, 619 places are considered to be of ‘Individual’ heritage significance (including places that are part of a heritage group, etc.), 327 places are of ‘Contributory’ heritage significance in heritage precincts and 138 places are of ‘Non-Contributory’ significance in heritage precincts.

Amendment C205 seeks to give effect to the findings and recommendations of the amalgamated Draft Study in the Planning Scheme.

Council is obliged to conserve places of local cultural heritage significance under Section 12(2) of the Act which requires planning authorities to implement the objectives of the Act. Section 4(1)(d) of the Act is ‘to conserve and enhance those buildings, areas or other places which are of scientific, aesthetic, architectural or historical interest, or otherwise of special cultural value’.

The Heritage Overlay is the most appropriate planning tool in Victoria to identify and conserve places of heritage significance by guiding future development proposals to be respectful of this significance.

The Amendment is required to implement recommendation 36 of the Planning Panel Report for Amendment C110 to the Planning Scheme, dated 26 April 2013, which recommended that a new incorporated plan be prepared to include all of the statements of significance for places in the Heritage Overlay to strengthen the level of protection afforded to these places.

The Amendment removes the Interim Heritage Overlay on 63, 65 and 67 Rea Street, Shepparton (HO406) and applies HO140 (existing Shepparton Residential Precinct North) to these properties on a permanent basis. The Amendment proposes to apply an additional Heritage Overlay to 30 places of ‘Individual’ heritage significance in existing heritage precincts to appropriately reflect the significance of these places: of ‘Individual’ significance and also of ‘Contributory’ significance to the precinct.

The Amendment is required to make a number of mapping changes introduced through Amendment C204 to better ensure that the Heritage Overlay are applied correctly to all places with an appropriate curtilage. The Amendment also seeks to ensure consistency with reforms to the Heritage Overlay implemented through Amendment VC148 on 31 July 2018.

The places of ‘Individual’ and ‘Contributory’ heritage significance were assessed against the standard criteria contained in Practice Note 01 Applying the Heritage Overlay (August 2018) and are considered to meet the requirements of local protection and warrant the application of the Heritage Overlay.

3.3 Planning Practice Note 01 – Applying the Heritage Overlay – August 2018

The Amendment has been prepared in accordance with Planning Practice Note 01 – Applying the Heritage Overlay – August 2018 (PPN1). PPN1 provides guidance on the application of the Heritage Overlay in the Planning Scheme.

Council submits that the requirements of Planning Practice Note have been met, as:

14 • all places identified in the Draft Study have been assessed by a suitably qualified heritage consultant and each place’s cultural heritage significance has been clearly outlined in the associated Place citation report and Statement of Significance; • all places of local cultural heritage significance have an associated Statement of significance that clearly establishes the place’s significance; • definitions used in the Draft Study have been based of the ICOMOS Burra Charter, 1999, where relevant; and • the places identified in the Draft Study has been assessed using HERCON criteria, as recommended by Heritage Victoria.

3.4 Planning Practice Note 13 – Incorporated and Background Documents – September 2018

The Amendment was prepared in accordance with Planning Practice Note 13 – Incorporated and Background Documents – September 2018 (PPN13). PPN13:

• explains the role of external documents in planning schemes;

• explains the difference between incorporated and background documents; and

• provides guidance on when a document should be incorporated or be a background document.

The Amendment seeks to update and introduce three (3) incorporated documents (these being the Greater Shepparton Heritage Incorporated Plan April 2019, Kialla Village Settlement Incorporated Document 2019 and the Statement of significance Incorporated Document 2019) and to introduce the Draft Study as a Reference Document.

A document must be incorporated if it is essential to the administration or enforcement of the Planning Scheme and is necessary to determine whether or not planning permission is required. The reasons for the implementation of the Incorporated Documents associated with the Amendment are outlined below:

• Greater Shepparton Heritage Incorporated Document April 2019: provides exemptions from the need for a planning permit in the Heritage Overlay where such works will not have an adverse impact on a place’s cultural heritage significance. The Greater Shepparton Heritage Incorporated Plan 2019 (GSHIP) was implemented into the Planning Scheme as part of Amendment C110 in 2013. Justification for the revision of this document is included in Section 5.7 of this submission.

• Statement of significance Incorporated Document 2019: based on recommendation 36 of the Planning Panel Report for Amendment C110 to the Planning Scheme, dated 26 April 2013 recommends a new incorporated document be prepared to include all of the statements of significance for places in the Heritage Overlay to strengthen the level of protection afforded to these places.

• Kialla Village Settlement Incorporated Document 2019: provides planning permit exemptions for buildings and works within the Heritage Overlay that applies to the Kialla Village Settlement (HO276). This document does not intend to provide planning permit exemptions from other planning scheme provisions that apply to the

15 land. It should be noted that the Heritage Act 2017 guides any works under Part 6 – Archaeological Heritage.

The Amendment proposes to amend Clause 21.09 Reference Documents to consulate previous heritage studies into one reference document (the Draft Study). Justification for this is included in Section 4.1 of this submission.

These documents will ensure the Planning Scheme functions properly and that statutory decision-making regarding heritage matters can be appropriately informed.

3.5 State Planning Policy Framework

The Amendment is supported by the following policy objectives in the Planning Policy Framework as outlined in Table 1.

The Amendment meets these strategies as the application of a Heritage Overlay will provide additional protection to prevent places of significance from being unsympathetically altered or demolished.

By applying heritage controls to all properties in the Draft Study, impacts on significance can be considered as part of the assessment of building and planning permits. 3.6 Local Planning Policy Framework

The Municipal Strategic Statement recognises that places of “cultural heritage significance are highly valued by the community” and are “committed to the continued conservation, protection and maintenance of these places” (Clause 21.05-4 – Cultural Heritage).

The following objectives, contained in Clause 21.05-4, are particularly relevant to this amendment:

• to ensure that places of cultural heritage significance are conserved or restored;

• to discourage the demolition of places of cultural heritage significance that are designated as Individually Significant or Contributory in heritage precincts; and

• to ensure that development does not adversely affect places of cultural heritage significance.

The Amendment better implements the objectives of the LPPF by identifying and including places of significance in the Heritage Overlay.

3.7 Ministerial Direction 11 – Strategic Assessment of Amendments

The purpose of this Direction is to ensure a comprehensive strategic evaluation of a planning scheme amendment and the outcomes it produces. An amendment to a planning scheme requires the preparation of an Explanatory Report to address all relevant strategic planning considerations. The preparation of the Explanatory Report associated with Amendment C205 complies with this Direction.

17 3.8 Greater Shepparton 2030 Strategy 2006

The Greater Shepparton 2030 Strategy 2006 outlines a preferred vision for Greater Shepparton and makes a number of recommendations that the community should strive to achieve.

