ANNUAL REPORT 2011 – 2012

1. PREAMBLE

1.1. The Bheemunipatnam Mutually Aided Co-operative Building Society emerged as an autonomous Society with effect from 01-04-2008 under the Mutually Aided Cooperative Societies (APMACS) Act, 1995 by converting the Bheemunipatnam Cooperative Building Society established on 29th May, 1970 under the APCS Act, 1964. The Management Board of The Bheemunipatnam Mutually Aided Cooperative Building Society presents its fourth Annual Report for the year 2011 - 2012. 2. MEMBERSHIP 2.1. The membership of the Society, as reported earlier, stands at 2301 as on 01-04-2011.

2.2. The number of members under Scheme – 1 was 1,994 as on 01-04-2011. There was no admission of new members into this Scheme during the year. Further, 10 members withdrew their membership from the Scheme-1 vide Annexure - 1. Also, 40 members transferred their membership to their kith and kin, vide Annexure - 2. Thus, the number of the members under this Scheme stands at 1,984 as on 01-04-2012.

2.3. Out of these members, 1529 members who paid the contribution as per the circulars dated 19-08-1980 and dated 28-01-1985 are only eligible for a plot under Scheme – 1 as per the decision of the General Body at its meeting held on 31-05-1998. From among these only 1199 members either fully or partly remitted the Special fund and land cost till the end of the year. In addition, there are 238 members on the wait list for Scheme-1.

2.4. There were no admissions or withdrawals from Scheme - 2 during the year under report. Thus, the number of members under this Scheme remains at 101 as on 01-04-2012.

2.5. There were neither admissions nor withdrawals from the Scheme during the year. Further 6 members took refund of excess amount vide Annexure - 1. Thus, the number of members under the Scheme-3 stands at 145 as on 01-04-2012. 3

2.6. The number of members under Scheme-6 was 61 as on 01-04-2011. No new members were admitted into this Scheme. Further, no member took refund and withdrew his membership. Thus, the membership to this Scheme stands at 61 members as on 01-04-2012.

3. THE MANAGEMENT BOARD

3.1. The Board as on 31-03-2012 was as under:

3.3. The Board met 7 (seven) times during the year under report, on 4th May, 2011, 26th June, 2011, 31st July 2011, 4th September, 2011, 6th November, 2011, 8th January 2012 and 26th February, 2012.

3.4. The year under report was a lull year with no significant progress and tangible outcome. It remained only a year of continuous and regular pursuit of the issues confronted by the Society. The only important event of the year was filing of a Contempt of Court petition in the Hon’ble Supreme Court and submission of an application to Visakhapatnam Urban Development Authority for approval to the Scheme-6 layout.

3.5. The Board during the year at these seven Board meetings deliberated on various issues related to the Society and decided as under:

3.5.1. It discussed and drawn out a procedure for processing the remittance of contributions from members of the Scheme-1 and other Schemes. It laid down the procedure as;

- To fix a last deadline date for receipt of land cost for Scheme – 1 as 31st March, 2012 in case of members who remitted according to the two appeals in 1980 and 1985 as these are only eligible, initially, for a plot under Scheme-1 as per the decision of the General Body at its meeting on 31-05-1998.

- to receive land cost contribution from the first twenty members who were on the wait list and paid only the first installment contribution till 20th May, 2012.

- to levy a penalty of Rs. 5,000/- for delayed payment to the Special Fund and another Rs. 5,000/- for delayed payment of the land cost contribution to distinguish the late remitters from the in time remitters.

- to consider the disqualification aspect in case of all the defaulters (including the contribution to Thrift Scheme Deposit) for three or more years.

- to work out the exact number of members of Scheme-1 for allotment of a plot to facilitate the calculation of the possible plot size.

3.6. The Board pursued the case of Amendments to the Bye-Laws as approved by the General Body at its meeting on 08-05-2011 with the competent authority for its approval and secured the approval of the concerned vide letter No. Rc. No. 1626/2011 C (Coop) dated 17-11-2011 from the District Co-operative Officer, Visakhapatnam (Annexure – 3).

3.7. The Board buoyed up at one point of time on understanding that the issue of securing the PATTA for the Scheme-1 is on the verge of successful completion of its efforts, debated upon the future plans and programmes for the Society and decided on the following plans

- To consolidate and clear the hurdles for developing the Scheme-4 layout for which a major chunk of about 13 Acres of land was purchased by the Society in 2007 when the demand for plots was at its peak.

