The Governments’ Suit This is the second time this Court confronts this set of facts.1 On June 19, 2016, the United States Department of Justice and the State of North Carolina 1 Additionally, there is a third lawsuit currently pending in the North Carolina Business Court. DiCesare v. Charlotte-Mecklenburg Hospital Authority, No. 16- CVS-164043 (N.C. Sept. 9, 2016). This state class action alleges violations of North Carolina law filed on behalf of residents of North Carolina who paid premiums to insurance companies that had Defendant in its network. Plaintiffs bring two claims 1 (“the Governments”) filed suit against the Charlotte-Mecklenburg Hospital Authority d/b/a Carolinas HealthCare System and Atrium Health (“Defendant” or “Atrium”) seeking injunctive relief. Doc. No. 1: “Governments’ Complaint,” United States v. Charlotte-Mecklenburg Hosp. Auth., No. 3:16-cv-311 (W.D.N.C. June 19, 2016) [hereinafter the Governments’ suit].     Highlights 2019 Report 1 Message from the President President the from | Letter I want to share a few quick highlights from the Atrium Health Musculoskeletal Institute (MSKI), Carolina Neurosurgery & Spine Associates (CNSA) and OrthoCarolina (OC) teams. Though we continue to deal with the repercussions of the COVID-19 pandemic, including the cancellation of the American Academy of Orthopaedic Surgeons meeting, the American Association of Neurological Surgeons meeting, and the majority of the other regional and specialty meetings, our teams continue to build and flourish. Here are some of the highlights you’ll find in this report: • MSKI celebrated the recent investiture of our second endowed chair in orthopaedic surgery and are beginning a campaign to add more in other specialty areas. • We’ve made an exciting transition in our education leadership, with Brian Scannell, MD, being named Atrium Health's orthopaedic surgery residency program’s new director after Joshua Patt, MD, became MSKI’s vice chair of education. • Construction has begun on the MSKI headquarters at Atrium Health Mercy, a facility of Carolinas Medical Center, with significant renovations that will enhance our ability to provide state-of-the-art care. • MSKI, CNSA and OC have added several outstanding experts, including three new physician-scientists. • Our organizations continue to use partnerships and outreach to be involved in communities across the Carolinas, and to make positive contributions to the lives of patients of all ages. Established by the Federal Communications Commission’s (“FCC”) Report and Order released December 21, 2012 (FCC 12-150), the Healthcare Connect Fund (“HCF”) is a Universal Service Fund (“USF”) program, authorized by Congress and administered by the Universal Service Administration Company (“USAC”). This Request for Proposal (“RFP”) seeks services to be provided pursuant to the HCF. b. The nonprofit Atrium Health Consortium joins together various network opportunities to healthcare providers in North Carolina, South Carolina and Georgia. The Atrium Health Consortium provides their facilities with an integrated data network connecting acute-care hospitals, surgery centers, dialysis centers, clinical facilities, skilled nursing facilities, rehabilitation facilities, administration, and data centers into one cohesive system. c. Atrium Health Consortium is comprised of both rural and urban locations, which allows the consortium to meet the needs of patients at any location within the network, even if those patients have to travel to an urban location for specialized care. d. Atrium Health Consortium is focused on providing a rigid network for telemedicine, which promotes the immediate and accurate diagnosis for patients in rural areas, as well as their treatment. e. The urgency of treatment necessitates that Atrium Health Consortium maintain the highest quality and reliability of data and networking services available.