The Amendment is in accordance with the following objectives and strategies in the Greater Shepparton 2030 Strategy 2006, specifically:

• Cultural Heritage – pre settlement: Objective 1- To conserve and protect identified sites of cultural heritage significance;

• Cultural Heritage – pre settlement: Strategy 1.1 - Promote the protection of places of heritage significance as these contribute to the character of the municipality;

• Cultural Heritage – post settlement: Objective 1 - To identify, protect and enhance sites and areas of recognised historic significance;

• Cultural Heritage – post settlement: Strategy 1.1 - Promote the protection of heritage buildings and sites so that heritage significance is not diminished or irreversibly damaged through proposed use or development; and

• Cultural Heritage – post settlement: Strategy 1.2 - Encourage the retention, adaptation and appropriate renovation of significant historic buildings and works, gardens and other areas as a viable alternative to demolition.

3.9 Greater Shepparton City Council: Council Plan 2017-2021

The Council Plan is the key document that drives the strategic direction of Council for the next four year and beyond. The themes outlined in the Council Plan are the vehicle for achieving this desired future. Specifically, the Amendment meets the following themes of the Council Plan:

Built • Objective 4.3 – Greater Shepparton’s heritage places, cultural landscapes, and objects are protected and conserved for future generations.

3.10 Amendment VC148

In July 2018, the Minister for Planning approved and gazetted Amendment VC148 to all municipal planning schemes across Victoria. Amendment VC148 is part of the Smart Planning program’s reforms to simplify and modernise Victoria’s planning policy and rules to make planning schemes more efficient, accessible and transparent.

Amendment VC148 also made a number of changes to the Heritage Overlay. New Clause 43.01-5 Statements of significance was introduced into the Planning Scheme which requires the Schedule to Clause 43.01 Heritage Overlay to specify a statement of significance for each heritage place. New Clause 43.01-6 enables the Schedule to Clause 43.01 Heritage Overlay to also specify any heritage design guidelines for any place affected by the Heritage Overlay. Critically, Amendment VC148 now requires councils to include any statements of

18 significance or guidelines as incorporated documents into the Planning Scheme. Amendment C205 was prepared in accordance with these new requirements by preparing the Statements of Significance Incorporated Document 2019 and revised the Greater Shepparton Heritage Incorporated Plan.

4.0 Draft Greater Shepparton Heritage Study Stage II 2019 4.1 Preparation of the Draft Greater Shepparton Heritage Study Stage II 2019

The Draft Study is a consolidation of a number of heritage studies previously prepared to assess places of post-contact and shared cultural heritage significance within the City of Greater Shepparton. They include the:

• City of Greater Shepparton Heritage Study Stage II 2007 (HSII) (prepared by Allom Lovell & Associates Pty Ltd);

• Greater Shepparton Heritage Study Stage IIB 2013 (HSIIB) (prepared by Heritage Concepts); and

• Greater Shepparton Heritage Study Stage IIC 2017 (HSIIC) (prepared by Heritage Concepts).

The Draft Study is intended to act as a key reference document for all places that were assessed as meeting the threshold of local cultural heritage significance and warrant the application of a Heritage Overlay to ensure that their significance is appropriately conserved.

The Draft Study was prepared in 2018-2019 by Heritage Concepts with assistance from Council officers.

The Draft Study identifies:

• ‘Individually’ significant places include buildings or surrounds that are of their own intrinsic importance to the City of Greater Shepparton (or the State of Victoria).

• For heritage precincts:

o ‘Contributory’ heritage places include buildings and surrounds that are representative places of local cultural heritage significance that contribute to the significance of their respective heritage precinct; and

o ‘Non-contributory’ heritage places are buildings located within a heritage precinct that do not actively contribute to the significance of the heritage precinct. Removing or altering non-contributory elements within a precinct is not of major concern. However, any redevelopment of land must respond in a manner appropriate to the significance of the precinct including its character and appearance.

• Group or (serial) listings are places that share a common history and/ or significance, but do not necessarily adjoin each other (for example the Nixon Street Group (HO174)). These collective groups of properties are considered to be one heritage place and often share a common statement of significance.

19 The preparation of the Draft Study involved undertaking a number of specific tasks. Specifically the:

• Amalgamation of previous heritage studies (HSII, HSIIB and HSIIC) into one Draft Study. This was proposed for several reasons, stated below:

o better usability by locating all relevant information in one Reference Document;

o the time periods between the preparation of all previously undertaken heritage studies; and

o ensure the amendment documentation is prepared in accordance with the requirements of Amendment VC148.

• revision of numerous statements of significance to align with current guidelines from Heritage Victoria and to correct erroneous details; and

• preparation of additional place citation reports for the following places:

o places of ‘Individual’ heritage significance in heritage precincts; and

o 18 and 20 Thomson Street, Tatura and 36 Welsford Street, Shepparton.

The Draft Study builds upon the work and recommendations of previous heritage studies by presenting additional information on places already within the Heritage Overlay. A property can still be of heritage significance even if it has not been identified within a previous study. Specifically, this new information relates to:

• An additional place citation report for all places proposed to be designated as being of ‘Individual’ and ‘Contributory’ significance within a Heritage Precinct. This means that a number of places already included within the Heritage Overlay have been ‘double listed’ (justification on this methodology is included in Section 5.3 of this submission).

After informal discussions with DELWP and Council’s Heritage Advisor, Council officers prepared revised controls for all places included within the Heritage Overlay to ensure controls were applied consistently to all places. Further explanation on the proposed changes to the Draft Study and the justification is discussed in Section 8.0 of this Part A submission.

4.2 Future Recommendations

The exhibited Draft Study recommends that further investigations be undertaken in Arcadia, Caniambo, Cosgrove, , Merrigum, Mooroopna, and . The Draft Study also recommends that the following places be investigated as part of any future study, these are:

• 645 Boundary Road CANIAMBO (Kurralane)

• Former jetty at Archer Street MOOROOPNA

• 16 Young Street and 6 Doonan Street, MOOROOPNA (Ardmona Cannery) prepare a detailed assessment to better determine the extant significant fabric of the place

• 165 Knight Street SHEPPARTON (House)

• 167 Knight Street SHEPPARTON (House)

• 172 Knight Street SHEPPARTON (House)

• 173 Knight Street SHEPPARTON (House)

• 179 Knight Street SHEPPARTON (House)

• 111 Maude Street SHEPPARTON (House)

• 16 McCracken Street SHEPPARTON (House)

• 108 Rea Street SHEPPARTON (House)

The aforementioned list of places was identified during:

• the consultation period for HSIIC Study in 2017; and

• as part of the preparation of the Amendment documentation by Council officers.

Council is also proposing post-exhibition changes to aforementioned list to recommend that the following properties be investigated as part of a future heritage study:

• 179 Knight Street, Shepparton;

• 209-211 Fryers Street, Shepparton;

• 161 Waverley Avenue, Merrigum;

• Northgate Street Group, Mooroopna; and

21 • 4920 , Murchison East.

It should be noted that the list of places recommended for future investigations is not expansive and that Council officers welcome input from members of the community or submitters as part of the Amendment about additional places to potentially be identified.

5.0 Amendment C205

5.1 Authorisation

On Wednesday, 6 June 2018, Council requested authorisation from DELWP to prepare and exhibit the Amendment. Authorisation for the Amendment was received from DELWP on Thursday, 21 June 2018.