- to initiate action to revive and undertake the development of a prestigious week–end homes layout as an outsourced venture.

- to plan and create a land bank when the land prices are reasonable and stable to facilitate the planning of future programmes such as an apartment complex, home for elders etc.

- to contemplate and envisage programmes of significance as outstanding ventures.

3.8. Further, the Board spent considerable time and thought to prepare an outline for the proposed layout for Scheme-1 so as to ensure that the layout will be an integrated all inclusive layout of current technology and reflect the world class standards for a comfortable and hygienic stay of its residents.

3.9. The Board as a continuation of this optimistic mood, envisaged installation of a “Website” for the Society and provide web services to its members. Also, the Board decided to restructure the Society office to extend and offer effective and better services to the members.

3.10. However, the Board deliberated upon a contingency plan, on a review of the financial position particularly on account of the significant expenses incurred during the year to meet such a possibility, in the event of unfavorable developments in adverse situations.

3.11. The Board secured the necessary approvals from the respective Panchayats and filed an application to VUDA for approval to the layout at Scheme-6 on 26-06-2011. Further, the Board revised this layout to accommodate lower income and weaker sections as per G.O No. 45 dated 28-01-2011 (Annexure - 4) on 13-12-2011. 3.12. The Board engaged the services of Shri. P. Venkata Rao, a Divisional Engineer and a M. Tech qualified engineer, on honorary basis, as the Engineer-In-Charge to supervise and guide the layout development for the Scheme-6.

3.13. The Board at its meeting on 08-01-2012 decided to request the Chairman of the Election Council of the Society to organize and conduct the Elections to the two posts of Directors falling vacant from 27-04-2012.

3.14. The Board, under compulsive circumstances, decided to file a “Contempt of Court” petition in the Hon’ble Supreme Court against three Senior IAS Officers and two other officials of the Andhra Pradesh Government as they had not implemented the orders dated 22-10-2009 and 09-12-2010 of the Hon’ble Supreme Court.

3.15. The Board after careful consideration of the present environ and circumstances, boldly decided to continue with the outsourcing efforts to secure the PATTA from the Andhra Pradesh Government irrespective of the contempt of court petition.

3.16. The Board decided to convene the General Body meeting on 08-05-2011 and it was held, accordingly. The minutes of the meeting are at Annexure – 5.

4. ACTIVITIES 4.1. PROGRESS OF WORKS: 4.1.1. SCHEME – 1:

4.1.1.1. Further to the progress reported regarding the Scheme-1 in the Annual Report for 2010 – 2011, the following further progress related to this Scheme was made.

4.1.1.2. The Society has made 11 appeals on 23-12-2010, 05-01-2011, 07-02-2011, 09-02-2011, 11-02-2011, 26-02-2011, 12-04-2011, 12-07-2011, 13-09-2011, 16-09-2011 and 30-09- 2011 to the Andhra Pradesh Government to implement the order dated 22-10-2009 of the Hon’ble Supreme Court. The appeal sent to the Minister for Revenue on 20-03- 2012 is at Annexure – 6.

4.1.1.3. The pursuits and efforts of the Society during the year under report were reported to the members from time to time vide its circulars Nos. 6 and 9 dated 30-09-2011 and 25-12-2011 vide (Annexures 7 and 8)

4.1.1.4. Inspite of these continuous efforts, the outcome was nil and the Government remained untouched with these appeals and remained silent. Under these circumstances, the Society, at the last minute of the time for filing the Contempt of Court petition filed it as there was no other way. It was admitted on 05-01-2012 and it was numbered as Contempt of Court Petition No. 9/2012. The proceedings of the Hon’ble Supreme Court were informed to the members vide Circular Nos. 11 & 13 dated 03-02-2012 and 15-03-2012 (Annexure – 9 & 10)

4.1.1.5. Thus, the matter, primarily, stays with the Hon’ble Supreme Court. However, the Society continues its efforts, with the assistance of outsourced sources, to secure the PATTA from the Andhra Pradesh Government.

4.1.1.6. In all probability, God blesses, the issue should come to its culmination and provide great relief to all the members of the Scheme before end of July, 2012.

4.1.2: SCHEME – 2:

4.1.2.1. There is no specific development regarding Scheme-2. The Society continued to ensure the safety of the plots of the 101 members of the Scheme.

