Ghias Doctor of Philosophy in Jurisprudence and Social Policy University of California, Berkeley Professor Malcolm M. Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime.

The deceased was struck by seven bullets in different parts of the body. Nine bullet shells of a 9mm pistol were recovered from the scene of the crime. According to police, the deceased was called to the location through a phone call. They said the late KMC employee was on his motorcycle waiting for someone. Two unidentified men killed him by opening fire at him at Hussainabad, near Okhai Memon Masjid, in the limits of Azizabad police station. The deceased, identified as Shakeel Ahmed, aged 35, son of Shafiq Ahmed, was shifted to Abbasi Shaheed Hospital for medico-legal formalities. He was a resident of house no. L-72 Sector 5C 4, North Karachi, and worked as a clerk in KMC‘s engineering department. Rangers and police officials reached the scene after receiving information of the incident. They recovered nine bullet shells of a 9mm pistol and have begun investigating the incident. According to Azizabad DSP Shaukat Raza, someone had phoned and summoned the deceased to Hussainabad, near Okhai Memon Masjid.

Except the first Khalifah, all the subsequent three Khulafa were unfortunately martyred either by their co-religionists or by antagonists. Though the assassination of Hazrat Umar (RA) did not create any sort of havoc in the Ummah, but the assassination of Hazrat Uthman (RA) caused a severe damage to the unity of Muslim Ummah. This was further aggravated by the internal dissentions caused by the assassination of the third Khalifah during the period of the fourth Khalifah, leading to some bloodshed of the Muslims in two bloody wars of Camel and Si/fin; Hazrat All's assassination was actually a result of that internal strife of the Muslims, dividing the Muslim community into two warring camps. Hazrat Hasan's abdication of the Khilafah tried to bridge the gulf but temporarily, and the situation became explosive once again when Hazrat Muawiyah (RA) nominated his son Yazid as his successor whose candidature was questioned and opposed by a group of people especially by Hazrat Husain (RA) on the ground that he was not fit for the Khilafah.

    Mufti-E-Azam Hind Mustafa Raza Khan (Radiallahuan) GLORIOUS BIRTH : Ghousul Waqt, Mufti-e-Azam-e-Hind (radi Allahu anhu) was born on Monday, 22nd of Zil Hijjah 1310 AH (18 July 1892) in the most beautiful city of Bareilly Shareef, India. It was in this very city that his illustrious father, the Mujaddid (Reviver) of Islam, Imam-e-Ahle Sunnat, A'la Hazrat, Ash Shah Imam Ahmed Raza Khan Al Qaderi (radi Allahu anhu) was born (1856 - 1921). At the time of the birth of Ghousul Waqt, Mufti-e-Azam-e-Hind (radi Allahu anhu), his distinguished father, was in Mahrerah Shareef, one of the great spiritual centers of the Sunni World. On that very night, Sayyiduna A'la Hazrat (radi Allahu anhu) dreamt that he had been blessed with a son and in his dream he named his son "Aale Rahmaan". Hazrat Makhdoom Shah Abul Hussain Ahmadi Noori (radi Allahu anhu), one of the great personalities of Mahrerah Shareef, named the child "Abul Barkaat Muhiy'yuddeen Jilani". Mufti-e-Azam-e-Hind (radi Allahu anhu) was later named "Mustapha Raza Khan". His Aqiqa was done on the name of "Muhammad", which was the tradition of the family. GLAD TIDINGS OF PEER-O-MURSHID : Upon the birth of Ghousul Waqt, Mufti-e-Azam-e-Hind (radi Allahu anhu) Sayyiduna Shah Abul Hussain Ahmadi Noori(radi Allahu anhu) told A'la Hazrat (radi Allahu anhu), "Maulana! When I come to Bareilly Shareef, then I will definitely see this child. He is a very blessed child." As promised, when Sayyiduna Abul Hussain Ahmadi Noori(radi Allahu anhu) went to Bareilly Shareef, he immediately summoned to see Mufti-e-Azam-e-Hind (radi Allahu anhu)who was only six (6) months old.