Ministerial Direction 15 sets timeframes for completing steps in the planning scheme amendment process. This includes Council giving notice of the amendment within 40 business days of receiving authorisation from DELWP; before notice is given, setting dates for a Directions Hearing and Panel Hearing with the agreement of Planning Panels Victoria.

On Monday, 13 August 2018, Council sought an exemption from Section 5 of Ministerial Direction 15 to the requirements of Section 4(1) for a planning authority to prepare and give notice of a planning scheme amendment within 40 business days after authorisation. This would allow Council have an adequate amount of time to prepare the Amendment documentation. The exemption request was granted by DELWP.

5.2 Exhibition of Amendment C205

Public notice of the Amendment, in accordance with Sections 17, 18 and 19 of the Act was given from Thursday, 13 June to Monday, 26 August 2019.

All affected land owners were notified of the Amendment. Properties identified as being of ‘Individual’ heritage significance were sent a letter outlining that planning controls are proposed to change on their property as part of the Amendment and a relevant Section of the Schedule to Clause 43.01 Heritage Overlay displaying these changes. Places of ‘Contributory’ and ‘Non-Contributory’ significance were similarly notified of the Amendment via a letter and a copy of the relevant Section of Clause 43.01 Heritage Overlay. Additionally, land owners and occupiers of land within a precinct also received a copy of a precinct map displaying which properties were ‘Individually significant’, ‘Contributory’ or ‘Non-Contributory places in the precinct.

5.2.1 What the Amendment Does

The Amendment proposes to amend the MSS, the Schedule to Clause 43.01 Schedule to Clause 43.01 Heritage Overlay and the Schedule to Clause 72.04 Schedule to the Documents Incorporated in the Planning Scheme of the Planning Scheme to implement the Draft Study.

The Amendment also revises the controls and mapping that apply to places included in the Heritage Overlay as part of the implementation of previous heritage studies, and makes

22 subsequent changes to the Schedule to Clause 43.01 Schedule to Clause 43.01 Heritage Overlay of the Planning Scheme.

Specifically, the Amendment makes the following changes to the Planning Scheme:

• amends Planning Scheme Map Nos. 2HO, 3HO, 4HO, 5HO, 6HO, 7HO, 8HO, 9HO, 11HO, 17HO, 18HO, 20HO, 21HO, 22HO, 23HO, 25HO 29HO, 32HO and 34HO to correctly identify places of cultural heritage significance and to apply the Heritage Overlay to places identified as being both ‘Contributory’ and ‘Individually Significant’ within heritage precincts; • amends Clause 21.05 Environment to remove the seven existing statements of significance for the heritage precincts, revise the demolition policy and update the strategic work program; • amends Clause 21.09 Reference Documents to consolidate all previous heritage studies into one reference document titled Draft Greater Shepparton Heritage Study Stage II 2019; • amends the Schedule to Clause 43.01 Schedule to Clause 43.01 Heritage Overlay to apply heritage controls applied on an interim basis through Amendment C204 permanent; • amends the Schedule to Clause 43.01 Schedule to Clause 43.01 Heritage Overlay to implement the outstanding recommendations of the Draft Greater Shepparton Heritage Study Stage II 2019 by revising the controls and the application of incorporated plans for places in the Heritage Overlay; and • amends the Schedule to Clause 72.04 Schedule to the Documents Incorporated in this Planning Scheme to include the revised Greater Shepparton Heritage Incorporated Plan April 2019 (GSHIP), the Greater Shepparton Statements of Significance for Places in the Heritage Overlay April 2019 and the Kialla Village Settlement Incorporated Plan April 2019 in the Planning Scheme.

5.2.2 Notification of the Amendment

The Act and the Victoria Planning Provisions set out the notification requirements, consideration of submissions and referral to an independent planning panel. The notification requirements in Section 19 of the Act require land owners and occupiers of land, relevant stakeholders, referral authorities and relevant ministers be given an appropriate opportunity to express their views on any changes to planning scheme provisions.

All relevant stakeholders were notified of the Amendment. The relevant prescribed ministers were sent electronic notice of the Amendment. Notice of the Amendment was also advertised in the Shepparton News and on Council’s website and social media pages.

The Act requires a planning authority to set a date for submissions, include notice of exhibition of an amendment in the Victoria Government Gazette and advertise for no less than one month after the date notice is given in the Gazette.

To better ensure that all parties had an appropriate opportunity to meet with Council officers and make submissions, Council exhibited the Amendment for 10 weeks. Additionally Council has continued to accept late submissions to the Amendment.

23 5.2.3 Notification of the Amendment for properties in the Kialla Village Settlement

Eleven (11) of the approximately forty (40) land holdings within the former Kialla Village Settlement (HO276) area were initially notified as part of the public consultation process for the Greater Shepparton Heritage Study Stage IIC in mid-2017. These same land owners were again notified of Amendment C204 to the Planning Scheme that applied a Heritage Overlay on an interim basis to only these eleven (11) lots in November 2018. Council officers became aware that the Kialla Village Settlement applied to a much larger area than initially understood. Amendment C205 seeks to rectify this by including the additional twenty-nine (29) properties in the Heritage Overlay that had not been notified in 2017. Amendment C205 seeks to apply heritage controls to all forty properties on a permanent basis. This is expanded upon further in Section 5.9 of this Part A submission.

5.3 Double Listing of Heritage Places

Council queried the validity of ‘double listing’ places of ‘Individual’ and ‘Contributory’ heritage significance in a heritage precinct at the Panel Hearing for Amendment C110 to the Planning Scheme in 2013. Council submitted that ‘double listing’ specific heritage properties is a more appropriate way of managing these properties and ensuring additional heritage controls are appropriately applied. Council discussed undertaking this approach with DELWP during the drafting stages of the Amendment where verbal in-principle support was received.

Planning Practice Note 1 – Applying the Heritage Overlay states that “the only instance where an individual property within a significant area should be scheduled and mapped is where it is proposed that a different requirement should apply”. The Draft Study recommends that the places listed in Table 2 (below) be double listed to appropriately reflect the significance of the place.

The place citation report provides more specific information on places that have been ‘double listed’ and recommends the application of an additional Heritage Overlay to appropriately reflect the place’s significance.

27 5.4 Application of External Paint Controls

In the Heritage Overlay, a planning permit is required to paint an unpainted external surface. This is a standard provision in the Heritage Overlay. External paint controls can be applied to places within the Heritage Overlay to guide the choice of future colour schemes for buildings of significance. Colour can play an important role for places of architectural significance– inappropriate colour schemes can have a detrimental impact upon the significance of a place. The painting of already unpainted masonry surfaces, sandblasting of surfaces or the painting of a colour that was not traditionally used for a building of the era is unlikely to be supported. If a land owner wishes to repaint an already external painted surface with the same colour, a planning permit will not be required.

The Amendment proposes to apply external paint controls to buildings of ‘Individual’ heritage significance and ‘Contributory’ heritage significance in heritage precincts for places that demonstrate high levels of aesthetic and architectural significance. The Place citation report and statement of significance associated with the place substantiates why these places are of aesthetic and architectural significance. External paint controls will assist in encouraging external materials, colours and finishes for heritage buildings that are consistent with and complement the architectural intent of the place.