4.1.3: SCHEME – 3:

4.1.3.1. The Society with pride declared the successful completion of this Scheme in early 2010 and allotted the 145 plots to the 145 members of the Scheme. The Registration of these plots was almost complete in majority of the cases.

4.1.3.2. During the year under report, the Society arranged to plant coconut trees in all the 145 plots @ 6 plants for each plot and ensued that the samplings are watered regularly and nurtured at considerable cost. This costed Rs. 6.27 Lakhs till the end of the year.

4.1.3.3. Further, the Society erected a solar fencing at a cost of Rs. 3.16 Lakhs to strengthen the security to the layout.

4.1.4. SCHEME – 4:

4.1.4.1. The Society added 1 Acre 33 cents of intermitten bits of land to provide contiguity to the layout during the year under report.

4.1.5. SCHEME-6:

4.1.5.1. The Society prepared the layout to the Scheme-6 after completing the land acquision of the intermitten bits of the land which delayed the Scheme considerably. It obtained the necessary approvals for the respective Panchayats and submitted the application for approval to the layout on 26-06-2011.

4.1.5.2. However, the VUDA, on 15-10-2011, asked the Society to revise the layout to provide plots to low Income and weaker sections as per G.O. No. Mis. No. 45 dated 28-01-2011. Accordingly, the Society redrawn the layout plan and re submitted it on 13-12-2011.

4.1.5.3. Unfortunately, this Scheme is being inordinately delayed due to hurdles in the land acquision and slow processing of the Society application for the layout approval by the VUDA. The Society is confident of completing the development and assign the plots before end of this year.

4.2. SERVICES TO MEMBERS:

4.2.1. The Society issued 15 circulars to its members during the year. It attended to 888 telephonic calls from the members and personally answered 416 visiting members during the year. The volume of work attended by the Staff of the Society is at Annexure - 11.

5. FINANCE

5.1. The accounts for the year 2011 – 2012 opened at Rs. 1,801.56 Lakhs (Rs. 1,472.30 Lakhs as Term Deposit, Rs. 327.76 Lakhs in the SB Accounts and Rs. 1,50,877.00 as cash on hand) and closed at Rs. 1,400.17 Lakhs (Rs. 679.55 Lakhs in term of term deposits, Rs. 720.62 Lakhs in SB Accounts and Rs. 3,410.00 as cash on hand). In other words, there was a net out flow of Rs. 401.39 Lakhs during the year under report.

5.2. Even then, the Society declared dividend to its members, this year as well. It is Rs. 722/- (Rs. 15,91,288/-) per member in 2010-2011 and Rs. 400/- (Rs. 9,20,219.74 p.s) per member in 2011-2012. The dividend amount for the years 2010-2011 and 2011-2012 have been credited to the account of the respective member.

5.3. The total revenue earnings of the Society during the year was as Rs. 101.53 Lakhs. Out of this Rs. 100.41 Lakhs was interest earned on the term deposits and S.B Account deposits. The remaining Rs. 1.12 Lakhs was from miscellaneous income.

5.4. The total revenue expenditure during the year under report was Rs. 50.40 Lakhs (vide Annexure – 12) of which the significant expenses amounted to Rs. 46.61 Lakhs, as under:

5.5. Thus, the Surplus of income over expenditure was Rs. 51.12 Lakhs (including the balance Income Tax of Rs. 5.11 Lakhs due for payment in 2012-2013 and yet to be paid). As such, setting aside the tax payable amount of Rs. 5.11 Lakhs, the net surplus of Rs. 46.01 Lakhs was distributed in accordance with Bye-Law 5.2.1 of the Society, as under: 1. General Reserve (20%) : Rs. 9,20,219-00 2. Bad Debt Reserve (5%) : Rs. 2,30,055-00 3. Building Fund (10%) : Rs. 4,60,109-00 4. Education Fund (10%) : Rs. 4,60,109-00 5. Community Welfare Fund (10%) : Rs. 4,60,109-00 The remaining balance of Rs. 9,20,219.74 Lakhs earmarked for Dividend to the members during the year 2011 – 2012. 5.6. Further, the Society refunded Rs. 7.23 Lakhs to members as their withdrawal settlement payment or excess remittances vide Annexure - 1. 5.7. The total receipts from the members in the year under report was Rs. 108.31 Lakhs (Annexure - 15) and the total Capital Expenditure was Rs. 490.20 Lakhs (Annexure – 13).

