INTRODUCTION Self-censorship refers to the decision by an individual or group to refrain from speaking and to the decision by a media organization to refrain from publishing information. Whenever an individual or group or the media engages in self-censorship, the values of the First Amendment are compromised, because the public is denied information or ideas.' It should not be sur- prising, therefore, that the principles, doctrines, and precedents of what I refer to as "the law of the First Amendment"' are designed to prevent self-censorship premised on fear of govern- mental sanctions against expression. This fear-induced self-cen- sorship will here be called "self-censorship bad." At the same time, the First Amendment also values and pro- tects a right to silence. -

INTRODUCTION Cloud computing has completely changed the landscape of information storage. Sensitive information that was once stored in file cabinets and eventually on computers is now stored remotely using web-based cloud computing services.1 The cloud’s prevalence in today’s world is undeniable, as recent studies show that nearly forty percent of all Americans2 and an estimated ninety percent of all businesses use the cloud in some capacity.3 Despite this fact, Congress has done little in recent years to protect users and providers of cloud computing services.4 What Congress has done dates back to its enactment of the Stored Communications Act (SCA) in 1986.5 Passed decades before the existence *J.D. OPEN LETTER TO REPUBLICAN NATIONAL COMMITTEE CHAIR REINCE PRIEBUS Where Does the GOP Stand on Gay Bashing? Dear Mr. Priebus, Fifteen years ago, your predecessor called for party members to shun the Council of Conservative Citizens because of the group’s “racist views.”1 “A member of the party of Lincoln should not belong to such an organization,” GOP Chairman Jim Nicholson said.2 His comments had their intended effect: Senior members of Congress distanced themselves from the group. Today, Chairman Priebus, we ask that you take a similar stand and call upon Republican officials to disassociate themselves from the groups behind the upcoming Values Voter Summit. The reason is simple: These groups engage in repeated, groundless demonization of LGBT people — portraying them as sick, vile, incestuous, violent, perverted, and a danger to the nation. The Family Research Council, the summit’s host, is vigorously opposed to extending equal rights to the LGBT community. Its president, Tony Perkins, has repeatedly claimed that pedophilia is a “homosexual problem.”3 He has called the “It Gets Better” campaign — designed to give LGBT students hope for a better tomorrow — “disgusting” and a “concerted effort” to “recruit” children into the gay “lifestyle.” 4 He has condemned the National Republican Congressional Committee for supporting three openly gay candidates.5 Bryan Fischer of the American Family Association, a summit sponsor, has said the U.S. needs to “be more like Russia,” which enacted a law criminalizing the distribution of LGBT “propaganda.”6 He also has said, “Homosexuality gave us Adolph Hitler, and homosexuals in the military gave us the Brown Shirts, the Nazi war machine, and six million dead Jews.”7 Similarly, Mat Staver of the Liberty Counsel, another summit sponsor, has compared those who do not denounce same-sex marriage to those who remained silent during the Holocaust. -

He has authored numerous interviews, articles, and short films spotlighting the Eastside scene. He plays guitar in the bands La Tuya and Our Band Sucks. Teresa Covarrubias was the vocalist for The Brat. Their debut EP, Attitudes, was released on The Plugz’ record label, featured contributions from John Doe and Exene from X, and is a prized item among collectors. Straight Outta East L.A., a double Photo: Edward Colver album packaging it with other rare tracks, was released in 2017. Tracy “Skull” Garcia was the bass player of Thee Undertakers. Starting off by playing local parties in 1977, they became regulars in the scene centered around the Vex. Their 1981 debut album, Crucify Me, successfully melded second-wave hardcore bite with first-wave art sensibilities, but wasn’t released until 2001 on CD and 2020 on vinyl.