Council, as the Planning Authority, is obliged to conserve and manage the impact of buildings and works on places of local cultural heritage significance under Section 4(1)(d) of the Act. Several planning panels in the past have noted that it is common and, in-principle, an accepted consequence that planning controls limit certain freedoms of individuals to better ensure the protection of significant fabric.

The proposition to apply external paint controls to various places already located within the Heritage Overlay is simply intended to provide an additional level of scrutiny for planning permits for external painting of places of local cultural heritage significance.

Amendment C205 to the Planning Scheme is not the first planning scheme amendment to use this approach. As part of Amendment C42 to the Maroondah Planning Scheme, external paint controls were proposed to apply to all buildings of heritage significance. The appropriateness of this approach was raised at the panel hearing for this Amendment. The Panel Report stated on page 58 that:

The Panel has concluded that the application of external paint controls to all buildings proposed for HO (Heritage Overlay) listing in Amendment C42 is not sufficiently discriminating.

Council officers submit that applying external paint controls in a ‘broad-brush’ approach is appropriate where they can be sufficiently justified. Justification regarding the application of external paint controls to specific submitters’ properties will be included in Council’s Part B submission.

Council officers acknowledge the recommendations of the Panel and Supplementary Report for Amendment C42 to the Maroondah Planning Scheme. Council officers submit that the approach undertaken for the application of external paint controls as part of Amendment

28 C205 has been discretionary and that external paint controls are only proposed to apply to places of aesthetic significance. External paint controls allow for planning permit triggers to paint significant features, such as window sills and fascias. External paint controls can also allow Council to provide guidance on the type of colour used.

5.5 Application of Internal Alteration Controls

As part of the Amendment, internal alteration controls are proposed to apply to several places identified as being of ‘individual’ heritage significance. Internal alterations controls have been applied sparingly and only to interiors of particular note and significance. The statement of significance denotes which elements are of significance.

5.5.1 Issues with Internal Alteration Controls

During the exhibition period, Council officers and Council’s Heritage Advisor met with a number of submitters to the Amendment of property proposed to have internal alteration controls. It became apparent that a number of land owners had negative misconceptions about the application of internal alteration controls and that their application would effectively ‘rule out’ any future interior modifications to their property. Council officers note that internal alteration controls have only been applied to the significant internal elements and that certain minor works would be permitted subject to a planning permit.

To respond to the concerns of three (3) land owners, Council officers are proposing post- exhibition changes to the Schedule to Clause 43.01 Heritage Overlay to specify which internal elements are of significance.

Council officers note the Panel Report and the subsequent approval of Amendment C118 to the Macedon Ranges Planning Scheme. The Schedule to Clause 43.01 Heritage Overlay in the Macedon Ranges Planning Scheme lists specifically which internal elements of a heritage place are significant. Please refer to Figure 2 below.

29 Case Study – Internal Alteration Controls and Outbuildings and Fences Controls

A number of places affected by the Amendment are proposed to have both internal alteration controls and outbuildings and fences controls, for example 93 & 93A Saddleback Road, Dookie (HO18).

As the Heritage Overlay covers the whole of the property at 93 & 93A Saddleback Road, Dookie, these controls would apply to the presbytery as well (even though the presbytery has no significant internal elements).

Council officers are proposing post-exhibition changes to some places affected by internal alteration controls to provide greater clarity and potentially ease the concerns of land owners by removing unnecessary permit triggers. Council officers acknowledge that such changes to the Schedule to Clause 43.01 Heritage Overlay would not be in accordance with Planning Practice Note 1 – Applying the Heritage Overlay. However, Council officers submit that Amendment C118 to the Macedon Ranges Planning Scheme sets a precedent to undertake this drafting change and that it would lead to a better outcome for land owners. The statement of significance will still describe in detail which interior elements are of significance. Council officers seek the Panel’s view on undertaking this approach. This will be further expanded upon in Council’s Part B submission.

30 5.6 Application of Tree Controls

5.6.1 Mature Trees

The Amendment proposes to apply tree controls to protect all ‘mature trees’ where the treed setting actively contributes to the aesthetic significance of a place. Any works that propose to remove, destroy or lop a mature tree will require a planning permit. The Schedule to Clause 43.01 Heritage Overlay will denote whether tree controls apply.

A ‘mature tree’ is any tree greater than 5 metres in height, or greater than 2 metres in circumference measured at 1.4 metres above ground level. The definition for a ‘mature tree’ was obtained from the Campaspe Planning Scheme. This definition was subject to the Panel for Amendment C101 to the Campaspe Planning Scheme which deemed the definition to be appropriate. Therefore Council officers submit that the definition for a ‘mature tree’ under the Heritage Overlay provisions is appropriate.

A list of all places where tree controls currently apply are proposed to apply is contained in Appendix 2 – Places affected by Tree Controls.

A planning permit would not be required for routine works and gardening. A planning permit would also not be required:

• to undertake any action which is necessary to keep the whole or any part of a tree clear of an electric line provided the action is carried out in accordance with a code of practice prepared under Section 86 of the Electricity Safety Act 1998. • if the tree presents an immediate risk of personal injury or damage to property.

Where tree controls to protect all ‘mature trees’ are proposed to apply, justification for their application as part of the Amendment is included in each place’s respective place citation report / statement of significance. During the exhibition period, Council officers noted that several places did not include sufficient justification to warrant the application of tree controls to protect all ‘mature trees’. Council officers are also cognisant of the recommendations of the Panel Report for Amendment C157 to the Whitehorse Planning Scheme which states that “If the Citation does not identify any significant trees or garden elements, and they are not listed in the Statement of Significance, there is no basis for activating tree controls”.

Council officers are proposing post-exhibition changes after undertaking a thorough review of all place citation reports and Statements of Significance to ensure that, where tree controls are proposed to apply, appropriate justification is included.

5.6.2 Specification of significant tree(s) where tree controls already apply

As part of the Amendment, where tree controls currently apply (as denoted by the Schedule to Clause 43.01 Heritage Overlay), Council officers have sought to specify which tree(s) are of intrinsic significance to the place in accordance with Planning Practice Note 1 – Applying the Heritage Overlay. Additionally, Council officers are proposing to revise several place citation reports to include further information on why they are significant.

31 5.7 Prohibited Uses Permitted

A ‘prohibited use’ in a zone is a use that conflicts with, or is irrelevant to the purpose of the zone. These uses are outlined in the zone provisions. The Heritage Overlay is unique in that it can effectively allow for the consideration of a prohibited use where it allows for the adaptive re-use of a heritage place.

As part of the Amendment, Council has sought to permit prohibited uses in all heritage places located in rural (e.g. Farming 1 Zone) and residential zones (e.g. General Residential Zone and Low Density Residential Zone). Council officers and Council’s Heritage Advisor have carefully considered the permitting prohibited uses in these places to ensure the adaptive re-use of significant places can be considered in the future.