6. MAN-POWER

6.1. The Society office is manned by 6 employed staff members. They are one Accountant, One Office Assistant, One Data Entry operator, One Attender and two senior Watchmen as shown at Annexure - 16.

6.2. The staff was granted the annual increment and revised dearness allowance based on the consumer index with effect from 01-04-2011. Also, they were paid ex-gratia @ a month salary for the year 2010-2011.

6.3. Further, the pay of the staff was revised with effect from 01-08-2011 as per the directions of the Labour Officer as per the pay admiserable to the employees under the shops and Establishment Act.

ORDER: In the GOs 1st to 4th read above, Government have issued Revised Common Building Rules for all Municipalities / Municipal Corporations and Urban Development Authority areas in the State. 2. Government of (GOI) announced Rajiv Awas Yojana (RAY) scheme for slum dwellers and urban poor for achieving inclusive and sustainable growth of the urban areas. Government of India will extend support under Jawaharlal Nehru National Urban Renewal Mission (JnNURM) to the States that are willing to assign property rights to people living in slum area to create a slum free India in five years. The Government of India have prescribed certain requirements to be made by the State Government to approach for the Central Assistance under the scheme, earmarking at least 20-25% of developed land in all housing projects (both public and private Agencies) for EWS/LIG category with a system of cross subsidization.

3. Government after detailed deliberations on the Rajiv Awas Yojana initiative of Government of India with all the concerned, approved the State Policy on Slum Free Andhra Pradesh by 2014 and issued orders G.O. 2nd read above. 4. Government have constituted a State Level Committee under the Chairmanship of Commissioner & Director of Municipal Administration, A.P. Hyderabad to suggest changes required in the Legal framework as mentioned above to implement Rajiv Awas Yojana (RAY) in the state. The Departmental Committee under the Chairmanship of Director of Town & Country Planning, A.P. Hyderabad with other members was constituted to suggest amendments to the enactments governing town planning to enable revision of population density norms, Floor Area Ratio (FAR), land use etc. The Departmental Committee shall submit its report in one month to the State Level Committee so that the said recommendations can be used for preparation of state legislative framework. The Chairman of the Departmental Committee, Director of Town & Country Planning, A.P. Hyderabad has submitted the report to the State Level Committee. The Departmental Committee among other things has suggested to earmark 20% of developed land in all housing projects and also furnished the necessary proposals for amendments to the Building Rules. 5. Government after careful examination of the Government of India guidelines and policy as adopted by the State Government and suggestions of Departmental Committee and in order to benefit the people belonging to Economically Weaker Sections (EWS) and Low Income Groups (LIG) for accessing housing facilities in upcoming housing projects, decided to make provision in the building rules for earmarking of at least 20% of developed land in all housing projects (both public and private agencies) for EWS/LIG category with a system of cross subsidization in all Municipalities, Municipal Corporations and Urban Development Authority areas in the State by issuing an amendment to revised Common Building Rules. Accordingly the following notifications will be published in an Extraordinary issue of the Andhra Pradesh Gazetee, dated 01-02-2011.

NOTIFICATION – I In exercise of the powers conferred under section 585 read with section 592 of the Greater Hyderabad Municipal Corporation Act, 1955 and proviso under sub-section (1) read with sub-section (2) of sections 14, 32, 46 and 58 of the Andhra Pradesh Urban Areas (Development) Act, 1975, the Government of Andhra Pradesh hereby amend the Hyderabad Revised Building Rules, 2006 issued in G.O.Ms.No. 86, MA & UD Department, dated 03-03-2006 and published in Rules Supplement to Part-I Extraordinary of the A.P.Gazette, dated 04-03-2006 as subsequently amended. 5. MINUTES OF THE GENERAL BODY MEETING HELD ON 08-05-2011

The meeting was held as per the schedule it was attended by 435 members of the Society (as per the list at Appendix - 1)

2. The meeting was opened by the President of the Society by extending a warm welcome to the members present and introducing the newly elected Directors and the nominated Directors inducted into the Management Board during the year, 2010-2011. This was followed by drawing the attention of the members to the Agenda Booklet and printed reports circulated to the members. According to the Agenda, the President made his welcome address to the members.

