(1) The National Nuclear Regulator (NNR) has directed the National Radioactive Waste Disposal Institute (NRWDI) to publish the attached Application for Nuclear Installation Licence for the Vaalputs National Radioactive Waste Disposal Facility in the Government Gazette and a minimum of two newspapers circulating in every municipality affected by the application. (2) Please find attached a copy of the Application. (3) Pursuant to the provisions of Section 21(4) of the National Nuclear Regulator Act, Act 47 of 1999, you are afforded an opportunity to submit, to the NNR, written representations, relating to health safety and environmental issues, connected to our application, by no later than 30 March 2021. The Board of NRWDI has duly authorised the Acting CEO, Mr. Alan Carolissen, to apply for the Nuclear Installation Licence (See Attachment 1) The following information as required in terms of Regulations GN 1219 of Government Gazette 39585 of 21 December 2007 for a Nuclear Installation Licence application, is herewith provided: The National Radioactive Waste Disposal Institute Act (NRWDIA) (Act no. 53 of 2008) was proclaimed by the President of the Republic of South Africa in Government Gazette no. 32764 and became effective on the 1st December 2009 (See Attachment 2). The NRWDIA endorses the establishment of NRWDI to discharge a ministerial institutional obligation to manage radioactive waste disposal on a national basis. The NRWDIA governs the activities of NRWDI for the long term management and disposal of all classes of radioactive waste on a national basis and provides for its functions and powers as per Sections 5 and 6 respectively of the NRWDIA. NRWDI is listed as a Schedule 3A public entity in terms of the Public Finance Management Act (No. 1 of 1999) and is a wholly owned by the State. NRWDI-FRM-001, Rev. 11 Classification Open This gazette is also available free online at www.gpwonline.co.za STAATSKOERANT, 26 FEBRUARIE 2021 No. 44192 5 In terms of Section 21(1) of the NRWDI Act, NRWDI receives its funds from, inter alia, the following sources: Fees received from waste generators on a cost recovery basis for services rendered (polluter pays principle); Money appropriated by Parliament; Income or interest earned on the Institute’s cash balance or on money invested; and Money transferred to the Institute from the Radioactive Waste Management Fund, which is still to be established by passing legislation. The fund is aimed at ensuring sufficient provision for the long- term management of radioactive waste. In April 2017 the Institute received its first three year baseline budget from National Treasury to discharge its mandate as a going concern. NRWDI received its future Medium Term Expenditure Funding (MTEF) allocations for the financial years 2019/20-2021/22 (See Attachment 3) to discharge its mandate as a going concern. Financial resources will thus be available to ensure delivery on the requirements of the Vaalputs nuclear installation licence, including providing financial security for claims against nuclear damage, consistent with the requirements of Section 29 (5) of the NNR Act and Regulations No. 388 on Safety Standards and Regulatory Practices of 2008. The Vaalputs site area measures approximately 10 000 hectares of which 10% (~1 000ha) is designated for Low Level Waste (LLW) disposal. Following a comprehensive site selection and site characterisation program, Vaalputs became operational in 1986 as the national, near surface radioactive waste disposal facility that serves South Africa’s needs for disposing of low level radioactive waste generated within the nuclear industry. The disposal concept is near surface disposal consisting of near surface trenches located in the region above the groundwater table. The scope of actions to be undertaken by Vaalputs are: (i). Receipt of Low Level Waste in approved waste packages. (ii). Temporary storage of waste packages in the shielded storage area in the reception hall.