Council officers submit that permitting prohibited uses can facilitate the continued use of the heritage place and associated future maintenance.

Additionally, it is considered that permitting prohibited uses will contribute to positive economic outcomes for land owners by allowing a wider variety of uses to be undertaken on the site subject to the discretion of the responsible authority.

5.8 Update to the Greater Shepparton Heritage Incorporated Plan 2019

The GSHIP was incorporated into the Planning Scheme as part of Amendment C110.

GSHIP currently applies to all places in the Heritage Overlay within a residential zone that currently serve a residential use.

GSHIP was updated as part of Amendment C204 to the Planning Scheme in November 2018 to provide planning permit exemptions to residential places in the five (5) new precincts. These permit exemptions already applied to residential precincts in Shepparton and Tatura. A number of changes are proposed to GSHIP as part of Amendment C205. These are:

• Removing the Statements of Significance; thereby simplifying the document. These statements of significance have been included in the Statement of Significance Incorporated Document 2019; • Includes a definition for mature trees; and • New precinct maps to which display places of ‘Individual’ heritage significance in heritage precincts.

A comprehensive assessment of each place and the exemptions provided for in GSHIP was undertaken by Council’s Heritage Advisor to ensure that places were not afforded exemptions from planning permits that would impact upon the places significance.

5.9 Kialla Village Settlement Incorporated Document 2019

The Kialla Village Settlement (Honeysuckle Park) is historically significant as one of two surviving examples of a government initiative known as the Village Settlement Scheme. These villages were set-up in response to the 1890s depression. The intent was to give impoverished families an opportunity to become sustainable by farming a small allotment. The subdivision pattern is variable with approximately 90 blocks of various sizes with an average size of 2.05 ha.

The purpose of this document is to provide planning permit exemptions for buildings and works within the Heritage Overlay that applies to the Kialla Village Settlement (HO276). There is no remnant significant fabric to conserve.

This document does not intend to provide planning permit exemptions from other planning scheme provisions that apply to the land.

It should be noted that the Heritage Act 2017 guides any works under Part 6 – Archaeological Heritage. Council officers are proposing post-exhibition changes to the Kialla Village Settlement Incorporated Document to state that the Aboriginal Heritage Act 2006 and Aboriginal Heritage Regulations 2018 guide any works that may impact areas of Aboriginal Cultural Heritage Sensitivity.

5.9.1 Extent of the Kialla Village Settlement

HSIIC initially only identified 230, 242, 244, 245, 249, 250, 253, and 254, 255, 260, 265 and 270 Riverview Drive, Kialla as part of the Kialla Village Settlement and recommended the Heritage Overlay apply to protect the subdivision pattern of the land. Amendment C204 to the Planning Scheme applied an interim heritage overlay (HO276) to these places. During the preparation of Amendment C205, Council officers became aware that curtilage for the Heritage Overlay is incorrect and that the Kialla Village Settlement initially included a much wider area. To rectify this, as part of Amendment C205, Council officers proposed to extend the curtilage of the Kialla Village Settlement (HO276) to ensure it is appropriately mapped. Please refer to Figure 6 and Table 3 below.

33 Council notified all affected land owners and occupiers within the Kialla Village Settlement as required under Section 19 of the Act. Given that HO276 is proposed to apply to a wider area, a number of land owners had not previously known about the Council’s aspirations to apply a Heritage Overlay to their property. During the formal exhibition period for the Amendment, Council officers met with a number of land owners within the Kialla Village Settlement to discuss the Amendment and the changes proposed for their land. Council officers also stressed that, for these landowners, no controls will change on their property until the Amendment is approved and gazetted by the Minister for Planning.

5.9.2 Permit exemptions for the Kialla Village Settlement Amendment C204 to the Planning Scheme applied HO276 to the land on an interim basis. However, it did not provide an Incorporated Document to provide planning permit exemptions for properties within the current curtilage of HO276. Based on the current planning scheme regulations, for properties affected by interim heritage controls (that is, all properties mapped in red in Figure 1), buildings and works are currently not exempt from

34 planning permit requirements under the Heritage Overlay. It should be noted that other planning permit provisions apply. Amendment C205 is required to provide planning permit exemptions for buildings and works under the Heritage Overlay for all properties affected by HO276.

5.9.3 The validity of using the Heritage Overlay to protect the subdivision pattern

The Heritage Overlay is a statutory planning tool that identifies places of local cultural heritage significance. In assessing whether it is appropriate to apply a Heritage Overlay to any place, the place must have something that requires careful management (e.g. subdivision pattern). Council officers consider that the Heritage Overlay is an appropriate planning tool to ensure that the subdivision pattern of the Kialla Village Settlement is protected in the future.

5.10 Demolition policy

The current demolition policy in Clause 21.05 Environment of the Planning Scheme seeks to discourage the demolition of ‘Individual’ and ‘Contributory’ significant heritage places, unless the following can be demonstrated:

o the building is structurally unsound (as determined by a suitably qualified Building Surveyor),and o the cost of repairs is considered to be unreasonable and economically unsustainable, and o the significant physical fabric is so compromised or in such poor condition that the replacement and/or repair would compromise and reduce the integrity of the building. • Demolition of features of Individually Significant or Contributory places may be considered if it will help to reveal the original fabric of the place. • Demolition of features that are identified as not contributing to the cultural heritage significance of either an Individually Significant or Contributory place can be removed. If the place is Individually Significant, the Statement of significance for the individual place will be used to inform the assessment of an application. • Demolition or removal of buildings or features on places identified as Non- Contributory on the relevant precinct map may be considered. • Demolition approvals should not be granted until replacement buildings or works have been approved. • New development visible from the street should be designed in a manner sympathetic to the character of the significant fabric or in an understated modern manner in complementary form and materials.

The purpose of this policy seeks to ensure that, while demolition in the Heritage Overlay was generally discouraged, there was a mechanism for buildings to be demolished subject to compliance with defined criteria, including financial considerations.

Council officers’ submit that the demolition policy in its current format is too definitive and allows for little discretion.

35 The proposed revised demolition policy states:

• Discourage demolition of significant and contributory buildings unless it is demonstrated to the satisfaction of the Responsible Authority that: o the building is structurally unsound and cannot be feasibly repaired or adapted for reuse; and o the original fabric of the building has deteriorated to such an extent that a substantial reconstruction would be required to make the building habitable; and o the replacement building displays design excellence; and o if located within a heritage precinct, the replacement building clearly and positively supports the ongoing significance of the heritage precinct. • Demolition of features of Individually Significant or Contributory places may be considered if it will help to reveal the original fabric of the place. • Demolition of features that are identified as not contributing to the cultural heritage significance of either an Individually Significant or Contributory place can be removed. If the place is Individually Significant, the Statement of significance for the individual place will be used to inform the assessment of an application. • Demolition approvals should not be granted until replacement buildings or works have been approved. New development visible from the street should be designed in a manner sympathetic to the character of the significant fabric or in an understated modern manner in complementary form and materials.