3. The substance of this address made to the members and as per Agenda Item No.1, is as under:

- The Title Deed to the land under reference is yet to be secured from the Government. - It was delayed due to three main factors such as the prevailing unstable and uncertain environment in the governance of the State, the normal lethargy of the bureaucracy and the current social considerations. - It was pointed out that the situation is being further complicated by the undesirable act of the Defence Ministry by filing an Impediment Petition by it in the Supreme Court. - It was stated that the Defence Ministry petition yet to be numbered by the Supreme Court and the Society is geared to confront this situation at the appropriate time. Further, the President referred to Agenda item No. 15 and sought the consideration and approval of the Body to the proposition in case of unforeseen and unfortunate developments.

- However, the President assured the Body that every possible effort will be made to secure the PATTA and ensure that every eligible member allotted with a plot. - In this connection, the President thanked the Body for its empowerment to him to decide and take all necessary measures as demand necessary to secure the Title. - For this, it was explained, in detail, the rationality and implications of inducting limited new members to mobilize the resources needed in a short period and the absolute compelling circumstances to part with a few plots for securing the services of concerned to secure the Title Deed. - Thereon, the President explained, at length, objectives and basis for proposing the Agenda item Nos. 9 and 10. The proposed features of the planned layout shall provide a layout about which each member shall feel proud and live in comfort of modern standards at a relatively economical cost. It was averred that the suggested methodology shall ensure an unbiased, transparent system of deciding the plot size and plot allotment procedure. - In this connection, the President declared in a loud voice that the entire exercise shall be a transparent exercise through open competition basis and the out flow of the funds shall be monitored by a committee constituted for the purpose. Thus, it was averred that there will be no scope for misuse or misappropriation of the funds. - At this stage, the President urged the members to note that the Society should endeavour for common benefit and growth of the Society and not for an individual or a vested group. - Accordingly, it was stated that Agenda item Nos 7 to 16 have been proposed for the consideration and approval of the Board. - It was explained that Agenda item Nos. 2, 3 and 4 are statutory requirements, Agenda item Nos. 7, 8 and 13 are procedural requirements, Agenda item Nos. 11, 14 and 16 are for the betterment and effective working of the Society and

Agenda item No. 12 for the growth of the Society. In view of this, the members have been requested to accord their approval to then. - It was averred, in conclusion, that the main and sole goal before him is to secure the PATTA and ensure that each member gets a plot in a modern well developed layout of reputation.

4. The President ended his address by stating that, probably, this will be his last address to this August gathering.

5. In response to the President invitation to the participating members to express their views or seek clarifications or male suggestions for better functioning or management of the Society or point out the erroneous acts of the Management etc, the following seven members came to the dias and spoke.

6. The gist of their observations is as under:

6.1. GL No. 1871 Shri. M.R. Krishna a regular participant and speaker stated that he is fully satisfied with the efforts and pursuits of the President and the Board to secure the Title Deed and other efforts to keep the Society in good trim. It was suggested that the President should continue with his pursuits irrespective of certain remarks by some set of members and that he firmly believe these efforts will ultimately give the required 30

results. He assured his total support to the President and the Board and wished that the President should continue as the Society President.

6.2. GL No. 803, Shri. K. Syam Sunder representing his mother Smt. K. Leelavathi stated that he is dissatisfied at the working of the Society and delays in not accounting the change of addresses of the members. It was advocated to opt for e-mail. It was stated that the members were not provided with the Bye-Laws of the Society and many of the members are not aware of these Bye-Laws. It was stated that the observations of the President to some senior members of the Society are most unwarranted and deplorable. It was suggested that Rs. 5 Lakhs remitted by a few for new membership may be refunded and that there should not be discrimination among the members in allotment of plots. It should be random, uniformly. It was wondered how every plot shall have Sea view and it is beyond his comprehension as an Engineer. It was stated that he will not comment on the restructuring of the Management Board as it is its prerogative.

6.3. GL No. 3678, Shri. A. Chellaram appreciated the efforts of the President and the Board to secure the PATTA and advised then to continue and stated that all members have full faith in the able stewardship of the President. He traced back to the Society struggle for the land from the time of the founder President whom he personally knows closely as his Bank Manager. References have been made to the eminent positions occupied by the present President during his services with the Government and stated that he is confident of the outcome since of the able service that will be provided by the President to the Society. It was stated that all members of the Society have full trust in the ability of the President and wished him all success.

