Thank you Chairman, for the record my name is Melissa Sevares Mayor of Dededo and I am in support ofBill449-30. This is the area right beyond Marine Corps Drive right before the Marks hardware property leaving Dededo and entering Yigo. The Pangelinan family is working with another warehouse, a light industrial company that would be expanding their property within their complex.

On behalf of the municipal planning council, and the community of Dededo, I am in favor of this.

Panel Comments and Questions

Chairman pangelinan: Thank you very much. Any questions from the panel? It is currently commercial in its activities. Thank you very much and si yu'os ma'ase madam Mayor for being present this morning to provide that testimony to us. I would like to state for the record that there was written testimony submitted by John Pangilinan.

For all the rezoning bills that you have before you, the committee sent a notice to the Department of Land Management, the Attorney General of Guam, the Governor of Guam, the Lieutenant Governor of Guam and all the members of the Development Review Committee of the Guam Land Use Commission which is in charge of the zoning. We solicit their input on the legislative proposal for the rezoning of these properties, to assure that we give the regulatory agencies, as well as the Mayors of the district they are in; we inform them of the proposal before the legislature so we can get their input on what the prospective impact could be as proposed by the zoning. We are taking this extra step to provide this body the greatest opportunity to receive and understand the impact on the community that this rezoning bills would have.

Section 1. Legislative Findings and Intent. I Liheslaturan Guahan finds that the lot identified herein is presently zoned Commercial and the property owners have requested consideration to provide expanded economic benefits for its overall use and application from its present zone to Light Industrial (Ml) that would enable any future use of the designated property to comply with industrial economic activities, and to further promote the creation of employment opportunities for the people of Guam. Therefore, it is the intent of I Liheslaturan Guahan to support the expanded use of existing properties in Guam that would provide economic benefits to property owners and most importantly positively contribute to the creation of jobs for Guam's people, that will also result in providing other benefits to the surrounding community. Section 2. Re-Zoning of Lot No. 10117-R6, located in the municipality of Dededo from Commercial ("C") to Light Industrial e"Ml"). Lot No. 10117-R6, containing an area of approximately 79,765 square meters, located in the municipality of Dededo, is hereby re-zoned from

E-mail Address: Our comments are as follows: dim @mail.gov.gu Bill 449-30 (LS) proposes to re-zone Lot 10117 -R6 from "C" (Commercial) to "M-1" (Light Industrial) for the purpose of expanding economic benefits for its overall use and application from its present zoning designation and would enable any future use of the property to comply with industrial economic activities. Basically the Telephone: 671-649-LAND (5263) request, if promulgated, will improve potential economic benefits to the property owners. Bill 449-30(LS) further provides the desirable end state of the zone re­ assignment will positively contribute to the creation of jobs for Guam's people.

EXISTING ZONE DESIGNATION: Lot 10117-R6 is currently dual zone designation Facsimile: with the "C" portion extending 200' (feet) from edge of Route 1 and into the 671 ·649-5383 property; and the remaining portion being zoned "A" (Rural-Agricultural).

EXISTING LAND USE: The subject lot contains a recorded land area of 79,765± square meters and is currently undeveloped/vacant. The Abutting lot ,Lot 10117-6 was re-zoned to a full "C" (Commercial) through the Territorial Land Use Commission, now Guam Land Use Commission, for the purpose of operating a news publication facility (Ref: DLM Doc. No. 548441) 1 Interestingly, the property owners originally requested for a zone change to "M-1" (Light-Industrial);

However, such request was denied based on the dissenting assessment from this department and objections during the public hearing on the matter (Ref: DLM Doc. 2 No. 545017) •

With the exception of the western abutting lot, Lot 10117-6 and eastern abutting Lot 10117-5, the other surrounding properties are under lease by private citizens for agricultural purposes from the Chamorro Land Trust Commission (CL TC). Although some these CL TC lots are vacant, the existing and or planned uses on these parcels are consistent with temporary and permanent homesteading and subsistent farming activities. On the northwest corner of Lot 10117-R6 lies GWA's deep water well Y-16 (on Lot 10119-16). The significance of this feature is that there may be a development restriction within a set distance buffer restriction due to environmental protection of the northern aquifer as well as safety issues since "chlorine" chemicals are in use in these deep well facilities. In addition, GWA may have several other deep wells in the area.

DISCUSSION: In any zone change, the criteria of Public Necessity, Convenience and General Welfare and Safety of the Community must be justified. In this case, an "M-1" zone request to re-zone property is the second highest-intensity zone allowable by law; and the uses permitted are a progression of all other uses in the lower zones (A, R-1, R-2 and C). As can be realized, there are many uses that can be realized in an M-Zone parcel some of which are more intense and may be obnoxious to a certain degree; and may not be compatible or conducive in the area.

"M-1" zoned properties are the most sought after and lucrative zone properties in today's real estate market industry because of the variety of the many applicable land uses available coupled with the fact that this is the only zone that will allow a "conditional use permit" for Temporary Workforces Housing Facilities". As provided in the Bill, the property owner cites, "... is to provide expanded economic benefits for the property's overall use and application from its present zone ... "

We uphold that it is not necessary for an M-1 upzone as this may be achieved through a zoning of "C" (Commercial). In light of existing surrounding uses, the expansion of the current CZone is an alternative zoning designation that is conducive in the overall future land use planning for the immediate area. While the Central and Northern Land Use Plan (CN LUP) ha? yet to be adopted, the plan use for the area is for a mix-use. Thus, if the CN LUP is approved, the potential for new uses will still lend support economically.