Council officers submit that the proposed revised demolition policy will achieve better outcomes by allowing the responsible authority to authorise greater discretion when assessing planning permit applications for demolition in the Heritage Overlay.

5.11 Inclusion of 18 & 20 Thomson Street, Tatura and 36 Welsford Street, Shepparton

In 2017, HSIIC identified a number of places to be protected as part a future heritage study. This list of places broadly reflects the list of properties contained in Section 4.2 of this Part A submission.

In late-2018, Council officers engaged Heritage Concepts during the preparation of the Draft Study to further review the place citation reports and Statements of Significance prepared as part of previous heritage studies. During this process, based on the recommendations of the Panel Report for Amendment C110 to the Planning Scheme, a number of ‘Contributory’ places in heritage precincts were ‘re-assessed’ and deemed to be of ‘Individual’ heritage significance (this list is included in Table 2 above) and an associated place citation report was prepared for each place (separate from the precinct citation). A limited budget was available for this work.

During this time, heritage places recommended for further assessment in HSIIC were also investigated. The properties at 18 & 20 Thomson Street, Tatura (proposed HO430 & HO431) and 36 Welsford Street, Shepparton (proposed HO427) were deemed to be of ‘Individual’ heritage significance. Interim Controls do not currently apply to these places. Council officers submit that given the historic, aesthetic and social significance of these three (3) places, a permanent Heritage Overlay should apply to these places.

5.12 Mapping Changes

The exhibited Amendment proposes a number of changes to existing Heritage Overlay maps to ensure that the Heritage Overlay only applies to the significant fabric and an appropriate curtilage. These maps are included in the associated Amendment documentation.

Additionally, Council officers are proposing a number of post-exhibition mapping changes to the Amendment. These changes and their justification are included in Section 8.2 and Appendix 3 – Proposed Post-Exhibition Mapping Changes of this Part A submission.

37 6.0 Comparative analysis of places in the Heritage Overlay

The Directions Letter prepared by the Independent Planning Panel requested that Council provide further information on the steps involved in the preparation of the comparative analysis.

Planning Practice Note 1 – Applying the Heritage Overlay states that:

to apply a threshold, some comparative analysis will be required to substantiate the significance of each place. The comparative analysis should draw on other similar places within the study area, including those previously included in a heritage register or overlay.

Discussion on the preparation of the comparative analysis is included in the Expert Witness Statement prepared by Heritage Concepts.

7.0 Issues identified in submissions

In total, Council received forty-two (42) submissions to the Amendment, thirty-nine (39) of which were objecting / requested changes to the amendment documentation. Whilst most the content of submissions received primarily related to an individual property, a number of common issues were identified. Council officers will provide a detailed response to these issues in Council’s Part B submission.

7.1 Inadequate consultation has occurred

Three (3) submissions raised concerns that inadequate consultation has occurred as part of the Amendment process. These submissions were concerned that Council had not properly engaged with residents in the Kialla Village Settlement.

Three (3) submissions raised concerns that other properties of similar or more significance in the immediate area as their property have unfairly not been included in the Heritage Overlay.

7.3 The Heritage Overlay is not warranted

Twenty-six (26) submissions received stated (for various reasons) stated that the Heritage Overlay is not warranted on their property.

7.4 Revise the extent of the Heritage Overlay

Three (3) submissions requested that the Heritage Overlay be retracted to only apply to the significant fabric.

7.5 Place citation report and the Statement of significance to be revised

Five (5) submissions raised concerns that the information presented in several place citation reports is factually incorrect or that further information should be included to provide a more comprehensive overview of the relevant aspects of a place of significance.

7.6 Proposed changes

Council officers acknowledge that the points mentioned above are general in nature. Council officers would like to highlight that Council will be including a detailed response to each submission as part of the Part B submission.

8.0 Scope of Works for Amendment C205

In October 2018, Council officers prepared a scope of works to engage a suitably qualified consultant to prepare amendment documentation to inform the Amendment and implement the findings of HSIIC.

In Council’s Statement of Requirements, the following outcomes were required: 1. Preparation of statements of significance: • Prepare statements of significance for four places (log structures) in the Heritage Overlay including 840 -Cooma Road, Cooma (HO142), 50 Merrigum-Ardmona Road, Merrigum (HO144), 745 Dunbar Road, Merrigum (HO145) and 1040 Tatura Undera Road, Mooroopna North West (HO143). 2. Update the following statements of significance to reflect the significance of these places to align with current guidelines from Heritage Victoria: • HO40 (Mooroopna Hospital, 2-6 McLennan Street, Mooroopna); • HO57 (Camp 13, Murchison); • HO83 and HO85 (St Brendan’s School, 130-160 Knight Street, Shepparton); • HO88 (Wesley Uniting Church, Hall & Manse 160 Maude Street, Shepparton); • HO89 (Former Wesley Church 162 Maude Street, Shepparton); • HO90 (Ambermere 78-84 Orr Street, Shepparton); • HO140 (Shepparton Residential Precinct North) and to include 65 Rea Street, Shepparton as a ‘Contributory’ place within the Precinct;

39 • HO141 (Shepparton Residential Precinct South); • HO435 (15 and 21 Watson Street, Murchison). These places were considered to form a group and were no longer part of the Murchison Township Precinct (HO336)); • HO437 (St Andrew’s Presbyterian Complex, 241 Hogan Street, Tatura). This place was amended to include the manse as being of significance. • HO14 (Dookie Agricultural College, 940 Dookie-Nalinga Road, Dookie). 3. Double Listing in Precincts: • Prepare place citation reports for ‘Contributory’ places in precincts that are ‘Individually Significant’. Place citation reports for these places are available in HERMES. These reports will need to be revised and updated to ensure they reflect the significance of these places and are in accordance with current guidelines from Heritage Victoria. These places include the addresses listed in Table 2 in section 5.3 of this Part A submission. 4. Review all controls in the proposed Schedule to Clause 43.01 Schedule to the Heritage Overlay to ensure that controls are applied consistently across places of similar thresholds of local significance. 5. Prepare a place citation report for 36 Welsford Street, Shepparton (house), 18 Thomson Street, Tatura (house) and 20 Thomson Street, Tatura (house). 6. Review the amended Greater Shepparton Heritage Incorporated Plan (GHSIP). The GSHIP will be revised to remove the statements of significance for the precincts. Council will prepare the draft document. 7. Review and suggest policy changes to Clause 21.05 Environment of the Planning Scheme. Council officers will prepare a draft of this document.

The aforementioned items were not researched as part of previous heritage studies. The Draft Study seeks to incorporate the findings and recommendations of the aforementioned items into the Planning Scheme.

9.0 List of proposed post-exhibition changes to Amendment C205

In response to the submissions received and upon further review of the Amendment documentation, Council officers are recommending a number of changes to the Amendment. These proposed changes are outlined in the proceeding sub-sections of this Part A submission.

These changes will be reiterated in Council’s Part B submission to the Panel. The list of proposed post-exhibition changes in the sections below does not preclude any further changes to the Amendment documentation recommended by the Panel.

