  • Brian Burke and Defamation Draft 2
Defamation, Celebrities, and the Internet By the very nature of their positions, celebrities in both the sports and entertainment spheres generate significant public attention and discussion. While the discourse will frequently be positive, inevitably many such conversations will result in negative, or even slanderous, remarks being made regarding such individuals. However, with the proliferation of the Internet and social media, many of these exchanges are now occurring not at the water cooler or in the schoolyard, but rather published online for a potentially wide audience to view. In fact, individuals are likely to exercise less restraint online than they would in a personal interaction, as they are protected, to varying degrees, by a veil of anonymity, and thus may be prone to making even more extreme statements. Defamation law is clear that individuals are held to the same standard for what they say online as offline, but as of yet there have been no known lawsuits that have proceeded through the legal system, all the way to damage calculations, for online libel. This article will provide recent examples of celebrities being involved in such cases, whether as the plaintiff or the defendant, and the difficulties that plaintiffs face in attempting to prevail in an online defamation lawsuit. Anonymous Defendants Brian Burke, the current general manager (“GM”) and president of the National Hockey League’s (“NHL”) Calgary Flames, as well as the former GM of the Toronto Maple Leafs, the Anaheim Ducks, the Vancouver Canucks, the Hartford Whalers, and the US men’s hockey team at the 2010 Winter Olympics in Vancouver, received substantial press about a year ago for a lawsuit he filed in the Supreme Court of British Columbia (“BC”).

DOBBER’S 2010-11 FANTASY GUIDE DOBBERHOCKEY.COM – HOME OF THE TOP 300 FANTASY PLAYERS I think we’re at the point in the fantasy hockey universe where DobberHockey.com is either known in a fantasy league, or the GM’s are sleeping. Besides my column in The Hockey News’ Ultimate Pool Guide, and my contributions to this year’s Score Forecaster (fifth year doing each), I put an ad in McKeen’s. That covers the big three hockey pool magazines and you should have at least one of them as part of your draft prep. The other thing you need, of course, is this Guide right here. It is not only updated throughout the summer, but I also make sure that the features/tidbits found in here are unique. I know what’s in the print mags and I have always tried to set this Guide apart from them. Once again, this is an automatic download – just pick it up in your downloads section. Look for one or two updates in August, then one or two updates between September 1st and 14th. After that, when training camp is in full swing, I will be updating every two or three days right into October. Make sure you download the latest prior to heading into your draft (and don’t ask me on one day if I’ll be updating the next day – I get so many of those that I am unable to answer them all, just download as late as you can). Any updates beyond this original release will be in bold blue.

The Ducks also qualified for post-season contention in all three seasons, winning six-of-eight playoff series over that span. Burke received two outstanding honours in the summer of 2008. On June 6, he was chosen by USA Hockey as General Manager of the 2010 U.S. Olympic Hockey Team, and was named a recipient of the 2008 Lester Patrick Award for outstanding service to hockey in the United States on August 7. Burke was ranked No. 1 by The Hockey News in the magazine’s Annual GM Rankings in March of 2008, and was a finalist for The Hockey News Executive of the Year in 2006. He was named the Sporting News Executive of the Year in 2001, and was a runner-up for the same award following the 2005-06 season. Burke joined the Ducks after a six-year stint (1998-2004) as President and General Manager of the Vancouver Canucks where he revitalized the team and the community en route to consecutive 100+ point seasons and the 2004 Northwest Division title.