Since the property is dual zone, we highly encouraged the property owner to consider availing themselves of the opportunity to apply under the Split Zone (SPZ) Program pursuant to Public Law 25-131 and extend the zone to a full CZone. The Director of Land Management is the approval authority for the SPZ Program so it is not a difficult process to pursue; and we believe that this alternative extension to a full CZone will support promoting economic benefits and creating additional job opportunities to be achieved. ...

Guam Power Authority has reviewed the application described above and submits the following position statement:

A. Comments and Recommendations Concerning GP A requirements:

1. GP A has no objection, however customer is required to comply with the following pursuant to the National Electrical Code, National Electrical Safety Code and GPA's Service Rules and Regulations: • Coordinate overhead/underground power requirements with GP A Engineering for new structures • Maintain minimum clearances as defined by the current edition of the National Electrical Safety Code and National Electrical Code • Maintain adequate clearance between any structures and electric utility easements in accordance with NESC and GPA requirements • Developer/Owner shall provide necessary electric utility easements to GP A prior to fmal connection • Provide scheduling and magnitude of project power demand requirements for new loads • All relocation costs for GPA's facilities, if necessary, is 100% chargeable to the applicant including but not limited to labor and materials

2. Primary distribution overhead and underground line extensions and GPA service connections must adhere to the guidelines outlined in the current issue ofGPA's Service Rules and Regulations.

3. A system impact assessment may be required to determine the effect of this facility on GPA's existing power facilities.

4. All costs associated with the modification of GP A facilities shall be chargeable to the customer. This includes relocation costs, new installation costs and any required system upgrades.

B. General Comments GPA has no objection to the request subject to the conditions cited above.

More than fifty years ago, my father, Marciano V. Pangilinan arrived on the shores of the island of Guam. He did not have much more than the shirt on his back and the desire of a better life. After a few years of understanding the way of Guam life, he knew the island was where he wanted to start new roots. He opened a small tailor shop and restaurant to serve the local community. He courted, and eventually married a local Chamorrita, Guadalupe Torres Pangilinan. He made Guam his home, because the people of Guam made him their son.

During the early years, my Dad was able to acquire many parcels of property. His vision of the potential of these properties was evident since he rarely ever sold property. He viewed each piece as an ''uncut diamond", waiting for the right opportunity to show its brilliance. He did this with the underlying premise that all improvements must benefit the local community.

This Bill is one of these opportunities. M. V .Pangilinan Enterprises, is humbly requesting for a rezoning of our property located in Municipality in Dededo. The rezoning of the property from Commercial to Ml will allow us to entertain off island companies willing to bring their expertise and products to Guam. These companies have proprietary products that will not only assist in the upcoming military buildup, but also many existing buildings and new developments already on island. In keeping with my Dad's vision, the off island company would encourage and train local residents in their building and management skills. The training would be beneficial locally, as well as internationally. MVP would lease the property so we may maintain and improve the land for future use.

Honorable Chairman and Committee Members:

This testimony is provided on behalf of the Bureau of Statistics and Plans in regards to the Bill Nos. 449-30 (COR), 458-30{COR), 471-30(COR), and 493-30(COR). We have reviewed the said bills and offer the following comments and concerns:

The Bureau has always had concerns with regards to the rezoning of properties by the Guam Legislature. We strongly believe that there is already a process that is in place that works which affords the surrounding neighbors as well as the general public the opportunity to provide comments on proposed zone changes. As you know, the Guam Land Use Commission (GLUC) in conjunction with the Application Review Committee (ARC) is tasked to be responsible for this process. With the technical assistance of the various government agencies and departments, the GLUC has the ability to come to a reasonable decision in the changing of zoning designations. Unlike the legislative zone change process, the GLUC guarantees that the affected surrounding neighborhood within 500 feet of the property proposed to be rezoned is informed by registered mail of the proposal and is invited to attend the GLUC Hearing to discuss any comments or concerns that they may have. Not everybody has access to the printed media to see the public announcements of upcoming public hearings. Furthermore, unlike the legislative process, the GLUC receives technical comments from appropriate government agencies on the impacts of a proposed zone change which is standard policy, prior to arriving to a decision.

Guam Coastal Management Program++Land Use Planning++Socio-Economic Planning++Pianning Information ++Business and Economic Statistics Program For example, based on our Land Use Planning Section, information that they have on land cover shows that Lot No.165-R4 seems to be encumbered by Palustrine Forested Wetlands and possibly Palustrine Emergent Wetlands. Furthermore, the FEMA Flood Insurance Rate Maps show that the lot may possibly be encumbered by a flood zone that is characterized as 0.2 Percent annual chance floodplain. The Bureau does not have the exact location of Lot 165-R4 however, available information dictates that there is a high possibility that this area may pose environmental considerations. Certain industrial land uses may be inappropriate uses in wetland or areas that may be prone to flooding. Therefore, a determination has to be made if the subject lot falls within these boundaries before the Government of Guam authorizes a change in zoning that may have adverse effects to the environment. Does the government take on the responsibility on mitigation if they approve such zone changes?

The Bureau would also like to comment that Lot 165-R4 is not "previously unzoned". It is a general understanding that all properties in the Official Guam Zoning Map that do not appear to have a zoning designation are "A" agricultural zoned. This excludes the military and recent federally released properties (Ancestral Lands).

The Bureau recognizes that the legislature has the authority to approve zone changes however involvement and feedback from the public and private sector alike are received through the GLUC process. We feel the legislative route needs to include more input from all stakeholders to receive a thorough review and include technical assistance from the ARC members. Until the process is amended, the Bureau will provide similar comments to all zone changes being routed and processed in this fashion.
