    An Industry Haunted by Its Own History | 1 An Industry Haunted by Its Own History By Kerry Pechter Thu, Nov 1, 2018 The ghost of demutualization haunts much of the annuity industry today. But that topic was not on the agenda of the annual LIMRA conference in New York earlier this week (Photo: Former FBI director James Comey, the keynote speaker at the conference). Bob Kerzner, in his final address to the LIMRA membership after 14 popular years as their CEO, posed a perennial question: why hasn’t the life insurance industry capitalized on the Boomer retirement opportunity to the degree that it hoped, expected and, in its mind, deserved to? A complete answer to that question (which may stem in part from a post-demutualization misalignment of interests with the public) will fill a book someday (see note at end of story). Bob Kerzner Kerzner spoke at the annual LIMRA conference, which was held this year at the Marriott Marquis Hotel in New York. As the polyglot mass of tourists posed for snaps with the “Naked Cowboy” et al in Times Square below, a thousand or so dark-suited executives gathered soberly in the hotel ballrooms above. The conference was ornamented by the appearances of a celebrity guest speaker, former FBI director James Comey, and an inspirational TED talker, Simon Sinek (pronounced “cynic”). African American women have consistently resisted, challenged, submitted to, and remixed racial myths and sexual stereotypes existing in American cinema and television programming. Mainstream film and television practices significantly contribute to the reinforcement of old stereotypes in contemporary black women characters. However, based on the efforts of African American producers like Shonda Rhimes, who has attempted to insert more realistic renderings of African American women in her recent television shows, black women’s representation is undergoing yet another shift in contemporary media.

Calling is probably the most effective way to contact her, because you can get immediate feedback on what tapes are available. In order to insure that borrowers are authorized through their law enforcement agency to borrow videos, please submit the initial lending request on agency letterhead (not a fax cover sheet or internal memo form). Also provide the name of the department’s training officer. If a requested tape is in the library at the time of the request, it will be sent to the borrower’s agency immediately. If the tape is not in, the borrower's name will be put on the tape's waiting list, and it will be sent as soon as possible. The due date--the date by which the tape must be back at NEMRT--is indicated on the loan receipt included with each loan. Since a lot of the tapes have long waiting lists, prompt return is appreciated not only by the Instructors' Library, but the other departments using the video collection.

Rueda PARTNER | HEAD OF US SPORTS AND ENTERTAINMENT | US CATEGORY: BLOG CLIENT TYPES: FAMILY TALENT AND CREATIVES SPORT On October 4th, 2019, during a National Basketball Association (“ NBA”) sponsored trip to China, Houston Rockets general manager, Daryl Morey, tweeted “ght for freedom, stand with Hong Kong.” The tweet has since been deleted, but not before sparking geopolitical controversy and outrage from the Chinese government, which demanded an apology, and announced Tuesday, October 8th that it had canceled the planned broadcast of two NBA exhibition games due to be played in the country. The NBA had Morey apologize and put out a statement characterizing his tweet as “regrettable” and clarifying that his support for Hong Kong protesters “does not represent the Rockets or the NBA.” However, the NBA’s attempt to quell the backlash in China prompted its own backlash from United States law makers, including Ted Cruz, Beto O’Rourke, and Julián Castro who were among those to denounce the NBA for giving in to Chinese condemnations. Now, the commissioner of the NBA, Adam Silver, has announced that the NBA “will not put itself in a position of regulating what players, employees, and team owners say or will not say on these issues,” and added: “It is inevitable that people around the world… will have different viewpoints over different issues. It is not the role of the NBA to adjudicate those differences.” Silver will travel to Shanghai on Wednesday, October 9th to meet with ofcials and some of the NBA’s business partners in hopes of nding some common ground.

INTRODUCTION Following thirty years as the commissioner of the National Bas- ketball Association (NBA), David Stern will retire on February 1, 2014.2 The longest-tenured commissioner in professional sports, Stern has methodically prepared for the upcoming transition by en- suring that Adam Silver, his Deputy Commissioner, will succeed him.3 Following Stern’s October 2012 announcement, the NBA Board of Governors (“Board”) unanimously agreed to begin negoti- ating with Stern’s handpicked successor.4 By May 2013, Silver had signed his contract and officially had become NBA Commissioner- Elect.5 The fifth individual to hold the position, Silver faces a wide * J.D., Yale Law School, 2011; B.A., Duke University, 2006.

Plaintiff Robert Burck is a "street entertainer" who performs in New York City's Times Square as The Naked Cowboy, wearing only a white cowboy hat, cowboy boots, and underpants, and carrying a guitar strategically placed to give the illusion of nudity. He has registered trademarks to "The Naked Cowboy" name and likeness. Beginning in April 2007, defendants Mars, Incorporated ("Mars") and Chute Gerdeman, Inc. ("Chute") began running an animated cartoon advertisement on two oversized video billboards in Times Square, featuring a blue M&M dressed "exactly like The Naked Cowboy," wearing only a white cowboy hat, cowboy boots, and underpants, and carrying a guitar. In this case, Burck sues defendants for compensatory and punitive damages. He alleges that defendants have violated his "right to publicity" under New York law and infringed his trademarks under federal law by using his likeness, persona, and image for commercial purposes without his written permission and by falsely suggesting that he has endorsed M&M candy. Three motions are before the Court: Chute moves pursuant to Fed. R. Civ. P. 12(b)(6) to dismiss the complaint; Mars moves pursuant to Fed. R. Civ. P. 12(c) for judgment on the pleadings; and Burck moves pursuant to Fed.