9.1 Draft Greater Shepparton Heritage Study Stage II 2019

A number of formatting, grammatical and address changes are proposed to be made to various existing datasheets accompanying the Draft Study. Unfortunately, due to the system specifications of HERMES (HERitage Management Electronic System) (the system used to generate datasheets for heritage places), it is not possible to highlight each specific change as a tracked change. Any place where grammatical changes are proposed will be listed

40 below. Additionally, any proposed change to any Statement of significance in the Draft Study will be replicated in the Statement of significance Incorporated Document 2019.

1. Shepparton Residential Precinct North (HO14O): Revise the place citation report to correct various grammatical errors.

2. Dookie Township Precinct (HO261): Revise the place citation report to include a physical description.

3. 400 Zeerust Road, Zeerust (Former Zeerust Uniting Church & Hall) (HO104): Amend the Statement of significance to state that the remaining toilet block is of significance. During discussions with Submitter 9, it was determined that the toilet block was constructed in a similar era as the Church building.

4. 75 Hoopers Road, Dookie (The Chateau) (HO15): Include further justification in the Statement of significance for the inclusion of the stone ha-ha in the Heritage Overlay.

5. 31 and 33-39 Judd Avenue, Merrigum (Former Carnation Milk Factory) (HO285): Make grammatical changes to rectify errors in the place citation report.

6. 209-231 McLennan Street, Mooroopna (Turkish Mosque) (HO310): Amend the recommendation in the place citation report to list the Imam’s House as a significant outbuilding.

7. 5 Murchison-Tatura Road, Murchison (Waranga Park Homestead) (HO328): Amend the place citation report and the Statement of significance to specify why the ‘mature trees’ contribute to the significance of the place and includes further information on the significant architectural features.

8. 16, 32 and 35 Young Street and 6 Doonan Street, Shepparton (Ardmona Cannery) (HO321): Amend the place citation report and the Statement of significance to further substantiate what fabric is of significance and why it is of significance.

9. 703 Midland Highway and 12 Hosie Road, (Former Shepparton East Hall) (HO368): Amend the recommendations to no longer recommend that internal alteration controls apply.

10. 150 Maneroo Road, Bunbartha (Maneroo Homestead) (HO240): Amend the place citation report to include further information on the history of the place based on the content included within Submission 2. The statement of significance has been altered to reflect this further information. A description of the place has also been included.

11. 61 Maude Street, Shepparton (HO186): Amend the recommendations to no longer recommend the brick fence and gate be listed as significant

12. Recommend that the following places be investigated as part of a future heritage study: a. 161 Waverly Avenue, Merrigum ;

41 b. Northgate Street area, Mooroopna; c. 179 Knight Street, Shepparton; d. 209-211 Fryers Street, Shepparton; and e. 4920 , Murchison East.

13. Amend the Place citation report for the property at 52 Vaughan Street, Shepparton (Former Goulburn Valley Winery) to state that the property was demolished in March 2019. A Heritage Overlay did not apply at the time a building permit to demolish was applied for. As such, heritage was not a consideration as part of the permit process.

14. Post-exhibition changes are also proposed for various properties with internal alteration controls to specify which interior elements are of significance. The changes proposed are located in Appendix 4 – Proposed Changes to specific Place citation reports.

15. Revise the place citation report for 97-99 Waverley Avenue, Merrigum (HO31) to revise the title of the place;

16. Revise the place citation report for 50 Merrigum-Ardmona Road, Merrigum (Snelling’s property) (HO144) to state that the third log building no longer remains.

17. Revise the place citation report for 115-119 Waverley Avenue, Merrigum to revise the title for the place;

18. Revise the place citation report for 5855 Midland Highway, Tatura (Moyola) (HO146) to revise the title for the place; and

19. Revise the place citation report for 8 River Road, Murchison to revise the history and historical context for the place.

It should also be noted that where post-exhibition changes are proposed to a place’s Statement of Significance; changes will be replicated in the Statements of Significance Incorporated Document 2019.

9.2 Mapping Changes

Council officers sent a letter to owners of 235 Zeerust Road, Zeerust on 2 July 2019 stating that Council is proposing a post-exhibition change to the Amendment to apply a Heritage Overlay on the property. To date, no response has been received from the land owners.

9.3 Schedule to Clause 43.01 Heritage Overlay

Based on submissions received to the Amendment upon further review of the Amendment documentation during the exhibition period by Council officers, Council officers are proposing the following changes:

1. Revise the address of HO405 to 235 Zeerust Road, Zeerust. This property was initially identified as part of HSIIC Study. The landowner of 235 Zeerust School Road, Zeerust met with Council officers who stated that no historic structure exists on the property. Council investigated this using images on real estate websites and determined that the log structures were indeed located at 235 Zeerust Road, Zeerust and not 235 Zeerust School Road, Zeerust. Council officers sent a letter to owners of 235 Zeerust Road, Zeerust on 2 July 2019 stating that Council is proposing a post-

62 exhibition change to the Amendment to apply a Heritage Overlay on the property. To date, no response has been received from the landowners.

2. Amend the address of the ‘Statement of Significance’ for HO190 to state 88 Maude Street, Shepparton and not 89 Maude Street, Shepparton.

3. Recommend that the second toilet block is of significance based on the contents of Submission 9 for 400 Zeerust Road, Zeerust (HO104).

4. Recommend that no prohibited uses be permitted in the Shepparton Central Business Area (HO160). HO160 is located entirely within the Activity Centre Zone (Precinct 1). Below is the list of Section 3 (prohibited) uses within Schedule 1 of the Activity Centre Zone.

Council officers submit that no uses listed in Section 3 be permitted as part of adaptive re-use of a place under the Heritage Overlay.

5. Recommend that Internal alteration controls no longer be proposed to apply 325 Poplar Avenue, Orrvale (HO342) as no significant internal fabric remains intact. This was determined after undertaking a site-visit by Council officers and Council’s Heritage Advisor on 17 September 2019.

6. Specify that the Imam’s House is a significant outbuilding at 209-231 McLennan Street, Mooroopna (HO310). The Statement of significance states that the Imam’s House contributes to the significance of the Turkish Mosque. Specifying the Imam’s House as a significant outbuilding in the Schedule to Clause 43.01 Heritage Overlay will reflect the information contained in the Statement of Significance.

7. No longer recommend applying ‘Internal Alteration Controls’ to 16 Alexandra Street, Mooroopna (HO302, Former Parsonage). ‘Internal Alteration Controls’ were erroneously proposed to apply in the exhibited Amendment Documentation.

63 8. Recommend that ‘Internal Alteration Controls’ no longer apply to 703 Midland Highway, Shepparton East. Internal alteration controls were applied through Amendment C204 to the Planning Scheme. A site inspection was undertaken by Council officers and Council’s Heritage Advisor and based on the contents of Submission 37 to the Amendment where it was determined that Internal alteration controls are not warranted.

9. No longer recommend that Outbuilding and Fences Controls apply to the property at 61 Maude Street, Shepparton (HO186, House) as a planning permit was granted (Planning Permit 2016-387) for the removal of the brick fence.