6.4. GL No. 4888, Shri. N. S. Rama Raju introduced himself as the former General Manager of the Andhra Pradesh Agro Industries Private Limited and referred to its association with the Society. It was stated that the present pursuits by the President and the Board are in the right direction and will definitely yield the required results. It was suggested

to pursue then and extended full support to the President and the Board. Further, it was suggested to plan for 500 Sq. Yards plots.

6.5. GL No. 4621, Smt. S.N. Kumar representing Smt. S.N. Vinaya Kumari extended full support to the President and pleaded the President not to be distracted on account of the remarks of some members without any foresight.

6.6. GL No. 1476, Shri. M.R.K. Rao stated that it is not easy for members not familiar with Real Estate issues to understand the difficulties involved in procurement of land and securing the related approvals from the agencies concerned. The valiant efforts pursued by the Society were appreciated by him and full unstinted support extended to the President and the Board by him and on behalf of all the members of the Society for its efforts and pursuits.

6.7. GL No. 1738, Smt. L. Ramadevi urged the members to be united as appealed by the President. It was opined by her that unity among members is absolutely essential for the progress of the Society. She strongly defended the observations of the President regarding certain members and stated that it became a habit for some members to attend the meetings, occasionally and comment without relevance. She urged the members to note this tendency and discourage such tendencies. She fully supported the President and asked him to pursue the issues to its culmination and asked the President to continue without leaving the Society. She expressed her wish that the President shall own a plot in the layout and reside on the layout.

7. Thereon, the Vice-President clarified the issues raised by the speakers and closed the meeting with thanks to the members after obtaining the approval of the Board to the proposals furnished in the Agenda notes.

8. Firstly, the members were informed by the Vice-President that though the emphasis and focus of the deliberations of the meeting were on Scheme-1, the Society neither ignored nor neglected the other schemes and plans for further growth of the Society. It was informed that plots were allotted to all the 145 members who registered for a plot 32

under Scheme - 3 in 2007 and the layout has been fully developed as per the current standards and secured the approval of the competent authority. It was stated that some of the NRI members expressed their great satisfaction at the layout amenities and particularly at the attractive park provided. It was stated, similarly, the layout for Scheme-6 will be taken up on similar lines and completed by December, 2011. The members were invited to participate in this scheme as there are some plots still available.

9. The position regarding the Bye-Laws was clarified and it was informed that every member of the Society was provided with a copy of the Bye-Law, as far back as 2008. Also, it was clarified the Society welcomes the use of e-mail by the Society and this facility has been provided. However, it seems the members do not opt for it since only 276 members informed their e-mail ID to the Society till to-date.

10. The Vice-President thanked the participating members of the Society on his own behalf and on behalf of the Board and the President for their participation in the meeting inspite of severe adverse weather conditions and for according their unanissions full support to the Agenda and activities of the Board. Further, he assured the members that the Society will soon secure the Title Deed and allot the plots.

11. In conclusion, the Vice-President sought the approval of the Body for the proposed Agenda and the specific propositions in it. In response, the Board unanimously accorded its approval to the entire Agenda and authorized the President and the Board to take all such measures deemed necessary to secure the Title Deed for Scheme-1 and development of other schemes. As a result, the following resolutions of the Body followed.

- To consider the Annual Report 2010-2011 as read and adopted. - To endorse and approve the actual expenditure by the Society during 2010-2011 and the Budget Estimates for 2011-2012.

- To re-nominate the present Election Council for another three years from May 2011 to 2014. - To authorize the Management Board to appoint a qualified Charted Accountancy firm as the Auditors of the Society for the next three years from 2011 to 2014. - To approve the proposed outline of the layout plan and estimate for development costs as stated at Agenda item No 9. - To determine the plot size and allotment of plots as proposed in the Agenda item Nos. 10 and fix 45 days from the date of securing the Title Deed for the land as the cutoff date for remitting the land cost to be eligible for a plot under Scheme- 1. - To ratify the decision of the Management Board to admit limited number of 220 members under Scheme-1 and part with the plots. - To undertake the proposed New Schemes, in a phased manner, either by the Society or as outsourced to associated subsidiary set-ups. - To windup Scheme - 1 as proposed at Agenda item No. 15 in case of such an eventuality. - To note the propositions at Agenda item Nos. 11, 14 and 16. - To accord approval, unanimously, to the proposed Amendments to the Bye-Laws as per Agenda item No. 13 by totally rejecting the observations of a single member on the subject.

