HUMAN RIGHTS QUARTERLY Bremer's "Gordian Knot": Transitional Justice and the US Occupation of Iraq Eric Stover,* Hanny Megally, ** & Hania Mufti*** ABSTRACT Shortly after the US invasion and occupation of Iraq, L. Paul Bremer III, in his capacity as the chief administrator of the Coalition Provisional Author- ity (CPA), introduced several transitional justice mechanisms that set the *Eric Stover is Director of the Human Rights Center at the University of California, Berkeley, and Adjunct Professor in the School of Public Health. In 1991, Stover led a team of forensic scientists to northern Iraq to investigate war crimes committed by Iraqi troops during the Anfal campaign against the Kurds in the late 1980s. In March and April 2003, he returned to northern Iraq where he and Hania Mufti monitored the compliance with the 1949 Geneva Conventions by all sides to the conflict. He returned to Iraq in February 2004 to assist Mufti in investigating the status of documentary and physical evidence to be used in trials against Saddam Hussein and other members of the Ba'athist Party. -

The US has endeavored to change the status quo of Iraq, and in doing so, it will most likely affect the status quo of the entire Arab world. What remains in the balance is whether that change in the current situation will enhance US interests or threaten them for many years to come. PFIFFNER ABSTRACT In May 2003 Paul Bremer issued CPA Orders to exclude from the new Iraq government members of the Baath Party (CPA Order 1) and to disband the Iraqi Army (CPA Order 2). These two orders severely undermined the capacity of the occupying forces to maintain security and continue the ordinary functioning of the Iraq government. The decisions reversed previous National Security Council judgments and were made over the objections of high ranking military and intelligence officers. The article concludes that the most likely decision maker was the Vice President. Early in the occupation of Iraq two key decisions were made that gravely jeopardized US chances for success in Iraq: (1) the decision to bar from government work Iraqis who ranked in the top four levels of Sadam’s Baath Party or who held positions in the top three levels of each ministry; (2) the decision to disband the Iraqi Army and replace it with a new army built from scratch. These two fateful decisions were made against the advice of military and CIA professionals and without consulting important members of the President’s staff and cabinet. This article will first examine the de- Baathification order and then take up the even more far reaching decision to disband the Iraqi Army. Both of these decisions fueled the insurgency by: (1) alienating hundreds of thousands of Iraqis who could not support themselves or their families; (2) by undermining the normal infrastructure necessary for social and economic activity; (3) by ensuring that there was not sufficient security to carry on normal life; and (4) by creating insurgents who were angry at the US, many of whom had weapons and were trained to use them. -

The study presents the best evidence against the alternative explanations that the invasion of Iraq was the result of an overreaction to 9/11, the threat of Weapons of Mass Destruction, a plan to spread democracy in the Middle East, a desire to protect Israel or a plan to profit from Iraqi oil. -
The Fraudulent War, Was Assembled in 2008
Explanatory note The presentation to follow, entitled The Fraudulent War, was assembled in 2008. It documents the appalling duplicity and criminality of the George W. Bush Administration in orchestrating the so-called “global war on terror.” A sordid story, virtually none of it ever appeared in the mainstream media in the U.S. Given the intensity of the anti-war movement at the time, the presentation enjoyed some limited exposure on the Internet. But anti-war sentiment was challenged in 2009 by Barack Obama's indifference to his predecessor's criminality, when the new president chose “to look forward, not backward.” The “war on terror” became background noise. The Fraudulent War was consigned to an archive on the ColdType website, a progressive publication in Toronto edited by Canadian Tony Sutton. There it faded from view. Enter CodePink and the People's Tribunal on the Iraq War. Through testimony and documentation the truth of the travesty was finally disclosed, and the record preserved in the Library of Congress. Only CodePink's initiative prevented the Bush crimes from disappearing altogether, and no greater public service could be rendered. The Fraudulent War was relevant once more. It was clearly dated, the author noted, but facts remained facts. Richard W. Behan, November, 2016 ------------------------------------------------- The author—a retired professor—was outraged after reading a book in 2002 subtitled, “The Case for Invading Iraq.” Unprovoked aggression is prohibited by the United Nations charter, so he took to his keyboard and the Common Dreams website in vigorous dissent. Within months thereafter George Bush indeed invaded the sovereign nation of Iraq, committing an international crime. -

Arthur M. Schlesinger Jr., 1974. Stanley Hoffmann has suggested that the use of historical analogies by U.S. foreign policy-makers is part and parcel of the American national style (Hoffmann, 1968). Similarly, Yuen Foong Khong notes that heads of state have always “turned to the past in dealing with the present” (Khong, 1992: 3). While some observers believe that historical analogies “are mostly utilized merely as post-hoc justifications for policy choices determined by ideology and partisanship and are therefore not independent variables in the policy process” (Taylor and Rourke, 1995: 460), others argue that they do exert a significant influence and perform specific functions within the decision-making process, particularly during the option selection and evaluation phase (Vertzberger, 1986; Khong, 1992). Among other things, they provide guideposts for interpreting new situations (Hemmer, 2000: 5) and keys to understanding the cognitive processes of decision-makers (Houghton, 1996: 549), helping them find solutions more quickly in urgent, politically murky circumstances (Hemmer, 2000: 2). U.S. foreign policy has been marked by two momentous events (Gilovich, 1981: 802) – Munich and the Vietnam War – but it would appear that only the Second World War was used as a frame of reference for the intervention in Iraq that began in 2003 (Welch Larson, 2010: 318). More specifically, studies have shown that the planning and implementation of Iraqi reconstruction after 2003 was informed by the analogy with German reconstruction (Hoogland Noon, 2004; Houghton, 2008; Locas, 2008; David, 2010; Angstrom, 2011; MacDonald, 2012), a finding that is confirmed by the memoirs of the main architects of the war in Iraq.