10. No longer propose the application of ‘Internal Alteration Controls’ to the property at 5 Young Street, Mooroopna (HO319, Former Undera Hall). Little significant internal fabric remains after the Former Undera Hall was relocated to its current location in the 1930s.

11. No longer propose the application of ‘Internal Alteration Controls’ to the property at 154 Welsford Street, Shepparton (HO95, Former Forester’s Hall). No significant internal fabric remains.

12. No longer propose the application of ‘Internal Alteration Controls’ to the property at 120-132 Welsford Street, Shepparton (HO163, Senior Citizens’ Rooms and the Helen Fairley Garden Reserve). No significant internal fabric remains.

13. No longer propose the application of ‘Internal Alteration Controls’ to the property at 190 Toolamba-Rushworth Road, Toolamba (HO396, Homestead Complex). Internal alteration controls should only apply to the shearing shed.

14. No longer propose the application of ‘Internal Alteration Controls’ to the property at 1070 River Road, (HO277, Ashville Homestead). Correct controls for HO277 that were erroneously applied as part of Amendment C204 in November 2018.

15. No longer recommend that the ‘wrought iron gates’ be listed as significant for the property at 89 Maude Street, Shepparton (HO191). A Planning Permit (Planning Permit 2018-63) was approved to demolish the existing fence and gateway and the construction of a new gateway and fence in accordance with the endorsed plans.

16. No longer recommend that HO292 apply to 35 Flynns Road, Moorilm (Homestead). Council officers are of the view that the existing built fabric has been so compromised that the building is no longer considered to be of significance. As such, Council officers are proposing the HO292 be removed.

17. Recommend that the property at 201 Hogan Street, Tatura be removed. Council officers and Council’s Heritage Advisor are of the view that the existing built fabric has been so compromised that the building is no longer considered to be of

64 significance. As such, Council officers are proposing the Heritage Overlay be removed.

18. Recommend that the property at 65 Doyles Road, Grahamvale be removed. Council officers can confirm that ‘Harris House’ was moved to its current location in 1968 from Maude Street in Shepparton. The basis for the inclusion of ‘Harris ‘House’ was that it was of historical significance for its association with the agricultural development of Grahamvale, and its association with Closer Settlement. Given that the house was moved to its current location, it does not sufficiently demonstrate these associations. As such, Council officers will recommend the Heritage Overlay no longer apply to the property.

19. Recommend that the property at 75 Quarry-Dookie Road, Dookie be removed as ‘Magennis’ was demolished in early-2019.

9.4 Greater Shepparton Heritage Incorporated Plan – Proposed changes

9.4.1 Inclusion of a definition for ‘lopping’

Several submissions raised concerns about the application of tree controls on their property.

As stated in Section 5.6 of this Part A Submission, Tree Controls are proposed to apply to protect all ‘mature trees’ where they actively contribute to the significance of the place. A ‘mature tree’ is a tree that is greater than 5 metres in height, or greater than 2 metres in circumference measured at a height of 1.4 metres above ground level. Works that propose to remove, lop or destroy a ‘mature tree’ would trigger a planning permit.

One (1) submission queried the definition for ‘lopping’, and at what point would ‘lopping’ trigger a planning permit. At this stage, there is no definition for ‘lopping’ a significant (non- native) tree in the Heritage Overlay.

Council officers drew guidance from Clause 52.17 Native Vegetation of the Planning Scheme which includes a permit exemption for ‘lopping and pruning (of trees) for maintenance’ stating that ‘lopping or pruning native vegetation, for maintenance only, provided no more than 1/3 of the foliage of each individual plant is lopped or pruned.

Council officers are proposing to insert similar wording in GSHIP to provide further clarity for land owners on planning permit requirements.

9.5 Kialla Village Settlement Incorporated Document – Proposed Changes

Council officers are proposing post-exhibition changes to the Kialla Village Settlement Incorporated Document to state that the Aboriginal Heritage Act 2006 and Aboriginal Heritage Regulations 2018 guide any works that may impact areas of Aboriginal Cultural Heritage Sensitivity.

9.6 Explanatory Report

Council officers are proposing to include further information in the Explanatory Report on the social and economic impacts of the Amendment. These are listed below:

65 Social Impacts: The Amendment will have positive social effects through the conservation of places of heritage significance for the benefit of current and future generations.

The Amendment also provides protection for places that are of aesthetic significance, all of which contribute to the cultural identity of the City of Greater Shepparton.

Economic Impacts: The Amendment will not have adverse economic impacts. The application of appropriate heritage controls may trigger the need for a planning permit for some buildings and works that previously did not need a planning permit. This may impose additional costs on the owners or developers of land. The Amendment also has the potential to affect redevelopment opportunities of some sites affected by the Heritage Overlay.

The implementation of the Greater Shepparton Heritage Incorporated Plan 2019 and the Kialla Village Settlement Incorporated Document 2019 will better facilitating decision-making and minimising time delays.

Council offers a free heritage advisory service to all land owners of property within the Heritage Overlay. At pre-planning stage, Council’s Heritage Advisor and Council officers provide advice on all planning and heritage-related issues to assist land owners in the preparation of a planning permit application.

The Amendment is expected to result in a net community benefit.

Justification for the changes to the social and economic impacts sections of the Explanatory Report will be outlined in Council’s Part B submission.

Council officers are also proposing changes to the Explanatory Report to note that the Amendment seeks to apply to permanent Heritage Overlay to 175 properties as opposed to the 178 properties as initially exhibited. This is to denote the proposed removal of the Heritage Overlay from the following properties:

10.0 Conclusion

The Amendment consolidates the recommendations of the previous heritage studies into one reference document, the Draft Greater Shepparton Heritage Study Stage II 2019 (the Draft Study). The Amendment seeks to apply permanent heritage controls to all of the 178 places identified in Amendments C204 and C216, and to apply a Heritage Overlay to three additional places 36 Welsford Street, Shepparton, and 18 and 20 Thompson Street, Tatura, and additional properties erroneously excluded from the Kialla Village Settlement (HO276).

The Amendment also revises controls and mapping that apply to places previously included in the Heritage Overlay as part of the implementation of previous heritage studies, and

66 makes subsequent changes to the Schedule to Clause 43.01 Heritage Overlay of the Planning Scheme.

The Amendment affects approximately 1,089 properties Greater Shepparton (a full list of places affected can be found in Tables 1 & 2 of the associated Explanatory Report). Of this total, 619 places are considered to be of ‘individual’ heritage significance (including places that are part of a heritage group, etc.), 327 places are of ‘contributory’ heritage significance in heritage precincts and 138 places are of ‘non-contributory’ significance in heritage precincts.

Three (3) of the submissions were received from referral authorities, which did not object to or request changes to the proposed Amendment. Thirty-nine (39) submissions were received that objected to and/or requested changes to the proposed Amendment.

This submission has addressed the strategic justification of the application of the Heritage Overlay to the properties listed in Appendix 1 – Places affected by the Amendment.

Council looks forward to receiving the Panel’s Report regarding these submissions and any further recommendations or advice that the Panel may have.
