Different legal systems have applied different analyses to such problems, and there is no clear and coherent answer to the question of whether file sharing, especially in the form of peer-to-peer (P2P), is legal. The particular focus of this thesis flows from the realisation that litigation around file sharing has uniformly explored it from the perspective of users downloading entertainment materials such as music and videos. Comparatively little attention has been paid to whether research and educational users have, or should have, rights to use the same digital file sharing technologies to access copyright materials important to their work. If digital file sharing is declared illegal by the courts at the behest of the entertainment industries, then what will happen to research and educational users of these networks? To explore this key problem, this thesis focuses on how fair use doctrine, the most important exception and limitation to copyright, has transferred from the traditional copyright environment into the context of digital file sharing. By undertaking a study of relevant legislation and cases, such as the well known Napster, Grokster and MP3.com, the “who” issue, namely, who is the party entitled to benefit from a fair use defence will be highlighted. Having established that fair use as a defence operates ineffectively in the digital file sharing environment, the thesis then looks at existing alternative or “fared” use models, and particularly the disadvantages of “fared” use system in serving research and educational file sharing. Finally the thesis turns to what is termed the “voluntary model”: a model in which copyright owners make their works available to academic users for free, via an institutional repository, the authors gaining non-pecuniary benefits while the commercial publisher being cut out as a “middleman”. Although future work to develop the details of this approach would be required, the thesis asserts this is a promising way towards ensuring access to copyright works in research and education thus benefiting society, whilst at the same time establishing fair compensation to authors for their efforts. We should all be extremely proud. At the same time, however, I am also struck by the fact that as good as the school is, there is still much we need to do to make it the very best it can be. for this reason, we are embarking on an ambitious capital campaign, the success of which is vital to the school’s ability, in an increasingly competitive environment, to continue producing great lawyers, judges, and leaders. this issue of the magazine focuses on this campaign and, consistent with our recently adopted strategic plan, on the areas in which resources raised will be invested—faculty, student scholarships, nationally prominent programs and skills training/experiential learning. While the school is generally ranked highly among all u.s. law schools, its funding is near the bottom. our direct expenditures per student last year ranked 141st out of 198 and our financial aid per student budget was in the bottom quartile. our resources are by far the lowest of all Big ten law schools. If we can provide an excellent education for students with this small amount of funding, consider what we could do if we had sufficient dollars to do what most other law schools can do already—such as fund endowed faculty chairs, or offer core classes with fewer than 100 students in the classroom.

    How do we care about care homes, asks Niamh Woodier Lloyd Rees, when discussing Australian modern art, argued that ‘the universal element in art, I feel, has often come from an intense localism’ (Rees in Butler & Donaldson 2015, 142). This quote has stayed with me since my Art History degree: Lloyd Rees was originally referring to the conflict between indigenous and Western symbolic vocabularies in the increasingly international trope of Australian modern art in 1930s Sydney. Although this quote is far from my life as a part-time GP receptionist, part-time Masters student in Global Health Policy in Scotland, the importance of ‘the local’ has been re-emphasised during the coronavirus pandemic. Working in the setting of community health has taught me that the universal element in healthcare often comes from intensely local care: care that is personalized, close to home and promotes both health and social well-being. The importance of local care has become central to the devastating impact of coronavirus in elderly populations, is an ongoing topical issue of care homes (Observer Reporters, 2020) and is changing what care will become. The UK population is ageing, and our health policy is adapting to suit the needs of this demographic. It is predicted that in 2066, 26% of the population will be 65 or older, compared to 18% in 2016 (ONS, 2018). Much of the integrated care that allows older people to be cared for at home was only established 20 years ago. In 2000 the NHS Reform Plan (Department of Health, 2000) introduced a new tier of services called ‘intermediate care’ to facilitate health and social care to older adults living in the community with the understanding that ‘older people have better health outcomes when they receive treatment closer to home’ (British Geriatrics Society 2019).