12-03-2012, the request of the Government to extend the time limit for consideration of its order referred to by another 4 weeks vide its order dated 12-03-2012. In this context, the Society, submits to you that the Hon’ble Supreme Court vide its order dated 27-01-2012 (copy enclosed) the petition of the Defence Ministry for allotment of this land to it was summarily dismissed. As such, it may kindly be noted that the plea advanced by your officials for delaying the consideration of the Society’s request to regularize the allotment of this land to it is no more valid and relevant. The Society further submits that it, reluctantly, filed the contempt of court petition No. 9/2012 at the last minute of the time given to it to file the contempt of court petition as it failed to make the Government to respond to its repeded appeals, for more than a year, to honour the directions of the Hon’ble Supreme Court and do justice to the Society by honouring the judgement on W.P. 4262/1992 of the Andhra Pradesh High Court in 1992. This was never contested by the Andhra Pradesh Government.

Under these circumstances, the helpless Society once again appeal to your esteemed Sir to order the concerned to respect the Hon’ble Supreme Court and implement its order, honourably, without further delay.

Sir/Madam, Sub: - Position regarding Scheme-1. *** Further to the Circular - 1 dated 08-04-2011of the Society on the subject, this is to inform that the Society, asked the Advocate to issue the ‘Contempt of Court’ notice on the Secretary (Revenue) and others concerned for the inordinate delay in implementing the Hon’ble Supreme Court order dated 22-10-2009 in CA No. 5095/2005. It may be noted that the Society has vigorously endeavoured to secure the G.O. concerned for the allotment of the land for Scheme-1 from the Government since the order dated 09-12-2010 of the Hon’ble Supreme Court. It is understood the concerned file has been cleared by the Legal Department, the Advocate-General has advised the Government to implement the orders of the Supreme Court and the Minister for Revenue approved it. Yet, the Secretary (Revenue) is reluctant, for the reasons best known to him, to issue the G.O. All efforts to persuade him have failed. As such, the Society has been left with no option except to file the ‘Contempt of Court’ petition. Accordingly, it advised the concerned Advocate to serve the notice. Further to the Circular No. BCBS/SCH/S-1/CIR-6/2011 dated 30-09-2011 of the Society, this is to inform you that the Society filed a “Contempt of Court” petition in the Hon’ble Supreme Court on 05-12-2011 as it has not received the allotment order for the Scheme – 1 land as per the orders dated 22-10-2009 and 09-12-2010 of the court. It may be stated that the Society has been pursuing this issue with the Andhra Pradesh Government and represented to it almost at the rate of one request each month since January, 2011. Yet it failed to receive a response from the Government. It is reliably understood that certain quarters are very adamant not to allot the land to the Society and prefers to allot the land to the Indian Navy. All efforts to convince and persuade then have almost failed. As such, the only option before the Society is to seek the intervention of the Hon’ble Supreme Court once again. This will be the last battle for the Society since the issue of Navy requirement may figure in this pursuit. Thus, even this hurdle may come to a final conclusion. In view of this, the members have to continue with their long patient waiting for the next three to fourth months in 2012. Let us hope for the best. With a prayer for a better 2012 and good wishes for the New Year.

It is to inform you the current position regarding the Scheme -1 further to the Society circular dated 25-12-2011. It may be noted that the Honorable Supreme Court heard on 23-01-2012, the contempt petition No. 9/2012 filed by the Society and the request petition (I.A. No. 6) of the Indian Navy (Defence Ministry) to permit it to file a petition against the earlier orders dated 22-10-2009 and 9-12-2010 of the Hon’ble Supreme Court and reposted the case to 27-01-2012. On this day, the Court dismissed the request of the Navy and directed the Counsel of the Andhra Pradesh Government to submit its reply within four weeks. Copy of the certified copy of these proceedings of the Court are at Annexure 1 and 2.

2. It means the Navy cannot file further petitions on the earlier orders of the Court, for the present. In other words, the Navy’s earlier petition seeking recall of the Hon’ble Supreme Court earlier orders stands, also, dismissed. On the other hand, the Andhra Pradesh Government has to decide the issue of land allotment to the Society before end of February, 2012 and submit its reply to the Hon’ble Supreme Court. In case the Court not satisfied with this reply of the Government it may direct the concerned officers to present before it.

Under these circumstances, the Society earnestly appeals the members to wait calmly and patiently, for a few more months, for the final outcome.
