This letter is in response to your written communication under date of December 30, 2014. On November 20, 2014 an evidentiary hearing was held before the Culture Heritage Commission wherein the said Commission found that: "The consensus of the Commission is that this property does not fall under the criteria in Section 22.171.7 of the Los Angeles Administrative Code. Therefore, the request has been declined.” This finding was memorialized in writing by the Commission on December 2, 2014.

The Tevrizian Family Trusts are the original owners of the subject property and are satisfied with the Commission's finding and decision. The Tevrizian Family Trusts never made application to have the property included as a Culture Heritage Monument. The application was submitted by an unauthorized individual and the application contained many gross inaccuracies and fictitious information. At the November 20th hearing I addressed the Commission and presented testimony that was contrary to the information contained in the unauthorized application. Unfortunately, I am not able to attend the public hearing scheduled for January 13, 2015, as I am a retired District Court Judge that is participating as an arbitrator in a matter of significant importance that has been previously scheduled for some period of time with witnesses coming from several parts of the United States. On November 6, 2014,1 submitted a Jetter to the Commission that articulated some of the gross inaccuracies contained in the unauthorized application. I wish to incorporate that letter by reference as well as point out that the original unauthorized application contained the following request: "Tevrizian Trust [PLEASE DO NOT CONTACT UNTIL YOU MUST IN THIS PROCESS.]" I pointed out to the Commission that this statement is an abuse of the legal process and a denial of due process. The Deputy City Attorney present at the November 20th hearing appeared to agree with me. I also submitted a letter to the Commission under date of August 13, 2014, which I would also like to incorporate by reference. 1 am assuming that the file contains the two (2) letters made reference to.

In conclusion, the undersigned respectfully requests that the Planning and Land Use Management Committee affirm and adopt the findings of the Culture Heritage Commission and conclude that this property does not fall under the criteria of Section 22.171.7 of the Los Angeles Administrative Code and that the unauthorized application be denied.
