ABSTRACT ROBINSON, JASON LESLEY. Discontinuities in fish assemblages and efficacy of thermal restoration in Toxaway River, NC (Under the direction of Peter S. Rand) Biogeographical studies in the Toxaway and Horsepasture Rivers, (Transylvania County, NC) were initiated along with the creation of a state park in the area. This region is noted for extreme topographic relief, high annual rainfall totals and many rare and endemic plants and animals. The study area encompasses a portion of the Blue Ridge Escarpment and the associated Brevard Fault Zone. These geologic features are important factors in determining the distribution of stream habitats and organisms. I hypothesize that major waterfalls and cascade complexes have acted to discourage invasion and colonization by fishes from downstream. This hypothesis is supported by longitudinal fish assemblage patterns in study streams. Fish species richness in Toxaway River increased from 4 to 23 between Lake Toxaway and Lake Jocassee, a distance of 10 river kilometers. No species replacement was observed in the study area, but additions of up to 7 species were observed in assemblages below specific waterfalls. A second component of the research examines the efficacy of a rapid bioassessment procedure in detecting thermal and biological changes associated with a reservoir mitigation project in an upstream site on Toxaway River. The mitigation project began in the winter of 2000 with the installation of a hypolimnetic siphon to augment the overflow release with cooler water during summer months. I record a greater summer temperature difference on Toxaway River below Lake Toxaway (comparison of pre- vs. post-manipulation), relative to control sites. -

(b) The Environmental Management Commission (hereinafter referred to as the Commission), prior to classifying and assigning standards of water quality to any waters of the State, shall proceed as follows: (1) The Commission, or its designee, shall determine waters to be studied for the purpose of classification and assignment of water quality standards on the basis of user requests, petitions, or the identification of existing or attainable water uses, as defined by Rule .0202 of this Subchapter, not presently included in the water classification. (2) In determining the best usage of waters and assigning classifications of such waters, the Commission shall consider the criteria specified in G.S. 143-214.1(d). In determining whether to revise a designated best usage for waters through a revision to the classifications, the Commission shall follow the requirements of 40 CFR 131.10 which is incorporated by reference including subsequent amendments and editions. -

THE CACAPON SETTLEMENT: 1749-1800 31 THE CACAPON SETTLEMENT: 1749-1800 31 5 THE CACAPON SETTLEMENT: 1749-1800 The existence of a settlement of Brethren families in the Cacapon River Valley of eastern Hampshire County in present day West Virginia has been unknown and uninvestigated until the present time. That a congregation of Brethren existed there in colonial times cannot now be denied, for sufficient evidence has been accumulated to reveal its presence at least by the 1760s and perhaps earlier. Because at this early date, Brethren churches and ministers did not keep records, details of this church cannot be recovered. At most, contemporary researchers can attempt to identify the families which have the highest probability of being of Brethren affiliation. Even this is difficult due to lack of time and resources. The research program for many of these families is incomplete, and this chapter is offered tentatively as a basis for additional research. Some attempted identifications will likely be incorrect. As work went forward on the Brethren settlements in the western and southern parts of old Hampshire County, it became clear that many families in the South Branch, Beaver Run and Pine churches had relatives who had lived in the Cacapon River Valley. Numerous families had moved from that valley to the western part of the county, and intermarriages were also evident. Land records revealed a large number of family names which were common on the South Branch, Patterson Creek, Beaver Run and Mill Creek areas. In many instances, the names appeared first on the Cacapon and later in the western part of the county. -

Brook Trout Outcome Management Strategy Introduction Brook Trout symbolize healthy waters because they rely on clean, cold stream habitat and are sensitive to rising stream temperatures, thereby serving as an aquatic version of a “canary in a coal mine”. Brook Trout are also highly prized by recreational anglers and have been designated as the state fish in many eastern states. They are an essential part of the headwater stream ecosystem, an important part of the upper watershed’s natural heritage and a valuable recreational resource. Land trusts in West Virginia, New York and Virginia have found that the possibility of restoring Brook Trout to local streams can act as a motivator for private landowners to take conservation actions, whether it is installing a fence that will exclude livestock from a waterway or putting their land under a conservation easement. The decline of Brook Trout serves as a warning about the health of local waterways and the lands draining to them. More than a century of declining Brook Trout populations has led to lost economic revenue and recreational fishing opportunities in the Bay’s headwaters. Newsletter 2014-15 April 11, 2014 GOVERNOR CALLS SPECIAL SESSION TO ADDRESS WAGE BILL, BUDGET ISSUES Gov. Earl Ray Tomblin says he plans to call a special session of the Legislature to correct problems with the minimum wage bill and to address issues with the 2015 fiscal year budget. The session is expected to be in conjunction with the May legislative interim meetings. H.B. 4283, which increases the state’s minimum wage incrementally, from $7.25 per hour to $8 per hour on January 1, 2015 and to $8.75 on January 1, 2016, contained an unintended consequence. As it is currently drafted, the bill prevents West Virginia employers from relying on certain existing overtime exemptions under the Fair Labor Standards Act. The business community, municipal and county governments, higher education institutions and others stated that previously exempt workers will become subject to overtime and maximum hours provisions. Cities and counties alone stated their fire and police budgets would increase hundreds of thousands of dollars. They recommended the governor veto the bill to eliminate the overtime language. Joining Gov. Tomblin in the bill’s signing were Senate President Jeff Kessler and House Speaker Tim Miley. They all pledged to preserve the federal exemptions and overtime provisions when the bill is brought up during the special session. State revenues continue to lag behind estimates. With one quarter left in this fiscal year, the state has a $78 million shortfall in revenues. While personal income tax collections are up, sales taxes are falling behind. The State of West Virginia was cut off from Virginia during the civil war and was admitted to the Union on June 19, 1863. As orig inally constituted it consisted of 48 counties; subsequently, in 1866, it was enlarged by the addition -of two counties, Berkeley and Jeffer son, which were also detached from Virginia. The boundaries of the State are in the highest degree irregular. Starting at Potomac River at Harpers Ferry,' the line follows the south bank of the Potomac to the Fairfax Stone, which was set to mark the headwaters of the North Branch of Potomac River; from this stone the line runs due north to Mason and Dixon's line, i. e., the southern boundary of Pennsylvania; thence it follows this line west to the southwest corner of that State, in approximate latitude 39° 43i' and longitude 80° 31', and from that corner north along the western boundary of Pennsylvania until the line intersects Ohio River; from this point the boundary runs southwest down the Ohio, on the northwestern bank, to the mouth of Big Sandy River. -

This project proposes to restore, to the greatest extent possible, the aquatic and ecological integrity of at least forty miles of the West Fork River and many more miles of adjoining tributaries. This project has the potential to restore more suitable habitat for as many as twenty-five species of freshwater mussels including two federally listed species. Liability to the dam’s owners, the Clarksburg Water Board, will be substantially reduced with implementation of the recommended alternative. -

Libertz, Director Water Division Date: _________ ______________ Decision Rationale Total Maximum Daily Loads for the Upper Guyandotte River Watershed, West Virginia I. Introduction The Clean Water Act (CWA) requires a Total Maximum Daily Load (TMDL) be developed for those waterbodies identified as impaired by a state where technology-based effluent limits and other pollution controls do not provide for the attainment of water quality standards. A TMDL establishes a target for the total load of a particular pollutant that a water body can assimilate and divides that load into wasteload allocations (WLA), given to point sources, load allocations (LAs), given to nonpoint sources and natural background, and a margin of safety (MOS), which takes into account any uncertainty. Mathematically, a TMDL is commonly expressed as an equation, shown below. 푇푀퐷퐿 = ∑푊퐿퐴푠 +∑퐿퐴푠 + 푀푂푆 This document sets forth the U.S. Environmental Protection Agency, Region III’s (EPA’s) rationale for approving 380 TMDLs submitted by the West Virginia Department of Environmental Protection (WVDEP) for total iron, total selenium, and/or fecal coliform bacteria in the Upper Guyandotte River Watershed. The TMDLs were developed to address impairments of water quality standards as identified on West Virginia’s section 303(d) list of water quality- limited segments. WVDEP electronically submitted the TMDLs in its report titled Total Maximum Daily Loads for the Upper Guyandotte River Watershed West Virginia (February 2021) (hereinafter referred to as the “TMDL Report”), to EPA for final review and action on February 26, 2021.
